<section id="HD56EB840B2114142943C5845C5D67878" section-type="subsequent-section"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Dream Act of 2019</short-title></quote>.</text></section> 
<subtitle id="HFF72C18C7CCB4075AE8195D5560454F8"><enum>A</enum><header>Treatment of certain long-term residents who entered the United States as children</header> 
<section id="H49AD27E3E5F24997B565DCADCB3F8F19"><enum>111.</enum><header>Permanent resident status on a conditional basis for certain long-term residents who entered the United States as children</header> 
<subsection id="H4AF85026863E4BBD98FD859B702A3419"><enum>(a)</enum><header>Conditional basis for status</header><text>Notwithstanding any other provision of law, and except as provided in section 113(c)(2), an alien shall be considered, at the time of obtaining the status of an alien lawfully admitted for permanent residence under this section, to have obtained such status on a conditional basis subject to the provisions of this title.</text></subsection> 
<subsection id="H6AC6ED30EB8E49F0AD28F84810C28A37"><enum>(b)</enum><header>Requirements</header> 
<paragraph id="HC2520C94B2984E3ABCEAC621969E99AF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary or the Attorney General shall cancel the removal of, and adjust to the status of an alien lawfully admitted for permanent residence on a conditional basis, or without the conditional basis as provided in section 113(c)(2), an alien who is inadmissible or deportable from the United States (or is under a grant of Deferred Enforced Departure or has temporary protected status under section 244 of the Immigration and Nationality Act (8 U.S.C. 1254a)) if—</text> 
<subparagraph id="H8C790115A2BF4181831C9EAB9348E0BA"><enum>(A)</enum><text display-inline="yes-display-inline">the alien has been continuously physically present in the United States since the date that is 4 years before the date of the enactment of this Act;</text></subparagraph> 
<subparagraph id="H0858E56831234570928725691F3F32ED" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the alien was younger than 18 years of age on the date on which the alien entered the United States and has continuously resided in the United States since such entry;</text></subparagraph> 
<subparagraph id="H09A0667252BE4F0F8173CD8B06EE2FDC"><enum>(C)</enum><text>the alien—</text> 
<clause id="H347D1EC839234F579D104113E0074E64"><enum>(i)</enum><text display-inline="yes-display-inline">subject to section 123(d), is not inadmissible under paragraph (1), (6)(E), (6)(G), (8), or (10) of section 212(a) of the Immigration and Nationality Act (8 U.S.C. 1182(a));</text></clause> 
<clause id="HBF1DA621167D4ED98B4CF5579C10F4FD"><enum>(ii)</enum><text display-inline="yes-display-inline">has not ordered, incited, assisted, or otherwise participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion; and</text></clause> 
<clause id="H5C122EBC4BDE4B309DB013A875F033D4" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">is not barred from adjustment of status under this title based on the criminal and national security grounds described under subsection (c), subject to the provisions of such subsection; and</text></clause></subparagraph> 
<subparagraph id="H16D4C9D1C76845EBAF57747B6985A5E7"><enum>(D)</enum><text>the alien—</text> 
<clause id="H2CD19B440E5649C897CC54F20D3F4319"><enum>(i)</enum><text>has been admitted to an institution of higher education;</text></clause> 
<clause id="H6AE0AA6FC09C4AACB06CA4297A8452BF"><enum>(ii)</enum><text display-inline="yes-display-inline">has been admitted to an area career and technical education school at the postsecondary level;</text></clause> 
<clause id="H9769356A60B14E38A98508A82FFDC224" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">in the United States, has obtained—</text> 
<subclause id="HDDA7CA2610CE4143A88C646E4498BA59" commented="no"><enum>(I)</enum><text>a high school diploma or a commensurate alternative award from a public or private high school;</text></subclause> 
<subclause id="H6347BE80BDA04B8E913CBDC994EE7F49" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">a General Education Development credential, a high school equivalency diploma recognized under State law, or another similar State-authorized credential; </text></subclause> 
<subclause id="H9E34B94951FA4CF795B3718A3DD46095" commented="no"><enum>(III)</enum><text display-inline="yes-display-inline">a credential or certificate from an area career and technical education school at the secondary level; or</text></subclause> 
<subclause id="H77FDA593D9EE492487B045BF168F7464"><enum>(IV)</enum><text display-inline="yes-display-inline">a recognized postsecondary credential; or</text></subclause></clause> 
<clause id="H659A6CB913FB4114A1FAE7FEEA4779F5"><enum>(iv)</enum><text>is enrolled in secondary school or in an education program assisting students in—</text> 
<subclause id="H877CE740313D4D4CA070B90C78AB9998"><enum>(I)</enum><text>obtaining a high school diploma or its recognized equivalent under State law;</text></subclause> 
<subclause id="H3686109E443C48D7BA6224502854EA4C"><enum>(II)</enum><text>passing the General Education Development test, a high school equivalence diploma examination, or other similar State-authorized exam; </text></subclause> 
<subclause id="HD901D828BC5F4B1F96644791F14FCB7B"><enum>(III)</enum><text display-inline="yes-display-inline">obtaining a certificate or credential from an area career and technical education school providing education at the secondary level; or</text></subclause> 
<subclause id="H4F98CD7AC6F04A609D4F7A90623480B7"><enum>(IV)</enum><text display-inline="yes-display-inline">obtaining a recognized postsecondary credential.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HD02F43197EAC47D0BAA3549FEF148BB9" commented="no"><enum>(2)</enum><header>Application fee</header> 
<subparagraph id="H55274A88AAA241ACBF8C720AB83AA6CF"><enum>(A)</enum><header>In general</header><text>The Secretary may, subject to an exemption under section 123(c), require an alien applying under this section to pay a reasonable fee that is commensurate with the cost of processing the application but does not exceed $495.00.</text></subparagraph> 
<subparagraph id="HF228FAFF9FCE45B9AD926E76114AD1B9"><enum>(B)</enum><header>Special procedure for applicants with DACA</header><text display-inline="yes-display-inline">The Secretary shall establish a streamlined procedure for aliens who have been granted DACA and who meet the requirements for renewal (under the terms of the program in effect on January 1, 2017) to apply for cancellation of removal and adjustment of status to that of an alien lawfully admitted for permanent residence on a conditional basis under this section, or without the conditional basis as provided in section 113(c)(2). Such procedure shall not include a requirement that the applicant pay a fee, except that the Secretary may require an applicant who meets the requirements for lawful permanent residence without the conditional basis under section 113(c)(2) to pay a fee that is commensurate with the cost of processing the application, subject to the exemption under section 123(c).</text></subparagraph></paragraph> 
<paragraph id="H5E4683A1CF3444AAB9F6D35B5E9B9A84"><enum>(3)</enum><header>Background checks</header><text display-inline="yes-display-inline">The Secretary may not grant an alien permanent resident status on a conditional basis under this section until the requirements of section 122 are satisfied.</text></paragraph> 
<paragraph id="HF8AE22A7C7CA41BD8642C8FEBA3E7048"><enum>(4)</enum><header>Military selective service</header><text display-inline="yes-display-inline">An alien applying for permanent resident status on a conditional basis under this section, or without the conditional basis as provided in section 113(c)(2), shall establish that the alien has registered under the Military Selective Service Act (50 U.S.C. 3801 et seq.), if the alien is subject to registration under such Act.</text></paragraph></subsection> 
<subsection id="H880EFFE7B3464992A1309CC61BF602F8"><enum>(c)</enum><header>Criminal and national security bars</header> 
<paragraph id="HDCBC0E7C2EE449F88DC8070245CE5793"><enum>(1)</enum><header>Grounds of ineligibility</header><text>Except as provided in paragraph (2), an alien is ineligible for adjustment of status under this title (whether on a conditional basis or without the conditional basis as provided in section 113(c)(2)) if any of the following apply:</text> 
<subparagraph id="H49AA64C120164888A030DC8466B16BC5"><enum>(A)</enum><text>The alien is inadmissible under paragraph (2) or (3) of section 212(a) of the Immigration and Nationality Act (8 U.S.C. 1182(a)).</text></subparagraph> 
<subparagraph id="H62E504614CA148289B6720B227623412"><enum>(B)</enum><text>Excluding any offense under State law for which an essential element is the alien’s immigration status, and any minor traffic offense, the alien has been convicted of—</text> 
<clause id="H70A09216F80B4DACBA572B5C68590EC9"><enum>(i)</enum><text>any felony offense;</text></clause> 
<clause id="HEBAAE349C50C430599AC7B0D6A0F041A" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">3 or more misdemeanor offenses (excluding simple possession of cannabis or cannabis-related paraphernalia, any offense involving cannabis or cannabis-related paraphernalia which is no longer prosecutable in the State in which the conviction was entered, and any offense involving civil disobedience without violence) not occurring on the same date, and not arising out of the same act, omission, or scheme of misconduct; or</text></clause> 
<clause id="HDC7AC46926184080BCE2D2C180CB2B6B"><enum>(iii)</enum><text>a misdemeanor offense of domestic violence, unless the alien demonstrates that such crime is related to the alien having been—</text> 
<subclause id="H5D97D6FDF4854DC7AC58ACFB0DFB933F"><enum>(I)</enum><text>a victim of domestic violence, sexual assault, stalking, child abuse or neglect, abuse or neglect in later life, or human trafficking;</text></subclause> 
<subclause id="H38621689FD214723A1D771B796FFD6B2"><enum>(II)</enum><text>battered or subjected to extreme cruelty; or</text></subclause> 
<subclause id="H32AA7126E9764C9C960169D13913597D"><enum>(III)</enum><text>a victim of criminal activity described in section 101(a)(15)(U)(iii) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(15)(U)(iii)).</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HCFC8D693ED53465EA013CCF49BA121A5"><enum>(2)</enum><header>Waivers for certain misdemeanors</header><text>For humanitarian purposes, family unity, or if otherwise in the public interest, the Secretary may—</text> 
<subparagraph id="H08703E79539B47609DA8B2624DA41541"><enum>(A)</enum><text>waive the grounds of inadmissibility under subparagraphs (A), (C), and (D) of section 212(a)(2) of the Immigration and Nationality Act (8 U.S.C. 1182(a)(2)), unless the conviction forming the basis for inadmissibility would otherwise render the alien ineligible under paragraph (1)(B) (subject to subparagraph (B)); and</text></subparagraph> 
<subparagraph id="H8061C8A4D35142CF8F82850B8497A8DD"><enum>(B)</enum><text display-inline="yes-display-inline">for purposes of clauses (ii) and (iii) of paragraph (1)(B), waive consideration of—</text> 
<clause id="H5DA3995B42C84FEFBBA16299434AB099"><enum>(i)</enum><text>one misdemeanor offense if the alien has not been convicted of any offense in the 5-year period preceding the date on which the alien applies for adjustment of status under this title; or</text></clause> 
<clause id="H11F6B03D6E0747D6ADCFC40B8E263B77"><enum>(ii)</enum><text>up to two misdemeanor offenses if the alien has not been convicted of any offense in the 10-year period preceding the date on which the alien applies for adjustment of status under this title.</text></clause></subparagraph></paragraph> 
<paragraph id="H2D394BC18C1F4902B87EA68651551BD5"><enum>(3)</enum><header>Authority to conduct secondary review</header> 
<subparagraph id="HA385369350824430833504D3F85072FA"><enum>(A)</enum><header>In general</header><text>Notwithstanding an alien’s eligibility for adjustment of status under this title, and subject to the procedures described in this paragraph, the Secretary of Homeland Security may, as a matter of non-delegable discretion, provisionally deny an application for adjustment of status (whether on a conditional basis or without the conditional basis as provided in section 113(c)(2)) if the Secretary, based on clear and convincing evidence, which shall include credible law enforcement information, determines that the alien is described in subparagraph (B) or (D).</text></subparagraph> 
<subparagraph id="HECA78070E2B24DD7B421208A37D0CDBD"><enum>(B)</enum><header>Public safety</header><text>An alien is described in this subparagraph if—</text> 
<clause id="HD593F1E6CC30418A91F6B7CD5DA15663" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">excluding simple possession of cannabis or cannabis-related paraphernalia, any offense involving cannabis or cannabis-related paraphernalia which is no longer prosecutable in the State in which the conviction was entered, any offense under State law for which an essential element is the alien’s immigration status, any offense involving civil disobedience without violence, and any minor traffic offense, the alien—</text> 
<subclause id="H7DF637D776B34656B4E49B3C6AB5EFC1" commented="no"><enum>(I)</enum><text>has been convicted of a misdemeanor offense punishable by a term of imprisonment of more than 30 days; or</text></subclause> 
<subclause id="H7532B801429C48418CCEF127EEBA8B14" commented="no"><enum>(II)</enum><text>has been adjudicated delinquent in a State or local juvenile court proceeding that resulted in a disposition ordering placement in a secure facility; and</text></subclause></clause> 
<clause id="H206605EE8BAE455480404C14FD16B8D0"><enum>(ii)</enum><text>the alien poses a significant and continuing threat to public safety related to such conviction or adjudication.</text></clause></subparagraph> 
<subparagraph id="H3B4A1B9617C24AF1AE7D180A04D280F7"><enum>(C)</enum><header>Public safety determination</header><text display-inline="yes-display-inline">For purposes of subparagraph (B)(ii), the Secretary shall consider the recency of the conviction or adjudication; the length of any imposed sentence or placement; the nature and seriousness of the conviction or adjudication, including whether the elements of the offense include the unlawful possession or use of a deadly weapon to commit an offense or other conduct intended to cause serious bodily injury; and any mitigating factors pertaining to the alien’s role in the commission of the offense.</text></subparagraph> 
