<section id="HAAAE9B36EFAC4745801D59A9EF1E3E61" section-type="undesignated-section"><text display-inline="yes-display-inline">The following sums in this Act are appropriated, out of any money in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2020, and for other purposes, namely:</text></section> 
<title id="HE9DF84AF6EF74CD78FC3872491F27198"><enum>I</enum><header>Department of Health and Human Services</header><appropriations-intermediate id="H9F9AFCD4DB2A4E07BD86525A38C26EF5"><header>Administration for Children and Families</header></appropriations-intermediate><appropriations-small id="HA262EF2CFFD54C51AAFF304E29012B56"><header>Payments to States for the Child Care and Development Block Grant</header></appropriations-small><appropriations-small id="H997AF042EB5B4561AE9F84A9559C1B64"><text display-inline="no-display-inline">For an additional amount for <quote>Payments to States for the Child Care and Development Block Grant</quote>, $50,000,000,000, to remain available until September 30, 2021, for necessary expenses to carry out the Child Care Stabilization Fund grants program, as authorized by section 1 of this Act: 
<proviso> <italic>Provided</italic></proviso>, That such funds shall be available without regard to the requirements in subparagraphs (C) through (E) of section 658E(c)(3) or section 658G of the Child Care and Development Block Grant Act: 
<proviso> <italic>Provided further</italic></proviso>, That funds appropriated under this heading in this Act may be made available to restore amounts, either directly or through reimbursement, for obligations incurred prior to the date of enactment of this Act for the purposes provided herein: 
<proviso> <italic>Provided further</italic></proviso>, That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985 and shall be available only if the President subsequently so designates such amount and transmits such designation to the Congress.</text></appropriations-small> 
<section id="HC51F0704A9F94986A061AF48F2A8326E" display-inline="no-display-inline"><enum>1.</enum><header>Child Care Stabilization Fund</header> 
<subsection id="H6719B1463F464EF58CB5AAAF89075637" display-inline="yes-display-inline"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H4F775F8B992F4F16A92E1A06D47E3777"><enum>(1)</enum><header>CCDBG terms</header><text>The terms <term>eligible child care provider</term>, <term>Indian tribe</term>, <term>lead agency</term>, <term>tribal organization</term>, <term>Secretary</term>, and <term>State</term> have the meanings given the terms in section 658P of the Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9858n) except as otherwise provided in this section.</text></paragraph> 
<paragraph id="H570C4B9AEDEF4C7497327BF508AE4A0E"><enum>(2)</enum><header>COVID–19 public health emergency</header><text>The term <term>COVID–19 public health emergency</term> means the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (42 U.S.C. 247d) on January 31, 2020, with respect to COVID–19, including any renewal of the declaration.</text></paragraph></subsection> 
<subsection id="H78C3557D03464BE096DF1DFB3460FFA1"><enum>(b)</enum><header>Grants</header><text display-inline="yes-display-inline">From the amounts appropriated to carry out this section and under the authority of section 658O of the Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9858m) and this section, the Secretary shall award child care stabilization grants to the lead agency of each State (as defined in that section 658O), territory described in subsection (a)(1) of such section, Indian tribe, and tribal organization from allotments and payments made under subsection (c)(2), not later than 30 days after the date of enactment of this Act. </text></subsection> 
<subsection id="H99B4D585B6AD45F5B79418437ED54E85"><enum>(c)</enum><header>Secretarial reservation and allotments</header> 
<paragraph id="H4BEAA026B6624FE395BAA841F4CA6C35"><enum>(1)</enum><header>Reservation</header><text display-inline="yes-display-inline">The Secretary shall reserve not more than 1 percent of the funds appropriated to carry out this section for the Federal administration of grants described in subsection (b).</text></paragraph> 
<paragraph id="H649D30E873D54E2BB1DC84A1775A683D"><enum>(2)</enum><header>Allotments</header><text display-inline="yes-display-inline">The Secretary shall use the remainder of the funds appropriated to carry out this section to award allotments to States, as defined in section 658O of the Child Care Development Block Grant Act of 1990 (42 U.S.C. 9858m), and payments to territories, Indian tribes, and tribal organizations in accordance with paragraphs (1) and (2) of subsection (a), and subsection (b), of section 658O of the Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9858m).</text></paragraph></subsection> 
<subsection id="H1CC799B68DB94F14A78D13B1561ED4E6"><enum>(d)</enum><header>State reservations and subgrants</header> 
<paragraph id="H5BE63DF58BBB407CA2899F0C1DAE18A5"><enum>(1)</enum><header>Reservation</header><text display-inline="yes-display-inline">A lead agency for a State that receives a child care stabilization grant pursuant to subsection (b) shall reserve not more than 10 percent of such grant funds—</text> 
