<section id="H73BE91A1360B4EC1BC4E2C2295F7B105"><enum>101.</enum><header>Workplace violence prevention standard</header> 
<subsection id="H5F9CD6B476B84F2F8287782A460B74C9"><enum>(a)</enum><header>Interim final standard</header> 
<paragraph id="H0F13777CEE364FB6981ABEFD5AC677E8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Labor shall promulgate an interim final standard on workplace violence prevention—</text> 
<subparagraph id="H7B7F615D25514C86A1BE82F2EAA53F82"><enum>(A)</enum><text display-inline="yes-display-inline">to require certain employers in the health care and social service sectors, and certain employers in sectors that conduct activities similar to the activities in the health care and social service sectors, to develop and implement a comprehensive workplace violence prevention plan to protect health care workers, social service workers, and other personnel from workplace violence; and</text></subparagraph> 
<subparagraph id="HADF30F4D85684978B76739B8F4FC4CFC"><enum>(B)</enum><text>that shall, at a minimum, be based on the Guidelines for Preventing Workplace Violence for Health care and Social Service Workers published by the Occupational Safety and Health Administration of the Department of Labor in 2015 and adhere to the requirements of this title.</text></subparagraph></paragraph> 
<paragraph id="HAC9EF55AD387489BA4244B8DFE623ABD"><enum>(2)</enum><header>Applicability of other statutory requirements</header><text>The following shall not apply to the promulgation of the interim final standard under this subsection:</text> 
<subparagraph id="H191C54C003FC405C92196E2E5AAFA15A"><enum>(A)</enum><text>The requirements applicable to occupational safety and health standards under section 6(b) of the Occupational Safety and Health Act of 1970 (29 U.S.C. 655(b)).</text></subparagraph> 
<subparagraph id="H716DFAB5CB4443DC8FCE41BF79655D3E"><enum>(B)</enum><text>The requirements of chapters 5 and 6 of title 5, United States Code, and titles 2 and 42, United States Code.</text></subparagraph></paragraph> 
<paragraph id="H12C5D1DE8C4C426CA0AD90F78ECC47D4"><enum>(3)</enum><header>Notice and comment</header><text display-inline="yes-display-inline">Notwithstanding paragraph (2)(B), the Secretary shall, prior to promulgating the interim final standard under this subsection, provide notice in the Federal Register of the interim final standard and a 30-day period for public comment.</text></paragraph> 
<paragraph id="HC32F9E59DCF241AD87381B15D9AD36F7"><enum>(4)</enum><header>Effective date of interim standard</header><text>The interim final standard shall—</text> 
<subparagraph id="H3B3AE5506350429DBC8B7A65E8968145"><enum>(A)</enum><text>take effect on a date that is not later than 30 days after promulgation, except that such interim final standard may include a reasonable phase-in period for the implementation of required engineering controls that take effect after such date;</text></subparagraph> 
<subparagraph id="H7729024C63D14B24961DD60F3527CF9D"><enum>(B)</enum><text display-inline="yes-display-inline">be enforced in the same manner and to the same extent as any standard promulgated under section 6(b) of the Occupational Safety and Health Act of 1970 (29 U.S.C. 655(b)); and</text></subparagraph> 
<subparagraph id="H88C7030DF32640CAB362F411657DE99E"><enum>(C)</enum><text>be in effect until the final standard described in subsection (b) becomes effective and enforceable.</text></subparagraph></paragraph> 
<paragraph id="H01EF7E491A3446A4B7CBDB1CB919E31F"><enum>(5)</enum><header>Failure to promulgate</header><text display-inline="yes-display-inline">If an interim final standard described in paragraph (1) is not promulgated not later than 1 year of the date of enactment of this Act, the provisions of this title shall be in effect and enforced in the same manner and to the same extent as any standard promulgated under section 6(b) of the Occupational Safety and Health Act (29 U.S.C. 655(b)) until such provisions are superseded in whole by an interim final standard promulgated by the Secretary that meets the requirements of paragraph (1).</text></paragraph></subsection> 
<subsection id="H9B1808E4E2B14661B7FC0D902DF1C50E"><enum>(b)</enum><header>Final standard</header> 
<paragraph id="H81C000FE0BA642C3823899B28EA7313F"><enum>(1)</enum><header>Proposed standard</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary of Labor shall, pursuant to section 6 of the Occupational Safety and Health Act (29 U.S.C. 655), promulgate a proposed standard on workplace violence prevention—</text> 
<subparagraph id="HAAF5246DF08749EBBDF9E58AA1D228CC"><enum>(A)</enum><text display-inline="yes-display-inline">for the purposes described in subsection (a)(1)(A); and</text></subparagraph> 
<subparagraph id="H3A61FE22F11F4EC7937141FD2077A1B4"><enum>(B)</enum><text display-inline="yes-display-inline">that shall include, at a minimum, the elements contained in the interim final standard promulgated under subsection (a).</text></subparagraph></paragraph> 
<paragraph id="H790E9440C4AF430E972C4414A7CA038E"><enum>(2)</enum><header>Final standard</header><text>Not later than 42 months after the date of enactment of this Act, the Secretary shall promulgate a final standard on such proposed standard that shall—</text> 
<subparagraph id="HD05694DC0A1044AAA76748171F55A128"><enum>(A)</enum><text>provide no less protection than any workplace violence standard adopted by a State plan that has been approved by the Secretary under section 18 of the Occupational Safety and Health Act of 1970 (29 U.S.C. 667); and</text></subparagraph> 