<subparagraph id="H26FF49B8DEE54B5B977B2DEAA4F72715"><enum>(D)</enum><header>Gang participation</header><text>An alien is described in this subparagraph if the alien has, within the 5 years immediately preceding the date of the application, knowingly, willfully, and voluntarily participated in offenses committed by a criminal street gang (as described in subsections (a) and (c) of section 521 of title 18, United States Code) with the intent to promote or further the commission of such offenses.</text></subparagraph> 
<subparagraph id="H88F89B32F80748EAAA36CE5F946F577B"><enum>(E)</enum><header>Evidentiary limitation</header><text>For purposes of subparagraph (D), allegations of gang membership obtained from a State or Federal in-house or local database, or a network of databases used for the purpose of recording and sharing activities of alleged gang members across law enforcement agencies, shall not establish the participation described in such paragraph.</text></subparagraph> 
<subparagraph id="H57CEC8CD010849EDA5614DEB9FFDCE5A"><enum>(F)</enum><header>Notice</header> 
<clause id="H66EA25B5B74445C18630CD19B8413687"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Prior to rendering a discretionary decision under this paragraph, the Secretary of Homeland Security shall provide written notice of the intent to provisionally deny the application to the alien (or the alien’s counsel of record, if any) by certified mail and, if an electronic mail address is provided, by electronic mail (or other form of electronic communication). Such notice shall—</text> 
<subclause id="H18507E0600AE420D8B6B63E6BCFF19A8"><enum>(I)</enum><text>articulate with specificity all grounds for the preliminary determination, including the evidence relied upon to support the determination; and</text></subclause> 
<subclause id="HFF250B40C5E142BCAB1A4970BAAF910F"><enum>(II)</enum><text>provide the alien with not less than 90 days to respond.</text></subclause></clause> 
<clause id="HD85A4466D030405D8EC4D98990CCF986"><enum>(ii)</enum><header>Second notice</header><text display-inline="yes-display-inline">Not more than 30 days after the issuance of the notice under clause (i), the Secretary of Homeland Security shall provide a second written notice that meets the requirements of such clause.</text></clause> 
<clause id="HDD3F064308E34E5AAD95FF973FDFA5FF"><enum>(iii)</enum><header>Notice not received</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, if an applicant provides good cause for not contesting a provisional denial under this paragraph, including a failure to receive notice as required under this subparagraph, the Secretary of Homeland Security shall, upon a motion filed by the alien, reopen an application for adjustment of status under this title and allow the applicant an opportunity to respond, consistent with clause (i)(II).</text></clause></subparagraph> 
<subparagraph id="HF07F91D36C0C4736A6B00DC2801570E1"><enum>(G)</enum><header>Judicial review</header><text>An alien is entitled to judicial review of the Secretary’s decision to provisionally deny an application under this paragraph in accordance with the procedures described in section 126(c).</text></subparagraph></paragraph> 
<paragraph id="H2975D6BF3C4A4FAE9EF391C452C9EED1"><enum>(4)</enum><header>Definitions</header><text>For purposes of this subsection—</text> 
<subparagraph id="HAD3214ED98024C28B1F2F6CFE37FC0D9"><enum>(A)</enum><text>the term <quote>felony offense</quote> means an offense under Federal or State law that is punishable by a maximum term of imprisonment of more than 1 year;</text></subparagraph> 
<subparagraph id="H39FAAD2F865247ABA8AB8819FA04C806"><enum>(B)</enum><text>the term <quote>misdemeanor offense</quote> means an offense under Federal or State law that is punishable by a term of imprisonment of more than 5 days but not more than 1 year;</text></subparagraph> 
<subparagraph id="HD3EC65AEEEA94A06B2E68B4A2F38E45F"><enum>(C)</enum><text>the term <quote>crime of domestic violence</quote> means any offense that has as an element the use, attempted use, or threatened use of physical force against a person committed by a current or former spouse of the person, by an individual with whom the person shares a child in common, by an individual who is cohabiting with or has cohabited with the person as a spouse, by an individual similarly situated to a spouse of the person under the domestic or family violence laws of the jurisdiction where the offense occurs, or by any other individual against a person who is protected from that individual’s acts under the domestic or family violence laws of the United States or any State, Indian tribal government, or unit of local government; and</text></subparagraph> 
<subparagraph id="HE2A3F5A1BF6240E6BD58A766E16C8891"><enum>(D)</enum><text>the term <quote>convicted</quote> or <quote>conviction</quote> does not include a judgment that has been expunged or set aside, that resulted in a rehabilitative disposition, or the equivalent.</text></subparagraph></paragraph></subsection> 
<subsection id="H68D61F85BE6E4B63B2CE6CE58FFFFD7C" commented="no"><enum>(d)</enum><header>Limitation on removal of certain alien minors</header><text display-inline="yes-display-inline">An alien who is under 18 years of age and meets the requirements under subparagraphs (A), (B), and (C) of subsection (b)(1) shall be provided a reasonable opportunity to meet the educational requirements under subparagraph (D) of such subsection. The Attorney General or the Secretary may not commence or continue with removal proceedings against such an alien.</text></subsection> 
<subsection id="H0329D69586DE4FE79BF6E443EE3F4AD2"><enum>(e)</enum><header>Withdrawal of application</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall, upon receipt of a request to withdraw an application for adjustment of status under this section, cease processing of the application, and close the case. Withdrawal of the application under this subsection shall not prejudice any future application filed by the applicant for any immigration benefit under this title or under the Immigration and Nationality Act (8 U.S.C. 1101 et seq.). </text></subsection></section> 
<section id="HEDA9ACBCDBA14CEC92EC00C840AD09E6" display-inline="no-display-inline" section-type="subsequent-section"><enum>112.</enum><header>Terms of permanent resident status on a conditional basis</header> 
<subsection id="H2750AB7C014E442483B5EDEACEF7B8E8"><enum>(a)</enum><header>Period of status</header><text>Permanent resident status on a conditional basis is—</text> 
<paragraph id="H8B05759E268E416B9167F6350253A697"><enum>(1)</enum><text>valid for a period of 10 years, unless such period is extended by the Secretary; and</text></paragraph> 
<paragraph id="HCC0895211D6B4DC8846ED6F6EEF338A0"><enum>(2)</enum><text>subject to revocation under subsection (c).</text></paragraph></subsection> 
<subsection id="HA6D73C15A97D451BB1AC66D9C688C7D4"><enum>(b)</enum><header>Notice of requirements</header><text>At the time an alien obtains permanent resident status on a conditional basis, the Secretary shall provide notice to the alien regarding the provisions of this title and the requirements to have the conditional basis of such status removed.</text></subsection> 
<subsection id="H125EACEC6DAE44CDB51835F5208472FA"><enum>(c)</enum><header>Revocation of status</header><text>The Secretary may revoke the permanent resident status on a conditional basis of an alien only if the Secretary—</text> 
<paragraph commented="no" id="H57F30DE22F2E459496B9CD3D91B4C6C7"><enum>(1)</enum><text>determines that the alien ceases to meet the requirements under section 111(b)(1)(C); and</text></paragraph> 
<paragraph commented="no" id="H253C466BF482474FB909075CEDD10C77"><enum>(2)</enum><text>prior to the revocation, provides the alien—</text> 
<subparagraph commented="no" id="H8DB2AAFBCE81419BB482055CCBCAD0F2"><enum>(A)</enum><text>notice of the proposed revocation; and</text></subparagraph> 
<subparagraph commented="no" id="H7F823A1C8EB045539BDE8C9A17FD41BF"><enum>(B)</enum><text>the opportunity for a hearing to provide evidence that the alien meets such requirements or otherwise to contest the proposed revocation.</text></subparagraph></paragraph></subsection> 
<subsection id="HFC481A5CFB1D40D4971526D70DCBBA67"><enum>(d)</enum><header>Return to previous immigration status</header><text>An alien whose permanent resident status on a conditional basis expires under subsection (a)(1) or is revoked under subsection (c), shall return to the immigration status that the alien had immediately before receiving permanent resident status on a conditional basis.</text></subsection></section> 
<section id="H0C78D7B85D93412792801FF720697A2A" display-inline="no-display-inline" section-type="subsequent-section"><enum>113.</enum><header>Removal of conditional basis of permanent resident status</header> 
<subsection id="H107EC4A75944434D975760DF3D1E5488"><enum>(a)</enum><header>Eligibility for removal of conditional basis</header> 
<paragraph id="H1F94416F96A74B1EAB852003BA545B7A"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Secretary shall remove the conditional basis of an alien’s permanent resident status granted under this title and grant the alien status as an alien lawfully admitted for permanent residence if the alien—</text> 
<subparagraph id="H3BB729A2BCEC463FB80B6BD51E86AC61"><enum>(A)</enum><text>is described in section 111(b)(1)(C);</text></subparagraph> 
<subparagraph id="HE325562B839E48FBBB0D5967292FDC3C"><enum>(B)</enum><text display-inline="yes-display-inline">has not abandoned the alien’s residence in the United States during the period in which the alien has permanent resident status on a conditional basis; and</text></subparagraph> 
<subparagraph id="H50478ECA3C80426490ED388934B41A09"><enum>(C)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H17D11EE856BC4179ADE7648C5C237D4C"><enum>(i)</enum><text display-inline="yes-display-inline">has obtained a degree from an institution of higher education, or has completed at least 2 years, in good standing, of a program in the United States leading to a bachelor’s degree or higher degree or a recognized postsecondary credential from an area career and technical education school providing education at the postsecondary level;</text></clause> 
<clause id="H8E7283E394F445BC9766D9851ACA810E" indent="up1"><enum>(ii)</enum><text>has served in the Uniformed Services for at least 2 years and, if discharged, received an honorable discharge; or</text></clause> 
<clause commented="no" id="H0D40DB83EBF849F4A36C3CDE892FA1D4" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">demonstrates earned income for periods totaling at least 3 years and at least 75 percent of the time that the alien has had a valid employment authorization, except that, in the case of an alien who was enrolled in an institution of higher education, an area career and technical education school to obtain a recognized postsecondary credential, or an education program described in section 111(b)(1)(D)(iii), the Secretary shall reduce such total 3-year requirement by the total of such periods of enrollment.</text></clause></subparagraph></paragraph> 
<paragraph id="H19BD2B8AD2DD48DE94A85B4D1950E85D"><enum>(2)</enum><header>Hardship exception</header><text>The Secretary shall remove the conditional basis of an alien’s permanent resident status and grant the alien status as an alien lawfully admitted for permanent residence if the alien—</text> 
<subparagraph id="H30A01795D10D4CC0BFCDF26FF50243B0"><enum>(A)</enum><text>satisfies the requirements under subparagraphs (A) and (B) of paragraph (1);</text></subparagraph> 
<subparagraph id="H735C184FAE094520848B040AF8F766B4"><enum>(B)</enum><text>demonstrates compelling circumstances for the inability to satisfy the requirements under subparagraph (C) of such paragraph; and</text></subparagraph> 
<subparagraph id="H9DC2C0D2FC084C9A94E1EF24A45D9025"><enum>(C)</enum><text>demonstrates that—</text> 
<clause id="HC49656665F3241F3BC5C893CB665FFD3"><enum>(i)</enum><text>the alien has a disability;</text></clause> 
<clause id="HFE85CB6F852541B6A2F0297AD08ACD8B"><enum>(ii)</enum><text>the alien is a full-time caregiver; or</text></clause> 
<clause id="HF35E8EED189048E8B70565566D2A6785"><enum>(iii)</enum><text>the removal of the alien from the United States would result in hardship to the alien or the alien’s spouse, parent, or child who is a national of the United States or is lawfully admitted for permanent residence.</text></clause></subparagraph></paragraph> 
<paragraph id="H9DAD0FE8A87145D98FB83EF1A5341FED"><enum>(3)</enum><header>Citizenship requirement</header> 
<subparagraph id="HE1B23C2081534610B2ADF5533FD6A4E3"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the conditional basis of an alien’s permanent resident status granted under this title may not be removed unless the alien demonstrates that the alien satisfies the requirements under section 312(a) of the Immigration and Nationality Act (8 U.S.C. 1423(a)).</text></subparagraph> 
<subparagraph id="H15E1D91CC30B4AFCB88368A009630EC8"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) shall not apply to an alien who is unable to meet the requirements under such section 312(a) due to disability.</text></subparagraph></paragraph> 
<paragraph id="H1A67EDA08EA147D48C5D91C351DFCA8C" commented="no"><enum>(4)</enum><header>Application fee</header><text display-inline="yes-display-inline">The Secretary may, subject to an exemption under section 123(c), require aliens applying for removal of the conditional basis of an alien’s permanent resident status under this section to pay a reasonable fee that is commensurate with the cost of processing the application.</text></paragraph> 
<paragraph id="HC452A2115C2D4F64B0F89E8ADE079671"><enum>(5)</enum><header>Background check</header><text>The Secretary may not remove the conditional basis of an alien’s permanent resident status until the requirements of section 122 are satisfied.</text></paragraph></subsection> 
<subsection id="HFEB4932C925C4675B9CD9F3A437BFC91"><enum>(b)</enum><header>Treatment for purposes of naturalization</header> 