<subparagraph id="HF1C8B59DFD874EF4AEF94AD8E5B97572"><enum>(A)</enum><text>to administer subgrants made to qualified child care providers under paragraph (2), including to carry out data systems building and other activities that enable the disbursement of payments of such subgrants;</text></subparagraph> 
<subparagraph id="H6931D15A7F69420B899FD31D752C470E"><enum>(B)</enum><text>to provide technical assistance and support in applying for and accessing the subgrant opportunity under paragraph (2), to eligible child care providers (including to family child care providers, group home child care providers, and other non-center-based child care providers and providers with limited administrative capacity), either directly or through resource and referral agencies or staffed family child care networks;</text></subparagraph> 
<subparagraph id="HA98DF88DB9A84577A4283D2B9C08A9F7"><enum>(C)</enum><text>to publicize the availability of subgrants under this section and conduct widespread outreach to eligible child care providers, including family child care providers, group home child care providers, and other non-center-based child care providers and providers with limited administrative capacity, either directly or through resource and referral agencies or staffed family child care networks, to ensure eligible child care providers are aware of the subgrants available under this section; </text></subparagraph> 
<subparagraph id="HC43C5196E1F945498CDB7DB11D5D1422"><enum>(D)</enum><text>to carry out the reporting requirements described in subsection (f); and</text></subparagraph> 
<subparagraph id="HD3D68342C74148F5A9C807972561F923"><enum>(E)</enum><text display-inline="yes-display-inline">to carry out activities to improve the supply and quality of child care during and after the COVID–19 public health emergency, such as conducting community needs assessments, carrying out child care cost modeling, making improvements to child care facilities, increasing access to licensure or participation in the State's tiered quality rating system, and carrying out other activities described in section 658G(b) of the Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9858e(b)), to the extent that the lead agency can carry out activities described in this subparagraph without preventing the lead agency from fully conducting the activities described in subparagraphs (A) through (D). </text></subparagraph></paragraph> 
<paragraph id="H8FB4F92CBF784AD49B879D16A9F92162"><enum>(2)</enum><header>Subgrants to qualified child care providers</header> 
<subparagraph id="H730C006189FC4B198A3C69545FA05824"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The lead agency shall use the remainder of the grant funds awarded pursuant to subsection (b) to make subgrants to qualified child care providers described in subparagraph (B), to support the stability of the child care sector during and after the COVID–19 public health emergency. The lead agency shall provide the subgrant funds in advance of provider expenditures for costs described in subsection (e), except as provided in subsection (e)(2).</text></subparagraph> 
<subparagraph id="HF1C1A3EEE4C5492A9D26B356E8D6A217"><enum>(B)</enum><header>Qualified child care provider</header><text>To be qualified to receive a subgrant under this paragraph, a provider shall be an eligible child care provider that—</text> 
<clause id="H62A643887538406EB7E4009F8A024D5F"><enum>(i)</enum><text>was providing child care services on or before March 1, 2020; and</text></clause> 
<clause id="H6DD24786256B4586AC8D3DAB74781984"><enum>(ii)</enum><text>on the date of submission of an application for the subgrant, was either—</text> 
<subclause id="H31E316B08B004BF3BA24477DBCBC95FD"><enum>(I)</enum><text>open and available to provide child care services; or</text></subclause> 
<subclause id="H59E4FC04547B409DBF7840A7F85306D5"><enum>(II)</enum><text>closed due to the COVID–19 public health emergency.</text></subclause></clause></subparagraph> 
<subparagraph id="HF616EE02472B41478B17057488AAA213"><enum>(C)</enum><header>Subgrant amount</header><text display-inline="yes-display-inline">The lead agency shall make subgrants, from amounts awarded pursuant to subsection (b), to qualified child care providers, and the amount of such a subgrant to such a provider shall—</text> 
<clause id="HD541ACA2CDEA483A941CF53B626CBADB"><enum>(i)</enum><text display-inline="yes-display-inline">be based on the provider’s stated average operating expenses during the period (of not longer than 6 months) before March 1, 2020, or before the provider’s last day of operation for a provider that operates seasonally, and at minimum cover such operating expenses for the intended length of the subgrant;</text></clause> 
<clause id="HC41C4D378BC84B8E8FCBE3B34B097E56"><enum>(ii)</enum><text>account for increased costs of providing or preparing to provide child care as a result of the COVID–19 public health emergency, such as provider and employee compensation and existing benefits (existing as of March 1, 2020) and the implementation of new practices related to sanitization, group size limits, and social distancing;</text></clause> 