<subparagraph commented="no" id="HB91118F6398B4AC6930E74D362B36B8F"><enum>(B)</enum><text display-inline="yes-display-inline">be effective and enforceable in the same manner and to the same extent as any standard promulgated under section 6(b) of the Occupational Safety and Health Act of 1970 (29 U.S.C. 655(b)).</text></subparagraph></paragraph></subsection></section> 
<section id="H0594B4F269EE49CA8626F2EDC523F9E6"><enum>102.</enum><header>Scope and application</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="HE7BBCEDC56664A65A71DDB06AD1F7A3B"><enum>(1)</enum><header>Covered facility</header><text>The term <term>covered facility</term> includes the following:</text> 
<subparagraph id="H585B294A56CF490A9C67A7D0F3264AED"><enum>(A)</enum><text display-inline="yes-display-inline">Any hospital, including any specialty hospital, in-patient or outpatient setting, or clinic operating within a hospital license, or any setting that provides outpatient services.</text></subparagraph> 
<subparagraph id="HC8B908EA4E794A13985A02E33B7365F5"><enum>(B)</enum><text>Any residential treatment facility, including any nursing home, skilled nursing facility, hospice facility, and long-term care facility.</text></subparagraph> 
<subparagraph id="H146C6FF5D858490ABCE61FD4A3A1D71B"><enum>(C)</enum><text>Any non-residential treatment or service setting.</text></subparagraph> 
<subparagraph id="H4E4E730AA9DA4B5A8FA8B5606C6D0684"><enum>(D)</enum><text>Any medical treatment or social service setting or clinic at a correctional or detention facility.</text></subparagraph> 
<subparagraph id="HBBC3577BE6054229AF73D255E7889B9C"><enum>(E)</enum><text>Any community care setting, including a community-based residential facility, group home, and mental health clinic.</text></subparagraph> 
<subparagraph id="H51671FFCCA9947A2B3572654D76F395A"><enum>(F)</enum><text>Any psychiatric treatment facility.</text></subparagraph> 
<subparagraph id="HD388892ACDB84E3FBAE47891DE6EF571"><enum>(G)</enum><text>Any drug abuse or substance use disorder treatment center.</text></subparagraph> 
<subparagraph id="H9A0A4DFA78FA4C59959FB012E54967F9"><enum>(H)</enum><text display-inline="yes-display-inline">Any independent freestanding emergency centers.</text></subparagraph> 
<subparagraph id="H210BA82042554B1CB58F7D16B4E2D6BE"><enum>(I)</enum><text>Any facility described in subparagraphs (A) through (H) operated by a Federal Government agency and required to comply with occupational safety and health standards pursuant to section 1960 of title 29, Code of Federal Regulations (as such section is in effect on the date of enactment of this Act).</text></subparagraph> 
<subparagraph id="H413388CD277947A4A34D16FC78F05680"><enum>(J)</enum><text>Any other facility the Secretary determines should be covered under the standards promulgated under section 101.</text></subparagraph></paragraph> 
<paragraph id="HAE2D88B9010D49E98743F0CE163D8606"><enum>(2)</enum><header>Covered services</header><text display-inline="yes-display-inline">The term <term>covered service</term> includes the following services and operations:</text> 
<subparagraph id="HF3DA0D0CFA98469AA9D9D61BE3DB7387"><enum>(A)</enum><text display-inline="yes-display-inline">Any services and operations provided in any field work setting, including home health care, home-based hospice, and home-based social work.</text></subparagraph> 
<subparagraph commented="no" id="H1F746EC2B46B43959B235A3C05254775"><enum>(B)</enum><text>Any emergency services and transport, including such services provided by firefighters and emergency responders.</text></subparagraph> 
<subparagraph id="H3CECEFFF05504F73A08052C2DE58CACC"><enum>(C)</enum><text display-inline="yes-display-inline">Any services described in subparagraphs (A) and (B) performed by a Federal Government agency and required to comply with occupational safety and health standards pursuant to section 1960 of title 29, Code of Federal Regulations (as such section is in effect on the date of enactment of this Act).</text></subparagraph> 
<subparagraph id="H610DB954120A4B48AEFD59573037D2DD"><enum>(D)</enum><text>Any other services and operations the Secretary determines should be covered under the standards promulgated under section 101.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H9CB2CF1C276645E09F43803169395672"><enum>(3)</enum><header>Covered employer</header> 
<subparagraph id="HD81054C17F7549D28B1C5A937B8571EA"><enum>(A)</enum><header>In general</header><text>The term <term>covered employer</term> includes a person (including a contractor, subcontractor, a temporary service firm, or an employee leasing entity) that employs an individual to work at a covered facility or to perform covered services.</text></subparagraph> 
<subparagraph id="HF73B9EF47C8B49B2818F6725A589451E"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>covered employer</term> does not include an individual who privately employs, in the individual’s residence, a person to perform covered services for the individual or a family member of the individual.</text></subparagraph></paragraph> 
<paragraph id="HCAB3AC4F04D44862A9A728EDB0D705E0"><enum>(4)</enum><header>Covered employee</header><text display-inline="yes-display-inline">The term <term>covered employee</term> includes an individual employed by a covered employer to work at a covered facility or to perform covered services.</text></paragraph></section> 
