<section id="HBB8FC50CC6BA45FC9E33FCECC20D74B3" display-inline="yes-display-inline" section-type="undesignated-section"><text display-inline="yes-display-inline">That the Rules of the House of Representatives of the One Hundred Twelfth Congress, including applicable provisions of law or concurrent resolution that constituted rules of the House at the end of the One Hundred Twelfth Congress, are adopted as the Rules of the House of Representatives of the One Hundred Thirteenth Congress, with amendments to the standing rules as provided in section 2, and with other orders as provided in sections 3, 4, and 5. </text></section>

<subsection id="HC737804A0E5240D994FA08B853058A9E"><enum>(a)</enum><header>Committee activity reports</header><text display-inline="yes-display-inline">In clause 1(d) of rule XI—</text> 
<paragraph id="HBF575D5D827744D3B72FEEC865F6EE22"><enum>(1)</enum><text>in subparagraph (1), strike <quote>the 30th day after June 1 and December 1</quote> and insert <quote>January 2 of each year</quote> and strike <quote>semiannual</quote> ;</text></paragraph>

<paragraph id="HC1BB0160AB554CE3924200A70C6087DF" commented="no"><enum>(2)</enum><text>During the One Hundred Thirteenth Congress, in the case of a reported bill or joint resolution considered pursuant to a special order of business, a point of order under section 303 of the Congressional Budget Act of 1974 shall be determined on the basis of the text made in order as an original bill or joint resolution for the purpose of amendment or to the text on which the previous question is ordered directly to passage, as the case may be.</text></paragraph> 
<paragraph id="H3D378A7551F444F7AF070E2E61F85E4B" commented="no"><enum>(3)</enum><text>During the One Hundred Thirteenth Congress, a provision in a bill or joint resolution, or in an amendment thereto or a conference report thereon, that establishes prospectively for a Federal office or position a specified or minimum level of compensation to be funded by annual discretionary appropriations shall not be considered as providing new entitlement authority within the meaning of the Congressional Budget Act of 1974.</text></paragraph>

<subparagraph id="H6581EB8FF49C4EC7BCB2AB9A709B1FBF" display-inline="yes-display-inline" commented="no"><enum>(A)</enum><text>During the One Hundred Thirteenth Congress, except as provided in subparagraph (C), a motion that the Committee of the Whole rise and report a bill to the House shall not be in order if the bill, as amended, exceeds an applicable allocation of new budget authority under section 302(b) of the Congressional Budget Act of 1974, as estimated by the Committee on the Budget.</text></subparagraph> 
<subparagraph id="HFB08BDB0F06541B3B11F6DCEEFA999CF" commented="no"><enum>(B)</enum><text>If a point of order under subparagraph (A) is sustained, the Chair shall put the question: <quote>Shall the Committee of the Whole rise and report the bill to the House with such amendments as may have been adopted notwithstanding that the bill exceeds its allocation of new budget authority under section 302(b) of the Congressional Budget Act of 1974?</quote>. Such question shall be debatable for 10 minutes equally divided and controlled by a proponent of the question and an opponent but shall be decided without intervening motion.</text></subparagraph> 
<subparagraph id="H26F0F804F15848F69D07ADC0B6C22D4B" commented="no"><enum>(C)</enum><text>Subparagraph (A) shall not apply—</text> 
<clause id="H64693D3A14AC49349C65FF05A412D355" commented="no"><enum>(i)</enum><text>to a motion offered under clause 2(d) of rule XXI; or</text></clause> 
<clause id="HA400F25C91C243EBAF20A252E6D74DC1" commented="no"><enum>(ii)</enum><text>after disposition of a question under subparagraph (B) on a given bill.</text></clause></subparagraph> 
<subparagraph id="H4B416715838343F6AA11EC4B09A21C04" commented="no"><enum>(D)</enum><text>If a question under subparagraph (B) is decided in the negative, no further amendment shall be in order except—</text> 