<paragraph id="H33A68AB480BF48F8B60CD41B180D7371"><enum>(1)</enum><header>In general</header><text>For purposes of title III of the Immigration and Nationality Act (8 U.S.C. 1401 et seq.), an alien granted permanent resident status on a conditional basis shall be considered to have been admitted to the United States, and be present in the United States, as an alien lawfully admitted for permanent residence.</text></paragraph> 
<paragraph id="HA9924C9670964719B168F808C0BDE713"><enum>(2)</enum><header>Limitation on application for naturalization</header><text>An alien may not apply for naturalization while the alien is in permanent resident status on a conditional basis.</text></paragraph></subsection> 
<subsection id="H4A59CBDAA45B4177BEA29C8D91FA40DB"><enum>(c)</enum><header>Timing of approval of lawful permanent resident status</header> 
<paragraph id="H6EAF3A9AF23E4C2693BDC23AB87A6E22"><enum>(1)</enum><header>In general</header><text>An alien granted permanent resident status on a conditional basis under this title may apply to have such conditional basis removed at any time after such alien has met the eligibility requirements set forth in subsection (a).</text></paragraph> 
<paragraph id="H0989CDF6DACF4366A87615AE60E1D7F0"><enum>(2)</enum><header>Approval with regard to initial applications</header> 
<subparagraph id="HD9ED026B8EB9414A8C493B508D5C2850"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, the Secretary or the Attorney General shall cancel the removal of, and adjust to the status of an alien lawfully admitted for permanent resident status without conditional basis, any alien who—</text> 
<clause id="HA38DB7ABA4D34F7FAC46D56A65EB1346"><enum>(i)</enum><text>demonstrates eligibility for lawful permanent residence status on a conditional basis under section 111(b); and</text></clause> 
<clause id="H71F3193592DB4088BE4DE4418B32FAB8"><enum>(ii)</enum><text>subject to the exceptions described in subsections (a)(2) and (a)(3)(B) of this section, already has fulfilled the requirements of paragraphs (1) and (3) of subsection (a) of this section at the time such alien first submits an application for benefits under this title.</text></clause></subparagraph> 
<subparagraph id="H58187A8AB00A4FEBA55C5F6B86ADCCFC"><enum>(B)</enum><header>Background checks</header><text display-inline="yes-display-inline">Subsection (a)(5) shall apply to an alien seeking lawful permanent resident status without conditional basis in an initial application in the same manner as it applies to an alien seeking removal of the conditional basis of an alien’s permanent resident status. Section 111(b)(3) shall not be construed to require the Secretary to conduct more than one identical security or law enforcement background check on such an alien.</text></subparagraph> 
<subparagraph id="H2D2430AA56EE46A4AAF96EF04E668FBA"><enum>(C)</enum><header>Application fees</header><text display-inline="yes-display-inline">In the case of an alien seeking lawful permanent resident status without conditional basis in an initial application, the alien shall pay the fee required under subsection (a)(4), subject to the exemption allowed under section 123(c), but shall not be required to pay the application fee under section 111(b)(2).</text></subparagraph></paragraph></subsection></section></subtitle> 
<subtitle id="H5BCFEA8B705B4BED8EED6C6C86D04C5A"><enum>B</enum><header>General Provisions</header> 
<section id="H3227F8EFE8324302A6393284C1AF27B7"><enum>121.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="H6D6861F8188D4E188DD368B7D2C3461B"><enum>(1)</enum><header>In general</header><text>Except as otherwise specifically provided, any term used in this title that is used in the immigration laws shall have the meaning given such term in the immigration laws.</text></paragraph> 
<paragraph id="H15D0E20FD6754B1B9844BC4435F73F83"><enum>(2)</enum><header>Appropriate United States district court</header><text display-inline="yes-display-inline">The term <quote>appropriate United States district court</quote> mean the United States District Court for the District of Columbia or the United States district court with jurisdiction over the alien’s principal place of residence.</text></paragraph> 
<paragraph id="HDFAC66FEDF3F4844A959CDF03B9DAAA6"><enum>(3)</enum><header>Area career and technical education school</header><text display-inline="yes-display-inline">The term <term>area career and technical education school</term> has the meaning given such term in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (20 U.S.C. 2302).</text></paragraph> 
<paragraph id="HC597B46DDD3A4815B6BF8C084F82DF29"><enum>(4)</enum><header>DACA</header><text>The term <term>DACA</term> means deferred action granted to an alien pursuant to the Deferred Action for Childhood Arrivals policy announced by the Secretary of Homeland Security on June 15, 2012.</text></paragraph> 
<paragraph id="HC39A0C4DC4344BA2A377814835A60B62"><enum>(5)</enum><header>Disability</header><text>The term <term>disability</term> has the meaning given such term in section 3(1) of the Americans with Disabilities Act of 1990 (42 U.S.C. 12102(1)).</text></paragraph> 
<paragraph id="H773954F1F2684671879170291A0606F1"><enum>(6)</enum><header>Federal poverty line</header><text display-inline="yes-display-inline">The term <term>Federal poverty line</term> has the meaning given such term in section 213A(h) of the Immigration and Nationality Act (8 U.S.C. 1183a).</text></paragraph> 
<paragraph id="HECB79E22BE37494C9ADBEF8E8A824EFB"><enum>(7)</enum><header>High school; secondary school</header><text>The terms <term>high school</term> and <term>secondary school</term> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801).</text></paragraph> 
<paragraph id="H641A47DD801F4F57A87F8FA95F8856AB"><enum>(8)</enum><header>Immigration laws</header><text>The term <term>immigration laws</term> has the meaning given such term in section 101(a)(17) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(17)).</text></paragraph> 
<paragraph id="H5D34E5D5236740F0B4903CA6B271E774"><enum>(9)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term>—</text> 
<subparagraph id="H4C7A30E5C8394CF097AB05AAEB816AAD"><enum>(A)</enum><text>except as provided in subparagraph (B), has the meaning given such term in section 102 of the Higher Education Act of 1965 (20 U.S.C. 1002); and</text></subparagraph> 
<subparagraph id="HE90A063B074143A98FD297AA0C389A11"><enum>(B)</enum><text>does not include an institution of higher education outside of the United States.</text></subparagraph></paragraph> 
<paragraph id="HA3CBCCCA2F594A248D2F675359491114" commented="no"><enum>(10)</enum><header>Recognized postsecondary credential</header><text display-inline="yes-display-inline">The term <term>recognized postsecondary credential</term> has the meaning given such term in section 3 of the Workforce Innovation and Opportunity Act (29 U.S.C. 3102).</text></paragraph> 
<paragraph id="HBA7D7D4F4A5242CC88B885331EF539C7"><enum>(11)</enum><header>Secretary</header><text>Except as otherwise specifically provided, the term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph> 
<paragraph id="H88B18D6BEFE64BFABC67FE241901614B"><enum>(12)</enum><header>Uniformed services</header><text>The term <term>Uniformed Services</term> has the meaning given the term <term>uniformed services</term> in section 101(a) of title 10, United States Code.</text></paragraph></section> 
<section id="H4B03CFABDCC743428BF68BC90D9C412B" display-inline="no-display-inline" section-type="subsequent-section"><enum>122.</enum><header>Submission of biometric and biographic data; background checks</header> 
<subsection id="HE3D5442435BC40FF9AB5E0229A69ED79"><enum>(a)</enum><header>Submission of biometric and biographic data</header><text display-inline="yes-display-inline">The Secretary may not grant an alien adjustment of status under this title, on either a conditional or permanent basis, unless the alien submits biometric and biographic data, in accordance with procedures established by the Secretary. The Secretary shall provide an alternative procedure for aliens who are unable to provide such biometric or biographic data because of a physical impairment.</text></subsection> 
<subsection id="H664FC0F1C0054D5EBE28214489D8DDB6"><enum>(b)</enum><header>Background checks</header><text display-inline="yes-display-inline">The Secretary shall use biometric, biographic, and other data that the Secretary determines appropriate to conduct security and law enforcement background checks and to determine whether there is any criminal, national security, or other factor that would render the alien ineligible for adjustment of status under this title, on either a conditional or permanent basis. The status of an alien may not be adjusted, on either a conditional or permanent basis, unless security and law enforcement background checks are completed to the satisfaction of the Secretary.</text></subsection></section> 
<section id="HCD6C26DAC4374222BFA2C0C00E0C1C4C" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>123.</enum><header>Limitation on removal; application and fee exemption; waiver of grounds for inadmissibility and other conditions on eligible individuals</header> 
<subsection id="H8AFE86E57760479B888098244AE46365" commented="no"><enum>(a)</enum><header>Limitation on removal</header><text display-inline="yes-display-inline">An alien who appears to be prima facie eligible for relief under this title shall be given a reasonable opportunity to apply for such relief and may not be removed until, subject to section 126(c), a final decision establishing ineligibility for relief is rendered.</text></subsection> 
<subsection id="HDDFDA8C4BA2E4A0085EB75D73718AC25" commented="no"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">An alien present in the United States who has been ordered removed or has been permitted to depart voluntarily from the United States may, notwithstanding such order or permission to depart, apply for adjustment of status under this title. Such alien shall not be required to file a separate motion to reopen, reconsider, or vacate the order of removal. If the Secretary approves the application, the Secretary shall cancel the order of removal. If the Secretary renders a final administrative decision to deny the application, the order of removal or permission to depart shall be effective and enforceable to the same extent as if the application had not been made, only after all available administrative and judicial remedies have been exhausted.</text></subsection> 
<subsection id="HD2FC3C3B8B0D404192E88756FE6FA695" commented="no"><enum>(c)</enum><header>Fee exemption</header><text display-inline="yes-display-inline">An applicant may be exempted from paying an application fee required under this title if the applicant—</text> 
<paragraph id="H3ADA5549B14F4C418B5DA706F9682EC7" commented="no"><enum>(1)</enum><text>is younger than 18 years of age;</text></paragraph> 
<paragraph id="HCC71D5A92B0F4BFFAEC2FADA22A7DF98" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">received total income, during the 12-month period immediately preceding the date on which the applicant files an application under this title, that is less than 150 percent of the Federal poverty line;</text></paragraph> 
<paragraph id="HAC4E64FB349943CEA01C78758CAD2AD5" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">is in foster care or otherwise lacks any parental or other familial support; or</text></paragraph> 
<paragraph id="H8601C56CF79A4C59827EE0A002BF013D" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">cannot care for himself or herself because of a serious, chronic disability.</text></paragraph></subsection> 
<subsection id="H200EBC97F0ED4089A0F8EBCDF1E65D75" commented="no"><enum>(d)</enum><header>Waiver of grounds of inadmissibility</header><text display-inline="yes-display-inline">With respect to any benefit under this title, and in addition to the waivers under section 111(c)(2), the Secretary may waive the grounds of inadmissibility under paragraph (1), (6)(E), (6)(G), or (10)(D) of section 212(a) of the Immigration and Nationality Act (8 U.S.C. 1182(a)) for humanitarian purposes, for family unity, or because the waiver is otherwise in the public interest.</text></subsection> 
<subsection id="H804B56CFB9D8443EB1585A8C0DB08937" commented="no"><enum>(e)</enum><header>Advance parole</header><text>During the period beginning on the date on which an alien applies for adjustment of status under this title and ending on the date on which the Secretary makes a final decision regarding such application, the alien shall be eligible to apply for advance parole. Section 101(g) of the Immigration and Nationality Act (8 U.S.C. 1101(g)) shall not apply to an alien granted advance parole under this section.</text></subsection> 
<subsection id="HB5C8A2B72B7A4E1EA29B23A0817671BC" commented="no"><enum>(f)</enum><header>Employment</header><text>An alien whose removal is stayed pursuant to this title, who may not be placed in removal proceedings pursuant to this title, or who has pending an application under this title, shall, upon application to the Secretary, be granted an employment authorization document.</text></subsection></section> 
<section id="HAE50E55C658A4AA0810E5A3E59DAAA67" display-inline="no-display-inline" section-type="subsequent-section"><enum>124.</enum><header>Determination of continuous presence and residence</header> 
<subsection id="H7A1CA1C6BB4C4A859FB067B6198C2009"><enum>(a)</enum><header>Effect of notice to appear</header><text display-inline="yes-display-inline">Any period of continuous physical presence or continuous residence in the United States of an alien who applies for permanent resident status under this title (whether on a conditional basis or without the conditional basis as provided in section 113(c)(2)) shall not terminate when the alien is served a notice to appear under section 239(a) of the Immigration and Nationality Act (8 U.S.C. 1229(a)).</text></subsection> 
<subsection id="H43CC9FCA2403476DB8ACCFC260F728BE"><enum>(b)</enum><header>Treatment of certain breaks in presence or residence</header> 
<paragraph id="HB44F926281024C84A4F0D21AD5362154"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraphs (2) and (3), an alien shall be considered to have failed to maintain—</text> 
<subparagraph id="HA3AF07AC33B847C89AEA76EAC109B72A"><enum>(A)</enum><text>continuous physical presence in the United States under this title if the alien has departed from the United States for any period exceeding 90 days or for any periods, in the aggregate, exceeding 180 days; and</text></subparagraph> 