<section id="HAB34FF26D3234623B42C699C68E074D8"><enum>103.</enum><header>Requirements for workplace violence prevention standard</header><text display-inline="no-display-inline">Each standard described in section 101 shall include, at a minimum, the following requirements:</text> 
<paragraph id="H1D2F87B0E9D84423B71AF2E52D88BDEF"><enum>(1)</enum><header>Workplace violence prevention plan</header><text display-inline="yes-display-inline">Not later than 6 months after the date of promulgation of the interim final standard under section 101(a), a covered employer shall develop, implement, and maintain an effective written workplace violence prevention plan for covered employees at each covered facility and for covered employees performing a covered service on behalf of such employer, which meets the following:</text> 
<subparagraph commented="no" id="HBC03F570A9FC4073BDBAFF680E3D449D"><enum>(A)</enum><header>Plan development</header><text>Each Plan shall—</text> 
<clause commented="no" id="H3B53662723354BF291F97CE4CF98A911"><enum>(i)</enum><text>be developed and implemented with the meaningful participation of direct care employees, other employees, and employee representatives, for all aspects of the Plan;</text></clause> 
<clause commented="no" id="HF635C7BE7CD64A109BD924B29DA2AFF2"><enum>(ii)</enum><text>be tailored and specific to conditions and hazards for the covered facility or the covered service, including patient-specific risk factors and risk factors specific to each work area or unit; and</text></clause> 
<clause commented="no" id="H691E2704B72046E7A22EF3640F3D09B4"><enum>(iii)</enum><text>be suitable for the size, complexity, and type of operations at the covered facility or for the covered service, and remain in effect at all times.</text></clause></subparagraph> 
<subparagraph commented="no" id="H970779ABC8D44D2D8013A30753B8358D"><enum>(B)</enum><header>Plan content</header><text>Each Plan shall include procedures and methods for the following:</text> 
<clause commented="no" id="H7186835F9740464BBDBE9BDE57EBDEDF"><enum>(i)</enum><text>Identification of the individual responsible for implementation of the Plan.</text></clause> 
<clause commented="no" id="HC3686529276C43FABEE2225EC970E103"><enum>(ii)</enum><text>With respect to each work area and unit at the covered facility or while covered employees are performing the covered service, risk assessment and identification of workplace violence risks and hazards to employees exposed to such risks and hazards (including environmental risk factors and patient-specific risk factors), which shall be—</text> 
<subclause id="HE2EFC69D207A438D9ECE73C3324408A8"><enum>(I)</enum><text>informed by past violent incidents specific to such covered facility or such covered service; and</text></subclause> 
<subclause id="H0ECFA97833B643DF9EFA94390AFD7816"><enum>(II)</enum><text>conducted with, at a minimum—</text> 
<item id="HD997CB80DDD44CB396D79C8C9D5FDB03"><enum>(aa)</enum><text>direct care employees;</text></item> 
<item id="HCAFCE3DCC58243EF8AD135958AA31EA7"><enum>(bb)</enum><text>where applicable, the representatives of such employees; and</text></item> 
<item id="H943405087BC442C3B1548FABACA42138"><enum>(cc)</enum><text>the employer.</text></item></subclause></clause> 
<clause commented="no" id="H04A13F6D594C4B78AF033E15671A7256"><enum>(iii)</enum><text display-inline="yes-display-inline">Hazard prevention, engineering controls, or work practice controls to correct hazards, in a timely manner, applying industrial hygiene principles of the hierarchy of controls, which— </text> 
<subclause commented="no" id="H46A456C9CE404057A6D480FE9644B4DD"><enum>(I)</enum><text>may include security and alarm systems, adequate exit routes, monitoring systems, barrier protection, established areas for patients and clients, lighting, entry procedures, staffing and working in teams, and systems to identify and flag clients with a history of violence; and</text></subclause> 
<subclause commented="no" id="H7DC82BCECB3D4F2A9A9643C7E514A703"><enum>(II)</enum><text display-inline="yes-display-inline">shall ensure that employers correct, in a timely manner, hazards identified in any violent incident investigation described in paragraph (2) and any annual report described in paragraph (5).</text></subclause></clause> 
<clause commented="no" id="HBA9A1EDE167B4FFEBCCA4C5A4006B344"><enum>(iv)</enum><text>Reporting, incident response, and post-incident investigation procedures, including procedures—</text> 
<subclause id="HC1502A31DA7343CEAF3B4699040F3A41"><enum>(I)</enum><text>for employees to report workplace violence risks, hazards, and incidents;</text></subclause> 
<subclause id="HF68BD15F30EE4E829BAABAF073AF8611"><enum>(II)</enum><text>for employers to respond to reports of workplace violence;</text></subclause> 
<subclause id="H35A92DA58C1E410F939D9F7B6C790C8D"><enum>(III)</enum><text>for employers to perform a post-incident investigation and debriefing of all reports of workplace violence with the participation of employees and their representatives; and</text></subclause> 
<subclause id="HC76B82C27C5542EBB31DC638B041FF2E"><enum>(IV)</enum><text>to provide medical care or first aid to affected employees.</text></subclause></clause> 
<clause commented="no" id="H6755F66DDD984B5FA9F941AA2C9BFB00"><enum>(v)</enum><text>Procedures for emergency response, including procedures for threats of mass casualties and procedures for incidents involving a firearm or a dangerous weapon.</text></clause> 
<clause commented="no" id="HC3ED57D545194E36A7B1F2A8DBAE7C25"><enum>(vi)</enum><text>Procedures for communicating with and training the covered employees on workplace violence hazards, threats, and work practice controls, the employer’s plan, and procedures for confronting, responding to, and reporting workplace violence threats, incidents, and concerns, and employee rights.</text></clause> 