<clause id="HE8B01CE2DCFA4952AAD3205ED9845706"><enum>(iii)</enum><text>be adjusted for payments or reimbursements made to an eligible child care provider to carry out the Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9857 et seq.) or the Head Start Act (42 U.S.C. 9831 et seq.); and</text></clause> 
<clause id="HC045F55154DF45B98DF26CDCFF51667B"><enum>(iv)</enum><text>be adjusted for payments or reimbursements made to an eligible child care provider through the Paycheck Protection Program set forth in section 7(a)(36) of the Small Business Act (15 U.S.C. 636(a)(36)), as added by section 1102 of the Coronavirus Aid, Relief, and Economic Security Act (Public Law 116–136).</text></clause></subparagraph> 
<subparagraph id="H230D642CF3954A009B842B3D92AF36F5"><enum>(D)</enum><header>Application</header> 
<clause id="HB8C0F6F6E5A940A7827D5C8BF0BAEA68"><enum>(i)</enum><header>Eligibility</header><text>To be eligible to receive a subgrant under this paragraph, a child care provider shall submit an application to a lead agency at such time and in such manner as the lead agency may require. Such application shall include—</text> 
<subclause id="HA1990956B4AC4E9AA481B44DF1DFE6F2"><enum>(I)</enum><text>a good-faith certification that the ongoing operations of the child care provider have been impacted as a result of the COVID–19 public health emergency;</text></subclause> 
<subclause id="HEFC47450DE4B4C7EB0ACF4FCFB747BDA"><enum>(II)</enum><text>for a provider described in subparagraph (B)(ii)(I), an assurance that, for the duration of the COVID–19 public health emergency—</text> 
<item id="HF4E736BBA00748D6B825F434A1160179"><enum>(aa)</enum><text>the provider will give priority for available slots (including slots that are only temporarily available) to—</text> 
<subitem id="HE193B50BEA4A46D08731945E0EB22DDD"><enum>(AA)</enum><text display-inline="yes-display-inline">children of essential workers (such as health care sector employees, emergency responders, sanitation workers, farmworkers, child care employees, and other workers determined to be essential during the response to coronavirus by public officials), children of workers whose places of employment require their attendance, children experiencing homelessness, children with disabilities, children at risk of child abuse or neglect, and children in foster care, in States, tribal communities, or localities where stay-at-home or related orders are in effect; or</text></subitem> 
<subitem id="HB4FA5E7179204D16953BBADC4AB58C03"><enum>(BB)</enum><text display-inline="yes-display-inline">children of workers whose places of employment require their attendance, children experiencing homelessness, children with disabilities, children at risk of child abuse or neglect, children in foster care, and children whose parents are in school or a training program, in States, tribal communities, or localities where stay-at-home or related orders are not in effect;</text></subitem></item> 
<item id="HA9DFACDFE0BA40958AE81128B37AEC5C"><enum>(bb)</enum><text display-inline="yes-display-inline">the provider will implement policies in line with guidance from the Centers for Disease Control and Prevention and the corresponding State, tribal, and local authorities, and in accordance with State, tribal, and local orders, for child care providers that remain open, including guidance on sanitization practices, group size limits, and social distancing;</text></item> 
<item id="H25A912A6B51B4630B827233825C9D5D4"><enum>(cc)</enum><text>for each employee, the provider will pay the full compensation described in subsection (e)(1)(C), including any benefits, that was provided to the employee as of March 1, 2020 (referred to in this clause as <quote>full compensation</quote>), and will not take any action that reduces the weekly amount of the employee's compensation below the weekly amount of full compensation, or that reduces the employee’s rate of compensation below the rate of full compensation; and </text></item> 
<item id="H702101B30AFF4AA89D100B5853A2B9C8"><enum>(dd)</enum><text>the provider will provide relief from copayments and tuition payments for the families enrolled in the provider’s program and prioritize such relief for families struggling to make either type of payments;</text></item></subclause> 
<subclause id="HF151FF4554EE4822BFFC454254786691"><enum>(III)</enum><text>for a provider described in subparagraph (B)(ii)(II), an assurance that—</text> 
<item id="HB9C253BC37B44C0AB69BE36A27E469D8"><enum>(aa)</enum><text>for the duration of the provider’s closure due to the COVID–19 public health emergency, for each employee, the provider will pay full compensation, and will not take any action that reduces the weekly amount of the employee's compensation below the weekly amount of full compensation, or that reduces the employee’s rate of compensation below the rate of full compensation;</text></item> 
<item id="H20D613D691B5431FB8C9DC435DCAAC52"><enum>(bb)</enum><text>children enrolled as of March 1, 2020, will maintain their slots, unless their families choose to disenroll the children; </text></item> 