<subparagraph id="HEA4549ABDEE04371A1B4BE8551B77214"><enum>(B)</enum><text display-inline="yes-display-inline">continuous residence in the United States under this title if the alien has departed from the United States for any period exceeding 180 days, unless the alien establishes to the satisfaction of the Secretary of Homeland Security that the alien did not in fact abandon residence in the United States during such period.</text></subparagraph></paragraph> 
<paragraph id="HFA283BECA3574A78A9F8DEFC3FE0B964"><enum>(2)</enum><header>Extensions for extenuating circumstances</header><text>The Secretary may extend the time periods described in paragraph (1) for an alien who demonstrates that the failure to timely return to the United States was due to extenuating circumstances beyond the alien’s control, including the serious illness of the alien, or death or serious illness of a parent, grandparent, sibling, or child of the alien.</text></paragraph> 
<paragraph id="HBD8855B7623048F7AF2B8B14FA0E8ADB" commented="no"><enum>(3)</enum><header>Travel authorized by the Secretary</header><text>Any period of travel outside of the United States by an alien that was authorized by the Secretary may not be counted toward any period of departure from the United States under paragraph (1).</text></paragraph></subsection> 
<subsection id="H95BF6B40139644B6A289F8C6366983DE"><enum>(c)</enum><header>Waiver of physical presence</header><text display-inline="yes-display-inline">With respect to aliens who were removed or departed the United States on or after January 20, 2017, and who were continuously physically present in the United States for at least 4 years prior to such removal or departure, the Secretary may, as a matter of discretion, waive the physical presence requirement under section 111(b)(1)(A) for humanitarian purposes, for family unity, or because a waiver is otherwise in the public interest. The Secretary, in consultation with the Secretary of State, shall establish a procedure for such aliens to apply for relief under section 111 from outside the United States if they would have been eligible for relief under such section, but for their removal or departure. </text></subsection></section> 
<section id="H9CAFDF71A7CA4665B69365ADAD5A69FC" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>125.</enum><header>Exemption from numerical limitations</header><text display-inline="no-display-inline">Nothing in this title or in any other law may be construed to apply a numerical limitation on the number of aliens who may be granted permanent resident status under this title (whether on a conditional basis, or without the conditional basis as provided in section 113(c)(2)).</text></section> 
<section id="H0F40AFA0DFA04E8FB6D38EA2615A088F" commented="no"><enum>126.</enum><header>Availability of administrative and judicial review</header> 
<subsection id="H4A9F79CE71DD404A8AF053A936EF60CF" commented="no"><enum>(a)</enum><header>Administrative review</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Secretary shall provide to aliens who have applied for adjustment of status under this title a process by which an applicant may seek administrative appellate review of a denial of an application for adjustment of status, or a revocation of such status.</text></subsection> 
<subsection id="HB501332A0A924A8CA9A3168EF0599428" commented="no"><enum>(b)</enum><header>Judicial review</header><text display-inline="yes-display-inline">Except as provided in subsection (c), and notwithstanding any other provision of law, an alien may seek judicial review of a denial of an application for adjustment of status, or a revocation of such status, under this title in an appropriate United States district court.</text></subsection> 
<subsection id="HB189939D33B84099AC93DB49EAC09B8C"><enum>(c)</enum><header>Judicial review of a provisional denial</header> 
<paragraph id="H962FED8F563D450B81C5CF4D6E6EE11C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, if, after notice and the opportunity to respond under section 111(c)(3)(E), the Secretary provisionally denies an application for adjustment of status under this title, the alien shall have 60 days from the date of the Secretary’s determination to seek review of such determination in an appropriate United States district court.</text></paragraph> 
<paragraph id="H3AFC4EA4D6324EF5960EE795887CB3E3"><enum>(2)</enum><header>Scope of review and decision</header><text>Notwithstanding any other provision of law, review under paragraph (1) shall be de novo and based solely on the administrative record, except that the applicant shall be given the opportunity to supplement the administrative record and the Secretary shall be given the opportunity to rebut the evidence and arguments raised in such submission. Upon issuing its decision, the court shall remand the matter, with appropriate instructions, to the Department of Homeland Security to render a final decision on the application.</text></paragraph> 
<paragraph id="HD2A65F50043841FF94590ED52B727CD0"><enum>(3)</enum><header>Appointed counsel</header><text>Notwithstanding any other provision of law, an applicant seeking judicial review under paragraph (1) shall be represented by counsel. Upon the request of the applicant, counsel shall be appointed for the applicant, in accordance with procedures to be established by the Attorney General within 90 days of the date of the enactment of this Act, and shall be funded in accordance with fees collected and deposited in the Immigration Counsel Account under section 132.</text></paragraph></subsection> 
<subsection id="HE47FAEE4FCAD4AF4B5499B124C291CD5" commented="no"><enum>(d)</enum><header>Stay of removal</header> 
<paragraph id="HA83ECB5673AF4102807CDA3A22B9520D"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), an alien seeking administrative or judicial review under this title may not be removed from the United States until a final decision is rendered establishing that the alien is ineligible for adjustment of status under this title.</text></paragraph> 
<paragraph id="H752AF23D2EC74545832BDF9ED27E257A"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The Secretary may remove an alien described in paragraph (1) pending judicial review if such removal is based on criminal or national security grounds described in this title. Such removal shall not affect the alien’s right to judicial review under this title. The Secretary shall promptly return a removed alien if a decision to deny an application for adjustment of status under this title, or to revoke such status, is reversed.</text></paragraph></subsection></section> 
<section id="H78C3495E149B4B6CB9AFC3EE9BF44BA6" display-inline="no-display-inline" section-type="subsequent-section" commented="no"><enum>127.</enum><header>Documentation requirements</header> 
<subsection id="H4CEA4DEC20F44710BE6B7A6B9C113D6E" commented="no"><enum>(a)</enum><header>Documents establishing identity</header><text display-inline="yes-display-inline">An alien’s application for permanent resident status under this title (whether on a conditional basis, or without the conditional basis as provided in section 113(c)(2)) may include, as evidence of identity, the following:</text> 
<paragraph id="HAAE70FC7A8874AE99C3E1949F7E8659B"><enum>(1)</enum><text display-inline="yes-display-inline">A passport or national identity document from the alien’s country of origin that includes the alien’s name and the alien’s photograph or fingerprint.</text></paragraph> 
<paragraph id="HD4E9EE3CE8264FE29255103F816B5BAF"><enum>(2)</enum><text>The alien’s birth certificate and an identity card that includes the alien’s name and photograph.</text></paragraph> 
<paragraph id="H0F42838489734CA587B2E68A9AEF39F5"><enum>(3)</enum><text display-inline="yes-display-inline">A school identification card that includes the alien’s name and photograph, and school records showing the alien’s name and that the alien is or was enrolled at the school.</text></paragraph> 
<paragraph id="H1CCB19ACC31E4B588435F505F114CEA1"><enum>(4)</enum><text>A Uniformed Services identification card issued by the Department of Defense.</text></paragraph> 
<paragraph id="HACFB68ED95244A4E95E93E5CFA58C965"><enum>(5)</enum><text>Any immigration or other document issued by the United States Government bearing the alien’s name and photograph. </text></paragraph> 
<paragraph id="HC5818E79D3F446EC881293CBDED83B2C"><enum>(6)</enum><text>A State-issued identification card bearing the alien's name and photograph.</text></paragraph> 
<paragraph id="HB04382D2286443B3B86D3A11D47ABA57"><enum>(7)</enum><text display-inline="yes-display-inline">Any other evidence determined to be credible by the Secretary.</text></paragraph></subsection> 
<subsection id="H37AC667E482B48B4BDA3E6C9E025EB17" commented="no"><enum>(b)</enum><header>Documents establishing entry, continuous physical presence, lack of abandonment of residence</header><text display-inline="yes-display-inline">To establish that an alien was younger than 18 years of age on the date on which the alien entered the United States, and has continuously resided in the United States since such entry, as required under section 111(b)(1)(B), that an alien has been continuously physically present in the United States, as required under section 111(b)(1)(A), or that an alien has not abandoned residence in the United States, as required under section 113(a)(1)(B), the alien may submit the following forms of evidence: </text> 
<paragraph id="HCE68A6CFD7A04AB687CDB38B28A0A1C0" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Passport entries, including admission stamps on the alien’s passport.</text></paragraph> 
<paragraph id="H6A0AEEBC404946C9A1CC6901697BFBCB"><enum>(2)</enum><text>Any document from the Department of Justice or the Department of Homeland Security noting the alien’s date of entry into the United States.</text></paragraph> 
<paragraph id="H3937FC4797FC47229DCE979B3203C376"><enum>(3)</enum><text>Records from any educational institution the alien has attended in the United States.</text></paragraph> 
<paragraph id="H6DBB711E39C84D79ACF787756AD3010E"><enum>(4)</enum><text display-inline="yes-display-inline">Employment records of the alien that include the employer’s name and contact information, or other records demonstrating earned income.</text></paragraph> 
<paragraph id="H9BB56E9FDCB34F0D91917DC38F6F3613" commented="no"><enum>(5)</enum><text>Records of service from the Uniformed Services.</text></paragraph> 
<paragraph id="H40B85E65E8464F318C09CBDD579A1534"><enum>(6)</enum><text display-inline="yes-display-inline">Official records from a religious entity confirming the alien’s participation in a religious ceremony.</text></paragraph> 
<paragraph id="H687B2428EDDA4588AD1671AF0A437981" commented="no"><enum>(7)</enum><text>A birth certificate for a child who was born in the United States.</text></paragraph> 
<paragraph id="H00A589264EE54921AC24F19D157A7F46"><enum>(8)</enum><text display-inline="yes-display-inline">Hospital or medical records showing medical treatment or hospitalization, the name of the medical facility or physician, and the date of the treatment or hospitalization.</text></paragraph> 
<paragraph id="H905E309DB814442D9F13D3977A3A87E1" commented="no"><enum>(9)</enum><text>Automobile license receipts or registration.</text></paragraph> 
<paragraph id="HE4AD77A88E4E404F8AEF9D66A4FF01E8" commented="no"><enum>(10)</enum><text>Deeds, mortgages, or rental agreement contracts.</text></paragraph> 
<paragraph id="H5067A2DBEDA94F6CBFCF037840450713"><enum>(11)</enum><text display-inline="yes-display-inline">Rent receipts or utility bills bearing the alien’s name or the name of an immediate family member of the alien, and the alien’s address.</text></paragraph> 
<paragraph id="H78D729BFBCC646EBB7E7AEC5C34F0558" commented="no"><enum>(12)</enum><text>Tax receipts.</text></paragraph> 
<paragraph id="H300FD9112C7C4D9FBD09F9E24A26404C" commented="no"><enum>(13)</enum><text>Insurance policies.</text></paragraph> 
<paragraph id="HF4D66379A032474BBE81B67717133254" commented="no"><enum>(14)</enum><text display-inline="yes-display-inline">Remittance records, including copies of money order receipts sent in or out of the country.</text></paragraph> 
<paragraph id="H32089AFBF05B478AA8E27E5A19D5C6D5"><enum>(15)</enum><text>Travel records.</text></paragraph> 
<paragraph id="H82CB0A46A60E487FB1AC52F476514151" commented="no"><enum>(16)</enum><text>Dated bank transactions.</text></paragraph> 
<paragraph id="HF991CC23898F4C0399D1286307C31302" commented="no"><enum>(17)</enum><text>Two or more sworn affidavits from individuals who are not related to the alien who have direct knowledge of the alien’s continuous physical presence in the United States, that contain—</text> 
<subparagraph id="HB7B813D97ED441C3855E1E9F04BD93A1" commented="no"><enum>(A)</enum><text>the name, address, and telephone number of the affiant; and</text></subparagraph> 
<subparagraph id="HEFF6C2F83414422FBDD580CDDD3FFF15" commented="no"><enum>(B)</enum><text>the nature and duration of the relationship between the affiant and the alien.</text></subparagraph></paragraph> 
<paragraph id="H48356F59E5DB44869789EA2535F1024E"><enum>(18)</enum><text display-inline="yes-display-inline">Any other evidence determined to be credible by the Secretary. </text></paragraph></subsection> 
<subsection id="HF8B907A720074493BBBB60CAFF040876" commented="no"><enum>(c)</enum><header>Documents establishing admission to an institution of higher education</header><text>To establish that an alien has been admitted to an institution of higher education, the alien may submit to the Secretary a document from the institution of higher education certifying that the alien—</text> 
<paragraph id="HB2A56984060F4EAD955CCB19173CC1B9" commented="no"><enum>(1)</enum><text>has been admitted to the institution; or</text></paragraph> 
<paragraph id="H9FC80DD2DDA243A797BBB116D54AA55B" commented="no"><enum>(2)</enum><text>is currently enrolled in the institution as a student.</text></paragraph></subsection> 
<subsection id="H3833FAD0A489450DAB4EED0589EF436A" commented="no"><enum>(d)</enum><header>Documents establishing receipt of a degree from an institution of higher education</header><text>To establish that an alien has acquired a degree from an institution of higher education in the United States, the alien may submit to the Secretary a diploma or other document from the institution stating that the alien has received such a degree.</text></subsection> 