<clause id="H1AFEBF61C8DA4AF7BD45E2EFDE810B1E" commented="no"><enum>(i)</enum><text>one proper amendment, which shall be debatable for 10 minutes equally divided and controlled by the proponent and an opponent, shall not be subject to amendment, and shall not be subject to a demand for division of the question in the House or in the Committee of the Whole; and</text></clause> 
<clause id="HFA3D651417B34701ABF870EE648A5B54" commented="no"><enum>(ii)</enum><text>pro forma amendments, if offered by the chair or ranking minority member of the Committee on Appropriations or their designees, for the purpose of debate.</text></clause></subparagraph></paragraph> 
<paragraph id="HEAEA325E5D19434198F53948EA39E4A6" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">During the first session of the One Hundred Thirteenth Congress, pending the adoption of a concurrent resolution on the budget for fiscal year 2014, the provisions of House Concurrent Resolution 112 (112th Congress), as adopted by the House, shall have force and effect in the House as though Congress has adopted such concurrent resolution and the allocations of spending authority printed in tables 11 and 12 of House Report 112–421 (112th Congress), and shall be considered for all purposes in the House to be the allocations under section 302(a) of the Congressional Budget Act of 1974.</text></paragraph></subsection> 
<subsection id="H673E3080C97949CEAF4DBA9F82CC8AED" commented="no"><enum>(c)</enum><header>Determinations for PAYGO Acts</header><text>In determining the budgetary effects of any legislation for the purposes of complying with the Statutory Pay-As-You-Go Act of 2010 (including the required designation in PAYGO Acts), the chair of the Committee on the Budget may make adjustments to take into account the exemptions and adjustments set forth in section 503(b)(1) of House Concurrent Resolution 112 (112th Congress).</text></subsection> 
<subsection id="H7B16EEFC37D44E609F238E9AF08768AB" commented="no"><enum>(d)</enum><header>Spending reduction amendments in appropriations bills</header> 
<paragraph id="HC2F0D93AD4EF415B8302AF06AA2C763F"><enum>(1)</enum><text>During the reading of a general appropriation bill for amendment in the Committee of the Whole House on the state of the Union, it shall be in order to consider en bloc amendments proposing only to transfer appropriations from an object or objects in the bill to a spending reduction account. When considered en bloc under this clause, such amendments may amend portions of the bill not yet read for amendment (following disposition of any points of order against such portions) and are not subject to a demand for division of the question in the House or in the Committee of the Whole.</text></paragraph> 
<paragraph id="HCD30A8EE1EDF4F248F2F68468DFB7688"><enum>(2)</enum><text>Except as provided in paragraph (1), it shall not be in order to consider an amendment to a spending reduction account in the House or in the Committee of the Whole House on the state of the Union.</text></paragraph> 
<paragraph id="HA97987C0188D4D2DA05CB205D159A487"><enum>(3)</enum><text>It shall not be in order to consider an amendment to a general appropriation bill proposing a net increase in budget authority in the bill (unless considered en bloc with another amendment or amendments proposing an equal or greater decrease in such budget authority pursuant to clause 2(f) of rule XXI).</text></paragraph> 
<paragraph id="HC2F14AE5E6C44DD68324891B0D9E5285"><enum>(4)</enum><text>A point of order under clause 2(b) of rule XXI shall not apply to a spending reduction account.</text></paragraph> 
<paragraph id="HA577B9FBB266422B9192756855BCE679"><enum>(5)</enum><text>A general appropriation bill may not be considered in the Committee of the Whole House on the state of the Union unless it includes a spending reduction account as the last section of the bill. An order to report a general appropriation bill to the House shall constitute authority for the chair of the Committee on Appropriations to add such a section to the bill or modify the figure contained therein.</text></paragraph> 
