<subparagraph id="H1CF4BF7954E24AF28BC1216FB8A8F091"><enum>(B)</enum><text>$6,922,645,000 for fiscal year 2013; and</text></subparagraph> 
<subparagraph id="HEE2F036260F24BAEA4A98AB41416D79E"><enum>(C)</enum><text>$7,018,499,000 for fiscal year 2014;</text></subparagraph><continuation-text continuation-text-level="paragraph">of which $24,500,000 is authorized for each of the fiscal years 2012, 2013, and 2014 to be derived from the Oil Spill Liability Trust Fund to carry out the purposes of section 1012(a)(5) of the Oil Pollution Act of 1990 (33 U.S.C. 2712(a)(5)).</continuation-text></paragraph>

<subparagraph id="H1A4DF6128BDB4067AB5BB6BD02930617"><enum>(A)</enum><text>$19,779,000 for fiscal year 2012;</text></subparagraph>

<section id="H7C5D87BD9E58487FA01CFADE1222B4F3"><enum>102.</enum><header>Authorized levels of military strength and training</header> 
<subsection id="H645FB5D336D94515BEFA7FA87ACAD3A6"><enum>(a)</enum><header>Active duty strength</header><text>The Coast Guard is authorized an end-of-year strength for active duty personnel of 47,000 for each of the fiscal years 2012 through fiscal year 2014.</text></subsection> 
<subsection id="HF296DEAA3EDF42ACA0B8BFC12EF2B4F3"><enum>(b)</enum><header>Military training student loads</header><text>The Coast Guard is authorized average military training student loads for the each of the fiscal years 2012 through fiscal year 2014 as follows:</text> 
<paragraph id="HF8DF503E4B9A4C608E1E3A5FD8EFD26E"><enum>(1)</enum><text>For recruit and special training, 2,500 student years.</text></paragraph> 
<paragraph id="HF34F0F98F1134D0AB3A30BE2D87D5C46"><enum>(2)</enum><text>For flight training, 165 student years.</text></paragraph> 
<paragraph id="H965CBBC69FCA48519A6EFDB1559D8C19"><enum>(3)</enum><text>For professional training in military and civilian institutions, 350 student years.</text></paragraph> 
<paragraph id="H2065B189A4C74CA6B0DCBD650A4486BD"><enum>(4)</enum><text>For officer acquisition, 1,200 student years.</text></paragraph></subsection></section></title> 
<title id="HE5E9FE5480EA412993638DC3E484948B"><enum>II</enum><header>Coast Guard and Servicemember Parity</header> 
<section id="H43C769DF330447AEACBDD6A5B3ECEEC1"><enum>201.</enum><header>Academy emoluments</header><text display-inline="no-display-inline">Section 195 of title 14, United States Code, is amended—</text> 
<paragraph id="H78784DB6C76048F7B548BCEA1E3B28D3"><enum>(1)</enum><text>in subsection (c)—</text> 
<subparagraph id="H56E262C972A04DAA81CF9E991CBAD006"><enum>(A)</enum><text>in the first sentence—</text> 
<clause id="H66CD71CC63B14CE28AE3DFA02499FD77"><enum>(i)</enum><text>by striking <quote>person</quote> and inserting <quote>foreign national</quote>; and</text></clause> 
<clause id="H73EE67D5FA86401380788FDBA92E2B27"><enum>(ii)</enum><text>by striking <quote>pay and allowances,</quote> and inserting <quote>pay, allowances, and emoluments,</quote>; and</text></clause></subparagraph> 
<subparagraph id="H335E39E94149433A89128382DA79521D"><enum>(B)</enum><text>in the second sentence—</text>

<section id="H6149D4293DAF4D45B9A7A18EDC41CB45"><enum>202.</enum><header>Policy on sexual harassment and sexual violence</header> 
<subsection id="HDC723C5F87B945C09EC264284EC6D209"><enum>(a)</enum><header>Policy requirement</header><text>Chapter 9 of title 14, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="H2995659877C941988DCD9599DE051266" style="USC"> 
<section id="H02D91E93A0B94EB3B9D3A36F511095DB"><enum>200.</enum><header>Policy on sexual harassment and sexual violence</header> 
<subsection id="HFAD360ABA46240F3BEB5F08811BD767F"><enum>(a)</enum><header>Required policy</header><text>The Commandant shall direct the Superintendent of the Coast Guard Academy to prescribe a policy on sexual harassment and sexual violence applicable to the cadets and other personnel of the Coast Guard Academy.</text></subsection> 
<subsection id="H586D798639A647EA9E78801A4A2A0CC5"><enum>(b)</enum><header>Matters To be specified in policy</header><text>The policy on sexual harassment and sexual violence prescribed under this section shall include specification of the following:</text> 
<paragraph id="H49BC2C555C7E48A8864F9D6FD422CFEC"><enum>(1)</enum><text>Programs to promote awareness of the incidence of rape, acquaintance rape, and other sexual offenses of a criminal nature that involve cadets or other Academy personnel.</text></paragraph> 
<paragraph id="H02EC158167CF4415B54AB6E02E3F71B8"><enum>(2)</enum><text>Procedures that a cadet should follow in the case of an occurrence of sexual harassment or sexual violence, including—</text> 
<subparagraph id="H6160621A44024237BEA16B7E7CADA40D"><enum>(A)</enum><text>if the cadet chooses to report an occurrence of sexual harassment or sexual violence, a specification of the person or persons to whom the alleged offense should be reported and the options for confidential reporting;</text></subparagraph> 
<subparagraph id="HB17DA89299EC426EA8BEE1AAE2B398FD"><enum>(B)</enum><text>a specification of any other person whom the victim should contact; and</text></subparagraph> 
<subparagraph id="H4FD4776D14FA44139203CAD24486FA62"><enum>(C)</enum><text>procedures on the preservation of evidence potentially necessary for proof of criminal sexual assault.</text></subparagraph></paragraph> 
<paragraph id="H1A2F1A67C0C24F22B9B4D3B544613D26"><enum>(3)</enum><text>Procedures for disciplinary action in cases of alleged criminal sexual assault involving a cadet or other Academy personnel.</text></paragraph> 
<paragraph id="HEF692E0CD2C04026AA40DC763F891E1F"><enum>(4)</enum><text>Any other sanction authorized to be imposed in a substantiated case of sexual harassment or sexual violence involving a cadet or other Academy personnel in rape, acquaintance rape, or any other criminal sexual offense, whether forcible or nonforcible.</text></paragraph> 
<paragraph id="H6AFC95AD095F43358DEB5C72C43450A9"><enum>(5)</enum><text>Required training on the policy for all cadets and other Academy personnel, including the specific training required for personnel who process allegations of sexual harassment or sexual violence involving Academy personnel.</text></paragraph></subsection> 
<subsection id="HB1A3DA9823224EB791C81FC8D791E0DA"><enum>(c)</enum><header>Annual assessment</header> 
<paragraph id="H02744779ECDC4906B548237FF38C4A92"><enum>(1)</enum><text>The Commandant shall direct the Superintendent of the Academy to conduct at the Academy during each Academy program year an assessment to determine the effectiveness of the policies, training, and procedures of the Academy with respect to sexual harassment and sexual violence involving Academy personnel.</text></paragraph> 
<paragraph id="H7A8B468F04E84D5D8480AFDCB1E28558"><enum>(2)</enum><text>For the assessment at the Academy under paragraph (1) with respect to an Academy program year that begins in an odd-numbered calendar year, the Superintendent shall conduct a survey of Academy personnel—</text> 
<subparagraph id="HFB88D25A957E4233BF19F2ADACA627A4"><enum>(A)</enum><text>to measure—</text> 
<clause id="H1F68A41AE83B412C9EA8D92D5806AE9F"><enum>(i)</enum><text>the incidence, during that program year, of sexual harassment and sexual violence events, on or off the Academy reservation, that have been reported to officials of the Academy; and</text></clause> 
<clause id="H308CD70412AF41039E87901844794C03"><enum>(ii)</enum><text>the incidence, during that program year, of sexual harassment and sexual violence events, on or off the Academy reservation, that have not been reported to officials of the Academy; and</text></clause></subparagraph> 
<subparagraph id="H09DB6DCF43EC4A14BFEC52CDFEA0D723"><enum>(B)</enum><text>to assess the perceptions of Academy personnel of—</text> 
<clause id="H28FA168DD32C40B390D84EB63E888032"><enum>(i)</enum><text>the policies, training, and procedures on sexual harassment and sexual violence involving Academy personnel;</text></clause> 
<clause id="H59D80EC796D6492EB6FE7F118DFF98BB"><enum>(ii)</enum><text>the enforcement of such policies;</text></clause> 
<clause id="H7A46CF35F9474E29AE248EFCB532B9B4"><enum>(iii)</enum><text>the incidence of sexual harassment and sexual violence involving Academy personnel; and</text></clause> 
<clause id="HF3DC1F332FF34B6EB329924A993D33F4"><enum>(iv)</enum><text>any other issues relating to sexual harassment and sexual violence involving Academy personnel.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H22431A8633474FD8A1DA509927404A73"><enum>(d)</enum><header>Annual report</header> 
<paragraph id="H4725E966F9D4463AB575877ECEE557E4"><enum>(1)</enum><text>The Commandant shall direct the Superintendent of the Academy to submit to the Commandant a report on sexual harassment and sexual violence involving cadets or other personnel at the Academy for each Academy program year.</text></paragraph> 
<paragraph id="H6686ED8D78624CEF90FB7ED5EDB4D0E3"><enum>(2)</enum><text>Each report under paragraph (1) shall include, for the Academy program year covered by the report, the following:</text> 
<subparagraph id="HA6DBBCE243664674BF6E29961150D9E9"><enum>(A)</enum><text>The number of sexual assaults, rapes, and other sexual offenses involving cadets or other Academy personnel that have been reported to Academy officials during the program year and, of those reported cases, the number that have been substantiated.</text></subparagraph> 
<subparagraph id="H8A1C77B9CA46438AB9435903A968A3CC"><enum>(B)</enum><text>The policies, procedures, and processes implemented by the Commandant and the leadership of the Academy in response to sexual harassment and sexual violence involving cadets or other Academy personnel during the program year.</text></subparagraph> 
<subparagraph id="H4CE2FD4E2E3E4561A6E71CCE6D9C8A22"><enum>(C)</enum><text>A plan for the actions that are to be taken in the following Academy program year regarding prevention of and response to sexual harassment and sexual violence involving cadets or other Academy personnel.</text></subparagraph></paragraph> 
<paragraph id="H7B7D5ADC52DA41DEAAF23033FA0FB690"><enum>(3)</enum><text>Each report under paragraph (1) for an Academy program year that begins in an odd-numbered calendar year shall include the results of the survey conducted in that program year under subsection (c)(2).</text></paragraph> 
<paragraph id="HB02FA44ECEB8476794428372E970F928"><enum>(4)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H34234DA0B8A44AD8A14160623D9A3DE0"><enum>(A)</enum><text>The Commandant shall transmit to the Board of Visitors of the Academy each report received by the Commandant under this subsection, together with the Commandant’s comments on the report.</text></subparagraph> 
<subparagraph id="HDAA4B18E8ACA44569FC20157A9BFCD2B" indent="up1"><enum>(B)</enum><text>The Commandant shall transmit each such report, together with the Commandant’s comments on the report, to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HCADC0E6CA1A343569D71749A6693CED6"><enum>(b)</enum><header>Conforming repeal</header><text>Section 217 of the Coast Guard Authorization Act of 2010 (14 U.S.C. 93 note), and the item relating to such section in the table of contents in section 1(b) of such Act, are repealed.</text></subsection>