<clause commented="no" id="HBA5D9AF1E23A4D188D5D9F4EDA381FBB"><enum>(vii)</enum><text display-inline="yes-display-inline">Procedures for—</text> 
<subclause id="HFDE9BE59E78A4226B2D8ED5EF965C6C0"><enum>(I)</enum><text>ensuring the coordination of risk assessment efforts, Plan development, and implementation of the Plan with other employers who have employees who work at the covered facility or who are performing the covered service; and</text></subclause> 
<subclause id="HCE850ED64546432C968779F9AA85AD22" commented="no"><enum>(II)</enum><text>determining which covered employer or covered employers shall be responsible for implementing and complying with the provisions of the standard applicable to the working conditions over which such employers have control.</text></subclause></clause> 
<clause commented="no" id="H1B10E3FC713D4E3B9631D78280CC6098"><enum>(viii)</enum><text>Procedures for conducting the annual evaluation under paragraph (6).</text></clause></subparagraph> 
<subparagraph id="H7DBC573CD82D4BFCA1076355F54F6E22"><enum>(C)</enum><header>Availability of Plan</header><text>Each Plan shall be made available at all times to the covered employees who are covered under such Plan.</text></subparagraph></paragraph> 
<paragraph id="H6A38A562C15548968CFAA50623DED65C"><enum>(2)</enum><header>Violent incident investigation</header> 
<subparagraph id="H545F28DCAA9D41EB9C0C4A5F881B1D52"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">As soon as practicable after a workplace violence incident, risk, or hazard of which a covered employer has knowledge, the employer shall conduct an investigation of such incident, risk, or hazard under which the employer shall—</text> 
<clause id="HD26570DEA5B7479B9D7B2C50A0939164"><enum>(i)</enum><text>review the circumstances of the incident, risk, or hazard, and whether any controls or measures implemented pursuant to the Plan of the employer were effective; and</text></clause> 
<clause id="H5C284E581EA141ACA0E45AC112E2ABAA"><enum>(ii)</enum><text>solicit input from involved employees, their representatives, and supervisors about the cause of the incident, risk, or hazard, and whether further corrective measures (including system-level factors) could have prevented the incident, risk, or hazard.</text></clause></subparagraph> 
<subparagraph id="H486D0EE8D861416185C3D7C1AA0E930C"><enum>(B)</enum><header>Documentation</header><text>A covered employer shall document the findings, recommendations, and corrective measures taken for each investigation conducted under this paragraph.</text></subparagraph></paragraph> 
<paragraph id="HBA51FF007C4D43EDA9678F7736C63F09"><enum>(3)</enum><header>Training and education</header><text>With respect to the covered employees covered under a Plan of a covered employer, the employer shall provide training and education to such employees who may be exposed to workplace violence hazards and risks, which meet the following requirements:</text> 
<subparagraph id="H6E2267154C744EB4A2DBB55B8999D81D"><enum>(A)</enum><text>Annual training and education shall include information on the Plan, including identified workplace violence hazards, work practice control measures, reporting procedures, record keeping requirements, response procedures, and employee rights.</text></subparagraph> 
<subparagraph id="HEDBF3DA2A04546D9A424EEB651DF6218"><enum>(B)</enum><text>Additional hazard recognition training shall be provided for supervisors and managers to ensure they—</text> 
<clause id="H790D6F197DDC4117BBBA958C87698305"><enum>(i)</enum><text>can recognize high-risk situations; and</text></clause> 
<clause id="H9454D00CF4CA4B4F8E444C2DDC8DE210"><enum>(ii)</enum><text>do not assign employees to situations that predictably compromise the safety of such employees.</text></clause></subparagraph> 
<subparagraph id="H71251F0640D0434D85FD83A256B43A2F"><enum>(C)</enum><text>Additional training shall be provided for each such covered employee whose job circumstances have changed, within a reasonable timeframe after such change.</text></subparagraph> 
<subparagraph id="HEDDB9C84857648DC9E71ACA03C2C8F89"><enum>(D)</enum><text>Applicable training shall be provided under this paragraph for each new covered employee prior to the employee’s job assignment. </text></subparagraph> 
<subparagraph id="H3A87701D0EED487490BBE5E1048A3E1D"><enum>(E)</enum><text>All training shall provide such employees opportunities to ask questions, give feedback on training, and request additional instruction, clarification, or other followup.</text></subparagraph> 
<subparagraph id="HC4831733661E4CE989D7E302A4E56566"><enum>(F)</enum><text>All training shall be provided in-person and by an individual with knowledge of workplace violence prevention and of the Plan, except that any annual training described in subparagraph (A) provided to an employee after the first year such training is provided to such employee may be conducted by live video if in-person training is impracticable.</text></subparagraph> 
<subparagraph id="H03DFEABFC6BB4846BD19471A1375F3C7"><enum>(G)</enum><text>All training shall be appropriate in content and vocabulary to the language, educational level, and literacy of such covered employees.</text></subparagraph></paragraph> 
<paragraph id="H6194A11C1E5849778D58A594CD0947D7"><enum>(4)</enum><header>Recordkeeping and access to plan records</header> 