<subsection id="HC74F20699F4841C785D51F7FFDC8EB22" commented="no"><enum>(e)</enum><header>Documents establishing receipt of a high school diploma, General Educational Development credential, or a recognized equivalent</header><text display-inline="yes-display-inline">To establish that in the United States an alien has earned a high school diploma or a commensurate alternative award from a public or private high school, has obtained the General Education Development credential, or otherwise has satisfied section 111(b)(1)(D)(iii), the alien may submit to the Secretary the following:</text> 
<paragraph id="HE41CB726D90F49DCAF05DBA36B7EF9D7" commented="no"><enum>(1)</enum><text>A high school diploma, certificate of completion, or other alternate award.</text></paragraph> 
<paragraph id="HACD1D89322F1411CBB8F38C6141E8E56" commented="no"><enum>(2)</enum><text>A high school equivalency diploma or certificate recognized under State law.</text></paragraph> 
<paragraph id="H5EB751C1ACA5492980A96CCD82FF4DA3" commented="no"><enum>(3)</enum><text>Evidence that the alien passed a State-authorized exam, including the General Education Development test, in the United States.</text></paragraph> 
<paragraph id="HD7DC5050624E413A8B411A1DE81419CB" commented="no"><enum>(4)</enum><text>Evidence that the alien successfully completed an area career and technical education program, such as a certification, certificate, or similar alternate award.</text></paragraph> 
<paragraph id="HB97DAA9694304C3A86CB1DA6392053A6" commented="no"><enum>(5)</enum><text>Evidence that the alien obtained a recognized postsecondary credential.</text></paragraph> 
<paragraph id="H3CBA5D55FD56425089033D071E0FD53F"><enum>(6)</enum><text display-inline="yes-display-inline">Any other evidence determined to be credible by the Secretary.</text></paragraph></subsection> 
<subsection id="H35BDD1BB06EF48D29646BF1CD4A623DA" commented="no"><enum>(f)</enum><header>Documents establishing enrollment in an educational program</header><text>To establish that an alien is enrolled in any school or education program described in section 111(b)(1)(D)(iv) or 113(a)(1)(C), the alien may submit school records from the United States school that the alien is currently attending that include—</text> 
<paragraph id="H085036D4FB814C53A9D571B67EE58ABF" commented="no"><enum>(1)</enum><text>the name of the school; and</text></paragraph> 
<paragraph id="H3FC998D6CC5E44B5BEBBA37CFF36EB31" commented="no"><enum>(2)</enum><text>the alien’s name, periods of attendance, and current grade or educational level.</text></paragraph></subsection> 
<subsection id="H8C5F694A72CE4FC98CD609D7DC51B82A" commented="no"><enum>(g)</enum><header>Documents establishing exemption from application fees</header><text>To establish that an alien is exempt from an application fee under section 123(c), the alien may submit to the Secretary the following relevant documents:</text> 
<paragraph id="H838CB16D011E46CAB7F73C9CC3A3906E" commented="no"><enum>(1)</enum><header>Documents to establish age</header><text>To establish that an alien meets an age requirement, the alien may provide proof of identity, as described in subsection (a), that establishes that the alien is younger than 18 years of age.</text></paragraph> 
<paragraph id="H2C70402236164F028EF7CDE47353AD8D" commented="no"><enum>(2)</enum><header>Documents to establish income</header><text>To establish the alien’s income, the alien may provide—</text> 
<subparagraph id="HF36D914E881442138C3D97DFB213A43A" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">employment records or other records of earned income, including records that have been maintained by the Social Security Administration, the Internal Revenue Service, or any other Federal, State, or local government agency;</text></subparagraph> 
<subparagraph id="HBD3DBD76EA924E9388081C69BBBBE092" commented="no"><enum>(B)</enum><text>bank records; or</text></subparagraph> 
<subparagraph id="HC1C2D5D162294D648FD34A7A4C29C1CB" commented="no"><enum>(C)</enum><text>at least 2 sworn affidavits from individuals who are not related to the alien and who have direct knowledge of the alien’s work and income that contain—</text> 
<clause id="HB7AAE5EE8EA142CE86D2D9CB5945F726" commented="no"><enum>(i)</enum><text>the name, address, and telephone number of the affiant; and</text></clause> 
<clause id="HD4C7CE99A6A94ED480EF8D87BF6B7036" commented="no"><enum>(ii)</enum><text>the nature and duration of the relationship between the affiant and the alien.</text></clause></subparagraph></paragraph> 
<paragraph id="HB69D276AB2824EBF8F2EA2FBB806922F" commented="no"><enum>(3)</enum><header>Documents to establish foster care, lack of familial support, or serious, chronic disability</header><text>To establish that the alien is in foster care, lacks parental or familial support, or has a serious, chronic disability, the alien may provide at least 2 sworn affidavits from individuals who are not related to the alien and who have direct knowledge of the circumstances that contain—</text> 
<subparagraph id="HCFD9A1F0B537461DB2F430E835A08768" commented="no"><enum>(A)</enum><text>a statement that the alien is in foster care, otherwise lacks any parental or other familiar support, or has a serious, chronic disability, as appropriate;</text></subparagraph> 
<subparagraph id="H4D9FAFCF75304AE3B4F04806093547DF" commented="no"><enum>(B)</enum><text>the name, address, and telephone number of the affiant; and</text></subparagraph> 
<subparagraph id="H99A7315DF5984E968DEE4684A6362275" commented="no"><enum>(C)</enum><text>the nature and duration of the relationship between the affiant and the alien.</text></subparagraph></paragraph></subsection> 
<subsection id="H09A4A3FB82B94F17A3A8BFDCA65A0F27" commented="no"><enum>(h)</enum><header>Documents establishing qualification for hardship exemption</header><text display-inline="yes-display-inline">To establish that an alien satisfies one of the criteria for the hardship exemption set forth in section 113(a)(2)(C), the alien may submit to the Secretary at least 2 sworn affidavits from individuals who are not related to the alien and who have direct knowledge of the circumstances that warrant the exemption, that contain—</text> 
<paragraph id="H80D60D6248384115A60DCD3A1F1451AF" commented="no"><enum>(1)</enum><text>the name, address, and telephone number of the affiant; and</text></paragraph> 
<paragraph id="H4B94377F56F545509EF4EFB97C8B8FC2" commented="no"><enum>(2)</enum><text>the nature and duration of the relationship between the affiant and the alien.</text></paragraph></subsection> 
<subsection id="H2F6A5CB2003141DF8C0FD5B186060CB8" commented="no"><enum>(i)</enum><header>Documents establishing service in the Uniformed Services</header><text>To establish that an alien has served in the Uniformed Services for at least 2 years and, if discharged, received an honorable discharge, the alien may submit to the Secretary—</text> 
<paragraph id="H94C586673C0D48A1BF34FA88716F2239" commented="no"><enum>(1)</enum><text>a Department of Defense form DD–214;</text></paragraph> 
<paragraph id="H2217F0D0CC174718BBA40061A4C64510" commented="no"><enum>(2)</enum><text>a National Guard Report of Separation and Record of Service form 22;</text></paragraph> 
<paragraph id="H86BB3D28D1C54B67B1092B0E6F22E5C3" commented="no"><enum>(3)</enum><text>personnel records for such service from the appropriate Uniformed Service; or</text></paragraph> 
<paragraph id="H5E2686969886467BAC2848B3B3D8A966" commented="no"><enum>(4)</enum><text>health records from the appropriate Uniformed Service.</text></paragraph></subsection> 
<subsection id="H094319A8772546F7AA354F9D0F037227" commented="no"><enum>(j)</enum><header>Documents establishing earned income</header> 
<paragraph id="H477E4D67677F47DEB1A7BE9274255E50" commented="no"><enum>(1)</enum><header>In general</header><text>An alien may satisfy the earned income requirement under section 113(a)(1)(C)(iii) by submitting records that—</text> 
<subparagraph id="H3B1E8348A79C4E28B33054BE35A912C1" commented="no"><enum>(A)</enum><text>establish compliance with such requirement; and</text></subparagraph> 
<subparagraph id="H68C0975817054F36BA9FADA633032AD8" commented="no"><enum>(B)</enum><text>have been maintained by the Social Security Administration, the Internal Revenue Service, or any other Federal, State, or local government agency.</text></subparagraph></paragraph> 
<paragraph id="HE95921FB9CC54865BB74598259C4DF53" commented="no"><enum>(2)</enum><header>Other documents</header><text display-inline="yes-display-inline">An alien who is unable to submit the records described in paragraph (1) may satisfy the earned income requirement by submitting at least 2 types of reliable documents that provide evidence of employment or other forms of earned income, including—</text> 
<subparagraph id="HFF7C8B931AC0487EAA52E15E11738B19" commented="no"><enum>(A)</enum><text>bank records;</text></subparagraph> 
<subparagraph id="H0BA094C5C5054F28B4A9AA4A597FEA2B" commented="no"><enum>(B)</enum><text>business records;</text></subparagraph> 
<subparagraph id="H098FDAEACCC14AD5B1E5A629C3E36141" commented="no"><enum>(C)</enum><text>employer or contractor records;</text></subparagraph> 
<subparagraph id="H6236EA3017F54799BE9F88DBA82A078D" commented="no"><enum>(D)</enum><text>records of a labor union, day labor center, or organization that assists workers in employment;</text></subparagraph> 
<subparagraph id="HFBEF0F3179CB43209688020D9413AD3C" commented="no"><enum>(E)</enum><text>sworn affidavits from individuals who are not related to the alien and who have direct knowledge of the alien’s work, that contain—</text> 
<clause id="H4D5A732A64514A2EB28CAADD46C345B6" commented="no"><enum>(i)</enum><text>the name, address, and telephone number of the affiant; and</text></clause> 
<clause id="H71851EB1A77A4A739333EDCF6872E374" commented="no"><enum>(ii)</enum><text>the nature and duration of the relationship between the affiant and the alien; </text></clause></subparagraph> 
<subparagraph id="H32AF6F6DA9164728B3B84B24CA9EB8A3" commented="no"><enum>(F)</enum><text>remittance records; or</text></subparagraph> 
<subparagraph id="H54909FE9859646FC810FC640E34C21B2"><enum>(G)</enum><text display-inline="yes-display-inline">any other evidence determined to be credible by the Secretary.</text></subparagraph></paragraph></subsection> 
<subsection id="HF6EAE1F114F24C0DA8244C623ADC6C8E" commented="no"><enum>(k)</enum><header>Authority to prohibit use of certain documents</header><text display-inline="yes-display-inline">If the Secretary determines, after publication in the Federal Register and an opportunity for public comment, that any document or class of documents does not reliably establish identity or that permanent resident status under this title (whether on a conditional basis, or without the conditional basis as provided in section 113(c)(2)) is being obtained fraudulently to an unacceptable degree, the Secretary may prohibit or restrict the use of such document or class of documents.</text></subsection></section> 
<section id="H704F7418CF834C51A9BB64C374AB1203" display-inline="no-display-inline" section-type="subsequent-section"><enum>128.</enum><header>Rule making</header> 
<subsection id="H8EC7C621AF3842F193214D8BBDBEBAD3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary shall publish in the Federal Register interim final rules implementing this title, which shall allow eligible individuals to immediately apply for relief under section 111 or 113(c)(2). Notwithstanding section 553 of title 5, United States Code, the regulation shall be effective, on an interim basis, immediately upon publication, but may be subject to change and revision after public notice and opportunity for a period of public comment. The Secretary shall finalize such rules not later than 180 days after the date of publication. </text></subsection> 
<subsection id="H0B493727363D4A0BB4E94A441BC24DED"><enum>(b)</enum><header>Paperwork Reduction Act</header><text>The requirements under chapter 35 of title 44, United States Code, (commonly known as the <quote>Paperwork Reduction Act</quote>) shall not apply to any action to implement this title.</text></subsection></section> 
<section id="HB58FC6F2ABA949CE9ABC3E1705873433" display-inline="no-display-inline" section-type="subsequent-section"><enum>129.</enum><header>Confidentiality of information</header> 
<subsection id="H4C51FDFBB1A5442EB88E2AF19DE9134A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may not disclose or use information (including information provided during administrative or judicial review) provided in applications filed under this title or in requests for DACA for the purpose of immigration enforcement.</text></subsection> 
<subsection id="H79CC64AD2E1243F3A086F941A1D7DAC5" commented="no"><enum>(b)</enum><header>Referrals prohibited</header><text display-inline="yes-display-inline">The Secretary, based solely on information provided in an application for adjustment of status under this title (including information provided during administrative or judicial review) or an application for DACA, may not refer an applicant to U.S. Immigration and Customs Enforcement, U.S. Customs and Border Protection, or any designee of either such entity.</text></subsection> 
<subsection id="H53250567583B4604A543F79617BC9A6B" commented="no"><enum>(c)</enum><header>Limited exception</header><text display-inline="yes-display-inline">Notwithstanding subsections (a) and (b), information provided in an application for adjustment of status under this title may be shared with Federal security and law enforcement agencies—</text> 
<paragraph id="H20D68ACB045344F09A575016FB592BA8" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">for assistance in the consideration of an application for adjustment of status under this title;</text></paragraph> 
<paragraph id="HA98146E420314DD29857338A1A8E8D95" commented="no"><enum>(2)</enum><text>to identify or prevent fraudulent claims;</text></paragraph> 
<paragraph id="H7517D018F03146DD8A2FDCE6C140F7B7" commented="no"><enum>(3)</enum><text>for national security purposes; or</text></paragraph> 
<paragraph id="H570B317BE8D7483BAC5223639E143FE0" commented="no"><enum>(4)</enum><text>for the investigation or prosecution of any felony offense not related to immigration status.</text></paragraph></subsection> 
<subsection id="H7410D7322E9D4A559865F467A1B29978"><enum>(d)</enum><header>Penalty</header><text>Any person who knowingly uses, publishes, or permits information to be examined in violation of this section shall be fined not more than $10,000.</text></subsection></section> 