<subsection id="HD64E990401C541A2BC26F8F20C562AEC"><enum>(a)</enum><header>In general</header><text>Whenever the Commandant conducts an accident investigation of an accident involving an aircraft under the jurisdiction of the Commandant, the records and report of the investigation shall be treated in accordance with this section.</text></subsection> 
<subsection id="H9765A195B79740F7A799F3EF3C41EB7A"><enum>(b)</enum><header>Public disclosure of certain accident investigation information</header> 
<paragraph id="HB139C5AC847D4B8AB62D4ED2624971B0"><enum>(1)</enum><text>Subject to paragraph (2), the Commandant, upon request, shall publicly disclose unclassified tapes, scientific reports, and other factual information pertinent to an aircraft accident investigation.</text></paragraph> 
<paragraph id="H5E05FB0543644857A4FBFB4CAE9F0635"><enum>(2)</enum><text>The Commandant shall not disclose the information requested in paragraph (1) unless the Commandant determines—</text> 
<subparagraph id="HB6A16FBEF4AB4F238B2C57EBFE1D2B2A"><enum>(A)</enum><text>that such tapes, reports, or other information would be included within and releasable with the final accident investigation report; and</text></subparagraph> 
<subparagraph id="H00D5E2D425014F70B10357F0E1E01F0B"><enum>(B)</enum><text>that release of such tapes, reports, or other information—</text> 
<clause id="H2461C6B777C84EA2AFFA9B859C8599E0"><enum>(i)</enum><text>would not undermine the ability of accident or safety investigators to continue to conduct the investigation; and</text></clause> 
<clause id="HFB8C7795A24046BD895538BB7F954D54"><enum>(ii)</enum><text>would not compromise national security.</text></clause></subparagraph></paragraph> 
<paragraph id="HCD49CAB6E6A3471488C2E27DE6AD17C2"><enum>(3)</enum><text>A disclosure under paragraph (1) may not be made by or through officials with responsibility for, or who are conducting, a safety investigation with respect to the accident.</text></paragraph></subsection> 
<subsection id="HE9E7E2F423DF49A591178FEAB30AB4AB"><enum>(c)</enum><header>Opinions regarding causation of accident</header><text>Following an aircraft accident referred to in subsection (a)—</text> 
<paragraph id="HD891192FA0484FE9A0B8B738C5051540"><enum>(1)</enum><text>if the evidence surrounding the accident is sufficient for the investigators who conduct the accident investigation to come to an opinion as to the cause or causes of the accident, the final report of the accident investigation shall set forth the opinion of the investigators as to the cause or causes of the accident; and</text></paragraph> 
<paragraph id="HA798663F6B7744139D8B1DA1E9EA4385"><enum>(2)</enum><text>if the evidence surrounding the accident is not sufficient for the investigators to come to an opinion as to the cause or causes of the accident, the final report of the accident investigation shall include a description of those factors, if any, that, in the opinion of the investigators, substantially contributed to or caused the accident.</text></paragraph></subsection> 
<subsection id="H9A17716F1D8B48D3AF25EBA847EE4045"><enum>(d)</enum><header>Use of information in civil proceedings</header><text>For purposes of any civil or criminal proceeding arising from an aircraft accident referred to in subsection (a), any opinion of the accident investigators as to the cause of, or the factors contributing to, the accident set forth in the accident investigation report may not be considered as evidence in such proceeding, nor may such report be considered an admission of liability by the United States or by any person referred to in such report.</text></subsection> 
<subsection id="H772C3AB8350942B4848C16600603DFD5"><enum>(e)</enum><header>Regulations</header><text>The Commandant shall prescribe regulations to carry out this section.</text></subsection> 
<subsection id="H564BEBA833804C71A4376DEED0635B83"><enum>(f)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="HF8D6E1E8391E417EBFD80D0802A40FE9"><enum>(1)</enum><text>the term <quote>accident investigation</quote> means any form of investigation by Coast Guard personnel of an aircraft accident referred to in subsection (a), other than a safety investigation; and</text></paragraph> 
<paragraph id="HE827D6C996654A44A901F4FD6B725B67"><enum>(2)</enum><text>the term <quote>safety investigation</quote> means an investigation by Coast Guard personnel of an aircraft accident referred to in subsection (a), that is conducted solely to determine the cause of the accident and to obtain information that may prevent the occurrence of similar accidents.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H848A21F6C3EF46F596B16DC7389304B5"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis at the beginning of such chapter is amended by adding at the end the following:</text>

<section id="HE305FB8E89A44D938B815C1C920EBD37"><enum>207.</enum><header>Coast Guard housing report</header><text display-inline="no-display-inline">In conjunction with the transmittal by the President of the budget of the United States for fiscal year 2013, the Commandant of the Coast Guard shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report on the status of Coast Guard servicemember housing, including—</text> 
<paragraph id="H73861DA9AD004D6BAB3E0AC9FA65B09E"><enum>(1)</enum><text>a statement of the Coast Guard’s housing needs requirements;</text></paragraph> 
<paragraph id="HDED4D21F7A5E45BAA1CB50770BA19C16"><enum>(2)</enum><text>an assessment of the condition of the Coast Guard’s current housing inventory, including both leased and owned property;</text></paragraph> 
<paragraph id="H3D6307EE92CC4F5FBA5782261B1487F9"><enum>(3)</enum><text>an assessment of housing available for Coast Guard use from surrounding communities and other government agencies for all duty stations;</text></paragraph> 
<paragraph id="H4942D50DBE5748109CB52C061F8A9666"><enum>(4)</enum><text>a list of housing capacity shortfalls and excess; and</text></paragraph> 
<paragraph id="H4C555107A3084AA19CA6C824F6AFE5C8"><enum>(5)</enum><text>a revised prioritized list of housing maintenance and recapitalization projects.</text></paragraph></section>

<paragraph id="H46DF5D946E564CEF8EFF151905468F65"><enum>(2)</enum><text>has achieved the goal of 225 days away from homeport for each of the first two national security cutters; and</text></paragraph> 
<paragraph id="H987295549BF848A686F9B684888E572A"><enum>(3)</enum><text>has submitted to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a program execution plan detailing increased aerial coverage to support national security cutter operations.</text></paragraph></subsection>

<subsection id="H3E4C6D26ACA249299549F5E7CBBDBD82"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of chapter 15 of title 14, United States Code, is further amended by adding at the end the following:</text>

<section id="H0B2DDA361B31458CABBFE9CC3FA259B1"><enum>569b.</enum><header>Major acquisitions report</header> 
<subsection id="HCBD44BD5D59146369F955F9BB15A15C5"><enum>(a)</enum><header>Major acquisition programs implementation report</header><text>In conjunction with the transmittal by the President of the budget of the United States for fiscal year 2013 and every two fiscal years thereafter, the Secretary shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report on the status of all major acquisition programs.</text></subsection> 
<subsection id="H21F99BBDDC0B454D8AF098EA221544D6"><enum>(b)</enum><header>Information To be included</header><text>The report shall include for each major acquisition program—</text> 
<paragraph id="HA8E7E2BE392A4253A729DC7F04AD44B9"><enum>(1)</enum><text display-inline="yes-display-inline">a statement of Coast Guard’s mission needs and performance goals for such program, including a justification for any change to those needs and goals from any report previously submitted under this subsection;</text></paragraph> 
<paragraph id="H2B271382C9FC4E9FA8AB120598AE7C63"><enum>(2)</enum><text>a justification for how the projected number and capabilities of each planned acquisition program asset meets those mission needs and performance goals;</text></paragraph> 
<paragraph id="HA63B5087314F45B18D1C398ABF53AA15"><enum>(3)</enum><text>an identification of any and all mission hour gaps, accompanied by an explanation on how and when the Coast Guard will close those gaps;</text></paragraph> 
<paragraph id="H5266ACC1581C4CF9BB484109EE37CFAF"><enum>(4)</enum><text>an identification of any changes to such program, including—</text> 
<subparagraph id="H8579FF63714E4000850AFDBD05682FD4"><enum>(A)</enum><text>any changes to the timeline for the acquisition of each new asset and the phase out of legacy assets; and</text></subparagraph> 
<subparagraph id="H825D8705C0544A0B9BE56BD6CDBA4F89"><enum>(B)</enum><text>any changes to the costs of new assets and legacy assets for that fiscal year, future fiscal years, or the total acquisition cost;</text></subparagraph></paragraph> 
<paragraph id="H6215CDD6270045F795DD96847B5D7F70"><enum>(5)</enum><text>a justification for how any change to such program fulfills the mission needs and performance goals of the Coast Guard;</text></paragraph> 
<paragraph id="HA1F3891857784946BC5620CC7A29AAB2"><enum>(6)</enum><text>a description of how the Coast Guard is planning for the integration of each new asset acquired under such program into the Coast Guard, including needs related to shore-based infrastructure and human resources;</text></paragraph> 
<paragraph id="HE0ABE7B39EBA44C087E2F323B141409A"><enum>(7)</enum><text>an identification of how funds in that fiscal year’s budget request will be allocated, including information on the purchase of specific assets;</text></paragraph> 
<paragraph id="H0CE532CAB5054AFEB72896D9C47DEBDB"><enum>(8)</enum><text>a projection of the remaining operational lifespan and lifecycle cost of each legacy asset that also identifies any anticipated resource gaps;</text></paragraph> 
<paragraph id="H0423F86081D84A3BA673043E427C0557"><enum>(9)</enum><text>a detailed explanation of how the costs of the legacy assets are being accounted for within such program;</text></paragraph> 
<paragraph id="HEB538CD909F648968680BA95407DC210"><enum>(10)</enum><text>an annual performance comparison of new assets to legacy assets; and</text></paragraph> 
<paragraph id="H9FC95B6B129B40448E1C92231EC94162"><enum>(11)</enum><text display-inline="yes-display-inline">an identification of the scope of the anticipated acquisitions workload for the next fiscal year; the number of officers, members, and employees of the Coast Guard currently assigned to positions in the acquisition workforce; and a determination on the adequacy of the current acquisition workforce to meet that anticipated workload, including the specific positions that are or will be understaffed, and actions that will be taken to correct such understaffing.</text></paragraph></subsection> 
<subsection id="HF00D576D6752422E9018E9F17737E97A"><enum>(c)</enum><header>Cutters not maintained in class</header><text>Each report under subsection (a) shall identify which, if any, Coast Guard cutters that have been issued a certificate of classification by the American Bureau of Shipping have not been maintained in class with an explanation detailing the reasons why they have not been maintained in class.</text></subsection> 
<subsection id="H274D894670BF45AD82020E7F9927E0B9"><enum>(d)</enum><header>Definition</header><text>For the purposes of this section, the term <quote>major acquisition program</quote> means an ongoing acquisition undertaken by the Coast Guard with a life-cycle cost estimate greater than or equal to $300,000,000.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection>

<subsection id="HADB49986D29E42AC914C4B588C0D9F03"><enum>(a)</enum><header>Polar sea</header><text>Not later than 6 months after the date of enactment of this Act, the Commandant of the Coast Guard shall decommission the USCGC POLAR SEA (WAGB 11).</text></subsection> 
<subsection id="H01D87F69255E4A1080A58FABF30F5192"><enum>(b)</enum><header>Polar star</header><text>Not later than 3 years after the date of enactment of this Act, the Commandant of the Coast Guard shall decommission the USCGC POLAR STAR (WAGB 10).</text></subsection></section> 
<section id="H021C7C5ADFFB44FCA6925C2ACDC07CCA"><enum>308.</enum><header>Assessment of needs for additional coast guard presence in high latitude regions</header><text display-inline="no-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretary of the department in which the Coast Guard is operating shall submit a report to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives assessing the need for additional Coast Guard prevention and response capability in the high latitude regions. The assessment shall address needs for all Coast Guard mission areas, including search and rescue, marine pollution response and prevention, fisheries enforcement, and maritime commerce. The Secretary shall include in the report—</text> 
<paragraph id="H1923E55DCAC745AFBC9E060C921A4428"><enum>(1)</enum><text>an assessment of the high latitude operating capabilities of all current Coast Guard assets other than icebreakers, including assets acquired under the Deepwater program;</text></paragraph> 
<paragraph id="HA3789E0D453A44A997A6DCBF726A7819"><enum>(2)</enum><text>an assessment of projected needs for Coast Guard operations in the high latitude regions; and</text></paragraph> 
<paragraph id="HC363C70D1F1942DD8868480BC3B76CA8"><enum>(3)</enum><text display-inline="yes-display-inline">an assessment of shore infrastructure, personnel, logistics, communications, and resources requirements to support Coast Guard operations in the high latitude regions, including forward operating bases and existing infrastructure in the furthest north locations that are ice free, or nearly ice free, year round.</text></paragraph></section> 
<section commented="no" display-inline="no-display-inline" id="HA14C78F61B67452BBDA94E0D22B71DF5" section-type="subsequent-section"><enum>309.</enum><header>Limitation on expenditures</header><text display-inline="no-display-inline">Section 149(d) of title 14, United States Code, is amended by adding at the end the following:</text>

<paragraph id="H339095DDFFEF4C539F3C0EBAB0BF7B7C"><enum>(2)</enum><text display-inline="yes-display-inline">The study of Coast Guard current and planned cutters conducted by the Office of Program Analysis and Evaluation of the Department of Homeland Security at the request of the Office of Management and Budget.</text></paragraph></subsection> 
<subsection id="H877E1BD279A649DCB1538C577E7D9D11"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">The Secretary and the Commandant may travel aboard a Coast Guard owned and operated fixed-wing aircraft—</text> 
<paragraph id="H823E702334DB4C528F514A68D036BA5A"><enum>(1)</enum><text display-inline="yes-display-inline">to respond to a major disaster or emergency declared under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5170);</text></paragraph> 
<paragraph id="HE3B089C7C36D4968BE6AA48B7A7DC5F0"><enum>(2)</enum><text>to respond to a discharge classified as a spill of national significance under part 300.323 of title 40, Code of Federal Regulations; or</text></paragraph> 
<paragraph id="HC1FE40B41EC34C30B2D3CC74A1D8A3A6"><enum>(3)</enum><text>for evacuation purposes including for a medical emergency.</text></paragraph></subsection></section></title>