<item id="H0678B06594B14D7B8E8F947839A7B9D9"><enum>(cc)</enum><text>for the duration of the provider’s closure due to the COVID–19 public health emergency, the provider will provide relief from copayments and tuition payments for the families enrolled in the provider's program and prioritize such relief for families struggling to make either type of payments; and</text></item> 
<item id="HF0303309268241238AEEF9D4F7114B8D"><enum>(dd)</enum><text display-inline="yes-display-inline">the provider will resume operations when the provider is able to safely implement policies in line with guidance from the Centers for Disease Control and Prevention and the corresponding State, tribal, and local authorities, and in accordance with State, tribal, and local orders;</text></item></subclause> 
<subclause id="HEC8CCB6678B04DDA8BE6BA48B13F94D6"><enum>(IV)</enum><text>information about the child care provider’s—</text> 
<item id="H7EE05794F4024FFB9E39F3493D42165D"><enum>(aa)</enum><text>program characteristics sufficient to allow the lead agency to establish the child care provider’s priority status, as described in subparagraph (F);</text></item> 
<item id="HA59601906EA5408F94B2B42CB5C2E26C"><enum>(bb)</enum><text>program operational status on the date of submission of the application;</text></item> 
<item id="H8E387DCE795447EC9560EA709880BDEB"><enum>(cc)</enum><text>type of program, including whether the program is a center-based child care, family child care, group home child care, or other non-center-based child care type program;</text></item> 
<item id="H8F8BC16B7D1A4FD3948C3CDC44209975"><enum>(dd)</enum><text display-inline="yes-display-inline">total enrollment on the date of submission of the application and total capacity as allowed by the State and tribal authorities; and</text></item> 
<item id="H0C0A5B9679124110B46CB16A618ECE44"><enum>(ee)</enum><text>receipt of assistance, and amount of assistance, through a payment or reimbursement described in subparagraph (C)(iv), and the time period for which the assistance was made; </text></item></subclause> 
<subclause id="H244945060D434B60AF2D7DBB3F564E07"><enum>(V)</enum><text display-inline="yes-display-inline">information necessary to determine the amount of the subgrant, such as information about the provider’s stated average operating expenses over the appropriate period, described in subparagraph (C)(i); and</text></subclause> 
<subclause id="H859A83630D5440ABA69A7E6D15003B29"><enum>(VI)</enum><text>such other limited information as the lead agency shall determine to be necessary to make subgrants to qualified child care providers.</text></subclause></clause> 
<clause id="H0875E241A1484C399E7D89A127E15D64"><enum>(ii)</enum><header>Frequency</header><text>The lead agency shall accept and process applications submitted under this subparagraph on a rolling basis. </text></clause> 
<clause id="H60A7216C78F742288D3EAAB4ACD25007"><enum>(iii)</enum><header>Updates</header><text>The lead agency shall—</text> 
<subclause id="H2016314BDFEA44F48DC800A4CCE12AEA"><enum>(I)</enum><text>at least once a month, verify by obtaining a self-attestation from each qualified child care provider that received such a subgrant from the agency, whether the provider is open and available to provide child care services or is closed due to the COVID–19 public health emergency; </text></subclause> 
<subclause id="HA7143689A840477685E679A032D8FF0A"><enum>(II)</enum><text>allow the qualified child care provider to update the information provided in a prior application; and</text></subclause> 
<subclause id="H88622E11F258419AAEC8A73C1E1AAAD0" commented="no"><enum>(III)</enum><text>adjust the qualified child care provider’s subgrant award as necessary, based on changes to the application information, including changes to the provider’s operational status.</text></subclause></clause> 
<clause id="H0572D83546404004889E0D11FE3C9641"><enum>(iv)</enum><header>Existing applications</header><text>If a lead agency has established and implemented a grant program for child care providers that is in effect on the date of enactment of this Act, and an eligible child care provider has already submitted an application for such a grant to the lead agency containing the information specified in clause (i), the lead agency shall treat that application as an application submitted under this subparagraph. If an eligible child care provider has already submitted such an application containing part of the information specified in clause (i), the provider may submit to the lead agency an abbreviated application that contains the remaining information, and the lead agency shall treat the 2 applications as an application submitted under this subparagraph.</text></clause></subparagraph> 
<subparagraph id="H08D017E223AD4BDDB15B3ECE162F4304"><enum>(E)</enum><header>Materials</header> 
<clause id="H98246B988F7E4C7285EC4B638032F079"><enum>(i)</enum><header>In general</header><text>The lead agency shall provide the materials and other resources related to such subgrants, including a notification of subgrant opportunities and application materials, to qualified child care providers in the most commonly spoken languages in the State. </text></clause> 