<section id="H8B081458B6A645EB92A50D4F1E4FE7B0" display-inline="no-display-inline" section-type="subsequent-section"><enum>130.</enum><header>Grant program to assist eligible applicants</header> 
<subsection id="H1DB834A8B86E48749B96A38FD524A99F"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Homeland Security shall establish, within U.S. Citizenship and Immigration Services, a program to award grants, on a competitive basis, to eligible nonprofit organizations that will use the funding to assist eligible applicants under this title by providing them with the services described in subsection (b).</text></subsection> 
<subsection id="HB320AAA3637F42C091D82E5153D877C0"><enum>(b)</enum><header>Use of funds</header><text>Grant funds awarded under this section shall be used for the design and implementation of programs that provide—</text> 
<paragraph id="H814B8CE88DF3473799E2A000034C61BC" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">information to the public regarding the eligibility and benefits of permanent resident status under this title (whether on a conditional basis, or without the conditional basis as provided in section 113(c)(2)), particularly to individuals potentially eligible for such status;</text></paragraph> 
<paragraph id="H01500749BC874E90BFA0971F9CE30BD3" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">assistance, within the scope of authorized practice of immigration law, to individuals submitting applications for adjustment of status under this title (whether on a conditional basis, or without the conditional basis as provided in section 113(c)(2)), including—</text> 
<subparagraph id="H7736248D273642A686B1C2FF6E500819" commented="no"><enum>(A)</enum><text>screening prospective applicants to assess their eligibility for such status;</text></subparagraph> 
<subparagraph id="HC202AB13354042C4B6AF610BB58D0D75" commented="no"><enum>(B)</enum><text>completing applications and petitions, including providing assistance in obtaining the requisite documents and supporting evidence; and</text></subparagraph> 
<subparagraph id="H9E82FC7C23EB445283B81D0CE271EE88" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">providing any other assistance that the Secretary or grantee considers useful or necessary to apply for adjustment of status under this title (whether on a conditional basis, or without the conditional basis as provided in section 113(c)(2)); and</text></subparagraph></paragraph> 
<paragraph id="H3C262130117040CAB195E6B936663F7F"><enum>(3)</enum><text>assistance, within the scope of authorized practice of immigration law, and instruction, to individuals—</text> 
<subparagraph id="H72DBFC79B9B64979885B046A7BB6A777"><enum>(A)</enum><text>on the rights and responsibilities of United States citizenship;</text></subparagraph> 
<subparagraph id="H2AC111B704CB4023BBA161CF24997667"><enum>(B)</enum><text>in civics and English as a second language;</text></subparagraph> 
<subparagraph id="H520504A1FD55492388DB65FFCE3D3798"><enum>(C)</enum><text>in preparation for the General Education Development test; and</text></subparagraph> 
<subparagraph id="H29AD4CE92BB745248A74C423A5ACA8E1"><enum>(D)</enum><text>in applying for adjustment of status and United States citizenship.</text></subparagraph></paragraph></subsection> 
<subsection id="HD6AC6061DB51484599861DB1B89B532B"><enum>(c)</enum><header>Authorization of appropriations</header> 
<paragraph id="H26920BE99BE94B4FA121DD98C8642F78"><enum>(1)</enum><header>Amounts authorized</header><text>There are authorized to be appropriated such sums as may be necessary for each of the fiscal years 2020 through 2030 to carry out this section.</text></paragraph> 
<paragraph id="H5B0619AA6E2D42F3ADB824E84B7D1EEF"><enum>(2)</enum><header>Availability</header><text>Any amounts appropriated pursuant to paragraph (1) shall remain available until expended.</text></paragraph></subsection></section> 
<section id="HD2454383DA6B404D9EA46961D666454C" display-inline="no-display-inline" section-type="subsequent-section"><enum>131.</enum><header>Provisions affecting eligibility for adjustment of status</header><text display-inline="no-display-inline">An alien’s eligibility to be lawfully admitted for permanent residence under this title (whether on a conditional basis, or without the conditional basis as provided in section 113(c)(2)) shall not preclude the alien from seeking any status under any other provision of law for which the alien may otherwise be eligible.</text></section> 
<section id="HD43C0DD626514324AF082A936E61A4EA"><enum>132.</enum><header>Supplementary surcharge for appointed counsel</header> 
<subsection id="H4E092E56EDD8437289D6F44A791393C8"><enum>(a)</enum><header>In general</header><text>Except as provided in section 122 and in cases where the applicant is exempt from paying a fee under section 123(c), in any case in which a fee is charged pursuant to this title, an additional surcharge of $25 shall be imposed and collected for the purpose of providing appointed counsel to applicants seeking judicial review of the Secretary’s decision to provisionally deny an application under section 126(c)(3).</text></subsection> 
<subsection id="HF71F30BD031B4B16817C5B433FDCCF6C"><enum>(b)</enum><header>Immigration counsel account</header><text>There is established in the general fund of the Treasury a separate account which shall be known as the <quote>Immigration Counsel Account</quote>. Fees collected under subsection (a) shall be deposited into the Immigration Counsel Account and shall to remain available until expended for purposes of providing appointed counsel as required under this title.</text></subsection> 
<subsection id="HA08C365728F246D297E6B71CA0E6EE77"><enum>(c)</enum><header>Report</header><text>At the end of each 2-year period, beginning with the establishment of this account, the Secretary of Homeland Security shall submit a report to the Congress concerning the status of the account, including any balances therein, and recommend any adjustment in the prescribed fee that may be required to ensure that the receipts collected from the fee charged for the succeeding two years equal, as closely as possible, the cost of providing appointed counsel as required under this title.</text></subsection></section> 
<section id="H997EF35910584BA5B401A70D00736569"><enum>133.</enum><header>Annual report on provisional denial authority</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Secretary of Homeland Security shall submit to the Congress a report detailing the number of applicants that receive—</text> 
<paragraph id="HFD65D9B84A204981B96E5978A32D6BB2"><enum>(1)</enum><text display-inline="yes-display-inline">a provisional denial under this title;</text></paragraph> 
<paragraph id="H8FA982DB30D44E4392DB03308626A935"><enum>(2)</enum><text>a final denial under this title without seeking judicial review;</text></paragraph> 
<paragraph id="H1A4B259AECF24D82BB0403B091D56912"><enum>(3)</enum><text>a final denial under this title after seeking judicial review; and</text></paragraph> 
<paragraph id="H314970C22BEC462FB66FE453CCB4068E"><enum>(4)</enum><text>an approval under this title after seeking judicial review.</text></paragraph></section></subtitle></title> 
<title id="H3AA819B66810444DBF8846CC5BEDA5AE"><enum>II</enum><header>American Promise Act</header> 
<section id="H54CEF457B4524E0596F022EEED199BAC" section-type="subsequent-section"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>American Promise Act of 2019</short-title></quote>.</text></section> 
<subtitle id="H9508193283A04597BB464C6C557CA1F8"><enum>A</enum><header>Treatment of certain nationals of certain countries designated for temporary protected status or deferred enforced departure</header> 
<section id="HF7A8F2D79D9E4B579391134E1CDDC13E"><enum>211.</enum><header>Adjustment of status for certain nationals of certain countries designated for temporary protected status or deferred enforced departure</header> 
<subsection id="H342FB82B874F43F18B7A0DE52AA723C8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary or the Attorney General shall cancel the removal of, and adjust to the status of an alien lawfully admitted for permanent residence, an alien described in subsection (b) if the alien—</text> 
<paragraph id="HD989EEDCA3084322912A5F46E92C21F3"><enum>(1)</enum><text display-inline="yes-display-inline">applies for such adjustment, including submitting any required documents under section 227, not later than 3 years after the date of the enactment of this Act;</text></paragraph> 
<paragraph id="H46F669447514425AB51E8572AB89E3FA"><enum>(2)</enum><text display-inline="yes-display-inline">has been continuously physically present in the United States for a period of not less than 3 years before the date of the enactment of this Act; and</text></paragraph> 
<paragraph id="H7378894222FD4CA5966A594791B24B72"><enum>(3)</enum><text display-inline="yes-display-inline">is not inadmissible under paragraph (1), (2), (3), (6)(D), (6)(E), (6)(F), (6)(G), (8), or (10) of section 212(a) of the Immigration and Nationality Act (8 U.S.C. 1182(a)).</text></paragraph></subsection> 
<subsection id="H7C2EADD90A6D4AD18A315CF79AF6C3AD"><enum>(b)</enum><header>Aliens eligible for adjustment of status</header><text display-inline="yes-display-inline">An alien shall be eligible for adjustment of status under this section if the alien is an individual—</text> 
<paragraph id="H63CBAE2808C14198854CBB92CC2BA948"><enum>(1)</enum><text>who—</text> 
<subparagraph id="HB9A4B13096D24966996D4DD0FFA2A205"><enum>(A)</enum><text display-inline="yes-display-inline">is a national of a foreign state (or part thereof) (or in the case of an alien having no nationality, is a person who last habitually resided in such state) with a designation under subsection (b) of section 244 of the Immigration and Nationality Act (8 U.S.C. 1254a(b)) on January 1, 2017, who had or was otherwise eligible for temporary protected status on such date notwithstanding subsections (c)(1)(A)(iv) and (c)(3)(C) of such section; and</text></subparagraph> 
<subparagraph id="H66FABABD679648CDB2887F9B48BDD730"><enum>(B)</enum><text display-inline="yes-display-inline">has not engaged in conduct since such date that would render the alien ineligible for temporary protected status under section 244(c)(2) of the Immigration and Nationality Act (8 U.S.C. 1245a(c)(2)); or</text></subparagraph></paragraph> 
<paragraph id="HBEE7389CF13C4BF8AFD03A4E6DDBB95D"><enum>(2)</enum><text display-inline="yes-display-inline">who was eligible for Deferred Enforced Departure as of January 1, 2017, and has not engaged in conduct since that date that would render the alien ineligible for Deferred Enforced Departure.</text></paragraph></subsection> 
<subsection id="HB10F2310128F4C098CC5CD7D3A5B2BA1"><enum>(c)</enum><header>Application</header> 
<paragraph id="HD8DA2C330F574252B3ECB144AC1121C0"><enum>(1)</enum><header>Fee</header><text>The Secretary shall, subject to an exemption under section 223(c), require an alien applying for adjustment of status under this section to pay a reasonable fee that is commensurate with the cost of processing the application, but does not exceed $1,140.</text></paragraph> 
<paragraph id="H76B9B1036C854FF8A861986FE3380CFC"><enum>(2)</enum><header>Background checks</header><text display-inline="yes-display-inline">The Secretary may not grant an alien permanent resident status on a conditional basis under this section until the requirements of section 222 are satisfied.</text></paragraph> 
<paragraph id="HC37DFA1429824BE4A466B841D6793CBB"><enum>(3)</enum><header>Withdrawal of application</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall, upon receipt of a request to withdraw an application for adjustment of status under this section, cease processing of the application and close the case. Withdrawal of the application under this subsection shall not prejudice any future application filed by the applicant for any immigration benefit under this title or under the Immigration and Nationality Act (8 U.S.C. 1101 et seq). </text></paragraph></subsection></section></subtitle> 
<subtitle id="H9E09D8B7AB7F41B0ADEB12745EBB7C58"><enum>B</enum><header>General Provisions</header> 
<section id="H05518E477E9C4E709339696BEB17DD98"><enum>221.</enum><header>Definitions</header> 
<subsection id="HAF5BC4C39DC24B26BC4DEFBA64F0D3AE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In this title:</text> 
<paragraph id="HB39CF614C5794CD39BD5550DCDDD4B13"><enum>(1)</enum><header>In general</header><text>Except as otherwise specifically provided, any term used in this title that is used in the immigration laws shall have the meaning given such term in the immigration laws.</text></paragraph> 
<paragraph id="H3218B32DFFF14A1CBF142EFA01B8CC40" display-inline="no-display-inline"><enum>(2)</enum><header>Disability</header><text>The term <term>disability</term> has the meaning given such term in section 3(1) of the Americans with Disabilities Act of 1990 (42 U.S.C. 12102(1)).</text></paragraph> 
<paragraph id="HA0CA05B9147247669ADB0C9097B62F7F"><enum>(3)</enum><header>Federal poverty line</header><text display-inline="yes-display-inline">The term <term>Federal poverty line</term> has the meaning given such term in section 213A(h) of the Immigration and Nationality Act (8 U.S.C. 1183a).</text></paragraph> 
<paragraph id="HB88964E2E6F0423DB54B33B8B266EA6D"><enum>(4)</enum><header>Immigration laws</header><text>The term <term>immigration laws</term> has the meaning given such term in section 101(a)(17) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(17)).</text></paragraph> 
<paragraph id="HC160F819D9B14B47BCE8B12703D3638E"><enum>(5)</enum><header>Secretary</header><text>Except as otherwise specifically provided, the term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph> 
<paragraph id="HF6E82C199B664ACD85E9EA182A350F7B"><enum>(6)</enum><header>Uniformed services</header><text>The term <term>Uniformed Services</term> has the meaning given the term <term>uniformed services</term> in section 101(a) of title 10, United States Code.</text></paragraph></subsection> 
<subsection id="H11778DF3FE5D49D396D2174B6B8759F3" commented="no"><enum>(b)</enum><header>Treatment of expunged convictions</header><text display-inline="yes-display-inline">For purposes of adjustment of status under this title, the terms <quote>convicted</quote> and <term>conviction</term>, as used in sections 212 and 244 of the Immigration and Nationality Act (8 U.S.C. 1182, 1254a), do not include a judgment that has been expunged or set aside, that resulted in a rehabilitative disposition, or the equivalent.</text></subsection></section> 