<paragraph id="H4A7106BED9B94CE0AC6DC9472CA806C4"><enum>(3)</enum><text>coordinate policies among Federal agencies to promote an efficient marine transportation system.</text></paragraph></subsection> 
<subsection id="HDB9CA0CDE365456C820EE92FC3841AE2"><enum>(c)</enum><header>Membership</header> 
<paragraph id="H2F57A983A7434BE8A8912906F68016E8"><enum>(1)</enum><header>In general</header><text>The Committee shall consist of the Secretary of Transportation, the Secretary of Defense, the Secretary of Homeland Security, the Secretary of Commerce, the Secretary of the Treasury, the Secretary of State, the Secretary of the Interior, the Secretary of Agriculture, the Attorney General, the Secretary of Labor, the Secretary of Energy, the Administrator of the Environmental Protection Agency, the Chairman of the Federal Maritime Commission, and the head of any other Federal agency that the Committee Chair, with the approval of a majority of the voting members of the Committee, determines can further the purpose and activities of the Committee.</text></paragraph> 
<paragraph id="HEB24ABC0589C49B7A92B02CC217A7657"><enum>(2)</enum><header>Ex-officio members</header><text>The Committee may also consist of so many nonvoting members as the Committee Chair, with the approval of a majority of the voting members of the Committee, determines is appropriate to further the purpose and activities of the Committee.</text></paragraph> 
<paragraph id="HB047CCD9F57643018A548852E18DC363"><enum>(3)</enum><header>Chairman</header><text>The Chair of the Committee shall rotate each year among the Secretary of Transportation, the Secretary of Defense, the Secretary of Homeland Security, and the Secretary of Commerce. The order of rotation shall be determined with the approval of a majority of the voting members of the Committee.</text></paragraph></subsection> 
<subsection id="H1BAF6ADA8F4142D4B6C0F4899675FB90"><enum>(d)</enum><header>Support</header> 
<paragraph id="H6A005DD771314E9BB1A93D1FBBF7E1F5"><enum>(1)</enum><header>Coordinating board</header><text>Each member of the Committee may select a senior level representative to serve on a coordinating board which shall assist the Committee in carrying out its purpose and activities.</text></paragraph> 
<paragraph id="H63B4373E2245432CB763089465602997"><enum>(2)</enum><header>Executive director</header><text>The Secretary of Transportation, in consultation with the Secretary of Defense, the Secretary of Homeland Security, and the Secretary of Commerce, shall select an executive director to assist the Committee in carrying out its purpose and activities.</text></paragraph></subsection> 
<subsection id="H5D7EF5B1E9C647BC8C2C0B50C60E89AE"><enum>(e)</enum><header>Marine transportation system assessment and strategy</header><text>Not later than one year after the date of enactment of this Act and every 5 years thereafter, the Committee shall provide a report to Congress which includes—</text> 
<paragraph id="HB4C32DDDD16E40AEB1CF6F99E967D024"><enum>(1)</enum><text>steps taken to implement actions recommended in the July 2008 <quote>National Strategy for the Marine Transportation System: A Framework for Action</quote>;</text></paragraph> 
<paragraph id="HCF0144C0B68140B98A342D7B931CF4BA"><enum>(2)</enum><text>an assessment of the condition of the marine transportation system;</text></paragraph> 
<paragraph id="H714E29A21F18416AAAE95777773216F9"><enum>(3)</enum><text>a discussion of the challenges the system faces in meeting user demand;</text></paragraph> 
<paragraph id="H34F0A2C652FF4C27A2BCB074AD8BD1C3"><enum>(4)</enum><text>a plan with recommended actions for improving the marine transportation system to meet current and future challenges; and</text></paragraph> 
<paragraph id="H52BCF4CE06A346FE9815B5644CCDDA5D"><enum>(5)</enum><text>steps taken to implement actions recommended in previous reports required under this subsection.</text></paragraph></subsection> 
<subsection id="H431ACA8E646D41C187FDE25AA76A09E1"><enum>(f)</enum><header>Consultation</header><text>In carrying out its purpose and activities, the Committee may consult with the Marine Transportation System National Advisory Council, interested parties, and the public.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H7996B0AAB3C74A06AFA91B55DE65B3D5"><enum>(2)</enum><text>enforcement of the Coast Guard’s foreign rebuild determination regulations; and</text></paragraph> 
<paragraph id="H28843488C62542D48690DF67A1AA5655"><enum>(3)</enum><text>recommendations for improving the transparency in the Coast Guard’s foreign rebuild determination process.</text></paragraph></section>

<paragraph id="H6EFBD6BC37A84D428F461E83A10C9041"><enum>(1)</enum><text>such seaman was not a permanent resident alien of the United States at the time the claim arose;</text></paragraph> 
<paragraph display-inline="no-display-inline" id="H7D9029F4E156434381E20E5E123DF0CE"><enum>(2)</enum><text display-inline="yes-display-inline">the injury, illness, or death arose outside the territorial waters of the United States; and</text></paragraph> 
<paragraph id="HB143786BA9404A9CB450B82729C0C7EC"><enum>(3)</enum><text>the seaman or the seaman’s personal representative has or had a right to seek compensation for the injury, illness, or death in, or under the laws of—</text> 
<subparagraph id="HDF63C7269EB0437DBD61720F4350CE47"><enum>(A)</enum><text>the nation in which the vessel was registered at the time the claim arose; or</text></subparagraph> 
<subparagraph id="H517822964DF144F08501E0EB740EAAE8"><enum>(B)</enum><text>the nation in which the seaman maintained citizenship or residency at the time the claim arose.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<subsection id="HC7D9E52AA2B74A5C8E0BB866690362D5"><enum>(a)</enum><header>In general</header><text>Subchapter I of chapter 313 of title 46, United States Code, is amended by adding at the end the following:</text>

<subparagraph id="H8F919B36D4504FC79443A71A3E0F6E4B"><enum>(A)</enum><text>authorizes a person or use of a vessel to engage in fishing; and</text></subparagraph> 
<subparagraph id="H8581B21FBE9042FCB6F037B6144BD053"><enum>(B)</enum><text>is issued under State or Federal law; and</text></subparagraph></paragraph> 
<paragraph id="HDE17ED890BBA47548C8860365968516A"><enum>(2)</enum><text>does not authorize any civil action to enforce a maritime lien on such a permit.</text></paragraph></subsection> 
<subsection id="H49A6AECB291D4523A51F8FED0461D5AA"><enum>(b)</enum><header>Fishing permit described</header><text>A fishing permit—</text> 
<paragraph id="HD7AADBD7E1C4483293C0DE0696631868"><enum>(1)</enum><text>is governed solely by the State or Federal law under which it was issued; and</text></paragraph> 
<paragraph id="HE1FD7157F6794995A6EEAF282AA5C5D8"><enum>(2)</enum><text>is not included in the whole of a vessel or as an appurtenance or intangible of a vessel for any purpose.</text></paragraph></subsection> 
<subsection id="H80420472821B4B1DBF633ED00DBF3D71"><enum>(c)</enum><header>Limitation on statutory construction</header><text>Nothing in subsections (a) and (b) shall be construed as imposing any limitation upon the authority of the Secretary of Commerce to modify, suspend, revoke, or sanction any Federal fishery permit issued by the Secretary of Commerce or to bring a civil action to enforce such modification, suspension, revocation, or sanction.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="HB678BDAB848F4DF3A8D245EA12CCF872"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the Coast Guard National Maritime Center’s merchant mariner medical evaluation program and alternatives to the program.</text></subsection> 
<subsection id="HDD07F5C3D0194A3AAA2227BA2C70302F"><enum>(b)</enum><header>Contents</header><text>The report required under subsection (a) shall include the following:</text> 
<paragraph id="H0A72761280144FB1849FAA8EA066880A"><enum>(1)</enum><text>An overview of the adequacy of the program for making medical certification determinations for issuance of merchant mariners’ documents.</text></paragraph> 
<paragraph id="H7443DF3F085647F2B2A93FC26AF65305"><enum>(2)</enum><text>An analysis of how a system similar to the Federal Motor Carrier Safety Administration’s National Registry of Certified Medical Examiners program, and the Federal Aviation Administration’s Designated Aviation Medical Examiners program, could be applied by the Coast Guard to make medical fitness determinations for issuance of merchant mariners’ documents.</text></paragraph> 
<paragraph id="H9D90DAC5030B401BBCECEEAAB7D27D81"><enum>(3)</enum><text>An explanation of how the amendments to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978, that enter into force on January 1, 2012, will require changes to the Coast Guard’s merchant mariner medical evaluation program.</text></paragraph></subsection></section>

<section id="H8DCBEC10D03E4D7F9042752074D551B2"><enum>2.</enum><header>Primary duties</header><text display-inline="no-display-inline">The Coast Guard shall—</text> 
<paragraph id="HF8392357CEB24B9CAF2DF0D0C8E3D0F3"><enum>(1)</enum><text>enforce or assist in the enforcement of all applicable Federal laws on, under, and over the high seas and waters subject to the jurisdiction of the United States;</text></paragraph> 
<paragraph id="HB2FD9D0596FA40D0BDEED2D1A27EE569"><enum>(2)</enum><text>engage in maritime air surveillance or interdiction to enforce or assist in the enforcement of the laws of the United States;</text></paragraph> 
<paragraph id="HF9E1E4FE5DCA4F05A6604ADAFB2A2AFF"><enum>(3)</enum><text>administer laws and promulgate and enforce regulations for the promotion of safety of life and property on and under the high seas and waters subject to the jurisdiction of the United States covering all matters not specifically delegated by law to some other executive department;</text></paragraph> 
<paragraph id="HA314ECE5B9284C22A2D77585B6DE1F27"><enum>(4)</enum><text>develop, establish, maintain, and operate, with due regard to the requirements of national defense, aids to maritime navigation, ice-breaking facilities, and rescue facilities for the promotion of safety on, under, and over the high seas and waters subject to the jurisdiction of the United States;</text></paragraph> 
<paragraph id="HA21AE96F33CF486FB2D1C5406DEF72CF"><enum>(5)</enum><text>pursuant to international agreements, develop, establish, maintain, and operate icebreaking facilities on, under, and over waters other than the high seas and waters subject to the jurisdiction of the United States;</text></paragraph> 
<paragraph id="HFF4036A25DD14CC1AEF6420FE2731ADB"><enum>(6)</enum><text>engage in oceanographic research of the high seas and in waters subject to the jurisdiction of the United States; and</text></paragraph> 
<paragraph id="H9FD178F5151D4B5F969BC7110C9522B6"><enum>(7)</enum><text>maintain a state of readiness to function as a specialized service in the Navy in time of war, including the fulfillment of Maritime Defense Zone command responsibilities.</text></paragraph></section> 
<section id="H4C563EC1982B41B9A9692B4A40F6CC8D"><enum>3.</enum><header>Department in which the Coast Guard operates</header> 
<subsection id="H400ACB4F610847FFA75A361D25BEBA16"><enum>(a)</enum><text>The Coast Guard shall be a service in the Department of Homeland Security, except when operating as a service in the Navy.</text></subsection> 
<subsection display-inline="no-display-inline" id="HC1035B3794DE4DE18E6BFD2AA28E0A4B"><enum>(b)</enum><text>Upon the declaration of war if Congress so directs in the declaration or when the President directs, the Coast Guard shall operate as a service in the Navy, and shall so continue until the President, by Executive order, transfers the Coast Guard back to the Department of Homeland Security. While operating as a service in the Navy, the Coast Guard shall be subject to the orders of the Secretary of the Navy, who may order changes in Coast Guard operations to render them uniform, to the extent such Secretary deems advisable, with Navy operations.</text></subsection> 
<subsection id="HF47E4EA0843D4CA2BF1FE30B31968DEF"><enum>(c)</enum><text>Whenever the Coast Guard operates as a service in the Navy:</text> 
<paragraph id="HCDB3CDEF8DAF4C3692ADA9522BC08659"><enum>(1)</enum><text>applicable appropriations of the Navy Department shall be available for the expense of the Coast Guard;</text></paragraph> 
<paragraph id="HCE05439FA0E6472BA4504597100C12D7"><enum>(2)</enum><text>applicable appropriations of the Coast Guard shall be available for transfer to the Navy Department;</text></paragraph> 
<paragraph id="HED7BA37ADF77481AB068512E8D0BB7D4"><enum>(3)</enum><text>precedence between commissioned officers of corresponding grades in the Coast Guard and the Navy shall be determined by the date of rank stated by their commissions in those grades;</text></paragraph> 
<paragraph id="HD497C794D87E4847AC622DC151157C80"><enum>(4)</enum><text>personnel of the Coast Guard shall be eligible to receive gratuities, medals, and other insignia of honor on the same basis as personnel in the naval service or serving in any capacity with the Navy; and</text></paragraph> 
<paragraph id="H6CADA34780CF4AE8A95AE2178284AF28"><enum>(5)</enum><text>the Secretary may place on furlough any officer of the Coast Guard and officers on furlough shall receive one half of the pay to which they would be entitled if on leave of absence, but officers of the Coast Guard Reserve shall not be so placed on furlough.</text></paragraph></subsection></section> 
<section id="HFC0D53BCEA00476F8D4780489547A47C"><enum>4.</enum><header>Secretary defined</header><text display-inline="no-display-inline">In this title, the term <quote>Secretary</quote> means the Secretary of the respective department in which the Coast Guard is operating.</text></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H1DC4E2BC78104ADB97F951971B1F6220"><enum>605.</enum><header>Distant water tuna fleet</header><text display-inline="no-display-inline">Section 421 of the Coast Guard and Maritime Transportation Act of 2006 (Public Law 109-241; 120 Stat. 548) is amended—</text>

<paragraph id="H5145E917C4A2488DA63354D4F8CC5673"><enum>(2)</enum><header>Treatment of license</header><text>An equivalent credential under paragraph (1) shall be considered as meeting the requirements of section 8304 of title 46, United States Code, but only while a person holding the credential is in the service of the vessel to which this section applies.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HF12E9631EACF4B059E49BEB803BE8996"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d) by striking <quote>on December 31, 2012</quote> and inserting <quote>on the date the Treaty on Fisheries Between the Governments of Certain Pacific Island States and the Government of the United States of America ceases to have effect for any party under Article 12.6 or 12.7 of such treaty, as in effect on the date of enactment of the Coast Guard and Maritime Transportation Act of 2011</quote>.</text></paragraph></section>