<paragraph id="H0E1461A7ED564B7EA614FB51BEBBB780"><enum>(6)</enum><text>For purposes of this subsection, the term <term>spending reduction account</term> means an account in a general appropriation bill that bears that caption and contains only a recitation of the amount by which an applicable allocation of new budget authority under section 302(b) of the Congressional Budget Act of 1974 exceeds the amount of new budget authority proposed by the bill.</text></paragraph></subsection> 
<subsection id="H3FA8B0A3C93F4494B5FF44ED57EEDC0B" commented="no"><enum>(e)</enum><header>Certain Subcommittees</header><text>Notwithstanding clause 5(d) of rule X, during the One Hundred Thirteenth Congress—</text> 
<paragraph id="H0990FC798B3240CEABFFE10A80A39255" commented="no"><enum>(1)</enum><text>the Committee on Armed Services may have not more than seven subcommittees;</text></paragraph> 
<paragraph id="H2DFCE9529D9342B28A4B9B0A6721D2B9" commented="no"><enum>(2)</enum><text>the Committee on Foreign Affairs may have not more than seven subcommittees; and</text></paragraph> 
<paragraph id="HCBDAEC205AF849C890EA2AFF1972CAE7" commented="no"><enum>(3)</enum><text>the Committee on Transportation and Infrastructure may have not more than six subcommittees.</text> </paragraph></subsection> 
<subsection id="HDE2E59781A514FA385277E1F85EF68C9" commented="no"><enum>(f)</enum><header>Exercise Facilities for Former Members</header><text>During the One Hundred Thirteenth Congress—</text> 
<paragraph id="H805CEFCA4BF54E45BABB6BEDC4C80941" commented="no"><enum>(1)</enum><text>The House of Representatives may not provide access to any exercise facility which is made available exclusively to Members and former Members, officers and former officers of the House of Representatives, and their spouses to any former Member, former officer, or spouse who is a lobbyist registered under the Lobbying Disclosure Act of 1995 or any successor statute or agent of a foreign principal as defined in clause 5 of rule XXV. For purposes of this section, the term <term>Member</term> includes a Delegate or Resident Commissioner to the Congress.</text></paragraph> 
<paragraph id="HD4187C1C835D4AF9BA312B6514A960AE" commented="no"><enum>(2)</enum><text>The Committee on House Administration shall promulgate regulations to carry out this subsection.</text> </paragraph></subsection> 
<subsection id="H4068256361AC48E5A232B25FF06003FF" commented="no"><enum>(g)</enum><header>Numbering of Bills</header><text>In the One Hundred Thirteenth Congress, the first 10 numbers for bills (H.R. 1 through H.R. 10) shall be reserved for assignment by the Speaker and the second 10 numbers for bills (H.R. 11 through H.R. 20) shall be reserved for assignment by the Minority Leader.</text></subsection></section> 
<section id="H1AE8C3AEDEFC448BA552FA1B9752E7B5"><enum>4.</enum><header>Committees, commissions, and house offices</header> 
<subsection id="H6D993A07DB6F419280104F4BDF87A10B"><enum>(a)</enum><header>Litigation Matters</header> 
<paragraph id="HCE5B7FD6BCAF452E97ABEE8B4DAF8C82"><enum>(1)</enum><header>Continuing authority for the Bipartisan Legal Advisory Group</header> 
<subparagraph id="H7663005981A947428EA05C5A0DDE750B"><enum>(A)</enum><text display-inline="yes-display-inline">The House authorizes the Bipartisan Legal Advisory Group of the 113th Congress—</text> 
<clause id="H0BBA79C0A2C84732A7A5F8F03980DAEC"><enum>(i)</enum><text display-inline="yes-display-inline">to act as successor in interest to the Bipartisan Legal Advisory Group of the 112th Congress with respect to civil actions in which it intervened in the 112th Congress to defend the constitutionality of section 3 of the Defense of Marriage Act (1 U.S.C. 7) or related provisions of titles 10, 31, and 38, United States Code, including in the case of Windsor v. United States, 833 F. Supp.2d 394 (S.D.N.Y. June 6, 2012), aff’d, 699 F.3d 169 (2d Cir. Oct. 18, 2012), cert. granted, No. 12–307 (Dec. 7, 2012), cert. pending No. 12–63 (July 16, 2012) and 12-__ (Dec. __2012);</text></clause> 