<section id="H5A518B6F7CB34B86B2FFD66B3FE79D0A" display-inline="no-display-inline" section-type="subsequent-section"><enum>222.</enum><header>Submission of biometric and biographic data; background checks</header> 
<subsection id="HB8C42D70D83A4B37BB5E51C1E6691987"><enum>(a)</enum><header>Submission of biometric and biographic data</header><text display-inline="yes-display-inline">The Secretary may not grant an alien adjustment of status under this title unless the alien submits biometric and biographic data, in accordance with procedures established by the Secretary. The Secretary shall provide an alternative procedure for aliens who are unable to provide such biometric or biographic data because of a physical impairment.</text></subsection> 
<subsection id="HECB361045AB846239E82B25AE80060E3"><enum>(b)</enum><header>Background checks</header><text display-inline="yes-display-inline">The Secretary shall use biometric, biographic, and other data that the Secretary determines appropriate to conduct security and law enforcement background checks and to determine whether there is any criminal, national security, or other factor that would render the alien ineligible for adjustment of status under this title. The status of an alien may not be adjusted unless security and law enforcement background checks are completed to the satisfaction of the Secretary.</text></subsection></section> 
<section id="HA16BA3222BE8434D96A148BCE77E28E7" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>223.</enum><header>Limitation on removal; application and fee exemption; waiver of grounds for inadmissibility and other conditions on eligible individuals</header> 
<subsection id="HA4CA8E7382BD4D8E884BB918D3392332" commented="no"><enum>(a)</enum><header>Limitation on removal</header><text display-inline="yes-display-inline">An alien who appears to be prima facie eligible for relief under this title shall be given a reasonable opportunity to apply for such relief and may not be removed until, subject to section 226(c), a final decision establishing ineligibility for relief is rendered.</text></subsection> 
<subsection id="H162C9B6D92724ADBA7B3A1749E5D48EB" commented="no"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">An alien present in the United States who has been ordered removed or has been permitted to depart voluntarily from the United States may, notwithstanding such order or permission to depart, apply for adjustment of status under this title. Such alien shall not be required to file a separate motion to reopen, reconsider, or vacate the order of removal. If the Secretary approves the application, the Secretary shall cancel the order of removal. If the Secretary renders a final administrative decision to deny the application, the order of removal or permission to depart shall be effective and enforceable to the same extent as if the application had not been made, only after all available administrative and judicial remedies have been exhausted.</text></subsection> 
<subsection id="H77CA840437EB42319A5DB75DE5D36868" commented="no"><enum>(c)</enum><header>Fee exemption</header><text display-inline="yes-display-inline">An applicant may be exempted from paying an application fee required under this title if the applicant—</text> 
<paragraph id="H5925390C1DFE44588699D78234CA2569" commented="no"><enum>(1)</enum><text>is younger than 18 years of age;</text></paragraph> 
<paragraph id="HAAFB1F1A02DA4CB29DFD755638CA8A20" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">received total income, during the 12-month period immediately preceding the date on which the applicant files an application under this title, that is less than 150 percent of the Federal poverty line;</text></paragraph> 
<paragraph id="H4457804560DB4E83950A0E761AFA2C81" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">is in foster care or otherwise lacks any parental or other familial support; or</text></paragraph> 
<paragraph id="H2F81305F9FD84E7AA863A18BA9BDBAD5" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">cannot care for himself or herself because of a serious, chronic disability.</text></paragraph></subsection> 
<subsection id="H7FBCFA44670D4716AEDC9E575654C1E5" commented="no"><enum>(d)</enum><header>Waiver of grounds of inadmissibility</header> 
<paragraph id="H21B8A440DE85440F9A78AF8298626CBC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), with respect to any benefit under this title, and in addition to any waivers that are otherwise available, the Secretary may waive the grounds of inadmissibility under paragraph (1), subparagraphs (A), (C), and (D) of paragraph (2), subparagraphs (D) through (G) of paragraph (6), or paragraph (10)(D) of section 212(a) of the Immigration and Nationality Act (8 U.S.C. 1182(a)) for humanitarian purposes, for family unity, or because the waiver is otherwise in the public interest.</text></paragraph> 
<paragraph id="H2DA15F15EE404C70AE3AF1C4E3EBC167"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The Secretary may not waive a ground described in paragraph (1) if such inadmissibility is based on a conviction or convictions, and such conviction or convictions would otherwise render the alien ineligible under section 244(c)(2)(B) of the Immigration and Nationality Act (8 U.S.C. 1254a(c)(2)(B)).</text></paragraph></subsection> 
<subsection id="HC63835B85D2C45F8B3279CE45A61980D" commented="no"><enum>(e)</enum><header>Advance parole</header><text>During the period beginning on the date on which an alien applies for adjustment of status under this title and ending on the date on which the Secretary makes a final decision regarding such application, the alien shall be eligible to apply for advance parole. Section 101(g) of the Immigration and Nationality Act (8 U.S.C. 1101(g)) shall not apply to an alien granted advance parole under this section.</text></subsection> 
<subsection id="H12940E7F3EE74458A997403D15772A31" commented="no"><enum>(f)</enum><header>Employment</header><text>An alien whose removal is stayed pursuant to this title, or who has pending an application under this title, shall, upon application to the Secretary, be granted an employment authorization document.</text></subsection></section> 
<section id="H47B6FA77733D40C6B2A8FC79FBCE004D" display-inline="no-display-inline" section-type="subsequent-section"><enum>224.</enum><header>Determination of continuous presence</header> 
<subsection id="HAA65F5717E7748DBA9D30AD72EE4900D"><enum>(a)</enum><header>Effect of notice to appear</header><text display-inline="yes-display-inline">Any period of continuous physical presence in the United States of an alien who applies for adjustment of status under this title shall not terminate when the alien is served a notice to appear under section 239(a) of the Immigration and Nationality Act (8 U.S.C. 1229(a)).</text></subsection> 
<subsection id="H1FCA44B29D7849A4A4305C4BC6E05D42"><enum>(b)</enum><header>Treatment of certain breaks in presence</header> 
<paragraph id="HBD4F8F658B58498681406BEBBA637C9E"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraphs (2) and (3), an alien shall be considered to have failed to maintain continuous physical presence in the United States under this title if the alien has departed from the United States for any period exceeding 90 days or for any periods, in the aggregate, exceeding 180 days.</text></paragraph> 
<paragraph id="H2D572DC5AF0244EEB1A8B0272D974676"><enum>(2)</enum><header>Extensions for extenuating circumstances</header><text>The Secretary may extend the time periods described in paragraph (1) for an alien who demonstrates that the failure to timely return to the United States was due to extenuating circumstances beyond the alien’s control, including the serious illness of the alien, or death or serious illness of a parent, grandparent, sibling, or child of the alien.</text></paragraph> 
<paragraph id="H2079B262EC42433BB77A8A0C2EE23D8B" commented="no"><enum>(3)</enum><header>Travel authorized by the Secretary</header><text>Any period of travel outside of the United States by an alien that was authorized by the Secretary may not be counted toward any period of departure from the United States under paragraph (1).</text></paragraph></subsection> 
<subsection id="HB93DA1FAD2A94C3AABE6B605EACB8117"><enum>(c)</enum><header>Waiver of physical presence</header><text display-inline="yes-display-inline">With respect to aliens who were removed or departed the United States on or after January 20, 2017, and who were continuously physically present in the United States for at least 3 years prior to such removal or departure, the Secretary may, as a matter of discretion, waive the physical presence requirement under section 211(a)(2) for humanitarian purposes, for family unity, or because a waiver is otherwise in the public interest. The Secretary, in consultation with the Secretary of State, shall establish a procedure for such aliens to apply for relief under section 211 from outside the United States if they would have been eligible for relief under such section, but for their removal or departure.</text></subsection></section> 
<section id="H1EFCBC3BCE59465196F9904FE691F0FA" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>225.</enum><header>Exemption from numerical limitations</header><text display-inline="no-display-inline">Nothing in this title or in any other law may be construed to apply a numerical limitation on the number of aliens who may be granted permanent resident status under this title.</text></section> 
<section id="HB6417BA8E9F140318DD7CDC1857D7933" commented="no"><enum>226.</enum><header>Availability of administrative and judicial review</header> 
<subsection id="HF525D05544EB45F49EA1D0A98F4294CA" commented="no"><enum>(a)</enum><header>Administrative review</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Secretary shall provide to aliens who have applied for adjustment of status under this title a process by which an applicant may seek administrative appellate review of a denial of an application for adjustment of status, or a revocation of such status.</text></subsection> 
<subsection id="H94C278C647BE42CD9546F8D434C70166" commented="no"><enum>(b)</enum><header>Judicial review</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, an alien may seek judicial review of a denial of an application for adjustment of status, or a revocation of such status, under this title in the United States district court with jurisdiction over the alien’s residence.</text></subsection> 
<subsection id="H1077315855CA4F4FBACE2A7060A116C0" commented="no"><enum>(c)</enum><header>Stay of removal</header> 
<paragraph id="H652D5AFD3803477CAB680E5363D928EF"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), an alien seeking administrative or judicial review under this title may not be removed from the United States until a final decision is rendered establishing that the alien is ineligible for adjustment of status under this title.</text></paragraph> 
<paragraph id="H1E17EE190C3A4A2EB9D2AA4FE034F99F"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The Secretary may remove an alien described in paragraph (1) pending judicial review if such removal is based on criminal or national security grounds. Such removal does not affect the alien’s right to judicial review under this title. The Secretary shall promptly return a removed alien if a decision to deny an application for adjustment of status under this title, or to revoke such status, is reversed. </text></paragraph></subsection></section> 
<section id="HBC4AB52FA64347DCB85D520AC25EAE86" display-inline="no-display-inline" section-type="subsequent-section" commented="no"><enum>227.</enum><header>Documentation requirements</header> 
<subsection id="H83E0983248554377AE2124C5FDFD133B" commented="no"><enum>(a)</enum><header>Documents establishing identity</header><text display-inline="yes-display-inline">An alien’s application for permanent resident status under this title may include, as evidence of identity, the following:</text> 
<paragraph id="HC31ACBA424EE4214AAAE153CB40D4611"><enum>(1)</enum><text display-inline="yes-display-inline">A passport or national identity document from the alien’s country of origin that includes the alien’s name and the alien’s photograph or fingerprint.</text></paragraph> 
<paragraph id="H28D31CF12EC04F17A7CD3E0FE7229A72"><enum>(2)</enum><text>The alien’s birth certificate and an identity card that includes the alien’s name and photograph.</text></paragraph> 
<paragraph id="H54C3FD10B63245EEA4ED3328F5A094B3"><enum>(3)</enum><text display-inline="yes-display-inline">A school identification card that includes the alien’s name and photograph, and school records showing the alien’s name and that the alien is or was enrolled at the school.</text></paragraph> 
<paragraph id="HEA3E59BCD90949A0BCF7419F4784AF9E"><enum>(4)</enum><text>A Uniformed Services identification card issued by the Department of Defense.</text></paragraph> 
<paragraph id="H4BF74FB7949846BDA7F8D398F91A30A4"><enum>(5)</enum><text>Any immigration or other document issued by the United States Government bearing the alien’s name and photograph.</text></paragraph> 
<paragraph id="H098F0F92F9B94D8CB5FB9F98E8CAC335"><enum>(6)</enum><text>A State-issued identification card bearing the alien's name and photograph.</text></paragraph> 
<paragraph id="HCD553CC270AE48A3A9A8184B78E898B4"><enum>(7)</enum><text>Any other evidence determined to be credible by the Secretary.</text></paragraph></subsection> 
<subsection id="HA82330BEB8DA47D0934F405DDB56E965" commented="no"><enum>(b)</enum><header>Documents establishing continuous physical presence</header><text display-inline="yes-display-inline">An alien’s application for permanent resident status under this title may include, as evidence that the alien has been continuously physically present in the United States, as required under section 211(a)(2), the following: </text> 
<paragraph id="HCF8922EFFD3F409999A735FFF739E6E0" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Passport entries, including admission stamps on the alien’s passport.</text></paragraph> 
<paragraph id="H5F26C7A72A464E3B95D824E52C58F8D7"><enum>(2)</enum><text>Any document from the Department of Justice or the Department of Homeland Security noting the alien’s date of entry into the United States.</text></paragraph> 
<paragraph id="HCB3CDC49A9C64759AA9E5F18617FB856"><enum>(3)</enum><text>Records from any educational institution the alien has attended in the United States.</text></paragraph> 