<subsection commented="no" id="HC1B7B01717454D7F9E6C1E6A9104BACF"><enum>(a)</enum><header>In general</header><text>Notwithstanding sections 12112 and 12132 and chapter 551 of title 46, United States Code, the Secretary of the department in which the Coast Guard is operating may issue a certificate of documentation with a coastwise endorsement for each of the following vessels:</text>

<subsection id="H8433A8830B4A459687BC282648DE0C2C"><enum>(a)</enum><header>In general</header><text>The owner or operator of a manned facility, installation, unit, or vessel shall locate a standby vessel—</text> 
<paragraph id="H61DE5A310E9E4F0AB5DA2D12FB59F072"><enum>(1)</enum><text>not more than 3 nautical miles from such manned facility, installation, unit, or vessel while it is performing drilling, plugging, abandoning, or workover operations; and</text></paragraph> 
<paragraph id="H3CE61A0A8E3246F395FA6FE9DE81850D"><enum>(2)</enum><text>not more than 12 nautical miles from such manned facility, installation, unit, or vessel while it is performing operations other than drilling, plugging, abandoning, or workover operations.</text></paragraph></subsection> 
<subsection id="HD99134ED573440129B1894F8DDA180B3"><enum>(b)</enum><header>Improved standby vessel response time</header> 
<paragraph id="HC4D3246BC1BE4D559A0C000B205A14B1"><enum>(1)</enum><header>In general</header><text>A Coast Guard District Commander may reduce the distances prescribed in subsection (a) for the area of command of the District Commander if the District Commander determines the reduction is necessary to address delays in standby vessel response times caused by inclement weather, high seas, or other conditions that prolong standby vessel response time or lessen the time survivors of an accident can remain in the water.</text></paragraph> 
<paragraph id="HA2FA9C8E57C9439B8A3354CEA9E19F45"><enum>(2)</enum><header>Approximation of normal response time</header><text>Any reduction under paragraph (1) shall be made to a distance that, in weather conditions necessitating the reduction, ensures that a standby vessel’s response time approximates that of a standby vessel covering the distance prescribed in subsection (a) during normal weather conditions.</text></paragraph> 
<paragraph id="H85030C914CFE443EB186A5CA9158AD08"><enum>(3)</enum><header>Prevention of hypothermia</header><text>Any reduction under paragraph (1) made due to water temperature or other factors that reduce the time survivors of an accident can remain in the water shall be made to a distance at which a standby vessel can be assumed to reach the survivor before the onset of hypothermia.</text></paragraph> 
<paragraph id="HE5CC87CA6FAF436EA070DE2E85E20F2A"><enum>(4)</enum><header>Notice to owners and operators</header><text>Before exercising the authority in paragraph (1), a District Commander shall provide 72 hours notice to the owners and operators of standby vessels and owners and operators of manned facilities, installations, units, and vessels operating in the District Commander’s area of command.</text></paragraph></subsection> 
<subsection commented="no" id="HA58143F3AE284319B30A681C76562BB3"><enum>(c)</enum><header>multiple platforms and uses</header><text>Nothing in this section shall be construed to prohibit—</text> 
<paragraph id="H203B964D18C14BFFA15F2418F7CC65E8"><enum>(1)</enum><text>use of one standby vessel for more than one manned facility, installation, unit, or vessel; or</text></paragraph> 
<paragraph id="H44D5C5DB288C4200AAC57AF699F72CD5"><enum>(2)</enum><text>use of a standby vessel for other purposes.</text></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="HBB6E89EDAF194D539B954A2CB5261787"><enum>(b)</enum><header>Content</header><text>The report shall include—</text> 
<paragraph id="HA3B5441DA62641BBA2FD483AC2A4156A"><enum>(1)</enum><text>a review of differences in Coast Guard policies and regulations governing the inspection of vessels documented in the United States and the policies and regulations of the International Maritime Organization governing the inspection of vessels not documented in the United States;</text></paragraph> 
<paragraph id="H895648124C094DF9901A4AD8CF932613"><enum>(2)</enum><text>a statement on the impact such differences have on operating costs for vessels documented in the United States; and</text></paragraph> 
<paragraph id="HF27A753129074EFF85D195DA3B4DAEA3"><enum>(3)</enum><text>recommendations on whether to harmonize any differences in the policies and regulations governing inspection of vessels by the Coast Guard and the International Maritime Organization.</text></paragraph></subsection> 
<subsection id="HF67DD34E26744EA7BA2C18C345038216"><enum>(c)</enum><header>Consultation</header><text>In preparing the report, the Commandant may consider the views of representatives of the owners or operators of vessels documented in the United States and the organizations representing the employees employed on such vessels.</text></subsection></section> 
<section id="HC8C1FC5A26D345A8AB197083026DB4F1"><enum>611.</enum><header>Report on drug interdiction in the Caribbean basin</header> 
<subsection id="H65326D7ACC0942ED86574C0294AC67B6"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on drug interdiction in the Caribbean basin. </text></subsection> 
<subsection id="HC8203363B4D544ED9639FE190DEFC6C4"><enum>(b)</enum><header>Content</header><text>The report shall include—</text> 
<paragraph id="H06326770DA00497F9F396E45EE4FE3D2"><enum>(1)</enum><text>a statement of the Coast Guard mission requirements for drug interdiction in the Caribbean basin;</text></paragraph> 
<paragraph id="HD0E646E3929C4DFA97D6762C673DE22A"><enum>(2)</enum><text>the number of maritime surveillance hours and Coast Guard assets used in each of fiscal years 2009 through 2011 to counter the illicit trafficking of drugs and other related threats throughout the Caribbean basin; and</text></paragraph> 
<paragraph id="HCEB86352D36149088A29751DB03C02B8"><enum>(3)</enum><text>a determination of whether such hours and assets satisfied the Coast Guard mission requirements for drug interdiction in the Caribbean basin.</text></paragraph></subsection></section></title> 
<title id="HABB75D00C5CA4590AE0FAE16225BA084"><enum>VII</enum><header>Commercial Vessel Discharges Reform</header> 
<section id="H44C36FAA90204B7B89784A5311D9C371" section-type="subsequent-section"><enum>701.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Commercial Vessel Discharges Reform Act of 2011</short-title></quote>.</text></section> 
<section id="H170E75198EDC427F96BCC9D14B939CEA"><enum>702.</enum><header>Discharges from commercial vessels</header><text display-inline="no-display-inline">Title III of the Federal Water Pollution Control Act (33 U.S.C. 1311 et seq.) is amended by adding at the end the following:</text>

<paragraph id="HB5F24E5A97BC4A49AE01D1426381A0F4"><enum>(1)</enum><header>Aquatic nuisance species</header><text>The term <term>aquatic nuisance species</term> means a nonindigenous species (including a pathogen) that threatens the diversity or abundance of native species or the ecological stability of navigable waters or commercial, agricultural, aquacultural, or recreational activities dependent on such waters.</text></paragraph> 
<paragraph id="HD48152582ADF4C9683C586FE534F55E0"><enum>(2)</enum><header>Ballast water</header> 
<subparagraph id="HD92D0793EF0D40F991B20EC22AC834ED"><enum>(A)</enum><header>In general</header><text>The term <term>ballast water</term> means any water (including any sediment suspended in such water) taken aboard a commercial vessel—</text> 
<clause id="H260A6218A6C740B399CDC8FA25F48898"><enum>(i)</enum><text>to control trim, list, draught, stability, or stresses of the vessel; or</text></clause> 
<clause id="HA33924B7748D44FB9A242D0B20B3D712"><enum>(ii)</enum><text>during the cleaning, maintenance, or other operation of a ballast water treatment system of the vessel.</text></clause></subparagraph> 
<subparagraph id="H66D5C7E5B45246BDB13AD18352804E53"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>ballast water</term> does not include any pollutant that is added to water described in subparagraph (A) that is not directly related to the operation of a properly functioning ballast water treatment technology certified under subsection (e).</text></subparagraph></paragraph> 
<paragraph commented="no" id="HBDC56DAECC6047948D55BF86A4467629"><enum>(3)</enum><header>Ballast water performance standard</header><text display-inline="yes-display-inline">The term <term>ballast water performance standard</term> or <term>performance standard</term> means a numerical ballast water performance standard specified under subsection (c) or established under subsection (d).</text></paragraph> 
<paragraph id="HF2D44605865B45D8A9AE850E316ECFED"><enum>(4)</enum><header>Ballast water treatment system</header><text display-inline="yes-display-inline">The term <term>ballast water treatment system</term> means any equipment on board a commercial vessel (including all compartments, piping, spaces, tanks, and multi-use compartments, piping, spaces, and tanks) that is—</text> 
<subparagraph id="H75555B6B41ED4C9198FFA046E1428BED"><enum>(A)</enum><text>designed for loading, carrying, treating, or discharging ballast water; and</text></subparagraph> 
<subparagraph id="H60F075F59D6D42648992F85382C13B80"><enum>(B)</enum><text>installed and operated to meet a ballast water performance standard.</text></subparagraph></paragraph> 
<paragraph id="H65A94F2D8CB44A09A4E36C89ECCAD308"><enum>(5)</enum><header>Ballast water treatment technology</header><text>The term <term>ballast water treatment technology</term> or <term>treatment technology</term> means any mechanical, physical, chemical, or biological process used, either singularly or in combination, to remove, render harmless, or avoid the uptake or discharge of aquatic nuisance species within ballast water.</text></paragraph> 
<paragraph id="H6B2BEBDF6A0D4FE2911A2D01CE125248"><enum>(6)</enum><header>Biocide</header><text>The term <term>biocide</term> means a substance or organism, including a virus or fungus, that is introduced into, or produced by, a ballast water treatment technology as part of the process used to comply with a ballast water performance standard under this section.</text></paragraph> 
<paragraph id="H2851A4EBF1A84AD887BE434AF327948D"><enum>(7)</enum><header>Commercial vessel</header><text>The term <term>commercial vessel</term> means every description of watercraft, or other artificial contrivance used or capable of being used as a means of transportation on water, that is engaged in commercial service (as defined under section 2101 of title 46, United States Code).</text></paragraph> 
<paragraph id="H624727E2DFB24E07946655B6CE3302D3"><enum>(8)</enum><header>Constructed</header><text display-inline="yes-display-inline">The term <term>constructed</term> means a state of construction of a commercial vessel at which—</text> 
<subparagraph id="H7ECA9FAD236E453EA06C6EB4A8B7DBC3"><enum>(A)</enum><text>the keel is laid;</text></subparagraph> 
<subparagraph id="H9F7400B93FF94452B1513C492992855F"><enum>(B)</enum><text>construction identifiable with the specific vessel begins;</text></subparagraph> 
<subparagraph id="HA6887936E4C74D3F97EF95AF2B6F2647"><enum>(C)</enum><text>assembly of the vessel has begun comprising at least 50 tons or 1 percent of the estimated mass of all structural material of the vessel, whichever is less; or</text></subparagraph> 
<subparagraph id="H07535C6692724F8984B99409CC0430E8"><enum>(D)</enum><text>the vessel commences a major conversion.</text></subparagraph></paragraph> 
<paragraph id="H175C8FFAA15C497B81C38C472CC94D1D"><enum>(9)</enum><header>Discharge incidental to the normal operation of a commercial vessel</header> 
<subparagraph commented="no" id="HBAC0C48FD9EB40D092B460F75B1CB80E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>discharge incidental to the normal operation of a commercial vessel</term> means—</text> 
<clause commented="no" id="HECF8037D01914264983CED7BFB3C0706"><enum>(i)</enum><text>a discharge into navigable waters from a commercial vessel of—</text> 
<subclause commented="no" id="HA5A310CC0B224C9EBC9057F7AC67BFEC"><enum>(I)</enum> 
<item commented="no" display-inline="yes-display-inline" id="HC9515C157EDE4B97BC73AD1972FF265D"><enum>(aa)</enum><text>graywater (except graywater referred to in section 312(a)(6)), bilge water, cooling water, oil water separator effluent, anti-fouling hull coating leachate, boiler or economizer blowdown, byproducts from cathodic protection, controllable pitch propeller and thruster hydraulic fluid, distillation and reverse osmosis brine, elevator pit effluent, firemain system effluent, freshwater layup effluent, gas turbine wash water, motor gasoline and compensating effluent, refrigeration and air condensate effluent, seawater pumping biofouling prevention substances, boat engine wet exhaust, sonar dome effluent, exhaust gas scrubber washwater, or stern tube packing gland effluent; or</text></item> 
<item commented="no" id="H51AD89318FD74957A781C281DB12F332" indent="up1"><enum>(bb)</enum><text>any other pollutant associated with the operation of a marine propulsion system, shipboard maneuvering system, habitability system, or installed major equipment, or from a protective, preservative, or absorptive application to the hull of a commercial vessel;</text></item></subclause> 
<subclause commented="no" id="H35D0205252EA46D386A804FE264043C1"><enum>(II)</enum><text>weather deck runoff, deck wash, aqueous film forming foam effluent, chain locker effluent, non-oily machinery wastewater, underwater ship husbandry effluent, welldeck effluent, or fish hold and fish hold cleaning effluent; or</text></subclause> 
<subclause commented="no" id="HEE84A545777F4CF1BF884FE4E4EE810B"><enum>(III)</enum><text>any effluent from a properly functioning marine engine; or</text></subclause></clause> 
<clause commented="no" id="H082B4BB414484C7FA8D16E99308C8FF9"><enum>(ii)</enum><text>a discharge of a pollutant into navigable waters in connection with the testing, maintenance, and repair of a system, equipment, or engine described in subclause (I)(bb) or (III) of clause (i) whenever the commercial vessel is waterborne.</text></clause></subparagraph> 
<subparagraph id="H3E5C55531BA8481FA4E003F3E27A67A6"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>discharge incidental to the normal operation of a commercial vessel</term> does not include—</text> 
<clause id="H14E002BF506942FA96A7CC526A16B606"><enum>(i)</enum><text display-inline="yes-display-inline">a discharge into navigable waters from a commercial vessel of—</text>