<clause id="H3E8C8A91835E4BDAB9DEADFC9D1128E9"><enum>(ii)</enum><text display-inline="yes-display-inline">to take such steps as may be appropriate to ensure continuation of such civil actions; and</text></clause> 
<clause id="HF689460AE61E4A4F8B8ADF6B4CFBFCB8"><enum>(iii)</enum><text display-inline="yes-display-inline">to intervene in other cases that involve a challenge to the constitutionality of section 3 of the Defense of Marriage Act or related provisions of titles 10, 31, and 38, United States Code.</text></clause></subparagraph> 
<subparagraph id="H9F444D00B932487D87832E88CC7602E6"><enum>(B)</enum><text display-inline="yes-display-inline">Pursuant to clause 8 of rule II, the Bipartisan Legal Advisory Group continues to speak for, and articulate the institutional position of, the House in all litigation matters in which it appears, including in Windsor v. United States.</text></subparagraph></paragraph> 
<paragraph id="H4CDD0D654F41421C8F6FCB23DB2DC56E" display-inline="no-display-inline"><enum>(2)</enum><header>Continuing Authorities for the Committee on Oversight and Government Reform and the Office of General Counsel</header> 
<subparagraph id="H6843B0D0361040088FCA62448E1ECEDA"><enum>(A)</enum><text>The House authorizes—</text> 
<clause id="HCBAEC5729200443DB2D6F928C32F0E2E"><enum>(i)</enum><text>the Committee on Oversight and Government Reform of the 113th Congress to act as the successor in interest to the Committee on Oversight and Government Reform of the 112th Congress with respect to the civil action Committee on Oversight and Government Reform, United States House of Representatives v. Eric H. Holder, Jr., in his official capacity as Attorney General of the United States, filed by the Committee on Oversight and Government Reform in the 112th Congress pursuant to House Resolution 706; and</text></clause> 
<clause id="H632C29D746794D86BA4CD1BA7D708316"><enum>(ii)</enum><text>the chair of the Committee on Oversight and Government Reform (when elected), on behalf of the Committee on Oversight and Government Reform, and the Office of General Counsel to take such steps as may be appropriate to ensure continuation of such civil action, including amending the complaint as circumstances may warrant.</text></clause></subparagraph> 
<subparagraph id="HC5481D6B74BE4956A50805C61A3957A9"><enum>(B)</enum><text>The House authorizes the chair of the Committee on Oversight and Government Reform (when elected), on behalf of the Committee on Oversight and Government Reform and until such committee has adopted rules pursuant to clause 2(a) of rule XI, to issue subpoenas related to the investigation into the United States Department of Justice operation known as <quote>Fast and Furious</quote> and related matters. </text></subparagraph> 
<subparagraph id="H0793463000A9412BA3429391AC736980"><enum>(C)</enum><text>The House authorizes the chair of the Committee on Oversight and Government Reform (when elected), on behalf of the Committee on Oversight and Government Reform, and the Office of General Counsel to petition to join as a party to the civil action referenced in <internal-xref idref="H6843B0D0361040088FCA62448E1ECEDA" legis-path="4.(e)(1)">paragraph (1)</internal-xref>, any individual subpoenaed by the Committee on Oversight and Government Reform of the 112th Congress as part of its investigation into the United States Department of Justice operation known as <quote>Fast and Furious</quote> and related matters, or any successor to such individual, who failed to comply with such subpoena or, at the authorization of the Speaker after consultation with the Bipartisan Legal Advisory Group, to initiate judicial proceedings concerning the enforcement of subpoenas issued to such individuals.</text></subparagraph> 