<clause id="HE7C4DA4C7A2141C097C947E6C2DF07A2"><enum>(ii)</enum><header>Application</header><text>The application shall be accessible on the website of the lead agency within 30 days after the lead agency receives grant funds awarded pursuant to subsection (b) and shall be accessible to all eligible child care providers, including family child care providers, group home child care providers, and other non-center-based child care providers and providers with limited administrative capacity.</text></clause></subparagraph> 
<subparagraph id="H0ED23CAD3BFD49ECA8308E274A7620FF"><enum>(F)</enum><header>Priority</header><text>In making subgrants under this section, the lead agency shall give priority to qualified child care providers that, prior to or on March 1, 2020—</text> 
<clause id="HC9CA7E0245EF466F813831B0A54C1404"><enum>(i)</enum><text>provided child care during nontraditional hours;</text></clause> 
<clause id="HF1D9C13ADD7845839D8B3D6F0B8F3F03"><enum>(ii)</enum><text>served dual language learners, children with disabilities, children experiencing homelessness, children in foster care, children from low-income families, or infants and toddlers;</text></clause> 
<clause id="H9EB0E4E04DBC4C7484C3E82ACBD08A6E"><enum>(iii)</enum><text>served a high proportion of children whose families received subsidies under the Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9857 et seq.) for the child care; or</text></clause> 
<clause id="H7B2A2A6524CC41EA944154E2F5885881"><enum>(iv)</enum><text>operated in communities, including rural communities, with a low supply of child care.</text></clause></subparagraph> 
<subparagraph id="H740F4AA9F4194D4F87C52B1C9AF1664C"><enum>(G)</enum><header>Providers receiving other assistance</header><text display-inline="yes-display-inline">The lead agency, in determining whether a provider is a qualified child care provider, shall not take into consideration receipt of a payment or reimbursement described in subparagraph (C)(iii) or subparagraph (C)(iv).</text></subparagraph> 
<subparagraph id="H9A7964083E2547488973D3BD876645DE"><enum>(H)</enum><header>Awards</header><text>The lead agency shall equitably make subgrants under this paragraph to center-based child care providers, family child care providers, group home child care providers, and other non-center-based child care providers, such that qualified child care providers are able to access the subgrant opportunity under this paragraph regardless of the providers’ setting, size, or administrative capacity.</text></subparagraph> 
<subparagraph id="H027B96513D6C4C32AB3DB97BB2AD8088"><enum>(I)</enum><header>Obligation</header><text>The lead agency shall obligate at least 50 percent of funds available to carry out this section for subgrants described in this paragraph, by December 31, 2020.</text></subparagraph></paragraph></subsection> 
<subsection id="HC6A78790D82B45018809D1D5A8A5D4C9"><enum>(e)</enum><header>Uses of funds</header> 
<paragraph id="H1F29F59B3501485FA7DDDFE033BEA109"><enum>(1)</enum><header>In general</header><text>A qualified child care provider that receives funds through such a subgrant may use the funds for the costs of—</text> 
<subparagraph id="HC3ECB1829EE048E99AC4A94350776E86"><enum>(A)</enum><text>payroll;</text></subparagraph> 
<subparagraph id="H006877EB14FF489987317CA72F613A42"><enum>(B)</enum><text>employee benefits, including group health plan benefits during periods of paid sick, medical, or family leave, and insurance premiums;</text></subparagraph> 
<subparagraph id="HE3BF22BDE323457998698EBA939A881C"><enum>(C)</enum><text>employee salaries or similar compensation, including any income or other compensation to a sole proprietor or independent contractor that is a wage, commission, income, net earnings from self-employment, or similar compensation; </text></subparagraph> 
<subparagraph id="H13165BFB8AEA4FDA82CB7C2D51915A50"><enum>(D)</enum><text>payment on any mortgage obligation;</text></subparagraph> 
<subparagraph id="H0D6DDAE933574793B1E0D3DB864E01D8"><enum>(E)</enum><text>rent (including rent under a lease agreement);</text></subparagraph> 
<subparagraph id="H1CC3B65C8D434715ADC290277D98AB15"><enum>(F)</enum><text>utilities;</text></subparagraph> 
<subparagraph id="H938855A46B5346B99F74D3266272310D"><enum>(G)</enum><text>insurance;</text></subparagraph> 
<subparagraph id="H21BD6CA8414D4F29AE595F859A6929E1"><enum>(H)</enum><text>providing premium pay for child care providers and other employees who provide services during the COVID–19 public health emergency;</text></subparagraph> 
<subparagraph id="H98F5E58BCFD84DCAB6600843E3D61F17"><enum>(I)</enum><text>sanitization and other costs associated with cleaning;</text></subparagraph> 
<subparagraph id="H3C225A5726DE428CB34D7DCC362AC79F"><enum>(J)</enum><text>personal protective equipment and other equipment necessary to carry out the functions of the child care provider;</text></subparagraph> 