<subclause id="H6BB9A405498E4504B85F3726E789EBD7"><enum>(III)</enum><text>oil or a hazardous substance within the meaning of section 311; or</text></subclause> 
<subclause id="H531A7A6C16E74715BF25888D9294AE25"><enum>(IV)</enum><text>sewage within the meaning of section 312; or</text></subclause></clause> 
<clause commented="no" id="HC88295837D8D4A89A7FFAD3880FB4B17"><enum>(ii)</enum><text>an emission of an air pollutant resulting from the operation onboard a commercial vessel of a vessel propulsion system, motor driven equipment, or incinerator.</text></clause></subparagraph></paragraph> 
<paragraph id="HC8AF8C8FF08649C48C7DCBC37F527FAA" commented="no"><enum>(10)</enum><header>Existing commercial vessel</header><text>The term <term>existing commercial vessel</term> means a commercial vessel constructed prior to January 1, 2012.</text></paragraph> 
<paragraph id="H80FD9E91079540BB87B03DBBD0C96E44"><enum>(11)</enum><header>Geographically limited area</header><text>The term <term>geographically limited area</term> means an area—</text> 
<subparagraph id="H512B4DF8C19F48518B9A13DE00A00B36"><enum>(A)</enum><text>with a physical limitation that prevents a commercial vessel from operating outside the area, as determined by the Secretary; or</text></subparagraph> 
<subparagraph id="H36E98AA18DF64D138E96D8A4EB608E88"><enum>(B)</enum><text>that is ecologically homogeneous, as determined by the Administrator, in consultation with the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HFD8A3F5F9B21446E8A2C5D79998AFAEC"><enum>(12)</enum><header>Major conversion</header><text display-inline="yes-display-inline">The term <term>major conversion</term> means a conversion of a commercial vessel that—</text> 
<subparagraph id="H10E62349FD0D45709CBC2E776E4BA0AE"><enum>(A)</enum><text>changes its ballast water capacity by 15 percent or more; or</text></subparagraph> 
<subparagraph id="H09B0C813C9964E099BD82C06BEDCD689"><enum>(B)</enum><text display-inline="yes-display-inline">prolongs the life of the commercial vessel by 10 years or more, as determined by the Secretary.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H9776740AB72C4DB7866E86EBBE0BF58D"><enum>(13)</enum><header>Manufacturer</header><text display-inline="yes-display-inline">The term <term>manufacturer</term> means a person engaged in the manufacturing, assembling, or importation of a ballast water treatment technology.</text></paragraph> 
<paragraph id="H085C59C57A8742248B4C15FB4FAF6691" commented="no"><enum>(14)</enum><header>Navigable waters</header><text>The term <term>navigable waters</term> includes the exclusive economic zone, as defined in section 107 of title 46, United States Code.</text></paragraph> 
<paragraph id="HEFA40F1671424DDCBC786C041CDD37BE"><enum>(15)</enum><header>Nonindigenous species</header><text>The term <term>nonindigenous species</term> means a species or other viable biological material that enters an ecosystem beyond its historic range.</text></paragraph> 
<paragraph id="HB289D9F2E3AF45C48E7C476551B11DA9"><enum>(16)</enum><header>Owner or operator</header><text display-inline="yes-display-inline">The term <term>owner or operator</term> means a person owning, operating, or chartering by demise a commercial vessel.</text></paragraph> 
<paragraph id="H9610E4BBFD3D4FEF9686C280CF0C2C23"><enum>(17)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the department in which the Coast Guard is operating.</text></paragraph> 
<paragraph commented="no" id="HACEBBB2DAB7042519F7C8163B82515D7"><enum>(18)</enum><header> Vessel General Permit</header><text>The term <term>Vessel General Permit</term> means the Vessel General Permit for Discharges Incidental to the Normal Operation of Vessels issued by the Administrator under section 402 for ballast water and other discharges incidental to the normal operation of vessels, as in effect on December 19, 2008, for all jurisdictions except Alaska and Hawaii, and February 6, 2009, for Alaska and Hawaii.</text></paragraph></subsection> 
<subsection id="H0AE70D02D5E74510ADB7096B4436D815"><enum>(b)</enum><header>General provisions</header> 
<paragraph id="HFE228207022B4F9EA94602BBD06F538A" commented="no"><enum>(1)</enum><header>Ballast water discharge requirements for commercial vessels</header><text display-inline="yes-display-inline">An owner or operator may discharge ballast water from a commercial vessel into navigable waters only if—</text> 
<subparagraph id="HD27A8E8B943747D6B65EDDE67C45DC26" commented="no"><enum>(A)</enum><text>the discharge—</text> 
<clause id="HFEE9F7C5965141A0AF982AD0FBBF4B14" commented="no"><enum>(i)</enum><text>meets the ballast water performance standard;</text></clause> 
<clause id="H54695994DA94408BB683C68FF45C3425" commented="no"><enum>(ii)</enum><text>is made pursuant to the safety exemption established by subsection (c)(2);</text></clause> 
<clause id="HA1AC6DB0088048C195B9E2BE1842BD65" commented="no"><enum>(iii)</enum><text>meets the requirements of an alternative method of compliance established for the commercial vessel under subsection (f); or</text></clause> 
<clause id="H24110B8E8105444095F8F15337F8FDEA" commented="no"><enum>(iv)</enum><text>is made pursuant to a determination that the commercial vessel meets the requirements relating to geographically limited areas under subsection (g); and</text></clause></subparagraph> 
<subparagraph id="H4369428510914853B11011E2C7D0D848" commented="no"><enum>(B)</enum><text>the owner or operator discharges the ballast water in accordance with a ballast water management plan approved under subsection (i).</text></subparagraph></paragraph> 
<paragraph commented="no" id="H5956770EAD5B4FAAA375B42C1AC39646"><enum>(2)</enum><header>Applicability</header> 
<subparagraph commented="no" id="HF343DBEDE4B8429FA6A06358E9F6691F"><enum>(A)</enum><header>Covered vessels</header><text>Paragraph (1) shall apply to the owner or operator of a commercial vessel that is designed, constructed, or adapted to carry ballast water if the commercial vessel is—</text> 
<clause commented="no" id="H143BD665C85B479E95D5FD0682939CC2"><enum>(i)</enum><text>documented under the laws of the United States; or</text></clause> 
<clause commented="no" id="H7AD15AF9C0914EFBBFC966E87FC405B8"><enum>(ii)</enum><text display-inline="yes-display-inline">operating in navigable waters on a voyage to or from a point in the United States.</text></clause></subparagraph> 
<subparagraph commented="no" id="H71FA3A4E32AA4E64BF4F63C66FD84671"><enum>(B)</enum><header>Exempted vessels</header><text>Paragraph (1) shall not apply to the owner or operator of—</text> 
<clause commented="no" id="H0EBC80588CDD45BDBD1A43DF41DDEC5B"><enum>(i)</enum><text display-inline="yes-display-inline">a commercial vessel that carries all of its ballast water in sealed tanks that are not subject to discharge;</text></clause> 
<clause commented="no" id="HCBDA9B3FE770457A934D97AA26FCAA5C"><enum>(ii)</enum><text display-inline="yes-display-inline">a commercial vessel that continuously takes on and discharges ballast water in a flow-through system;</text></clause> 
<clause commented="no" id="H5A0980F3CDCF4BB588BD7592AC46840E"><enum>(iii)</enum><text display-inline="yes-display-inline">any vessel in the National Defense Reserve Fleet that is scheduled to be disposed of through scrapping or sinking;</text></clause> 
<clause commented="no" id="H373A35EF09AB44B2843CDFDA2F960E56"><enum>(iv)</enum><text display-inline="yes-display-inline">a commercial vessel that discharges ballast water consisting solely of water—</text> 
<subclause commented="no" id="H8D081233DA1144E1B776D33738B48BC9"><enum>(I)</enum><text>taken aboard from a municipal or commercial source; and</text></subclause> 
<subclause commented="no" id="HC31C0F1C4A3B452BBAE6C16BAE60F6B9"><enum>(II)</enum><text>that, at the time the water is taken aboard, meets the applicable regulations or permit requirements for such source under the Safe Drinking Water Act (42 U.S.C. 300f et seq.) and section 402 of this Act; or</text></subclause></clause> 
<clause commented="no" id="H4CAA34614DFF45878B83694815C0DF46"><enum>(v)</enum><text display-inline="yes-display-inline">a commercial vessel that is 3 years or fewer from the end of its useful life, as determined by the Secretary, on the date on which the regulations issued under paragraph (3) become effective for the vessel pursuant to the implementation schedule issued under paragraph (3)(B).</text></clause></subparagraph> 
<subparagraph commented="no" id="HDC157C57EE3F4CB19DD374417ED87C76"><enum>(C)</enum><header>Limitation</header><text display-inline="yes-display-inline">An exemption under subparagraph (B)(v) shall cease to be effective on the date that is 3 years after the date on which the regulations under paragraph (3) become effective for the commercial vessel pursuant to the implementation schedule issued under paragraph (3)(B).</text></subparagraph></paragraph> 
<paragraph commented="no" id="H60A306FD92AC48A69A5E546D84D7716D"><enum>(3)</enum><header>Issuance of regulations</header> 
<subparagraph commented="no" id="H8461518E429D4783B2E812E8EB7EE6E9"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this section, the Secretary, in consultation with the Administrator, shall issue final regulations to implement the requirements of this section.</text></subparagraph> 
<subparagraph commented="no" id="H5254BE692F304557BF55527110ED9482"><enum>(B)</enum><header>Proposed rule</header><text>For the purposes of chapter 5 of title 5, United States Code, the proposed rulemaking published by the Coast Guard on August 28, 2009 (74 Fed. Reg. 44632; relating to standards for living organisms in ships’ ballast water discharged in U.S. waters), shall serve as a proposed rule for the purposes of issuing regulations under this section.</text></subparagraph></paragraph> 
<paragraph id="HA728B9CABB954B4C850DF8D2EA22C793" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Compliance schedules</header> 
<subparagraph id="HFF75AB0534784F38B833DD67F9E2F721"><enum>(A)</enum><header>Initial performance standard compliance deadlines</header> 
<clause id="H09FC8CAEDEE64756B6D0172710F6EE8D"><enum>(i)</enum><header>In general</header><text>An owner or operator shall comply with the performance standard established under subsection (c) on or before the deadline that applies to the commercial vessel of the owner or operator, as specified in clause (ii).</text></clause> 
<clause id="H14D833F666B84B83BA29DF05E716606E"><enum>(ii)</enum><header>Deadlines</header><text>The deadlines for compliance with the performance standard established under subsection (c) are as follows:</text> 
<subclause id="H7D63884AC48C4633BC74A470DA0D30AA" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text>For a commercial vessel constructed on or after January 1, 2012, the date of delivery of the vessel.</text></subclause> 
<subclause id="HBC71AA6A39C94C2C86D81F38A3012066" commented="no"><enum>(II)</enum><text>For an existing commercial vessel with a ballast water capacity of less than 1,500 cubic meters, the date of the first drydocking of the vessel after January 1, 2016.</text></subclause> 
<subclause id="H863B3B384B0848438E699677802E555E" commented="no"><enum>(III)</enum><text>For an existing commercial vessel with a ballast water capacity of at least 1,500 cubic meters but not more than 5,000 cubic meters, the date of the first drydocking of the vessel after January 1, 2014.</text></subclause> 
<subclause id="H5419359A52874DF5B68219C7067E7B86" commented="no"><enum>(IV)</enum><text>For an existing commercial vessel with a ballast water capacity of greater than 5,000 cubic meters, the date of the first drydocking of the vessel after January 1, 2016.</text></subclause></clause> 
<clause id="HBFC305BB631F416EB4235149654C5EEC"><enum>(iii)</enum><header>Regulations</header><text>In issuing regulations under paragraph (3), the Secretary shall include a compliance schedule that sets forth the deadlines specified in clause (ii).</text></clause></subparagraph> 
<subparagraph id="HAA3D2C157ABB4D71A2A9DF55FC94573F" commented="no"><enum>(B)</enum><header>Revised performance standard compliance deadlines</header> 
<clause id="H3F86AB3D40294700A781F705E0F38CF5"><enum>(i)</enum><header>In general</header><text>Upon revision of a performance standard under subsection (d), the Secretary, in consultation with the Administrator, shall issue a compliance schedule that establishes deadlines for an owner or operator to comply with the revised performance standard.</text></clause> 
<clause id="H3B32F6C68E3040A88D8C1B3FB96B96D9"><enum>(ii)</enum><header>Factors</header><text>In issuing a compliance schedule under this subparagraph, the Secretary—</text> 
<subclause id="H10A9F00225784D83AA82C3697F3D2DCE" commented="no"><enum>(I)</enum><text>shall consider the factors identified in subparagraph (C)(iv); and</text></subclause> 
<subclause id="HF201918748A443B29AFD4FB9319F0F57" commented="no"><enum>(II)</enum><text>may establish different compliance deadlines based on vessel class, type, or size.</text></subclause></clause> 
<clause id="H6AC57C2CB65C42A697A66CB0CC34A052"><enum>(iii)</enum><header>Vessels constructed after issuance of revised performance standards</header><text display-inline="yes-display-inline">A compliance schedule issued under this subparagraph with respect to a revised performance standard shall require, at a minimum, the owner or operator of a commercial vessel that commences a major conversion or is constructed on or after the date of issuance of the revised performance standard to comply with the revised performance standard.</text></clause></subparagraph> 
<subparagraph id="H3C7C8897D7014EC8B74F7FA68EC614AB" commented="no"><enum>(C)</enum><header>Extension of compliance deadlines</header> 
<clause id="H7F2B1B4FA4FF4EACA708F69C82109154"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may extend a compliance deadline established under subparagraph (A) or (B) on the Secretary’s own initiative or in response to a petition submitted by an owner or operator.</text></clause> 
