<section id="H6F722E128C7242F587AFD206CC8D0829"><enum>101.</enum><text display-inline="yes-display-inline">The Continuing Appropriations Act, 2020 (division A of Public Law 116–59) is amended—</text> 
<paragraph id="H5931BC08628945AE97EE42D3D263717B" commented="no"><enum>(1)</enum><text>by striking the date specified in section 106(3) and inserting <quote>December 20, 2019</quote>;</text></paragraph> 
<paragraph id="HB0B127B923614AAE81F1542FAB50BD3D"><enum>(2)</enum><text>by striking section 122 and inserting the following:</text>

<section id="HC5A182F2A79C476EADA9E8011906342E" display-inline="no-display-inline" commented="no"><enum>147.</enum><header>Adjustments for Certain Rates of Pay for the Uniformed Services</header><text display-inline="no-display-inline">Amounts made available in applicable accounts by section 101—</text> 
<paragraph id="HEBB82FAE82C2430C8CE2CFD06E413D09" commented="no"><enum>(1)</enum><text>for monthly basic pay for members of the uniformed services under section 203(a) of title 37, United States Code, may be apportioned up to the rate for operations necessary to provide monthly pay consistent with section 4 of Executive Order 13866 of March 28, 2019; and</text></paragraph> 
<paragraph id="HE7C6EE8B958F47D2BF489E7DCD9E9BEE" commented="no"><enum>(2)</enum><text>for monthly cadet or midshipmen pay for cadets or midshipmen under section 203(c) of title 37, United States Code, may be apportioned up to the rate for operations necessary to provide monthly pay consistent with section 4 of Executive Order 13866 of March 28, 2019.</text></paragraph></section> 
<section id="H9B0053273B564B5799375641A1BB704B" commented="no"><enum>148.</enum><text display-inline="yes-display-inline">In addition to amounts provided in section 101, amounts are provided for the Payments in Lieu of Taxes program authorized by chapter 69 of title 31, United States Code, at a rate for operations of $400,000, to be used solely for administrative expenses.</text></section> 
<section id="H57D98846541048D29BBF4BC89B2776E5"><enum>149.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, there is hereby appropriated for fiscal year 2020 for payment to Maya M. Rockeymoore, widow of Elijah E. Cummings, late a Representative from the State of Maryland, $174,000.</text></section> 
<section id="H38668A8B59B342AFB8D611976A33E8A8" commented="no"><enum>150.</enum><text display-inline="yes-display-inline">Notwithstanding section 251(a)(1) of the Balanced Budget and Emergency Deficit Control Act of 1985 and the timetable in section 254(a) of such Act, the final sequestration report for fiscal year 2020 pursuant to section 254(f)(1) of such Act and any order for fiscal year 2020 pursuant to section 254(f)(5) of such Act shall be issued, for the Congressional Budget Office, 10 days after the date specified in section 106(3), and for the Office of Management and Budget, 15 days after the date specified in section 106(3).</text></section> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<subsection id="HE89E8326EE4141B2989DC84275A23330"><enum>(b)</enum><header>Technical corrections to the USVSST Fund</header> 
<paragraph id="H612D9F2CEF6C42169DA521DE894BA8FC"><enum>(1)</enum><header>In general</header><text>The Justice for United States Victims of State Sponsored Terrorism Act (34 U.S.C. 20144) is amended—</text> 
<subparagraph id="HC7ED6EF4C93E4D41A73808FCA897390F"><enum>(A)</enum><text>in subsection (b)—</text> 
<clause id="HB34A88A04B9846DB8DE129437D7DF0DF"><enum>(i)</enum><text>in paragraph (1)(B), by striking <quote>section.</quote> and inserting <quote>section, except that, during the 1-year period beginning on the date of enactment of the <short-title>United States Victims of State Sponsored Terrorism Fund Clarification Act</short-title>, the Special Master may utilize an additional 5 full-time equivalent Department of Justice personnel.</quote>; and</text></clause>

<subclause id="H765DE1CA7BEA454BB7B2AEA282D447A7"><enum>(II)</enum><text>further dividing the funds allocated to non-9/11 related victims of state sponsored terrorism on a pro rata basis, based on the amounts outstanding and unpaid on eligible claims, until such amounts have been paid in full or the Fund is closed; and</text></subclause> 
<subclause id="H2A1B5D3469E747F291D356CBA8EE6AFB"><enum>(III)</enum><text>further dividing the funds allocated to 9/11 related victims of state sponsored terrorism on a pro rata basis, based on the amounts outstanding and unpaid on eligible claims, until such amounts have been paid in full or the Fund is closed.</text></subclause></clause> 
<clause id="HE0D9CC87A6B849EA9C0F56D8141D5145"><enum>(ii)</enum><header>Limitations</header><text>The limitations described in this clause are as follows:</text> 
<subclause id="HF2FC0EAC86444FE78DAAB3CC3CD2A219"><enum>(I)</enum><text>In the event that a United States person has an eligible claim that exceeds $20,000,000, the Special Master shall treat that claim as if it were for $20,000,000 for purposes of this section.</text></subclause> 
<subclause id="H3E1315621CBA4315994E5372AAC17AF3"><enum>(II)</enum><text>In the event that a non-9/11 related victim of state sponsored terrorism and the immediate family members of such person have claims that if aggregated would exceed $35,000,000, the Special Master shall, for purposes of this section, reduce such claims on a pro rata basis such that in the aggregate such claims do not exceed $35,000,000.</text></subclause> 
<subclause id="HDFC6D8F4B64C4AC189D0DC060DD20FB8"><enum>(III)</enum><text>In the event that a 9/11 victim, 9/11 spouse, or 9/11 dependent and the immediate family members of such person (who are also 9/11 victims, 9/11 spouses, or 9/11 dependents) have claims that if aggregated would exceed $35,000,000, the Special Master shall, for purposes of this section, reduce such claims on a pro rata basis such that in the aggregate such claims do not exceed $35,000,000.</text></subclause> 
<subclause id="H30A696B4581F4C939D74E929AD9837B7"><enum>(IV)</enum><text>In the event that a 9/11 family member and the family members of such person (who are also 9/11 family members) have claims that if aggregated would exceed $20,000,000, the Special Master shall, for purposes of this section, reduce such claims on a pro rata basis such that in the aggregate such claims do not exceed $20,000,000.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause> 
<clause id="HC805215E5B744809B4B50423D2361274"><enum>(ii)</enum><text>in paragraph (4)—</text>