<subparagraph id="H8E71DBFEAF574F819EE304325FAEC989"><enum>(K)</enum><text>training and professional development related to health and safety practices, including the proper implementation of policies in line with guidance from the Centers for Disease Control and Prevention and the corresponding State, tribal, and local authorities, and in accordance with State, tribal, and local orders;</text></subparagraph> 
<subparagraph id="H6AE5138954E5455D91FEC17E513F08A9"><enum>(L)</enum><text>modifications to child care services as a result of the COVID–19 public health emergency, such as limiting group sizes, adjusting staff-to-child ratios, and implementing other heightened health and safety measures; </text></subparagraph> 
<subparagraph id="HD1305AF4B1D544C2B520A62A7BE2ADE3"><enum>(M)</enum><text>mental health supports for children and employees; and</text></subparagraph> 
<subparagraph id="H8EFEF322821547BF94C0C86BA95E8065"><enum>(N)</enum><text>other goods and services necessary to maintain or resume operation of the child care program, or to maintain the viability of the child care provider as a going concern during and after the COVID–19 public health emergency.</text></subparagraph></paragraph> 
<paragraph id="HAAA50DDEA73B4B549B43590484FC8F03" commented="no"><enum>(2)</enum><header>Reimbursement</header><text>The qualified child care provider may use the subgrant funds to reimburse the provider for sums obligated or expended before the date of enactment of this Act for the cost of a good or service described in paragraph (1) to respond to the COVID–19 public health emergency.</text></paragraph></subsection> 
<subsection id="H49A8E506E68F48CFBAD67B5EF9115924"><enum>(f)</enum><header>Reporting</header> 
<paragraph id="H10B76E024CA54927B27C88C644DA2E31"><enum>(1)</enum><header>Initial report</header><text>A lead agency receiving a grant under this section shall, within 60 days after making the agency’s first subgrant under subsection (d)(2) to a qualified child care provider, submit a report to the Secretary that includes—</text> 
<subparagraph id="HCD1205781F3D46C385652EB0C1DDB2CC"><enum>(A)</enum><text>data on qualified child care providers that applied for subgrants and qualified child care providers that received such subgrants, including—</text> 
<clause id="HCE188BF715E6479E931279C42EE3FC4A"><enum>(i)</enum><text>the number of such applicants and the number of such recipients;</text></clause> 
<clause id="HA33C94F5E31448B6A8ECF1F62FB51C1D"><enum>(ii)</enum><text>the number and proportion of such applicants and recipients that received priority and the characteristic or characteristics of such applicants and recipients associated with the priority;</text></clause> 
<clause id="HD70B4F05DD9C40D6B9BCD5E14BCF46A8"><enum>(iii)</enum><text>the number and proportion of such applicants and recipients that are—</text> 
<subclause id="H3CD255F218064AAD81999F3B15C123ED"><enum>(I)</enum><text>center-based child care providers;</text></subclause> 
<subclause id="HCD25680562A04EB2AD380185DB56B561"><enum>(II)</enum><text>family child care providers;</text></subclause> 
<subclause id="H0EB97D3C2386473C93D68D43F4A7B35B"><enum>(III)</enum><text>group home child care providers; or</text></subclause> 
<subclause id="H74A65B88C7E54116AC1E6B099C3FFAC1"><enum>(IV)</enum><text>other non-center-based child care providers; and</text></subclause></clause> 
<clause id="H54CD723BBF964E1C831D2A4F6E03B809"><enum>(iv)</enum><text>within each of the groups listed in clause (iii), the number of such applicants and recipients that are, on the date of submission of the application—</text> 
<subclause id="H4B5121CD843F4FAEB4DA78B3728D0292"><enum>(I)</enum><text>open and available to provide child care services; or</text></subclause> 
<subclause id="HDDDE97FAA04847358E40B225413F5C55"><enum>(II)</enum><text>closed due to the COVID–19 public health emergency;</text></subclause></clause></subparagraph> 
<subparagraph id="H077DA21B360B4A1AA7BDC4E13B4F267E"><enum>(B)</enum><text>the total capacity of child care providers that are licensed, regulated, or registered in the State on the date of the submission of the report;</text></subparagraph> 
<subparagraph id="H27C94347E1434CF58F5538576753E1B1"><enum>(C)</enum><text>a description of—</text> 
<clause id="H536D69BACF0943D3A855914B8F297A00"><enum>(i)</enum><text>the efforts of the lead agency to publicize the availability of subgrants under this section and conduct widespread outreach to eligible child care providers about such subgrants, including efforts to make materials available in languages other than English;</text></clause> 
<clause id="HC86014CE69D941368009806D76981200"><enum>(ii)</enum><text>the lead agency’s methodology for determining amounts of subgrants under subsection (d)(2);</text></clause> 
<clause id="HA98C2601B661431EA3F3D26FDAC385DD"><enum>(iii)</enum><text>the lead agency’s timeline for disbursing the subgrant funds; and</text></clause> 
<clause id="H48DFD9E826974DD6B4205F7D9113315A"><enum>(iv)</enum><text>the lead agency’s plan for ensuring that qualified child care providers that receive funding through such a subgrant comply with assurances described in subsection (d)(2)(D) and use funds in compliance with subsection (e); and</text></clause></subparagraph> 
<subparagraph id="HBDD2EB69D570496BA023B2E20EE1D5BB"><enum>(D)</enum><text>such other limited information as the Secretary may require.</text></subparagraph></paragraph> 