<subparagraph id="H64F41BE25A364008886594712FC94C83"><enum>(D)</enum><text display-inline="yes-display-inline">The House authorizes the chair of the Committee on Oversight and Government Reform (when elected), on behalf of the Committee on Oversight and Government Reform, and the Office of General Counsel—</text> 
<clause id="HD299894971CE4AEC868011FEE3A0C143"><enum>(i)</enum><text>to petition to join as a party to the civil action referenced in paragraph (1) any individual subpoenaed by the Committee on Oversight and Government Reform of the 112th Congress as part of its investigation into the United States Department of Justice operation known as <quote>Fast and Furious</quote> and related matters who failed to comply with such subpoena, or any successor to such individual; and</text></clause> 
<clause id="H310822AC9F52421CA0A5EBE2AFCDFB58"><enum>(ii)</enum><text>at the authorization of the Speaker after consultation with the Bipartisan Legal Advisory Group, to initiate judicial proceedings concerning the enforcement of subpoenas issued to such individuals.</text> </clause></subparagraph></paragraph></subsection> 
<subsection id="H024C65AF99E447E8A331D5635E22CBAC" commented="no"><enum>(b)</enum><header>House Democracy Assistance Commission</header><text display-inline="yes-display-inline">House Resolution 24, One Hundred Tenth Congress, shall apply in the One Hundred Thirteenth Congress in the same manner as such resolution applied in the One Hundred Tenth Congress except that the commission concerned shall be known as the House Democracy Partnership.</text></subsection> 
<subsection id="H3294BC6083074FAB9D22869C6323F69D" commented="no"><enum>(c)</enum><header>Tom Lantos Human Rights Commission</header><text>Sections 1 through 7 of House Resolution 1451, One Hundred Tenth Congress, shall apply in the One Hundred Thirteenth Congress in the same manner as such provisions applied in the One Hundred Tenth Congress, except that—</text> 
<paragraph id="H039D2B2ACFDE4E9B8C4EF9CE87CA84A8" commented="no"><enum>(1)</enum><text>the Tom Lantos Human Rights Commission may, in addition to collaborating closely with other professional staff members of the Committee on Foreign Affairs, collaborate closely with professional staff members of other relevant committees; and</text></paragraph> 
<paragraph id="HE77325DE23E847C788D6ADA30B1B93D0" commented="no"><enum>(2)</enum><text>the resources of the Committee on Foreign Affairs which the Commission may use shall include all resources which the Committee is authorized to obtain from other offices of the House of Representatives.</text></paragraph></subsection> 
<subsection id="H9B897371FCDF4E15BD2E5230DD5A1CE8" commented="no"><enum>(d)</enum><header>Office of Congressional Ethics</header><text>Section 1 of House Resolution 895, One Hundred Tenth Congress, shall apply in the One Hundred Thirteenth Congress in the same manner as such provision applied in the One Hundred Tenth Congress, except that—</text> 
<paragraph id="H3881337184F34F3E91098112311B51E7"><enum>(1)</enum><text>the Office of Congressional Ethics shall be treated as a standing committee of the House for purposes of section 202(i) of the Legislative Reorganization Act of 1946 (2 U.S.C. 72a(i));</text></paragraph> 
<paragraph id="H6C0C3A93509441A4834ECD821C3BE223"><enum>(2)</enum><text>references to the Committee on Standards of Official Conduct shall be construed as references to the Committee on Ethics; and</text></paragraph> 
<paragraph id="HB9C5B1F08C50483CB709BEEA8B4BDE54"><enum>(3)</enum><text>the second sentence of section 1(b)(6)(A) shall not apply.</text></paragraph></subsection> 
<subsection id="H56E2545DAB2B4AECA5BFD8364F5285B1" commented="no"><enum>(e)</enum><header>Empaneling Investigative Subcommittee of the Committee on Standards of Official Conduct</header><text>The text of House Resolution 451, One Hundred Tenth Congress, shall apply in the One Hundred Thirteenth Congress in the same manner as such provision applied in the One Hundred Tenth Congress.</text></subsection></section>