<clause id="HFA05880B956A4310B16F896D964EA660"><enum>(ii)</enum><header>Processes for granting extensions</header><text>In issuing regulations under paragraph (3), the Secretary shall establish—</text> 
<subclause id="H9640F609667843F7BB5E7D7BA66D29D8"><enum>(I)</enum><text display-inline="yes-display-inline">a process for the Secretary, in consultation with the Administrator, to issue an extension of a compliance deadline established under subparagraph (A) or (B) for a commercial vessel (or class, type, or size of vessel); and </text></subclause> 
<subclause id="H0CC69A5A17FC434FADDE76C33695105D"><enum>(II)</enum><text>a process for an owner or operator to submit a petition to the Secretary for an extension of a compliance deadline established under subparagraph (A) or (B) with respect to the commercial vessel of the owner or operator.</text></subclause></clause> 
<clause id="HD7752E93690540D0897B89C1A677BBCD"><enum>(iii)</enum><header>Period of extensions</header><text>An extension issued under this subparagraph shall—</text> 
<subclause id="HBCB7EBC6D752427482DFBC30BB4C92E5"><enum>(I)</enum><text>apply for a period of not to exceed 18 months; and</text></subclause> 
<subclause id="H5F9B5BF899A644688C2AD1DD31E233B4"><enum>(II)</enum><text>be renewable for an additional period of not to exceed 18 months.</text></subclause></clause> 
<clause id="H520E9F6868F94F21A45D48F16660F148"><enum>(iv)</enum><header>Factors</header><text>In issuing an extension or reviewing a petition under this subparagraph, the Secretary shall consider, with respect to the ability of an owner or operator to meet a compliance deadline, the following factors:</text> 
<subclause id="HAE3002CC790D4C48BC2F60D97F1B1EE6" commented="no"><enum>(I)</enum><text>Whether the treatment technology to be installed is available in sufficient quantities to meet the compliance deadline.</text></subclause> 
<subclause id="H72894B64C6EB4FA58C19541118ED9BA7" commented="no"><enum>(II)</enum><text>Whether there is sufficient shipyard or other installation facility capacity.</text></subclause> 
<subclause id="HA7E6185D5332439CBAA84E859DCA171A" commented="no"><enum>(III)</enum><text>Whether there is sufficient availability of engineering and design resources.</text></subclause> 
<subclause id="HC9D479EDA92646BE85802186F7A15FF4" commented="no"><enum>(IV)</enum><text>Vessel characteristics, such as engine room size, layout, or a lack of installed piping.</text></subclause> 
<subclause id="H7C6B36D0AD8D46EEAF3943FF569E2BEF" commented="no"><enum>(V)</enum><text>Electric power generating capacity aboard the vessel.</text></subclause> 
<subclause id="H785B16ED0D0349ADBB32BAF2B48B884E" commented="no"><enum>(VI)</enum><text>Safety of the vessel and crew.</text></subclause></clause> 
<clause id="HFD18C1DA91DE42DB8ABE6CC65E828C1C" commented="no"><enum>(v)</enum><header>Consideration of petitions</header> 
<subclause id="H8C5AB2C3EF50441FB8A52152CFB86101"><enum>(I)</enum><header>Determinations</header><text>The Secretary shall approve or deny a petition for an extension of a compliance deadline submitted by an owner or operator under this subparagraph.</text></subclause> 
<subclause id="H48B49932159D45768165CBC0BE5DED0D"><enum>(II)</enum><header>Deadline</header><text>If the Secretary does not approve or deny a petition referred to in subclause (I) on or before the last day of the 90-day period beginning on the date of submission of the petition, the petition shall be deemed approved.</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="HFAEC153BD800498385C12DDA39BD3605"><enum>(c)</enum><header>Ballast water performance standard for commercial vessels</header> 
<paragraph commented="no" id="HEBD44E01DC174B22BF2E365908BC7C05"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To meet the ballast water performance standard, an owner or operator shall—</text> 
<subparagraph commented="no" id="H42EE9C471397479DBDEA858C4B0B2D87"><enum>(A)</enum><text>conduct ballast water treatment before discharging ballast water from a commercial vessel into navigable waters using a ballast water treatment technology certified for the vessel (or class, type, or size of vessel) under subsection (e); and</text></subparagraph> 
<subparagraph commented="no" id="H16878388FAF24571B9FD4C0D9CA206FD"><enum>(B)</enum><text>ensure that any ballast water so discharged meets, at a minimum, the numerical ballast water performance standard set forth in the International Convention for the Control and Management of Ships’ Ballast Water and Sediments, as adopted on February 13, 2004, or a revised numerical ballast water performance standard established under subsection (d).</text></subparagraph></paragraph> 
<paragraph id="HF6BE35BF14F04B7DA320696634C12B5C"><enum>(2)</enum><header>Safety exemption</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), an owner or operator may discharge ballast water without regard to a ballast water performance standard if—</text> 
<subparagraph id="H0CBF62480AD749D795097FE05342FB4C"><enum>(A)</enum><text>the discharge is done solely to ensure the safety of life at sea;</text></subparagraph> 
<subparagraph id="H7A586C6325E34EDCB1B837024528593D"><enum>(B)</enum><text>the discharge is accidental and the result of damage to the commercial vessel or its equipment and—</text> 
<clause id="H7A6C4A79D7A047DBAE24010A2C53C79B"><enum>(i)</enum><text>all reasonable precautions to prevent or minimize the discharge have been taken; and</text></clause> 
<clause id="H4524C7AFF4244E6CA7336EB3022A7071"><enum>(ii)</enum><text>the owner or operator did not willfully or recklessly cause such damage; or</text></clause></subparagraph> 
<subparagraph id="H3B8C92324F0A4FEC8B79F217FB7C1807"><enum>(C)</enum><text>the discharge is solely for the purpose of avoiding or minimizing discharge from the vessel of pollution that would otherwise violate an applicable Federal or State law.</text></subparagraph></paragraph></subsection> 
<subsection id="H6511B918A8D44EEE9E40A202A2647452"><enum>(d)</enum><header>Review of performance standard</header> 
<paragraph id="HD733773119A04723986D43B6A8D3DC72"><enum>(1)</enum><header>In general</header><text>Not later than January 1, 2016, and every 10 years thereafter, the Administrator, in consultation with the Secretary, shall complete a review to determine whether revising the ballast water performance standard would result in a scientifically demonstrable and substantial reduction in the risk of the introduction or establishment of aquatic nuisance species.</text></paragraph> 
<paragraph id="HE4B58368B2FD49EEA9F514EE8FE49D0B"><enum>(2)</enum><header>Considerations</header><text>In conducting the review, the Administrator shall consider—</text> 
<subparagraph id="H868656A86EE042E79DB699AD8AC22673"><enum>(A)</enum><text display-inline="yes-display-inline">improvements in the scientific understanding of biological and ecological processes that lead to the introduction or establishment of aquatic nuisance species;</text></subparagraph> 
<subparagraph id="HC97AD24223234B1C916034E2455820E7"><enum>(B)</enum><text>improvements in ballast water treatment technology, including—</text> 
<clause id="HF1605DDBF9854785949B103723C819F7"><enum>(i)</enum><text>the capability of such technology to achieve a revised ballast water performance standard;</text></clause> 
<clause id="HA45570B1FBCC4FE695C2B3CE4F4328ED"><enum>(ii)</enum><text>the effectiveness and reliability of such technology in the shipboard environment;</text></clause> 
<clause id="H79112791709E4D719CBE1F708D08D6C7"><enum>(iii)</enum><text display-inline="yes-display-inline">the compatibility of such technology with the design and operation of commercial vessels by class, type, and size;</text></clause> 
<clause id="H40E60AC1973443D68467DA986821C13E"><enum>(iv)</enum><text>the commercial availability of such technology; and</text></clause> 
<clause id="HA293996AC1AE4CC1A605550AA54E8482"><enum>(v)</enum><text>the safety of such technology;</text></clause></subparagraph> 
<subparagraph id="HD6B9BADF5A8641ECA726D89EB2CFF414"><enum>(C)</enum><text>improvements in the capabilities to detect, quantify, and assess the viability of aquatic nuisance species at the concentrations under consideration;</text></subparagraph> 
<subparagraph id="H92979894B2A04C7DAA70C46607862542"><enum>(D)</enum><text>the impact of ballast water treatment technology on water quality; and</text></subparagraph> 
<subparagraph id="H46A370DA86EB49CEBEA717726C944D19"><enum>(E)</enum><text>the costs, cost-effectiveness, and impacts of—</text> 
<clause id="HCE5D7F1200C7426A97E6988A371CE824"><enum>(i)</enum><text>a revised ballast water performance standard, including the potential impacts on shipping, trade, and other uses of the aquatic environment; and</text></clause> 
<clause id="H78296AA3D05A4B55ACBF2D772B2CFB95"><enum>(ii)</enum><text>maintaining the existing ballast water performance standard, including the potential impacts on water-related infrastructure, recreation, the propagation of native fish, shellfish, and wildlife, and other uses of navigable waters.</text></clause></subparagraph></paragraph> 
<paragraph id="H35AC2178F84F4DA0B50208B1273DF84C"><enum>(3)</enum><header>Revision of performance standard</header> 
<subparagraph id="H878250489E804DDC8F581B292A42B7F7"><enum>(A)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">If, pursuant to a review conducted under paragraph (1), the Administrator, in consultation with the Secretary, determines that revising the ballast water performance standard would result in a scientifically demonstrable and substantial reduction in the risk of the introduction or establishment of aquatic nuisance species, the Administrator shall undertake a rulemaking to revise the performance standard.</text></subparagraph> 
<subparagraph commented="no" id="H4F1A8010E062477F8B241024C30172BA"><enum>(B)</enum><header>Special rule</header><text>The Administrator may not issue a revised performance standard pursuant to this paragraph that applies to a commercial vessel constructed prior to the date on which the revised performance standard is issued unless the revised performance standard is at least 2 orders of magnitude more stringent than the performance standard in effect on the date that the review is completed.</text></subparagraph></paragraph> 
<paragraph id="HF5E51CD3413D4F6D9A23B35CF91596C0"><enum>(4)</enum><header>State petition for review of performance standards</header> 
<subparagraph id="H350857091D5342A6B87B9C34B8D917ED"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Governor of a State may submit a petition requesting that the Administrator review a ballast water performance standard if there is significant new information that could reasonably indicate the performance standard could be revised to result in a scientifically demonstrable and substantial reduction in the risk of the introduction or establishment of aquatic nuisance species.</text></subparagraph> 
<subparagraph id="H7D7F52B8D2C548D8A36D29C7D4BA4FA2"><enum>(B)</enum><header>Timing</header><text>A Governor may not submit a petition under subparagraph (A) during the 1-year period following the date of completion of a review under paragraph (1).</text></subparagraph> 
<subparagraph id="H91D43E88DB944AF1A6E4CD54DD93A06F"><enum>(C)</enum><header>Required information</header><text>A petition submitted to the Administrator under subparagraph (A) shall include the scientific and technical information on which the petition is based.</text></subparagraph> 
<subparagraph id="H216DE698E9904E6DAB5FC902D33AC3FF"><enum>(D)</enum><header>Review and reporting</header><text>Upon receipt of a petition from a Governor under subparagraph (A), the Administrator shall make publicly available a copy of the petition, including the scientific and technical information provided by the Governor under subparagraph (C).</text></subparagraph> 
<subparagraph id="H53D91D96475E4328A33B2D12815DFEBC"><enum>(E)</enum><header>Review and revision of performance standards</header> 
<clause id="H2AB24C5DF06D428DBEAA5244955A0CA0"><enum>(i)</enum><header>In general</header><text>If, after receiving a petition submitted by a Governor under subparagraph (A) for review of a performance standard, the Administrator, in consultation with the Secretary, determines that the petition warrants additional action, the Administrator may—</text> 
<subclause id="HC05C22E544CA4A739CB9CEDED2EF2ABE"><enum>(I)</enum><text>in consultation with the Secretary, initiate a review of the performance standard under paragraph (1); and</text></subclause> 
<subclause id="H68DF4AA2E5E449239F481FB41963B4F7"><enum>(II)</enum><text>in consultation with the Secretary, revise the performance standard through a rulemaking under paragraph (3)(A), subject to the limitation in paragraph (3)(B).</text></subclause></clause> 
<clause id="HE9A9D5B9F66442D4BF3AE2BC6441BF8E"><enum>(ii)</enum><header>Treatment of more than one petition as a single petition</header><text>The Administrator may treat more than one petition as a single petition for review.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H77E2F2E587A24D829FE43B9879ED398C"><enum>(e)</enum><header>Treatment technology certification</header> 
<paragraph commented="no" id="HF331D3FFC21B4B2193E8432B8AC67275"><enum>(1)</enum><header>Certification required</header> 
<subparagraph commented="no" id="HB8792F3EC5124B23AF4AAB67F73A86DB"><enum>(A)</enum><header>Certification process</header> 
<clause commented="no" id="H4FC0106A28C04BCCBCD020BC28FF81ED"><enum>(i)</enum><header>Evaluation</header><text display-inline="yes-display-inline">Upon application of a manufacturer, the Secretary shall evaluate a ballast water treatment technology with respect to—</text> 
<subclause commented="no" id="H46EC67EF5D764393A0BFEFE79182AC32"><enum>(I)</enum><text display-inline="yes-display-inline">whether the treatment technology meets the ballast water performance standard when installed on a commercial vessel (or a class, type, or size of commercial vessel);</text></subclause> 
<subclause commented="no" id="HE7DEC88FF5844D88A0272B64F04C5BFA"><enum>(II)</enum><text>the effect of the treatment technology on commercial vessel safety; and</text></subclause> 