<paragraph id="H4928079EF01548B980CCADBC8E613ED0"><enum>(4)</enum><text>Employment records of the alien that include the employer’s name and contact information.</text></paragraph> 
<paragraph id="H5CBE431026B247CBAF918B60F0C1070A" commented="no"><enum>(5)</enum><text>Records of service from the Uniformed Services.</text></paragraph> 
<paragraph id="H5AF7A927E8B049FABB95842D8337F877"><enum>(6)</enum><text display-inline="yes-display-inline">Official records from a religious entity confirming the alien’s participation in a religious ceremony.</text></paragraph> 
<paragraph id="H1C7553A86FD647F0A6B6138869320BE3" commented="no"><enum>(7)</enum><text>A birth certificate for a child who was born in the United States.</text></paragraph> 
<paragraph id="HB63A93A5DF0D478BA6F3A47F94D30782"><enum>(8)</enum><text display-inline="yes-display-inline">Hospital or medical records showing medical treatment or hospitalization, the name of the medical facility or physician, and the date of the treatment or hospitalization.</text></paragraph> 
<paragraph id="HB57557271FC043AFB4EB8D6D858CCEC0" commented="no"><enum>(9)</enum><text>Automobile license receipts or registration.</text></paragraph> 
<paragraph id="H45C2449977EC43E88188B9C33A11E18D" commented="no"><enum>(10)</enum><text>Deeds, mortgages, or rental agreement contracts.</text></paragraph> 
<paragraph id="H183BCBA38A5644C89F3457CEE6AA51F0"><enum>(11)</enum><text display-inline="yes-display-inline">Rent receipts or utility bills bearing the alien’s name or the name of an immediate family member of the alien, and the alien’s address.</text></paragraph> 
<paragraph id="H07DD3C6B53F1472D99658F71B8971A2E" commented="no"><enum>(12)</enum><text>Tax receipts;</text></paragraph> 
<paragraph id="H3BD19A35D2CB4FD7A06FA2075826C8EA" commented="no"><enum>(13)</enum><text>Insurance policies.</text></paragraph> 
<paragraph id="H19413E1F962A41B388DD15BE3310671F" commented="no"><enum>(14)</enum><text display-inline="yes-display-inline">Remittance records, including copies of money order receipts sent in or out of the country.</text></paragraph> 
<paragraph id="HE3F42853D92547ACBFF2204C3DA13E0E"><enum>(15)</enum><text>Travel records.</text></paragraph> 
<paragraph id="H8C112B466D964222B3511A4C68892E85" commented="no"><enum>(16)</enum><text>Dated bank transactions.</text></paragraph> 
<paragraph id="H87A2E206AFCA4317A2552BA6BAC8566A" commented="no"><enum>(17)</enum><text>Two or more sworn affidavits from individuals who are not related to the alien who have direct knowledge of the alien’s continuous physical presence in the United States, that contain—</text> 
<subparagraph id="HA4CBFCC9276740849068D59041B0E3A3" commented="no"><enum>(A)</enum><text>the name, address, and telephone number of the affiant; and</text></subparagraph> 
<subparagraph id="H71B134F0ECCA40D7A8152DE3632287D0" commented="no"><enum>(B)</enum><text>the nature and duration of the relationship between the affiant and the alien.</text></subparagraph></paragraph> 
<paragraph id="H8B7A3E8E88C142F9AB649AB6F9C95A34"><enum>(18)</enum><text>Any other evidence determined to be credible by the Secretary.</text></paragraph></subsection> 
<subsection id="H24206BC172824C81A0C78BC5663CC865" commented="no"><enum>(c)</enum><header>Documents establishing exemption from application fees</header><text display-inline="yes-display-inline">An alien’s application for permanent resident status under this title may include, as evidence that the alien is exempt from an application fee under section 223(c), the following:</text> 
<paragraph id="HEA7977F72723404AB119D27D1EB4F605" commented="no"><enum>(1)</enum><header>Documents to establish age</header><text>To establish that an alien meets an age requirement, the alien may provide proof of identity, as described in subsection (a), that establishes that the alien is younger than 18 years of age.</text></paragraph> 
<paragraph id="H00DC1B5E999B47EAB63B1A2180FBC641" commented="no"><enum>(2)</enum><header>Documents to establish income</header><text>To establish the alien’s income, the alien may provide—</text> 
<subparagraph id="H140A0007C09D45C9832A9E5FB97126D0" commented="no"><enum>(A)</enum><text>employment records or other records of earned income, including records that have been maintained by the Social Security Administration, the Internal Revenue Service, or any other Federal, State, or local government agency;</text></subparagraph> 
<subparagraph id="H8E59496604FB4141ABD36E3384DF4505" commented="no"><enum>(B)</enum><text>bank records; or</text></subparagraph> 
<subparagraph id="H4247879129F049F98949AC93505BD30F" commented="no"><enum>(C)</enum><text>at least 2 sworn affidavits from individuals who are not related to the alien and who have direct knowledge of the alien’s work and income that contain—</text> 
<clause id="HDC4D838207DB407DA6FFDE14697E491B" commented="no"><enum>(i)</enum><text>the name, address, and telephone number of the affiant; and</text></clause> 
<clause id="H2A7B87170E614AF480B80B897DF4AF65" commented="no"><enum>(ii)</enum><text>the nature and duration of the relationship between the affiant and the alien.</text></clause></subparagraph></paragraph> 
<paragraph id="H9AA8114966B7416B91859198C49D4DFC" commented="no"><enum>(3)</enum><header>Documents to establish foster care, lack of familial support, or serious, chronic disability</header><text>To establish that the alien is in foster care, lacks parental or familial support, or has a serious, chronic disability, the alien may provide at least 2 sworn affidavits from individuals who are not related to the alien and who have direct knowledge of the circumstances that contain—</text> 
<subparagraph id="H21DD4EA6C36A4BEE8FBD64B62AEAA88F" commented="no"><enum>(A)</enum><text>a statement that the alien is in foster care, otherwise lacks any parental or other familiar support, or has a serious, chronic disability, as appropriate;</text></subparagraph> 
<subparagraph id="H1356374D2FBB4A37A7902F3A7659C5B0" commented="no"><enum>(B)</enum><text>the name, address, and telephone number of the affiant; and</text></subparagraph> 
<subparagraph id="HA802402951FD4020AE54FF1866647CA8" commented="no"><enum>(C)</enum><text>the nature and duration of the relationship between the affiant and the alien.</text></subparagraph></paragraph></subsection> 
<subsection id="H986700177DAE413F9FE4E2A5D4A9F244" commented="no"><enum>(d)</enum><header>Authority to prohibit use of certain documents</header><text display-inline="yes-display-inline">If the Secretary determines, after publication in the Federal Register and an opportunity for public comment, that any document or class of documents does not reliably establish identity or that permanent resident status under this title is being obtained fraudulently to an unacceptable degree, the Secretary may prohibit or restrict the use of such document or class of documents.</text></subsection></section> 
<section id="HF55D9C738AD4407F90B0BEBD2319EE5C" display-inline="no-display-inline" section-type="subsequent-section"><enum>228.</enum><header>Rule making</header> 
<subsection id="H2EFA5E6D23FA4F26BEA3AC79FB482E63"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary shall publish in the Federal Register interim final rules implementing this title, which shall allow eligible individuals to immediately apply for relief under section 211. Notwithstanding section 553 of title 5, United States Code, the regulation shall be effective, on an interim basis, immediately upon publication, but may be subject to change and revision after public notice and opportunity for a period of public comment. The Secretary shall finalize such rules not later than 180 days after the date of publication. </text></subsection> 
<subsection id="H6F1B2A93F0F743399788E3D2387D49D3"><enum>(b)</enum><header>Paperwork Reduction Act</header><text>The requirements under chapter 35 of title 44, United States Code, (commonly known as the <quote>Paperwork Reduction Act</quote>) shall not apply to any action to implement this title.</text></subsection></section> 
<section id="H7A0ECBC0BEC64BC0ABAF292A5593A472" display-inline="no-display-inline" section-type="subsequent-section"><enum>229.</enum><header>Confidentiality of information</header> 
<subsection id="HC2B022AC977A4057A19313A86B0333A1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may not disclose or use information provided in applications filed under this title (including information provided during administrative or judicial review) for the purpose of immigration enforcement.</text></subsection> 
<subsection id="HFDC43A1F44424CADB18BCDCD4CF5B3DD" commented="no"><enum>(b)</enum><header>Referrals prohibited</header><text display-inline="yes-display-inline">The Secretary, based solely on information provided in an application for adjustment of status under this title (including information provided during administrative or judicial review), may not refer an applicant to U.S. Immigration and Customs Enforcement, U.S. Customs and Border Protection, or any designee of either such entity .</text></subsection> 
<subsection id="H665FC477790541BAAD73D4A40BC1112D" commented="no"><enum>(c)</enum><header>Limited exception</header><text display-inline="yes-display-inline">Notwithstanding subsections (a) and (b), information provided in an application for adjustment of status under this title may be shared with Federal security and law enforcement agencies—</text> 
<paragraph id="H094D85A956DF43239A373E17B0F39AFD" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">for assistance in the consideration of an application for adjustment of status under this title;</text></paragraph> 
<paragraph id="HBBF3828FE4DA4687B5558C09CAEA5FE4" commented="no"><enum>(2)</enum><text>to identify or prevent fraudulent claims;</text></paragraph> 
<paragraph id="HB52CD4DEE6EA4CEBB863BA6C175E4A45" commented="no"><enum>(3)</enum><text>for national security purposes; or</text></paragraph> 
<paragraph id="H1D89BD1E3C2B4FD8B49925A1E7335E1E" commented="no"><enum>(4)</enum><text>for the investigation or prosecution of any felony not related to immigration status.</text></paragraph></subsection> 
<subsection id="HEF7996DE38F14CDB83BA739B6AFA9853"><enum>(d)</enum><header>Penalty</header><text>Any person who knowingly uses, publishes, or permits information to be examined in violation of this section shall be fined not more than $10,000.</text></subsection></section> 
<section id="HBD84D0AE76FF4F229627DA0F3F2AE320" display-inline="no-display-inline" section-type="subsequent-section"><enum>230.</enum><header>Grant program to assist eligible applicants</header> 
<subsection id="H63A63B397BB04D0591AF7BE41BCD6FD9"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Homeland Security shall establish, within U.S. Citizenship and Immigration Services, a program to award grants, on a competitive basis, to eligible nonprofit organizations that will use the funding to assist eligible applicants under this title by providing them with the services described in subsection (b).</text></subsection> 
<subsection id="HDD5605B098E94AD1AEC2B66D1E5E1749"><enum>(b)</enum><header>Use of funds</header><text>Grant funds awarded under this section shall be used for the design and implementation of programs that provide—</text> 
<paragraph id="HBC613034876D482DAA8CB8E8F5A1C7E1" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">information to the public regarding the eligibility and benefits of permanent resident status under this title, particularly to individuals potentially eligible for such status;</text></paragraph> 
<paragraph id="HB87979C0216C4A59835D074378238DCF" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">assistance, within the scope of authorized practice of immigration law, to individuals submitting applications for adjustment of status under this title, including—</text> 
<subparagraph id="H87DC3089FE7C40878BAFCEE621CA543F" commented="no"><enum>(A)</enum><text>screening prospective applicants to assess their eligibility for such status;</text></subparagraph> 
<subparagraph id="HD7AB315DD03C409B964550BD386CCFBB" commented="no"><enum>(B)</enum><text>completing applications and petitions, including providing assistance in obtaining the requisite documents and supporting evidence; and</text></subparagraph> 
<subparagraph id="H831E50803D644040AA736BBFEE1F2A63" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">providing any other assistance that the Secretary or grantee considers useful or necessary to apply for adjustment of status under this title; and</text></subparagraph></paragraph> 
<paragraph id="H8A0B946542DE4CD5B39152F6E806B526"><enum>(3)</enum><text>assistance, within the scope of authorized practice of immigration law, and instruction, to individuals—</text> 
<subparagraph id="H2E202851E4A24757BBC3A86F2209C25A"><enum>(A)</enum><text>on the rights and responsibilities of United States citizenship;</text></subparagraph> 
<subparagraph id="H3837E35ACC1949E58B59EBD3C77336DC"><enum>(B)</enum><text>in civics and English as a second language;</text></subparagraph> 
<subparagraph id="H0D593563A9F5494AB6A17436717E7BA2"><enum>(C)</enum><text>in preparation for the General Education Development test; and</text></subparagraph> 
<subparagraph id="HE54BC7671F174E4EBF4ECD83448BBCA3"><enum>(D)</enum><text>in applying for adjustment of status and United States citizenship.</text></subparagraph></paragraph></subsection> 
<subsection id="HA599F5C0FA6B4188A30E8FBA434EF094"><enum>(c)</enum><header>Authorization of appropriations</header> 
<paragraph id="HA943327D946C42498EB3CB243B5562AC"><enum>(1)</enum><header>Amounts authorized</header><text>There are authorized to be appropriated such sums as may be necessary for each of the fiscal years 2020 through 2030 to carry out this section.</text></paragraph> 
<paragraph id="H3E01D0FEE58A4B79B5A5CEBF17182567"><enum>(2)</enum><header>Availability</header><text>Any amounts appropriated pursuant to paragraph (1) shall remain available until expended.</text></paragraph></subsection></section> 
<section id="HBF00312EEE8A46F3B73020952C064F12" display-inline="no-display-inline" section-type="subsequent-section"><enum>231.</enum><header>Provisions affecting eligibility for adjustment of status</header><text display-inline="no-display-inline">An alien’s eligibility to be lawfully admitted for permanent residence under this title shall not preclude the alien from seeking any status under any other provision of law for which the alien may otherwise be eligible.</text></section></subtitle></title>
