<official-title display="yes">Authorizing remote voting by proxy in the House of Representatives and providing for official remote committee proceedings during a public health emergency due to a novel coronavirus, and for other purposes.</official-title>

<section display-inline="no-display-inline" section-type="section-one" id="H84520FE99CF14A1E9E34D68021BB9DAF"><enum>1.</enum><header>Authorization of remote voting by proxy during public health emergency due to novel coronavirus</header> 
<subsection id="HDA1B2944867D423480374C74A0F797D4"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">Notwithstanding rule III, at any time after the Speaker or the Speaker’s designee is notified by the Sergeant-at-Arms, in consultation with the Attending Physician, that a public health emergency due to a novel coronavirus is in effect, the Speaker or the Speaker’s designee, in consultation with the Minority Leader or the Minority Leader’s designee, may designate a period (hereafter in this resolution referred to as a <quote>covered period</quote>) during which a Member who is designated by another Member as a proxy in accordance with section 2 may cast the vote of such other Member or record the presence of such other Member in the House.</text></subsection> 
<subsection id="H73AC32CBD47D4AB790D7B93655EA9DF3"><enum>(b)</enum><header>Length of covered period</header> 
<paragraph id="H56A6FF80C5904CC0B6DFB3D5938CE564"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraphs (2) and (3), a covered period shall terminate 45 days after the Speaker or the Speaker’s designee designates such period.</text></paragraph> 
<paragraph id="H8C4780D0FF0542958A054426DA5D4FDF"><enum>(2)</enum><header>Extension</header><text display-inline="yes-display-inline">If, during a covered period, the Speaker or the Speaker’s designee receives further notification from the Sergeant-at-Arms, in consultation with the Attending Physician, that the public health emergency due to a novel coronavirus remains in effect, the Speaker or the Speaker’s designee, in consultation with the Minority Leader or the Minority Leader’s designee, may extend the covered period for an additional 45 days.</text></paragraph> 
<paragraph id="H5D6D422237B349608C5DCF9A044501F0"><enum>(3)</enum><header>Early termination</header><text display-inline="yes-display-inline">If, during a covered period, the Speaker or the Speaker’s designee receives further notification by the Sergeant-at-Arms, in consultation with the Attending Physician, that the public health emergency due to a novel coronavirus is no longer in effect, the Speaker or the Speaker’s designee shall terminate the covered period.</text></paragraph></subsection></section> 
<section id="HF817B20057FA4D06983F8F6413941CD1"><enum>2.</enum><header>Process for designation of proxies</header> 
<subsection id="HD7A628EA9F92414F8D1D97A1A86D491F"><enum>(a)</enum><header>In general</header> 
<paragraph id="HF86F753D61EB460DA5C2A2DC929CABC9"><enum>(1)</enum><header>Designation by signed letter</header><text display-inline="yes-display-inline">In order for a Member to designate another Member as a proxy for purposes of section 1, the Member shall submit to the Clerk a signed letter (which may be in electronic form) specifying by name the Member who is designated for such purposes.</text></paragraph> 
<paragraph id="HFBACC5E4F4DF497993729BC2EB26137D"><enum>(2)</enum><header>Alteration or revocation of designation</header> 
<subparagraph id="H30D8027751C34F83924D0BA1F3F04A95"><enum>(A)</enum><header>In general</header><text>At any time after submitting a letter to designate a proxy under paragraph (1), a Member may submit to the Clerk a signed letter (which may be in electronic form) altering or revoking the designation.</text></subparagraph> 
<subparagraph id="H06405F7A91AB4634A995EE949B364203"><enum>(B)</enum><header>Automatic revocation upon casting of vote or recording of presence</header><text>If during a covered period, a Member who has designated another Member as a proxy under this section casts the Member’s own vote or records the Member’s own presence in the House, the Member shall be considered to have revoked the designation of any proxy under this subsection with respect to such covered period.</text></subparagraph></paragraph> 
<paragraph id="HB1B23C0BE90D4165B1DC8D283F79C7ED"><enum>(3)</enum><header>Notification</header><text>Upon receipt of a letter submitted by a Member pursuant to paragraphs (1) or (2), the Clerk shall notify the Speaker, the Majority Leader, the Minority Leader, and the other Member or Members involved of the designation, alteration, or revocation.</text></paragraph> 
<paragraph id="HA5F432628E034024B696A3319CF5073B"><enum>(4)</enum><header>Limitation</header><text display-inline="yes-display-inline">A Member may not be designated as a proxy under this section for more than 10 Members concurrently.</text></paragraph></subsection> 