<subclause commented="no" id="H663DC2C3145D402EBF2122AD0D904F8A"><enum>(III)</enum><text>any other criteria the Secretary considers appropriate.</text></subclause></clause> 
<clause commented="no" id="H95235492A1564A1B9F4B3BF05DCD44EC"><enum>(ii)</enum><header>Certification</header><text display-inline="yes-display-inline">If, after conducting the evaluation required by clause (i), the Secretary determines the treatment technology meets the criteria established under such clause, the Secretary may certify the treatment technology for use on a commercial vessel (or a class, type, or size of commercial vessel).</text></clause> 
<clause commented="no" id="H4B73440486DE476E8EE19C9ED67AE56F"><enum>(iii)</enum><header>Suspension and revocation of certification</header><text display-inline="yes-display-inline">The Secretary shall, by regulation, establish a process to suspend or revoke a certification issued under this subparagraph.</text></clause></subparagraph> 
<subparagraph commented="no" id="HD2FDA8BF719E453EBD6A385AD13787DE"><enum>(B)</enum><header>Certificates of type approval</header> 
<clause commented="no" id="H576014B08B954DDDA98934554CFE1725"><enum>(i)</enum><header>Issuance of certificates to manufacturer</header><text display-inline="yes-display-inline">If the Secretary certifies a ballast water treatment technology under subparagraph (A), the Secretary shall issue to the manufacturer of the treatment technology, in such form and manner as the Secretary determines appropriate, a certificate of type approval for the treatment technology.</text></clause> 
<clause commented="no" id="H3D464C8ACEAE4D7D9AA6EC2F5502ABDC"><enum>(ii)</enum><header>Conditions to be included in certificates</header><text>A certificate of type approval issued under clause (i) shall include any conditions that are imposed by the Secretary under paragraph (2).</text></clause> 
<clause commented="no" id="H6560054672D14B2B9FBB4E2E264A18CF"><enum>(iii)</enum><header>Issuance of copies of certificates to owners and operators</header><text display-inline="yes-display-inline">A manufacturer that receives a certificate of type approval under clause (i) for a ballast water treatment technology shall furnish a copy of the certificate to any owner or operator of a commercial vessel on which the treatment technology is installed.</text></clause> 
<clause commented="no" id="H43F1D9A316264B3CAE6D22BAAFD29CC8"><enum>(iv)</enum><header>Inspections</header><text display-inline="yes-display-inline">An owner or operator who receives a copy of a certificate under clause (iii) for a ballast water treatment technology installed on a commercial vessel shall retain a copy of the certificate onboard the commercial vessel and make the copy of the certificate available for inspection at all times that such owner or operator is utilizing the treatment technology.</text></clause></subparagraph> 
<subparagraph commented="no" id="H9ECD5B8537104A0DBCCBC8AAD99955F0"><enum>(C)</enum><header>Treatment technologies that use or generate biocides</header><text display-inline="yes-display-inline">The Secretary may not certify a ballast water treatment technology that—</text> 
<clause commented="no" id="H4CD9578F22B849A4B8C5EC0BB1345EAA"><enum>(i)</enum><text>uses a biocide or generates a biocide that is a <term>pesticide</term>, as defined in section 2 of the Federal Insecticide, Fungicide, and Rodenticide Act (7 U.S.C. 136), unless the biocide is registered under such Act or the Administrator has approved the use of such biocide in such treatment technology; or</text></clause> 
<clause commented="no" id="H19AA1F99ABC34CA8B851C0B05E789DAF"><enum>(ii)</enum><text>uses or generates a biocide the discharge of which causes or contributes to a violation of a water quality standard under section 303 of this Act.</text></clause></subparagraph> 
<subparagraph commented="no" id="H01F585F40D1E494995DD9D49BE81FD01"><enum>(D)</enum><header>Prohibition</header> 
<clause id="H54665ED3D04F402A82AFBD04877506FB"><enum>(i)</enum><header>In general</header><text>Except as provided by clause (ii), an owner or operator may not use a ballast water treatment technology to comply with the requirements of this section unless the Secretary has certified the treatment technology under subparagraph (A).</text></clause> 
<clause id="HFF0B2F78998642968B646BBA4210CD2A"><enum>(ii)</enum><header>Exceptions</header> 
<subclause id="H238C8CD912594D52BE7CF5C477BC4EAB"><enum>(I)</enum><header>Coast Guard Shipboard Technology Evaluation Program</header><text>An owner or operator may use a ballast water treatment technology that has not been certified by the Secretary to comply with the requirements of this section if the technology is being evaluated under the Coast Guard Shipboard Technology Evaluation Program.</text></subclause> 
<subclause commented="no" id="HB5344C2FCF784A28A63B42E20750121B"><enum>(II)</enum><header>Ballast water treatment technologies certified by foreign entities</header><text display-inline="yes-display-inline">An owner or operator may use a ballast water treatment technology that has not been certified by the Secretary to comply with the requirements of this section if the technology has been certified by a foreign entity and the certification demonstrates performance and safety of the treatment technology equivalent to the requirements of this subsection, as determined by the Secretary.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H4F8222BBCC7E48548BD42C073D664B07"><enum>(2)</enum><header>Certification conditions</header> 
<subparagraph id="H3766C79DAEC2473D8C89D25E0123887E"><enum>(A)</enum><header>Imposition of conditions</header><text display-inline="yes-display-inline">In certifying a ballast water treatment technology under this subsection, the Secretary, in consultation with the Administrator, may impose any condition on the subsequent installation, use, or maintenance of the treatment technology onboard a commercial vessel as is necessary for—</text> 
<clause id="H21CB108A49164891AEBB3A6A923A770B"><enum>(i)</enum><text>the safety of the vessel, the crew of the vessel, and any passengers aboard the vessel;</text></clause> 
<clause id="HD730580F3D284B02A7BBB1A453AFDB6C"><enum>(ii)</enum><text>the protection of the environment; and</text></clause> 
<clause id="H289D2E1974ED40BCABC31783E514D9E2"><enum>(iii)</enum><text display-inline="yes-display-inline">the effective operation of the treatment technology.</text></clause></subparagraph> 
<subparagraph id="H70FA75333AFC4133ABF5A2623E252EC1"><enum>(B)</enum><header>Failure to comply</header><text display-inline="yes-display-inline">The failure of an owner or operator to comply with a condition imposed under subparagraph (A) is a violation of this section.</text></subparagraph></paragraph> 
<paragraph id="H7E5564F612B14882A87F18490DF66119" commented="no"><enum>(3)</enum><header>Use of ballast water treatment technologies once installed</header> 
<subparagraph id="H51D8ADE5D72242ED96607F4A599A2992"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), an owner or operator who installs a ballast water treatment technology that the Secretary has certified under paragraph (1) may use the treatment technology, notwithstanding any revisions to a ballast water performance standard occurring after the installation so long as the owner or operator—</text> 
<clause id="H644D1F3173FF455EB69EE4BD490AF9B0" commented="no"><enum>(i)</enum><text>maintains the treatment technology in proper working condition; and</text></clause> 
<clause id="HC1DA96AB96914D0D8291F91D33D80F33" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">maintains and uses the treatment technology in accordance with—</text> 
<subclause id="HF102D4E48E0E4B8F84AE7707D21FFEA1" commented="no"><enum>(I)</enum><text>the manufacturer’s specifications; and</text></subclause> 
<subclause commented="no" id="H619477EA02C84670A064DCC725565B80"><enum>(II)</enum><text>any conditions imposed by the Secretary under paragraph (2).</text></subclause></clause></subparagraph> 
<subparagraph id="H9CA71735A2284092B2B79ADBFE1714B3" commented="no"><enum>(B)</enum><header>Limitation</header><text>Subparagraph (A) shall cease to apply with respect to a commercial vessel after the first to occur of the following:</text> 
<clause id="HD85F0B7BD9244859995E145D88919C97"><enum>(i)</enum><text>The expiration of the service life of the ballast water treatment technology of the vessel, as determined by the Secretary.</text></clause> 
<clause id="HDEA36AC8D765460DB334448C8A5A12EC"><enum>(ii)</enum><text>The expiration of service life of the vessel, as determined by the Secretary.</text></clause> 
<clause id="H6E96E4EDD38C4F39BC2420F5F8F44735"><enum>(iii)</enum><text display-inline="yes-display-inline">The completion of a major conversion of the vessel.</text></clause></subparagraph></paragraph> 
<paragraph id="HACF88CD5AEFD471B8BBA004A767B5AED"><enum>(4)</enum><header>Testing protocols</header><text>Not later than 180 days after the date of enactment of this section, the Administrator, in consultation with the Secretary, shall issue guidelines specifying land-based and shipboard testing protocols or criteria for—</text> 
<subparagraph id="H85A67C66233B4C50B9314F8055233668"><enum>(A)</enum><text>certifying the performance of ballast water treatment technologies under this subsection; and</text></subparagraph> 
<subparagraph id="H438CEBDF1BB2487DB7B480790B4DC4BB"><enum>(B)</enum><text display-inline="yes-display-inline">certifying laboratories to evaluate such treatment technologies.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H5A72DB76EDC244C9B1BC4EC3DAE236CA"><enum>(5)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Following the date on which the requirements of subsection (b)(1) apply with respect to a commercial vessel pursuant to the implementation schedule issued under subsection (b)(3)(B), no manufacturer of a ballast water treatment technology shall sell, offer for sale, or introduce or deliver for introduction into interstate commerce, or import into the United States for sale or resale, a ballast water treatment technology for the commercial vessel unless the technology has been certified under this subsection.</text></paragraph></subsection> 
<subsection commented="no" id="H17BDC1BBC29A49A1B9B7DFF2BCB53EDC"><enum>(f)</enum><header>Alternative methods of compliance</header> 
<paragraph commented="no" id="H314A830E16594965AF5D492CA6BE6C1E"><enum>(1)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this section, the Secretary, in consultation with the Administrator, shall establish an alternative method of compliance with this section for a commercial vessel having a maximum ballast water capacity of less than 8 cubic meters.</text></paragraph> 
<paragraph commented="no" id="H8B08F79886FA43858B1B806205350493"><enum>(2)</enum><header>Factors for consideration</header><text>In establishing an alternative method of compliance under paragraph (1), the Secretary shall consider—</text> 
<subparagraph commented="no" id="HB0F980A0F06A4594BF282BC77A361D23"><enum>(A)</enum><text display-inline="yes-display-inline">the effectiveness of the alternative method in reducing the risk of the introduction or establishment of aquatic nuisance species relative to the performance standard; and</text></subparagraph> 
<subparagraph commented="no" id="H9FB349F279054E9CB83B94A9236BB155"><enum>(B)</enum><text>any other factor the Secretary considers appropriate.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H532879DF6FD74A85B8C9B7FCA20AA389"><enum>(3)</enum><header>Best management practices</header><text display-inline="yes-display-inline">The Secretary may establish as an alternative method of compliance appropriate ballast water best management practices to minimize the introduction or establishment of aquatic nuisance species.</text></paragraph></subsection> 
<subsection commented="no" id="H8281D0F8DA694919AC714F161DA432C4"><enum>(g)</enum><header>Geographically limited areas</header> 
<paragraph commented="no" id="HC27119CE1E3B42DBA87D80A40CD5BEFC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subsections (c), (e), and (i) shall not apply to a commercial vessel that—</text> 
<subparagraph commented="no" id="H47B536FD47664462863897A514EE1ECA"><enum>(A)</enum><text>operates exclusively within a geographically limited area, as determined by the Secretary, in consultation with the Administrator; or</text></subparagraph> 
<subparagraph commented="no" id="H7309FCEB56B3459B97A1658C80103BC2"><enum>(B)</enum><text>operates pursuant to a geographic restriction issued for the commercial vessel under section 3309 of title 46, United States Code.</text></subparagraph></paragraph> 
<paragraph commented="no" id="HEAD9ACA7F2D74FC398E14EC97CC962B5"><enum>(2)</enum><header>Petition for determination by the Secretary</header> 
<subparagraph id="H97929D98E49B4C5E9A00A271E3862142"><enum>(A)</enum><header>Submission of petitions</header><text>Following the date of issuance of final regulations under subsection (b), an owner or operator may petition the Secretary for a determination under paragraph (1).</text></subparagraph> 
<subparagraph id="H4C688BF5008749F18B8907396B9CD2E2"><enum>(B)</enum><header>Determinations</header><text display-inline="yes-display-inline">The Secretary shall approve or deny a petition submitted by an owner or operator under subparagraph (A).</text></subparagraph> 
<subparagraph id="HC041A36EA44146719472D48E0DAB1C22"><enum>(C)</enum><header>Deadline</header><text display-inline="yes-display-inline">If the Secretary does not approve or deny a petition submitted by an owner or operator under subparagraph (A) on or before the last day of the 90-day period beginning on the date of submission of the petition, the petition shall be deemed approved.</text></subparagraph></paragraph> 