<subparagraph id="H3E7A4AA99214420A914588E42963209F"><enum>(A)</enum><header>In general</header><text>Each covered employer shall—</text> 
<clause id="HB918EF6531154F4B8280A789E901A593"><enum>(i)</enum><text>maintain for not less than 5 years—</text> 
<subclause id="HA9CCDA6B78F5437582E62F0063CC5E0E"><enum>(I)</enum><text>records related to each Plan of the employer, including workplace violence risk and hazard assessments, and identification, evaluation, correction, and training procedures;</text></subclause> 
<subclause id="HA599B31158D14E868B700C56191EC1B5"><enum>(II)</enum><text display-inline="yes-display-inline">a violent incident log described in subparagraph (B) for recording all workplace violence incidents; and</text></subclause> 
<subclause id="H49804DA057E8407FB36F2401E1146C22"><enum>(III)</enum><text>records of all incident investigations as required under paragraph (2)(B); and</text></subclause></clause> 
<clause id="H2805E031B68F40F5877960947C477DA0"><enum>(ii)</enum> 
<subclause id="H3C3A646D324642BEAB76162AE92D87F5" display-inline="yes-display-inline"><enum>(I)</enum><text>make such records and logs available, upon request, to covered employees and their representatives for examination and copying in accordance with section 1910.1020 of title 29, Code of Federal Regulations (as such section is in effect on the date of enactment of this Act), and in a manner consistent with HIPAA privacy regulations (defined in section 1180(b)(3) of the Social Security Act (42 U.S.C. 1320d–9(b)(3))) and part 2 of title 42, Code of Federal Regulations (as such part is in effect on the date of enactment of this Act); and</text></subclause> 
<subclause id="HA808057C68574AD19231905BA4148567" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">ensure that any such records and logs that may be copied, transmitted electronically, or otherwise removed from the employer’s control for purposes of this clause omit any element of personal identifying information sufficient to allow identification of any patient, resident, client, or other individual alleged to have committed a violent incident (including the individual’s name, address, electronic mail address, telephone number, or social security number, or other information that, alone or in combination with other publicly available information, reveals such individual’s identity).</text></subclause></clause></subparagraph> 
<subparagraph id="H99CBA05D0C5B484A9BA79591EBCFB039"><enum>(B)</enum><header>Violent incident log description</header><text>Each violent incident log shall—</text> 
<clause commented="no" id="H1099FA5401EE495EAB545D1AA4A34BD4"><enum>(i)</enum><text>be maintained by a covered employer for each covered facility controlled by the employer and for each covered service being performed by a covered employee on behalf of such employer;</text></clause> 
<clause id="H0E018E08588E428A9F40D6B4E120FB98"><enum>(ii)</enum><text>be based on a template developed by the Secretary not later than 1 year after the date of enactment of this Act;</text></clause> 
<clause id="H0BC302712A3A427DB6F0CD53F45FA8EA"><enum>(iii)</enum><text display-inline="yes-display-inline">include, at a minimum, a description of—</text> 
<subclause id="H64B408D3B9314B69ABE5062B1B55C730"><enum>(I)</enum><text>the violent incident (including environmental risk factors present at the time of the incident);</text></subclause> 
<subclause id="H138881C6AA9944ADA13BC5A50B1DFC78"><enum>(II)</enum><text>the date, time, and location of the incident, and the names and job titles of involved employees;</text></subclause> 
<subclause id="HB92CCF5A262345A6A98C78ED7FCE02F7"><enum>(III)</enum><text>the nature and extent of injuries to covered employees;</text></subclause> 
<subclause id="H884DF4EAD92B4A7E98DF7EDC66FF971F"><enum>(IV)</enum><text display-inline="yes-display-inline">a classification of the perpetrator who committed the violence, including whether the perpetrator was—</text> 
<item id="HD645543D154F47F3A6910A7505FE5923"><enum>(aa)</enum><text>a patient, client, resident, or customer of a covered employer;</text></item> 
<item id="H8EE6E90223464800B2CBF5EEAA325F0A"><enum>(bb)</enum><text>a family or friend of a patient, client, resident, or customer of a covered employer;</text></item> 
<item id="H64777F54C2E04909BF2EE1ACB0BA7880"><enum>(cc)</enum><text>a stranger;</text></item> 
<item id="H0966AAE4D101474EBB59C593B63A0CA7"><enum>(dd)</enum><text>a coworker, supervisor, or manager of a covered employee;</text></item> 
<item id="HD0F2459489264B789D86D8F4C87D8B52"><enum>(ee)</enum><text>a partner, spouse, parent, or relative of a covered employee; or</text></item> 
<item id="HBA0B411BA52D4CC4857C8A78A08574B5"><enum>(ff)</enum><text>any other appropriate classification;</text></item></subclause> 
<subclause id="H7511D2579486404D9275B7CC725F5BB4"><enum>(V)</enum><text>the type of violent incident (such as type 1 violence, type 2 violence, type 3 violence, or type 4 violence); and</text></subclause> 
<subclause id="HDF68E67A0878442A952087575A4AA9DA"><enum>(VI)</enum><text>how the incident was abated;</text></subclause></clause> 
<clause id="HE325A601353A40DDBD4C94D295553F98"><enum>(iv)</enum><text>not later than 7 days after the employer learns of such incident, contain a record of each violent incident, which is updated to ensure completeness of such record;</text></clause> 
<clause id="HAA97BEED52424787B0EADFE870B5F8FF" commented="no"><enum>(v)</enum><text>be maintained for not less than 5 years; and </text></clause> 