<paragraph id="HEB0692AE48BA4E9EA4041562AEE199C3"><enum>(2)</enum><header>Quarterly report</header><text>The lead agency shall, following the submission of such initial report, submit to the Secretary a report that contains the information described in subparagraphs (A), (B), and (D) of paragraph (1) once a quarter until all funds allotted for activities authorized under this section are expended.</text></paragraph> 
<paragraph id="H136F7630ABDB4108ADEC1BEF4F9D8573"><enum>(3)</enum><header>Final report</header><text>Not later than 60 days after a lead agency receiving a grant under this section has obligated all of the grant funds (including funds received under subsection (h)), the lead agency shall submit a report to the Secretary, in such manner as the Secretary may require, that includes—</text> 
<subparagraph id="H0526191A5CCA46ED8075D627F81B6202"><enum>(A)</enum><text>the total number of eligible child care providers who were providing child care services on or before March 1, 2020, in the State and the number of such providers that submitted an application under subsection (d)(2)(D);</text></subparagraph> 
<subparagraph id="HE83DF3469E014B8C922A80799E0DA554"><enum>(B)</enum><text>the number of qualified child care providers in the State that received funds through the grant;</text></subparagraph> 
<subparagraph id="HF608D183D319487397FF28173A3D7973"><enum>(C)</enum><text>the lead agency’s methodology for determining amounts of subgrants under subsection (d)(2);</text></subparagraph> 
<subparagraph id="H7B9C9844EBCE4EFCB9F732376E7113EA"><enum>(D)</enum><text>the average and range of the subgrant amounts by provider type (center-based child care, family child care, group home child care, or other non-center-based child care provider);</text></subparagraph> 
<subparagraph id="H02435EC566514421A1669CFBAC3904F3"><enum>(E)</enum><text>the percentages of the child care providers that received such a subgrant, that, on or before March 1, 2020—</text> 
<clause id="H3F76FDEEC2824678A5C8C40FC46A4270"><enum>(i)</enum><text>provided child care during nontraditional hours;</text></clause> 
<clause id="H45BE58383CEE4B78AC6F98281E912418"><enum>(ii)</enum><text>served dual language learners, children with disabilities, children experiencing homelessness, children in foster care, children from low-income families, or infants and toddlers;</text></clause> 
<clause id="H086ECD7E5F5348F4AB82E41E955FB3FA"><enum>(iii)</enum><text>served a high proportion of children whose families received subsidies under the Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9857 et seq.) for the child care; and</text></clause> 
<clause id="HFAD06E664619485090DEA813994D3069"><enum>(iv)</enum><text>operated in communities, including rural communities, with a low supply of child care;</text></clause></subparagraph> 
<subparagraph id="HEDB7C9DC41624800951D002EA28F7912"><enum>(F)</enum><text>the number of children served by the child care providers that received such a subgrant, for the duration of the subgrant;</text></subparagraph> 
<subparagraph id="HDFBFFF886C68471E8208E5353174EF08"><enum>(G)</enum><text>the percentages, of the child care providers that received such a subgrant, that are—</text> 
<clause id="H9EEDCF2E0EDC4E9CA64376F7B51F1297"><enum>(i)</enum><text>center-based child care providers;</text></clause> 
<clause id="H9B2BD0471B51491D83A0A7C01535973E"><enum>(ii)</enum><text>family child care providers;</text></clause> 
<clause id="H2F6BE59866F34A329AA2D939F9B442C3"><enum>(iii)</enum><text>group home child care providers; or</text></clause> 
<clause id="H85BE0B90B1794B37BCFC0E8660AE713F"><enum>(iv)</enum><text>other non-center-based child care providers;</text></clause></subparagraph> 
<subparagraph id="H8BFE6E7EA05B4F019BC6CFE0989E7D47"><enum>(H)</enum><text>the percentages, of the child care providers listed in subparagraph (G) that are, on the date of submission of the application—</text> 
<clause id="H22453A6B5C8543E89587BF2785E759ED"><enum>(i)</enum><text>open and available to provide child care services; or</text></clause> 
<clause id="H3610F45D97C4491D991185FCDE9667D6"><enum>(ii)</enum><text>closed due to the COVID–19 public health emergency;</text></clause></subparagraph> 
<subparagraph id="H754AF77EA0534853BC5613FA213FF553"><enum>(I)</enum><text>information about how child care providers used the funds received under such a subgrant; </text></subparagraph> 
<subparagraph id="H4D44BB21CB37410092DAA8BC72A65303"><enum>(J)</enum><text>information about how the lead agency used funds reserved under subsection (d)(1); and</text></subparagraph> 
<subparagraph id="H4BA13FB4B6814F0AA4CD2A1182DD10BA"><enum>(K)</enum><text>information about how the subgrants helped to stabilize the child care sector.</text></subparagraph></paragraph> 
<paragraph id="H69CC4F9BE0934D7E8ECAC130E46A623E"><enum>(4)</enum><header>Reports to Congress</header> 