<subsection id="HE118C72F4C3B4A08B253EFDB0976BA44"><enum>(b)</enum><header>Maintenance and availability of list of designations</header><text>The Clerk shall maintain an updated list of the designations, alterations, and revocations submitted or in effect under subsection (a), and shall make such list publicly available in electronic form and available during any vote conducted pursuant to section 3.</text></subsection></section> 
<section id="H7557E2E4177D44FC9C993C233170E084"><enum>3.</enum><header>Process for voting during covered periods</header> 
<subsection id="H1CF120003F21403AA0784DC8B86AC250"><enum>(a)</enum><header>Recorded votes ordered</header> 
<paragraph id="H373D82D110B84F6DAC4C90C7895B8DE1"><enum>(1)</enum><header>In general</header><text>Notwithstanding clause 6 of rule I, during a covered period, the yeas and nays shall be considered as ordered on any vote on which a recorded vote or the yeas and nays are requested, or which is objected to under clause 6 of rule XX.</text></paragraph> 
<paragraph id="H5F6D7C6574674088B28E132C35DD62E3"><enum>(2)</enum><header>Indications of proxy status</header><text display-inline="yes-display-inline">In the case of a vote by electronic device, a Member who casts a vote or records a presence as a designated proxy for another Member under this resolution shall do so by ballot card, indicating on the ballot card <quote>by proxy</quote>.</text></paragraph></subsection> 
<subsection id="H4BE3F37315AA4E49B5C869DAC9CD3BE8"><enum>(b)</enum><header>Determination of quorum</header><text>Any Member whose vote is cast or whose presence is recorded by a designated proxy under this resolution shall be counted for the purpose of establishing a quorum under the rules of the House.</text></subsection> 
<subsection id="H18681EA497254CC3911D177F1CEADD8B"><enum>(c)</enum><header>Instructions from member authorizing proxy</header> 
<paragraph id="H49D6561D2FA746DD9F1F5DF4F08F4A15"><enum>(1)</enum><header>Receiving instructions</header><text display-inline="yes-display-inline">Prior to casting the vote or recording the presence of another Member as a designated proxy under this resolution, the Member shall obtain an exact instruction from the other Member with respect to such vote or quorum call, in accordance with the regulations referred to in section 6.</text></paragraph> 
<paragraph id="HD78C187165AD4BAABBEE5DEF9D85B7B4"><enum>(2)</enum><header>Announcing instructions</header><text display-inline="yes-display-inline">Immediately prior to casting the vote or recording the presence of another Member as a designated proxy under this resolution, the Member shall seek recognition from the Chair to announce the intended vote or recorded presence pursuant to the exact instruction received from the other Member under paragraph (1).</text></paragraph> 
<paragraph id="H9373FF5909B84DA8BCC4B311349236FA"><enum>(3)</enum><header>Following instructions</header><text>A Member casting the vote or recording the presence of another Member as a designated proxy under this resolution shall cast such vote or record such presence pursuant to the exact instruction received from the other Member under paragraph (1).</text></paragraph></subsection></section> 
<section id="H6C8C650D269B415A87E481CC92723EA5"><enum>4.</enum><header>Authorizing remote proceedings in committees</header> 
<subsection id="H4F87E123E7B64D0C89451EF2838CF758"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">During any covered period, and notwithstanding any rule of the House or its committees—</text> 
<paragraph id="HC14297A7FD3B48A689AD2AAF139C8211"><enum>(1)</enum><text>any committee may conduct proceedings remotely in accordance with this section, and any such proceedings conducted remotely shall be considered as official proceedings for all purposes in the House;</text></paragraph> 
<paragraph id="HF27A678E493B4B0DBF28EC92DC92C742"><enum>(2)</enum><text display-inline="yes-display-inline">committee members may participate remotely during in-person committee proceedings, and committees shall, to the greatest extent practicable, ensure the ability of members to participate remotely;</text></paragraph> 
<paragraph id="H8EBE72ECB74341BEA0E743130C31ABDD"><enum>(3)</enum><text>committee members may cast a vote or record their presence while participating remotely;</text></paragraph> 
<paragraph id="H18FF6CB5529A4E29B08D89C00743198D"><enum>(4)</enum><text>committee members participating remotely pursuant to this section shall be counted for the purpose of establishing a quorum under the rules of the House and the committee;</text></paragraph> 
<paragraph id="H33C9774BAFAD4EB88E2CF41AD0B1B64C"><enum>(5)</enum><text>witnesses at committee proceedings may appear remotely;</text></paragraph> 
<paragraph id="HA767BC9236354123B1284EED5FE4170C"><enum>(6)</enum><text display-inline="yes-display-inline">committee proceedings conducted remotely are deemed to satisfy the requirement of a “place” for purposes of clauses 2(g)(3) and 2(m)(1) of rule XI; and</text></paragraph> 