<clause id="H92D5B553A3E14D778B3AC572686FF256"><enum>(vi)</enum><text display-inline="yes-display-inline">in the case of a violent incident involving a privacy concern case, protect the identity of employees in a manner consistent with section 1904.29(b) of title 29, Code of Federal Regulations (as such section is in effect on the date of enactment of this Act).</text></clause></subparagraph> 
<subparagraph id="H85CC56DC49E1405481CDD36A249C3D32"><enum>(C)</enum><header>Annual summary</header> 
<clause id="HF649FD1516F54FA3BF9D20CA2FEACE95"><enum>(i)</enum><header>Covered employers</header><text>Each covered employer shall prepare an annual summary of each violent incident log for the preceding calendar year that shall—</text> 
<subclause id="HA575F06ABBC34AB6A66A4800EA1E485F"><enum>(I)</enum><text>with respect to each covered facility, and each covered service, for which such a log has been maintained, include the total number of violent incidents, the number of recordable injuries related to such incidents, and the total number of hours worked by the covered employees for such preceding year;</text></subclause> 
<subclause id="H5AA010A2E0E44A7FBED7D8839D31EAF6"><enum>(II)</enum><text>be completed on a form provided by the Secretary;</text></subclause> 
<subclause id="H9D7392040E3348EE911568B28CA26025"><enum>(III)</enum><text display-inline="yes-display-inline">be posted for three months beginning February 1 of each year in a manner consistent with the requirements of section 1904 of title 29, Code of Federal Regulations (as such section is in effect on the date of enactment of this Act), relating to the posting of summaries of injury and illness logs;</text></subclause> 
<subclause id="HD91DF4A6025C4CB4A47E92F8CAA93260"><enum>(IV)</enum><text>be located in a conspicuous place or places where notices to employees are customarily posted; and</text></subclause> 
<subclause id="HD4FC65B660D941F3B33FFE2650A01FB4"><enum>(V)</enum><text>not be altered, defaced, or covered by other material.</text></subclause></clause> 
<clause id="H0896E2A4229A46DE89D37C6FB875338B"><enum>(ii)</enum><header>Secretary</header><text>Not later than 1 year after the promulgation of the interim final standard under section 101(a), the Secretary shall make available a platform for the electronic submission of annual summaries required under this paragraph.</text></clause></subparagraph></paragraph> 
<paragraph id="H9318BEF8CF244CE286193FBDAA6C980E"><enum>(5)</enum><header>Annual report</header><text>Not later than February 15 of each year, each covered employer shall report to the Secretary, the frequency, quantity, and severity of workplace violence, and any incident response and post-incident investigation (including abatement measures) for the incidents set forth in the annual summary of the violent incident log described in paragraph (4)(C).</text></paragraph> 
<paragraph id="H155C9FCC085546D6802D1E5E04B70E4F"><enum>(6)</enum><header>Annual evaluation</header><text>Each covered employer shall conduct an annual written evaluation, conducted with the full, active participation of covered employees and employee representatives, of—</text> 
<subparagraph id="HE57ED18EE04E4C4690660DDE4C68A4A1"><enum>(A)</enum><text>the implementation and effectiveness of the Plan, including a review of the violent incident log; and</text></subparagraph> 
<subparagraph id="HD66DD531705641BD93F01DE76D533AEB"><enum>(B)</enum><text>compliance with training required by each standard described in section 101, and specified in the Plan.</text></subparagraph></paragraph> 
<paragraph id="H8CBA7D5CECF4490A909FDAFC6069A992"><enum>(7)</enum><header>Anti-retaliation</header> 
<subparagraph id="HF95EB0EF035E47C29FD42AC00B0C23EC"><enum>(A)</enum><header>Policy</header><text display-inline="yes-display-inline">Each covered employer shall adopt a policy prohibiting any person (including an agent of the employer) from discriminating or retaliating against any employee for reporting, or seeking assistance or intervention from, a workplace violence incident, threat, or concern to the employer, law enforcement, local emergency services, or a government agency, or participating in an incident investigation.</text></subparagraph> 
<subparagraph id="HEC4D1DDAB1A549D2B9D5BE12DACDC42F"><enum>(B)</enum><header>Prohibition</header><text>No covered employer shall discriminate or retaliate against any employee for—</text> 
<clause id="H9001D1106585421380799F7B8A76086A"><enum>(i)</enum><text>reporting a workplace violence incident, threat, or concern to, or seeking assistance or intervention with respect to such incident, threat, or concern from, the employer, law enforcement, local emergency services, or a local, State, or Federal government agency; or</text></clause> 
<clause id="HE85A178B37444F0BB5918E50C52BE519"><enum>(ii)</enum><text>exercising any other rights under this paragraph.</text></clause></subparagraph> 
<subparagraph commented="no" id="H4AB6C4AF30F14FB99818A976ED5F5356"><enum>(C)</enum><header>Enforcement</header><text display-inline="yes-display-inline">This paragraph shall be enforced in the same manner and to the same extent as any standard promulgated under section 6(b) of the Occupational Safety and Health Act (29 U.S.C. 655(b)).</text></subparagraph></paragraph></section> 
<section id="HD40B828575F94770A134FC32419F842A"><enum>104.</enum><header>Rules of construction</header><text display-inline="no-display-inline">Notwithstanding section 18 of the Occupational Safety and Health Act of 1970 (29 U.S.C. 667)—</text> 