<subparagraph id="H565AF3ED098F45ADB1F61DC6A450806A"><enum>(A)</enum><header>Findings from initial reports</header><text display-inline="yes-display-inline">Not later than 60 days after receiving all reports required to be submitted under paragraph (1), the Secretary shall provide a report to the Committee on Education and Labor of the House of Representatives, to the Committee on Health, Education, Labor and Pensions of the Senate, and to the Committees on Appropriations of the House of Representatives and the Senate, summarizing the findings from the reports received under paragraph (1).</text></subparagraph> 
<subparagraph id="H117099BAD4664181BF4D664068D193F6"><enum>(B)</enum><header>Findings from final reports</header><text display-inline="yes-display-inline">Not later than 36 months after the date of enactment of this Act, the Secretary shall provide a report to the Committee on Education and Labor of the House of Representatives, to the Committee on Health, Education, Labor and Pensions of the Senate, and to the Committees on Appropriations of the House of Representatives and the Senate, summarizing the findings from the reports received under paragraph (3).</text></subparagraph></paragraph></subsection> 
<subsection id="HDEEE23C0B82843F8B8D14FE441EF9741"><enum>(g)</enum><header>Supplement not supplant</header><text>Amounts made available to carry out this section shall be used to supplement and not supplant other Federal, State, and local public funds expended to provide child care services for eligible individuals, including funds provided under the Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9857 et seq.) and State child care programs.</text></subsection> 
<subsection id="H923D635703A94D989DCEC7477152D46F"><enum>(h)</enum><header>Reallotment of unobligated funds</header> 
<paragraph id="H5A49F5D064EC4E4C84DAA5FB9BCD9377"><enum>(1)</enum><header>Unobligated funds</header><text>A State, Indian tribe, or tribal organization shall return to the Secretary any grant funds received under this section that the State, Indian tribe, or tribal organization does not obligate by September 30, 2021.</text></paragraph> 
<paragraph id="H789BD0CD233F4F928E052B3B4BFBE23C"><enum>(2)</enum><header>Reallotment</header><text display-inline="yes-display-inline">The Secretary shall award new allotments and payments, in accordance with subsection (c)(2), to covered States, Indian tribes, or tribal organizations from funds that are returned under paragraph (1) within 60 days of receiving such funds. Funds made available through the new allotments and payments shall remain available to each covered State, Indian tribe, or tribal organization until September 30, 2022.</text></paragraph> 
<paragraph id="H3D7E12528D364F83927F938D40F5CE6B"><enum>(3)</enum><header>Covered State, Indian tribe, or tribal organization</header><text>For purposes of paragraph (2), a covered State, Indian tribe, or tribal organization is a State, Indian tribe, or tribal organization that received an allotment or payment under this section and was not required to return grant funds under paragraph (1).</text></paragraph></subsection> 
<subsection id="H95E29E6C68444ACB9C16F7629A661E3E"><enum>(i)</enum><header>Exceptions</header><text display-inline="yes-display-inline">The Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9857 et seq.), excluding requirements in subparagraphs (C) through (E) of section 658E(c)(3), section 658G, and section 658J(c) of such Act (42 U.S.C. 9858c(c)(3), 9858e, 9858h(c)), shall apply to child care services provided under this section to the extent the application of such Act does not conflict with the provisions of this section. Nothing in this Act shall be construed to require a State, Indian tribe, or tribal organization to submit an application, other than the application described in section 658E or 658O(c) of the Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9858c, 9858m(c)), to receive a grant under this Act.</text></subsection> 
<subsection id="H62E1C2EB48614198B763E4DD81567C3B"><enum>(j)</enum><header>Authorization of appropriation</header> 
<paragraph id="HFA30BBDDFD7C4FE0B9700EB8D67A1654"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this Act $50,000,000,000 for fiscal year 2020. </text></paragraph> 
<paragraph id="H466608FAC4CC4D4FAFA88D23C1FEE296"><enum>(2)</enum><header>Application</header><text>In carrying out the Child Care and Development Block Grant Act of 1990 with funds other than the funds appropriated under paragraph (1), the Secretary shall calculate the amounts of appropriated funds described in subsections (a) and (b) of section 658O of such Act (42 U.S.C. 9858m) by excluding funds appropriated under paragraph (1). </text></paragraph></subsection></section> 
<section id="HEB7FABB9399D4815B8D0F89780193011"><enum>2.</enum><text display-inline="yes-display-inline">Each amount appropriated or made available by this Act is in addition to any amounts otherwise appropriated for the fiscal year involved.</text></section> 
<section id="H32AE7AE94BBF47D294E8291CC6F19B7C"><enum>3.</enum><text display-inline="yes-display-inline">Unless otherwise provided for by this Act, the additional amounts appropriated by this Act to appropriations accounts shall be available under the authorities and conditions applicable to such appropriations accounts for fiscal year 2020.</text></section>