The Special Master shall accept applications from eligible applicants (consistent with the deadlines for application submission prescribed in subsection (c)(3)) until the date that is 90 days after the date of enactment of the <short-title>United States Victims of State Sponsored Terrorism Fund Clarification Act</short-title>.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause></subparagraph> 
<subparagraph id="H4D7C8985812A47059632D92EE28087D0"><enum>(D)</enum><text>in subsection (e)—</text>

<subparagraph id="HE127435E2E964C359505D2D2ADC9797F"><enum>(F)</enum><text>in subsection (j)—</text>

<paragraph id="H0D701C4B9EC24FCF99AEB193ED69973A"><enum>(10)</enum><header>9/11 related victim of state sponsored terrorism</header><text>The term <term>9/11 related victim of state sponsored terrorism</term> means a 9/11 victim, 9/11 spouse, 9/11 dependent, or 9/11 family member.</text></paragraph> 
<paragraph id="HC8CD4B9B35224621BF17CD697D671F21"><enum>(11)</enum><header>9/11 dependent</header><text>The term <term>9/11 dependent</term> means a United States person who has an eligible claim under subsection (c) who at the time of a 9/11 victim’s death was—</text> 
<subparagraph id="HDAB7DC1B3F3E487188278B19FD67EA3F"><enum>(A)</enum><text>a dependent, as defined in section 104.3 of title 28, Code of Federal Regulations, or any successor thereto, of the 9/11 victim; or </text></subparagraph> 
<subparagraph id="H8200CA3C75634FE1981E876D3BE2A870"><enum>(B)</enum><text>the child of the 9/11 victim who has not, before the date of enactment of the <short-title>United States Victims of State Sponsored Terrorism Fund Clarification Act</short-title>, received payment from the Fund. </text></subparagraph></paragraph> 
<paragraph id="H4C56128D3C6C4B8792125F58BB26DCAB"><enum>(12)</enum><header>9/11 family member</header><text>The term <term>9/11 family member</term> means the immediate family member of an individual described in section 405(c) of the Air Transportation Safety and System Stabilization Act (49 U.S.C. 40101 note) who is not a 9/11 dependent or a 9/11 spouse.</text></paragraph> 
<paragraph id="H4577CCA272E04F2697B54378AF49C8BE"><enum>(13)</enum><header>9/11 spouse</header><text>The term <term>9/11 spouse</term> means a United States person who has an eligible claim under subsection (c) who is a spouse, as defined in section 104.3 of title 28, Code of Federal Regulations, or any successor thereto, of an individual described in section 405(c) of the Air Transportation Safety and System Stabilization Act (49 U.S.C. 40101 note).</text></paragraph> 
<paragraph id="HC8128D2C4BAD45A985E644B2095BC8E1"><enum>(14)</enum><header>9/11 victim</header><text>The term <term>9/11 victim</term> means a United States person who has an eligible claim under subsection (c) who is an individual described in section 405(c)(2) of the Air Transportation Safety and System Stabilization Act (49 U.S.C. 40101 note).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection> 
<subsection id="H34EA9BA8445841E4BB13E5E779D5FFD4"><enum>(c)</enum><header>Rule of construction</header><text>A determination by the Special Master before the date of enactment of the <short-title>United States Victims of State Sponsored Terrorism Fund Clarification Act</short-title> that an award or award determination under section 405 of the Air Transportation Safety and Stabilization Act (49 U.S.C. 40101 note) was controlling for purposes of the Fund (pursuant to subsection (d)(3)(A)(ii)(III) of the Justice for United States Victims of State Sponsored Terrorism Act (34 U.S.C. 20144(d)(3)(A)(ii)(III)), as such section was in effect on the day before the date of enactment of this Act) shall not prejudice a claim of a 9/11 victim, 9/11 spouse, or 9/11 dependent. </text></subsection> 
<subsection id="HFB98448671CC41119BE610064BD5D05D"><enum>(d)</enum><header>Applicability</header><text>This section and the amendments made by this section shall take effect on the date of enactment of this Act. </text></subsection></section> 
<section id="HC207E3E801FC48A9983F425AE6F87FB2"><enum>1702.</enum><header>Repeal of rescission</header>

<subsection id="H09BF5EFB9D284DCA94C5F7FAA9606F01"><enum>(d)</enum><header>PAYGO Annual Report</header><text display-inline="yes-display-inline">For the purposes of the annual report issued pursuant to section 5 of the Statutory Pay-As-You-Go Act of 2010 (2 U.S.C. 934) after adjournment of the first session of the 116th Congress, and for determining whether a sequestration order is necessary under such section, the debit for the budget year on the 5-year scorecard, if any, and the 10-year scorecard, if any, shall be deducted from such scorecard in 2020 and added to such scorecard in 2021.</text></subsection></section></title> </division>