<paragraph id="HBBE09DF3B66A42F39FF4D0166700ED70"><enum>(7)</enum><text display-inline="yes-display-inline">reports of committees (including those filed as privileged) may be delivered to the Clerk in electronic form, and written and signed views under clause 2(l) of rule XI may be filed in electronic form with the clerk of the committee.</text></paragraph></subsection> 
<subsection id="H526F6674C9684D488868E8C0A3549ADF"><enum>(b)</enum><header>Limitation on business meetings</header><text display-inline="yes-display-inline">A committee shall not conduct a meeting remotely or permit remote participation at a meeting under this section until a member of the committee submits for printing in the Congressional Record a letter from a majority of the members of the committee notifying the Speaker that the requirements for conducting a meeting in the regulations referred to in subsection (h) have been met and that the committee is prepared to conduct a remote meeting and permit remote participation.</text></subsection> 
<subsection id="HBF79B8D004E640EF8FC75D8DE0C80D28"><enum>(c)</enum><header>Remote proceedings</header><text display-inline="yes-display-inline">Notwithstanding any rule of the House or its committees, during proceedings conducted remotely pursuant to this section—</text> 
<paragraph id="HC529F5E42A334716A2B59FB5BB1B6849"><enum>(1)</enum><text display-inline="yes-display-inline">remote participation shall not be considered absence for purposes of clause 5(c) of rule X or clause 2(d) of rule XI;</text></paragraph> 
<paragraph id="H6FB7A0B9CFCF453AB0E14C4110BFC250"><enum>(2)</enum><text>the chair may declare a recess subject to the call of the chair at any time to address technical difficulties with respect to such proceedings;</text></paragraph> 
<paragraph id="HAD1121EF3C294723B7ED1A1BF8A6E070"><enum>(3)</enum><text>copies of motions, amendments, measures, or other documents submitted to the committee in electronic form as prescribed by the regulations referred to in subsection (h) shall satisfy any requirement for the submission of printed or written documents under the rules of the House or its committees;</text></paragraph> 
<paragraph id="H6E307CB2E3CC47839B69AA2FEEE64370"><enum>(4)</enum><text>the requirement that results of recorded votes be made available by the committee in its offices pursuant to clause 2(e)(1)(B)(i) of rule XI shall not apply;</text></paragraph> 
<paragraph id="H583FFAFF9EAF490F949D4A5BA736FCA1"><enum>(5)</enum><text>a committee may manage the consideration of amendments pursuant to the regulations referred to in subsection (h);</text></paragraph> 
<paragraph id="H79859032E4534191A9DB573D4C4D5B61"><enum>(6)</enum><text>counsel shall be permitted to accompany witnesses at a remote proceeding in accordance with the regulations referred to in subsection (h); and</text></paragraph> 
<paragraph id="H7668F6062C7F4959A8BD69A07DEA4D11"><enum>(7)</enum><text>an oath may be administered to a witness remotely for purposes of clause 2(m)(2) of rule XI.</text></paragraph></subsection> 
<subsection id="H5E85A3D685154F1D99506C277B642CD8"><enum>(d)</enum><header>Remote participants during in-person proceedings</header><text display-inline="yes-display-inline">All relevant provisions of this section and the regulations referred to in subsection (h) shall apply to committee members participating remotely during in-person committee proceedings held during any covered period.</text></subsection> 
<subsection id="H519D947588B048669586F210A56158B3"><enum>(e)</enum><header>Transparency for meetings and hearings</header><text display-inline="yes-display-inline">Any committee meeting or hearing that is conducted remotely in accordance with the regulations referred to in subsection (h)—</text> 
<paragraph id="H2539F923A04F45A6B99120761081FA71"><enum>(1)</enum><text display-inline="yes-display-inline">shall be considered open to the public;</text></paragraph> 
<paragraph id="H71927C155FBF4949B5418C03F32599A5"><enum>(2)</enum><text>shall be deemed to have satisfied the requirement for non-participatory attendance under clause 2(g)(2)(C) of rule XI; and</text></paragraph> 
<paragraph id="H641A5700C82348F9B68DF48513DA386D"><enum>(3)</enum><text>shall be deemed to satisfy all requirements for broadcasting and audio and visual coverage under rule V, clause 4 of rule XI, and accompanying committee rules.</text></paragraph></subsection> 
<subsection id="HBA10321569804DA180C96112FEE102B3"><enum>(f)</enum><header>Subpoenas</header> 
<paragraph id="H7E35FF95CE2D4CCDB27AF52E6AE04E54"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">Any committee or chair thereof empowered to authorize and issue subpoenas may authorize and issue subpoenas for return at a hearing or deposition to be conducted remotely under this section.</text></paragraph> 
<paragraph id="H58A6539F81E245E187FCD09C2D366FBD"><enum>(2)</enum><header>Use of electronic signature and seal</header><text display-inline="yes-display-inline">During any covered period, authorized and issued subpoenas may be signed in electronic form; and the Clerk may attest and affix the seal of the House to such subpoenas in electronic form.</text></paragraph></subsection> 