<paragraph id="H9BB683468F934153889FEF6C81816B33"><enum>(1)</enum><text>nothing in this title shall be construed to curtail or limit authority of the Secretary under any other provision of the law; and</text></paragraph> 
<paragraph id="H9C54DF34D70B4656B5AA9449DBD176AF"><enum>(2)</enum><text>the rights, privileges, or remedies of covered employees shall be in addition to the rights, privileges, or remedies provided under any Federal or State law, or any collective bargaining agreement.</text></paragraph></section> 
<section id="H718391F87E4C4BECBAEDECC46A9AF086"><enum>105.</enum><header>Other definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="H6FA201FEC81B4F2BB4FEE41E9D73CF16"><enum>(1)</enum><header>Workplace Violence</header> 
<subparagraph id="H8F0567A56E34410FAB50F2563A55BB09"><enum>(A)</enum><header>In general</header><text>The term <term>workplace violence</term> means any act of violence or threat of violence, without regard to intent, that occurs at a covered facility or while a covered employee performs a covered service.</text></subparagraph> 
<subparagraph id="H337E4DFE581F47658102F3D91CDA336A"><enum>(B)</enum><header>Exclusions</header><text>The term <term>workplace violence</term> does not include lawful acts of self-defense or lawful acts of defense of others.</text></subparagraph> 
<subparagraph id="HF3F3E32CEB3F4CF3A93E3FA4EBF666D3"><enum>(C)</enum><header>Inclusions</header><text>The term <term>workplace violence</term> includes—</text> 
<clause id="HB9CD604CAD24400A98EB5A421FAF2A4C"><enum>(i)</enum><text>the threat or use of physical force against a covered employee that results in or has a high likelihood of resulting in injury, psychological trauma, or stress, without regard to whether the covered employee sustains an injury, psychological trauma, or stress; and</text></clause> 
<clause id="H54AB56AE090A41A09100CB69F12847E7"><enum>(ii)</enum><text display-inline="yes-display-inline">an incident involving the threat or use of a firearm or a dangerous weapon, including the use of common objects as weapons, without regard to whether the employee sustains an injury, psychological trauma, or stress.</text></clause></subparagraph></paragraph> 
<paragraph commented="no" id="H0555D6D2A5E0425DBC0D14D5CD9D86F3"><enum>(2)</enum><header>Type 1 violence</header><text display-inline="yes-display-inline">The term <term>type 1 violence</term>—</text> 
<subparagraph id="H688BC8B34C954AE28F11789C2F9F464C"><enum>(A)</enum><text>means workplace violence directed at a covered employee at a covered facility or while performing a covered service by an individual who has no legitimate business at the covered facility or with respect to such covered service; and</text></subparagraph> 
<subparagraph id="HBEE76002AF3F44DDAC160926D05853D7"><enum>(B)</enum><text>includes violent acts by any individual who enters the covered facility or worksite where a covered service is being performed with the intent to commit a crime.</text></subparagraph></paragraph> 
<paragraph id="HCBFF85EFE77142FBB2D5EB91B840BA96"><enum>(3)</enum><header>Type 2 violence</header><text>The term <term>type 2 violence</term> means workplace violence directed at a covered employee by customers, clients, patients, students, inmates, or any individual for whom a covered facility provides services or for whom the employee performs covered services.</text></paragraph> 
<paragraph id="H9161C5955A7A4DD9A9FFF5E6409E65AB"><enum>(4)</enum><header>Type 3 violence</header><text display-inline="yes-display-inline">The term <term>type 3 violence</term> means workplace violence directed at a covered employee by a present or former employee, supervisor, or manager.</text></paragraph> 
<paragraph id="H3F5C2FD5E5FA4DE48EDC701448DE5A59"><enum>(5)</enum><header>Type 4 violence</header><text display-inline="yes-display-inline">The term <term>type 4 violence</term> means workplace violence directed at a covered employee by an individual who is not an employee, but has or is known to have had a personal relationship with such employee, or with a customer, client, patient, student, inmate, or any individual for whom a covered facility provides services or for whom the employee performs covered services.</text></paragraph> 
<paragraph id="H85552792A16E491B842F5A178F49ABD0"><enum>(6)</enum><header>Threat of Violence</header><text>The term <term>threat of violence</term> means a statement or conduct that—</text> 
<subparagraph id="HC809C09B0C254EE4B929E4F974ED8E8C"><enum>(A)</enum><text>causes an individual to fear for such individual’s safety because there is a reasonable possibility the individual might be physically injured; and</text></subparagraph> 
<subparagraph id="HF0675D1AC6A8434A91025A62E1A74400"><enum>(B)</enum><text>serves no legitimate purpose.</text></subparagraph></paragraph> 
<paragraph id="H3D9253894FFF455B84EA61E11F8CF50A"><enum>(7)</enum><header>Alarm</header><text>The term <term>alarm</term> means a mechanical, electrical, or electronic device that does not rely upon an employee’s vocalization in order to alert others.</text></paragraph> 
<paragraph id="H3D6DA321A931441794182462DE16CB99"><enum>(8)</enum><header>Dangerous weapon</header><text>The term <term>dangerous weapon</term> means an instrument capable of inflicting death or serious bodily injury, without regard to whether such instrument was designed for that purpose.</text></paragraph> 
<paragraph id="HDE4CBABC60DE4A019B28512276628CE3"><enum>(9)</enum><header>Engineering controls</header> 
<subparagraph id="H19F18B2FA92C4FAEA72868E1E46BC636"><enum>(A)</enum><header>In general</header><text>The term <term>engineering controls</term> means an aspect of the built space or a device that removes a hazard from the workplace or creates a barrier between a covered employee and the hazard.</text></subparagraph> 
