<section id="H91F3C2405AEA423C834C2A1D1DD30EE9" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Delivering for America Act</quote>. </text></section> 
<section id="HBAFE4B97B8CF4977855BBB27DA101A2F"><enum>2.</enum><header>Prompt and reliable postal services during COVID-19 pandemic</header> 
<subsection id="H3A0A83EEA3ED45D5AF1E6D0EAA9F7445"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">During the period beginning on the date of enactment of this Act and ending on the last day of the COVID-19 public health emergency or January 31, 2021, whichever is later, the United States Postal Service may not implement or approve any change to the operations or the level of service provided by the Postal Service from those in effect on January 1, 2020, that would reduce service performance or impede prompt, reliable, and efficient services, including any of the following actions:</text> 
<paragraph id="HA2C79AB5606B42B585F2ABF04931A4FA"><enum>(1)</enum><text>Any change in the nature of postal services which will generally affect service on a nationwide or substantially nationwide basis.</text></paragraph> 
<paragraph id="HB5490690F5714B318367157E119C7E4F"><enum>(2)</enum><text>Any revision of service standards.</text></paragraph> 
<paragraph id="H50DB373B386C4DD1A8284CDC3AF4B82D"><enum>(3)</enum><text display-inline="yes-display-inline">Any closure or consolidation of any post office or postal facility, or any reduction of such office or facility hours.</text></paragraph> 
<paragraph id="H45ABCD911EAA4BF1A5574F6926D10C68"><enum>(4)</enum><text display-inline="yes-display-inline">Any prohibition or restriction on the use of overtime or overtime pay to Postal Service officers or employees.</text></paragraph> 
<paragraph id="H2621B6392CE04977AD48D87CE0758CB4"><enum>(5)</enum><text>Any change that would prevent the Postal Service from meeting its service standards or cause a decline in measurements of performance relative to those service standards.</text></paragraph> 
<paragraph id="H592761C97D2F45D3A76EE90B37A99CBF"><enum>(6)</enum><text>Any change that would have the effect of delaying deferring, or curtailing mail, allowing for the non-delivery of mail to a delivery route, or increasing the volume of undelivered mail.</text></paragraph> 
<paragraph id="H7304916E67CC4A44A3118AD5B9D90506"><enum>(7)</enum><text display-inline="yes-display-inline">Treating election mail as any class of mail other than first-class mail, regardless of whether such treatment requires payment of overtime pay to officers or employees of the Postal Service.</text></paragraph> 
<paragraph id="HA5620BA1E29B4B66940CBC2552DD58DB"><enum>(8)</enum><text display-inline="yes-display-inline">Removing, decommissioning, or any other stoppage of mail sorting machines, other than for routine maintenance.</text></paragraph> 
<paragraph id="HD5D46B2E1A6E432ABA579111F96554EE"><enum>(9)</enum><text display-inline="yes-display-inline">Removing or eliminating any mail collection box that is available to the public.</text></paragraph> 
<paragraph id="HF65AA461A624465D9102B05E1392D6DB"><enum>(10)</enum><text display-inline="yes-display-inline">Enacting any rule, policy, or standard the purpose or effect of which would delay the delivery of mail to or from a government entity.</text></paragraph> 
<paragraph id="H37347CCA50864E329B3AE0EDEFFA5525"><enum>(11)</enum><text>Instituting any hiring freeze.</text></paragraph></subsection> 
<subsection id="H8EE71000B18242468F937A39D1E4CA03"><enum>(b)</enum><header>Reversal of policies hindering delivery of mail</header><text>The United States Postal Service shall reverse any initiative or action that is causing delay in processing or delivery or non-delivery of the mail.</text></subsection> 
<subsection id="H80ED890EA6DD48CE83A16EE358D7F0FF"><enum>(c)</enum><header>Election mail</header> 
<paragraph id="HD6B55A1A7E284561AF8BBE774FC547FB"><enum>(1)</enum><header>Policy on postmarks</header><text>It shall be the policy of the United States Postal Service to postmark, which shall include any imprinted indicia from the Postal Service that indicates the date of receipt, all election mail processed by the Postal Service.</text></paragraph> 