<subsection id="HD63FEFB86E2C487B9DA9D4BD1D2A134F"><enum>(g)</enum><header>Executive sessions</header> 
<paragraph id="HF4FFC2383BF74BE397F4BC8C6F0A0460"><enum>(1)</enum><header>Prohibition</header><text>A committee may not conduct closed or executive session proceedings remotely, and members may not participate remotely in closed or executive session proceedings.</text></paragraph> 
<paragraph id="H05E5F1111591461EBD25738DD5EECD4E"><enum>(2)</enum><header>Motion to close proceedings</header><text display-inline="yes-display-inline">Upon adoption of a motion to close proceedings or to move into executive session with respect to a proceeding conducted remotely under this section, the chair shall declare the committee in recess subject to the call of the chair with respect to such matter until it can reconvene in person.</text></paragraph> 
<paragraph id="H727745E7893F4DF4AA0648CFF43FEE96"><enum>(3)</enum><header>Exception</header><text>Paragraphs (1) and (2) do not apply to proceedings of the Committee on Ethics.</text></paragraph></subsection> 
<subsection id="H62ECFD4DF6C642E2BB8E893D9588BFB7"><enum>(h)</enum><header>Regulations</header><text display-inline="yes-display-inline">This section shall be carried out in accordance with regulations submitted for printing in the Congressional Record by the chair of the Committee on Rules. </text></subsection> 
<subsection id="HE3D0CBCE92FD41C985EB272AEF0C91E4"><enum>(i)</enum><header>Application to subcommittees and select committees</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>committee</term> or <term>committees</term> also includes a subcommittee and a select committee.</text></subsection></section> 
<section id="HF0EE25D223DA46088BBFE6C4A005EF90"><enum>5.</enum><header>Study and certification of feasibility of remote voting in House</header> 
<subsection id="H6EC02A71D46A4BB186209B83F0B826BF"><enum>(a)</enum><header>Study and certification</header><text display-inline="yes-display-inline">The chair of the Committee on House Administration, in consultation with the ranking minority member, shall study the feasibility of using technology to conduct remote voting in the House, and shall provide certification to the House upon a determination that operable and secure technology exists to conduct remote voting in the House.</text></subsection> 
<subsection id="H8B72D62ECD1A46078500861E11B9BED0"><enum>(b)</enum><header>Regulations</header> 
<paragraph id="H3E1FF89F571C4F5DBA972FA56C6D4828"><enum>(1)</enum><header>Initial regulations</header><text>On any legislative day that follows the date on which the chair of the Committee on House Administration provides the certification described in subsection (a), the chair of the Committee on Rules, in consultation with the ranking minority member, shall submit regulations for printing in the Congressional Record that provide for the implementation of remote voting in the House.</text></paragraph> 
<paragraph id="H396801F7F488417C99167720D6928ABF"><enum>(2)</enum><header>Supplemental regulations</header><text>At any time after submitting the initial regulations under paragraph (1), the chair of the Committee on Rules, in consultation with the ranking minority member, may submit regulations to supplement the initial regulations submitted under such paragraph for printing in the Congressional Record.</text></paragraph></subsection> 
<subsection id="HC9B6AA08351445E483DF9FFD731BAA16"><enum>(c)</enum><header>Implementation</header><text>Notwithstanding any rule of the House, upon notification of the House by the Speaker after the submission of regulations by the chair of the Committee on Rules under subsection (b)—</text> 
<paragraph id="H22F201A3DCA24A62A36E6CD9D73EF476"><enum>(1)</enum><text display-inline="yes-display-inline">Members may cast their votes or record their presence in the House remotely during a covered period;</text></paragraph> 
<paragraph id="HD8E781553ACD4BDCA6D9705CA4654E07"><enum>(2)</enum><text display-inline="yes-display-inline">any Member whose vote is cast or whose presence is recorded remotely under this section shall be counted for the purpose of establishing a quorum under the rules of the House; and</text></paragraph> 
<paragraph id="H3CE6F679866242BF93FF126643E49538"><enum>(3)</enum><text>the casting of votes and the recording of presence remotely under this section shall be subject to the applicable regulations submitted by the chair of the Committee on Rules under subsection (b).</text></paragraph></subsection></section> 
<section id="HA6066A2CB73D434189F67F576DDFDC92"><enum>6.</enum><header>Regulations</header><text display-inline="no-display-inline">To the greatest extent practicable, sections 1, 2, and 3 of this resolution shall be carried out in accordance with regulations submitted for printing in the Congressional Record by the chair of the Committee on Rules.</text></section>