<subparagraph id="HC58ACF79938C4108A91D939754C1CBDD"><enum>(B)</enum><header>Inclusions</header><text>For purposes of reducing workplace violence hazards, the term <term>engineering controls</term> includes electronic access controls to employee occupied areas, weapon detectors (installed or handheld), enclosed work­stations with shatter-resistant glass, deep service counters, separate rooms or areas for high-risk patients, locks on doors, removing access to or securing items that could be used as weapons, furniture affixed to the floor, opaque glass in patient rooms (which protects privacy, but allows the health care provider to see where the patient is before entering the room), closed-circuit television monitoring and video recording, sight-aids, and personal alarm devices.</text></subparagraph></paragraph> 
<paragraph id="H983C9CF976844DA49776B4949A48E776"><enum>(10)</enum><header>Environmental risk factors</header> 
<subparagraph id="H587F332D8EA14B03BDB7F30EFAED81D0"><enum>(A)</enum><header>In general</header><text>The term <term>environmental risk factors</term> means factors in the covered facility or area in which a covered service is performed that may contribute to the likelihood or severity of a workplace violence incident.</text></subparagraph> 
<subparagraph id="H72F6C650FD164D13ABFE08C61354444E"><enum>(B)</enum><header>Clarification</header><text>Environmental risk factors may be associated with the specific task being performed or the work area, such as working in an isolated area, poor illumination or blocked visibility, and lack of physical barriers between individuals and persons at risk of committing workplace violence.</text></subparagraph></paragraph> 
<paragraph id="HADDAE8E6A40F497EAB2722F5471E389B"><enum>(11)</enum><header>Patient-specific risk factors</header><text display-inline="yes-display-inline">The term <term>patient-specific risk factors</term> means factors specific to a patient that may increase the likelihood or severity of a workplace violence incident, including—</text> 
<subparagraph id="H4FE8FD8E7BC04D94BEA8534B8CD86B06"><enum>(A)</enum><text display-inline="yes-display-inline">a patient’s treatment and medication status, and history of violence and use of drugs or alcohol; and </text></subparagraph> 
<subparagraph id="H7A14F4424D5148CC944EA5D9106B084C"><enum>(B)</enum><text display-inline="yes-display-inline">any conditions or disease processes of the patient that may cause the patient to experience confusion or disorientation, be non-responsive to instruction, behave unpredictably, or engage in disruptive, threatening, or violent behavior. </text></subparagraph></paragraph> 
<paragraph id="HF542428B63B448A6A67B30E89AABB538"><enum>(12)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph> 
<paragraph id="HF2C53991AE3C44D19631F5806F5BF645"><enum>(13)</enum><header>Work practice controls</header> 
<subparagraph id="H877BBF506C0C44A98BC9D4D93981ED52"><enum>(A)</enum><header>In general</header><text>The term <term>work practice controls</term> means procedures and rules that are used to effectively reduce workplace violence hazards.</text></subparagraph> 
<subparagraph id="HAC646216522F4E269BECAEDF6DC8E8B3"><enum>(B)</enum><header>Inclusions</header><text>The term <term>work practice controls</term> includes—</text> 
<clause id="H929D582929E04515A2C4B3C37E35AE27"><enum>(i)</enum><text>assigning and placing sufficient numbers of staff to reduce patient-specific Type 2 workplace violence hazards;</text></clause> 
<clause id="H625A8B6A91D449F7B7C5CA894471D72C"><enum>(ii)</enum><text>provision of dedicated and available safety personnel such as security guards;</text></clause> 
<clause id="HEAF530C0CD1349DAB111EAE1C7E0EEAA"><enum>(iii)</enum><text>employee training on workplace violence prevention methods and techniques to de-escalate and minimize violent behavior; and</text></clause> 
<clause id="H32C5DE05891B4BFB978DF9209BAACDB7"><enum>(iv)</enum><text>employee training on procedures for response in the event of a workplace violence incident and for post-incident response.</text></clause></subparagraph></paragraph></section></title> 
<title commented="no" id="H8977491AF31C4437987BE42584EB0D54"><enum>II</enum><header>Amendments to the Social Security Act</header> 
<section commented="no" id="H75A73FAF19304041883435558F2B50AC"><enum>201.</enum><header>Application of the workplace violence prevention standard to certain facilities receiving Medicare funds</header>

<clause id="HAF71FB440D354EECBAC2CC19DCAD278E"><enum>(i)</enum><text>by striking <quote>(a)(1)(U)</quote> and inserting <quote>(a)(1)(V)</quote>; and</text></clause> 
<clause id="HBF90858959F34FE0A6A45B7216D0A2BB"><enum>(ii)</enum><text>by inserting <quote>(or, in the case of a failure to comply with the requirement of subsection (a)(1)(Z), for a violation of the Workplace Violence Prevention standard referred to in such subsection by a hospital or skilled nursing facility, as applicable, that is subject to the provisions of such Act)</quote> before the period at the end.</text></clause></subparagraph></paragraph></subsection> 
<subsection commented="no" id="H73EF9CED475B4C94A63421EF2D29DE31"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply beginning on the date that is 1 year after the date of issuance of the interim final standard on workplace violence prevention required under section 101.</text></subsection></section></title>