<paragraph id="H8C27351916144D7988D5F6064F0C67E2"><enum>(2)</enum><header>Same-day processing</header><text display-inline="yes-display-inline">The United States Postal Service shall ensure, to the maximum extent practical, that election mail is processed and cleared from any postal facility or post office on the same day it is received at such a facility or post office.</text></paragraph></subsection> 
<subsection id="H122E402FF0744171AC356C6ECA68C504"><enum>(d)</enum><header>Private right of action</header><text display-inline="yes-display-inline">A person who is harmed by a violation of this Act may bring a civil action against the Postal Service in an appropriate district court for injunctive and declaratory relief with respect to the violation.</text></subsection> 
<subsection id="HBCE2981A030A4BBAA360244FF3915AAB"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text> 
<paragraph id="H5C8DD6D57F5A49E6AD6E356E30C414F8"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>COVID–19 public health emergency</quote> means the public health emergency declared by the Secretary of Health and Human Services on January 27, 2020, with respect to the 2019 Novel Coronavirus; </text></paragraph> 
<paragraph id="H2BC19668BC5E4F898572EC9D55842570"><enum>(2)</enum><text>the term <quote>election mail</quote> means mail consisting of—</text> 
<subparagraph id="H803A53235E7D4A5083E96F585C601875"><enum>(A)</enum><text display-inline="yes-display-inline">voter registration application forms, completed voter registration application forms, and voter registration cards or similar materials;</text></subparagraph> 
<subparagraph id="H2C9E74AC462248D28F8235DEE61424E5"><enum>(B)</enum><text display-inline="yes-display-inline">absentee and other mail-in ballot application forms, blank absentee and other mail-in ballots, and completed absentee and other mail-in ballots; and</text></subparagraph> 
<subparagraph id="HEFA4139F0ED0455FA779EBE9CB3B1A66"><enum>(C)</enum><text display-inline="yes-display-inline">other materials relating to an election which are mailed by a State or local election official to individuals who are registered to vote in the election; and</text></subparagraph></paragraph> 
<paragraph id="H339779600850467E8D38308E5EA03575"><enum>(3)</enum><text>the term <quote>government entity</quote> means the Federal Government or any State (as that term is defined in section 311 of title 5, United States Code) or local government and any subdivision thereof.</text></paragraph></subsection></section> 
<section id="H919B556A530D4EEF9CDF342448C91604"><enum>3.</enum><header>Additional appropriation for the Postal Service</header><text display-inline="no-display-inline">There is appropriated, out of any money in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2020, for an additional payment to the Postal Service Fund (established under section 2003 of title 39, United States Code), $25,000,000,000, to remain available until expended. Of the amount appropriated in the previous sentence, $15,000,000 shall be transferred to <quote>United States Postal Service—Office of Inspector General—Salaries and Expenses</quote>. </text></section> 
<section id="HA423FEE720824700AAFA225306E38B71"><enum>4.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to alter or otherwise effect the terms and conditions of section 3406 of title 39, United States Code (relating to balloting materials under the Uniformed and Overseas Citizens Absentee Voting Act).</text></section> 
<section id="HE1667268D3F5433F8F38EDE81398FFC2"><enum>5.</enum><header>Budgetary effects</header> 
<subsection id="H71E9CA94792A4F6AB6B0F0F515695BCA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The amounts provided by this Act are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (2 U.S.C. 933(g)).</text></subsection> 
<subsection id="H92A4F5BADA6148538EC7527D9551493E"><enum>(b)</enum><header>Designation in the Senate</header><text display-inline="yes-display-inline">In the Senate, this Act is designated as an emergency requirement pursuant to section 4112(a) of H. Con. Res. 71 (115th Congress), the concurrent resolution on the budget for fiscal year 2018.</text></subsection></section>
