<section id="H75B1F173B6B64B5E9EA683F68E47F67F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting and Securing Florida’s Coastline Act of 2019</short-title></quote>.</text></section> 
<section id="HEDC5DB9D275844D8B4F7F7EC0127CE5B"><enum>2.</enum><header>Permanent extension of moratorium on leasing in certain areas of the Gulf of Mexico</header><text display-inline="no-display-inline">Section 104(a) of the Gulf of Mexico Energy Security Act of 2006 (43 U.S.C. 1331 note) is amended by striking <quote>Effective during</quote> and all that follows through <quote>the Secretary</quote> and inserting <quote>The Secretary</quote>.</text></section> 
<section id="H89CA2247466D49758F0F0BE630F771B0" display-inline="no-display-inline"><enum>3.</enum><header>Inspection Fee Collection</header><text display-inline="no-display-inline">Section 22 of the Outer Continental Shelf Lands Act (43 U.S.C. 1348) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H02D9A42835704BDEA2EE7D901D221E9C" display-inline="no-display-inline"> 
<subsection id="HB9D24E8D48CC46EDA4763FD0CC0D2ECC"><enum>(g)</enum><header>Inspection fees</header> 
<paragraph id="H7BC650C209B74D3BA11119F38EE99DB9"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of the Interior shall collect from the operators of facilities subject to inspection under subsection (c) non-refundable fees for such inspections—</text> 
<subparagraph id="H2B625068CFB549CBA9B66957942A4EC5"><enum>(A)</enum><text display-inline="yes-display-inline">at an aggregate level equal to the amount necessary to offset the annual expenses of inspections of outer Continental Shelf facilities (including mobile offshore drilling units) by the Secretary of the Interior; and</text></subparagraph> 
<subparagraph id="H1FF0B18287CD4A43B77B9C0509ECBDE3"><enum>(B)</enum><text display-inline="yes-display-inline">using a schedule that reflects the differences in complexity among the classes of facilities to be inspected.</text></subparagraph></paragraph> 
<paragraph id="H3CF45AF4FB1B4C21BDAD0C44B60FFE06"><enum>(2)</enum><header>Ocean Energy Safety Fund</header><text display-inline="yes-display-inline">There is established in the Treasury a fund, to be known as the <quote>Ocean Energy Safety Fund</quote> (referred to in this subsection as the <quote>Fund</quote>), into which shall be deposited all amounts collected as fees under paragraph (1) and which shall be available as provided under paragraph (3).</text></paragraph> 
<paragraph id="H9E7DE61E50564D9CB17CA0D17263F31E"><enum>(3)</enum><header>Availability of fees</header><text display-inline="yes-display-inline">Notwithstanding section 3302 of title 31, United States Code, all amounts deposited in the Fund—</text> 
<subparagraph id="H8A954B275A0B446D8959D5465E0EC854"><enum>(A)</enum><text display-inline="yes-display-inline">shall be credited as offsetting collections;</text></subparagraph> 
<subparagraph id="H44C9E7623A584AD996234FB4D19A7ED2"><enum>(B)</enum><text display-inline="yes-display-inline">shall be available for expenditure for purposes of carrying out inspections of outer Continental Shelf facilities (including mobile offshore drilling units) and the administration of the inspection program under this section;</text></subparagraph> 
<subparagraph id="HD918779CE5754FA3B5ECD3D10438F5A3"><enum>(C)</enum><text display-inline="yes-display-inline">shall be available only to the extent provided for in advance in an appropriations Act; and</text></subparagraph> 
<subparagraph id="H7C9749B08D884FF89E849267CF602D20"><enum>(D)</enum><text display-inline="yes-display-inline">shall remain available until expended.</text></subparagraph></paragraph> 
<paragraph id="H35726662A6D2450F8E646F70368E1D1E"><enum>(4)</enum><header>Adjustment for inflation</header><text display-inline="yes-display-inline">For each fiscal year beginning after fiscal year 2020, the Secretary shall adjust each dollar amount specified in this subsection for inflation based on the change in the Consumer Price Index from fiscal year 2020.</text></paragraph> 
<paragraph id="H97C2947F83294CBB99322A0A4AF06733"><enum>(5)</enum><header>Annual fees</header><text display-inline="yes-display-inline">Annual fees shall be collected under this subsection for facilities that are above the waterline, excluding drilling rigs, and are in place at the start of the fiscal year. Fees for fiscal year 2020 shall be—</text> 
<subparagraph id="H61441EA9A1344C8B81412B64CB712C8D"><enum>(A)</enum><text display-inline="yes-display-inline">$11,500 for facilities with no wells, but with processing equipment or gathering lines;</text></subparagraph> 
<subparagraph id="HCE6D772B611F4B5290C274F8E92B5A90"><enum>(B)</enum><text display-inline="yes-display-inline">$18,500 for facilities with 1 to 10 wells, with any combination of active or inactive wells; and</text></subparagraph> 
<subparagraph id="H6ECDF279943A4DC8B6FEAB9EA553BF0E"><enum>(C)</enum><text display-inline="yes-display-inline">$34,500 for facilities with more than 10 wells, with any combination of active or inactive wells.</text></subparagraph></paragraph> 
<paragraph id="H2F6044DF059C426EA67279F811DAC2A1"><enum>(6)</enum><header>Fees for drilling rigs</header><text display-inline="yes-display-inline">Fees shall be collected under this subsection for drilling rigs on a per inspection basis. Fees for fiscal year 2020 shall be—</text> 
<subparagraph id="HA411F47CBA0946BAAA28644881ABFCEA"><enum>(A)</enum><text display-inline="yes-display-inline">$33,500 per inspection for rigs operating in water depths of 500 feet or more; and</text></subparagraph> 
<subparagraph id="H0E286A2D8B254965AC04B42484E3C6C3"><enum>(B)</enum><text display-inline="yes-display-inline">$18,500 per inspection for rigs operating in water depths of less than 500 feet.</text></subparagraph></paragraph> 
<paragraph id="HA04A2032DB5B442889A8A26555B94158"><enum>(7)</enum><header>Fees for non-rig units</header><text display-inline="yes-display-inline">Fees shall be collected under this subsection for well operations conducted via non-rig units as outlined in subparts D, E, F, and Q of part 250 of title 30, Code of Federal Regulations, on a per inspection basis. Fees for fiscal year 2020 shall be—</text> 
<subparagraph id="HFB895226B804408193C7A8DE09795054"><enum>(A)</enum><text display-inline="yes-display-inline">$13,260 per inspection for non-rig units operating in water depths of 2,500 feet or more;</text></subparagraph> 
<subparagraph id="HA15E4598B2DF4D4EA23ADC8730BC3E19"><enum>(B)</enum><text display-inline="yes-display-inline">$11,530 per inspection for non-rig units operating in water depths between 500 and 2,499 feet; and</text></subparagraph> 
<subparagraph id="HCF0AFCD0FEE247429A533052B07C3129"><enum>(C)</enum><text display-inline="yes-display-inline">$4,470 per inspection for rigs operating in water depths of less than 500 feet.</text></subparagraph></paragraph> 
<paragraph id="HE12C79BDDBBA403EB3F9CF5ED7490257"><enum>(8)</enum><header>Billing</header><text display-inline="yes-display-inline">The Secretary shall bill designated operators under paragraph (5) annually, with payment required within 30 days of billing. The Secretary shall bill designated operators under paragraph (6) within 30 days of the end of the month in which the inspection occurred, with payment required within 30 days after billing.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC15FDBFBDB8B465091DD93BA9B9AF33A"><enum>4.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section>