<paragraph commented="no" id="HD5E8D5835DBF4145A46CA402D094F800"><enum>(3)</enum><header>Notification</header><text display-inline="yes-display-inline">The Secretary shall notify the Administrator and the Governor of each State the waters of which could be affected by the discharge of ballast water from a commercial vessel for which a petition has been granted under paragraph (2) of the granting of any such petition.</text></paragraph> 
<paragraph id="H09E0FABC50C54BB283774196F0998BBF" commented="no"><enum>(4)</enum><header>Best management practices</header><text>For a commercial vessel for which a petition is granted under paragraph (2), the Secretary shall require the owner or operator to implement appropriate ballast water best management practices to minimize the introduction or establishment of aquatic nuisance species.</text></paragraph></subsection> 
<subsection id="H50E070903DE345718161A38B284E93B4"><enum>(h)</enum><header>Reception facilities</header> 
<paragraph id="H468F2011F6444E8F8B21AD507A2DED61"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An owner or operator shall discharge ballast water in compliance with subsection (c) or (f) unless discharging ballast water into—</text> 
<subparagraph id="HD4468ADE564C4405987D8EC994A52064"><enum>(A)</enum><text>an onshore facility for the reception of ballast water that meets standards issued by the Administrator, in consultation with the Secretary; or</text></subparagraph> 
<subparagraph id="HCB37F1889D66419296473B0AE163ED0A"><enum>(B)</enum><text>an offshore facility for the reception of ballast water that meets standards issued by the Secretary, in consultation with the Administrator.</text></subparagraph></paragraph> 
<paragraph id="HCDA616A23C2A43B88FD0BB92A769F3B7"><enum>(2)</enum><header>Issuance of standards</header><text>Not later than 2 years after the date of enactment of this section—</text> 
<subparagraph commented="no" id="HE325FBD61FB24E4E95713EBA616E600F"><enum>(A)</enum><text display-inline="yes-display-inline">the Administrator, in consultation with the Secretary, shall issue the standards referred to in paragraph (1)(A); and</text></subparagraph> 
<subparagraph commented="no" id="HDDA51128A404465EACB4478C0880D529"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary, in consultation with the Administrator, shall issue the standards referred to in paragraph (1)(B).</text></subparagraph></paragraph> 
<paragraph commented="no" id="H757BFA3A33A9483091D73AE3830CBA29"><enum>(3)</enum><header>Sole method of discharge</header><text>The Secretary, in consultation with the Administrator, and upon petition by an owner or operator, may issue to an owner or operator a certificate stating that a commercial vessel is in compliance with the requirements of subsection (b)(1)(A) if discharging ballast water into a facility meeting the standards issued under this subsection is the sole method by which the owner or operator discharges ballast water from the commercial vessel.</text></paragraph> 
<paragraph id="H51F806FABF6047A09970F1425C3E3621" commented="no"><enum>(4)</enum><header>Ballast water management plans</header><text>An owner or operator discharging ballast water under this subsection shall discharge such water in accordance with a ballast water management plan approved under subsection (i).</text></paragraph></subsection> 
<subsection id="H35E4CE8DDD084935BCBD56EEC5EB667F"><enum>(i)</enum><header>Commercial vessel ballast water management plan</header> 
<paragraph id="H36D32015B9584B7C9EA9D8D762DDEE75"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An owner or operator shall discharge ballast water in accordance with a ballast water management plan that—</text> 
<subparagraph id="HC75EC94670B94B9CA547DDDA1932ECFD"><enum>(A)</enum><text>meets requirements prescribed by the Secretary; and</text></subparagraph> 
<subparagraph id="H6A899E4D9CE04D76BEE0A28975B48875"><enum>(B)</enum><text>is approved by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HAF87E15371EE407DBCBF0206AAFAEE48"><enum>(2)</enum><header>Foreign commercial vessels</header><text display-inline="yes-display-inline">The Secretary may approve a ballast water management plan for a foreign commercial vessel on the basis of a certificate of compliance issued by the country of registration of the commercial vessel if the requirements of the government of that country for a ballast water management plan are substantially equivalent to regulations issued by the Secretary.</text></paragraph> 
<paragraph id="HB72CF67B378643CE98172C4E5313C008"><enum>(3)</enum><header>Recordkeeping</header> 
<subparagraph id="H23FECE017E8C411DB0356FE58926A43A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided by subparagraph (B), an owner or operator shall maintain in English and have available for inspection by the Secretary a ballast water record book in which each operation of the commercial vessel involving a ballast water discharge is recorded in accordance with regulations issued by the Secretary.</text></subparagraph> 
<subparagraph id="H342821DE66DA498AB7ECF56CEF4DF3F8"><enum>(B)</enum><header>Alternative means of recordkeeping</header><text>The Secretary may provide for alternative methods of recordkeeping, including electronic recordkeeping, to comply with the requirements of this paragraph.</text></subparagraph></paragraph></subsection> 
<subsection id="HC3D24FB743CD45D2869894EC5A91549E"><enum>(j)</enum><header>Regulation of ballast water discharges</header><text>Effective on and after the date of enactment of this section—</text> 
<paragraph id="H89159FD38472422D8D13FF03B93FBB7E"><enum>(1)</enum><text>the Administrator (or a State in the case of a permit program approved under section 402) shall not require any new permit or permit condition under section 402 for any discharge of ballast water from a commercial vessel into navigable waters; and</text></paragraph> 
<paragraph id="HBAA2F4AAF6D942E98E31DCA43C832B89"><enum>(2)</enum><text>except as provided by subsection (k), a State or political subdivision thereof shall not adopt or enforce any law or regulation of the State or political subdivision with respect to such a discharge.</text></paragraph></subsection> 
<subsection id="H6CEF77F0A8CA4C318B06904AD9BDF66A"><enum>(k)</enum><header>State authority</header> 
<paragraph id="HA82056C6CD5B452A8F718692CBCE6AF0"><enum>(1)</enum><header>State programs</header><text>The Governor of a State desiring to administer its own inspection and enforcement authority for ballast water discharges within its jurisdiction may submit to the Secretary a complete description of the program the Governor proposes to establish and administer under State law. In addition, the Governor shall submit a statement from the State attorney general that the laws of the State provide adequate authority to carry out the described program.</text></paragraph> 
<paragraph id="H8B9999C09BA94999BB73852B32DADD6C"><enum>(2)</enum><header>Approval</header><text>The Secretary, with the concurrence of the Administrator, may approve a program of a State submitted under paragraph (1) providing for the State’s own inspection and enforcement authority for ballast water discharges within its jurisdiction, if the Secretary determines that the State possesses adequate resources to—</text> 
<subparagraph id="H67B728EA97494DAE8211529D6FADD34A"><enum>(A)</enum><text display-inline="yes-display-inline">inspect, monitor, and board a commercial vessel at any time, including the taking and testing of ballast water samples, to ensure the commercial vessel’s compliance with this section;</text></subparagraph> 
<subparagraph id="H28805A65919448D2AA86173792107760"><enum>(B)</enum><text>ensure that any ballast water discharged within the waters subject to the jurisdiction of the State meets the requirements of this section;</text></subparagraph> 
<subparagraph id="H23D1B5AC64494FC99587B8A9D1F95BA5"><enum>(C)</enum><text>establish adequate procedures for reporting violations of this section;</text></subparagraph> 
<subparagraph id="H8781372927EF48C99AECA8DB9686E153"><enum>(D)</enum><text>investigate and abate violations of this section, including the imposition of civil and criminal penalties consistent with subsection (o); and</text></subparagraph> 
<subparagraph id="H96D9E654816D460F8CF277B0EFD11B7B"><enum>(E)</enum><text>ensure that the Secretary and the Administrator receive notice of each violation of this section in an expeditious manner.</text></subparagraph></paragraph> 
<paragraph id="H21C7B23C10554CFEBE085EB974CEA7CD"><enum>(3)</enum><header>Compliance</header><text>Any State program approved under paragraph (2) shall at all times be conducted in accordance with this subsection.</text></paragraph> 
<paragraph id="HE66324F9EEAA4C1B9B9A282862A2656C"><enum>(4)</enum><header>Withdrawal of Approval</header><text>Whenever the Secretary, in consultation with the Administrator, determines, after providing notice and the opportunity for a public hearing, that a State is not administering a program in accordance with the terms of the program as approved under paragraph (2), the Secretary shall notify the State, and, if appropriate corrective action is not taken within a period of time not to exceed 90 days, the Secretary, with the concurrence of the Administrator, shall withdraw approval of the program. The Secretary shall not withdraw approval of a program unless the Secretary has first notified the State and made public, in writing, the reasons for the withdrawal.</text></paragraph> 
<paragraph id="H8DF6B9812C6F4BFBA182B0B8C707B451"><enum>(5)</enum><header>Limitation on statutory construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall limit the authority of the Administrator or the Secretary to carry out inspections of any commercial vessel under subsection (n).</text></paragraph> 
<paragraph commented="no" id="H4A3BFAC597034C1EA718E76BCA36D6AB"><enum>(6)</enum><header>State laws</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, a State may enact such laws as are necessary to provide for the implementation of the State ballast water inspection and enforcement program provided under this subsection. The requirements for a ballast water inspection and enforcement program contained in such State law shall be substantively and procedurally equivalent to those required in this section, and any requirements relating to recordkeeping, reporting, and sampling or analysis contained in such State law shall be substantively and procedurally equivalent to the requirements of this section and its implementing regulations and guidance.</text></paragraph></subsection> 
<subsection id="H31DD108CDF6743468372E63E51C923AF"><enum>(l)</enum><header>Discharges incidental to the normal operations of a commercial vessel</header> 
<paragraph id="H3879C1F2999648DEA74EACD1CD093E1C"><enum>(1)</enum><header>Evaluation of incidental discharges</header> 
<subparagraph id="HBF91C15506214111A26683B5FCDF679A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this section, the Administrator, in consultation with the Secretary, shall complete an evaluation of discharges incidental to the normal operation of a commercial vessel.</text></subparagraph> 
<subparagraph id="HFD39D343BF6E4F28BE18685C9AA97A66"><enum>(B)</enum><header>Factors</header><text>In carrying out the evaluation, the Administrator shall analyze—</text> 
<clause id="HEDC230F1895A49A98CFD5C9A7A629C69"><enum>(i)</enum><text display-inline="yes-display-inline">the characterization of the various types and composition of discharges incidental to the normal operation of a commercial vessel by different classes, types, and sizes of commercial vessels;</text></clause> 
<clause id="H5097D47948F64A93A1DCB40204133C22"><enum>(ii)</enum><text display-inline="yes-display-inline">the volume of such discharges for representative individual commercial vessels and by classes, types, and sizes of commercial vessels in the aggregate;</text></clause> 
<clause id="HAD665772BEFB4E52A28E6AE509D4A260"><enum>(iii)</enum><text>the availability and feasibility of implementing technologies or best management practices for the control of such discharges;</text></clause> 
<clause id="HB380F0A9D7F14F4594595E16B6B53DEB"><enum>(iv)</enum><text>the characteristics of the receiving waters of such discharges;</text></clause> 
<clause id="H24F1D4504C8D405B91AB635F3B2A69FC"><enum>(v)</enum><text>the nature and extent of potential effects of such discharges on human health, welfare, and the environment;</text></clause> 
<clause id="H21AF4D1AC1824354843C79F42CB45341"><enum>(vi)</enum><text>the extent to which such discharges are currently subject to and addressed by regulations under existing Federal laws or binding international obligations of the United States; and</text></clause> 
<clause id="H371E7B65AFE44B3B86EF0524637E9030"><enum>(vii)</enum><text>any additional factor that the Administrator considers appropriate.</text></clause></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H5E215DD10DD84352AF18694EB123819C"><enum>(2)</enum><header>Regulation of incidental discharges</header><text display-inline="yes-display-inline">Effective on and after the date of enactment of this section—</text> 
<subparagraph commented="no" id="H44F34D3495344B4C86F30FB788375D89"><enum>(A)</enum><text display-inline="yes-display-inline">the Administrator (or a State in the case of a permit program approved under section 402) shall not require any new permit or permit conditions under section 402 for any discharge incidental to the normal operation of a commercial vessel; and</text></subparagraph> 
<subparagraph commented="no" id="H13718C0118074323B3AAF9C640E3E177"><enum>(B)</enum><text>a State or political subdivision thereof shall not adopt or enforce any law or regulation of the State or political subdivision with respect to such a discharge.</text></subparagraph></paragraph></subsection> 
<subsection commented="no" id="HEDEB7DD281174E34B16B6F035E6D6B9A" display-inline="no-display-inline"><enum>(m)</enum><header>Effect on Vessel General Permit</header> 
<paragraph commented="no" id="H95DF10A9AF3B4BA891563D64D453DB28"><enum>(1)</enum><header>Expiration</header><text>Notwithstanding the expiration date set forth in the Vessel General Permit, the Vessel General Permit shall expire as follows:</text> 
<subparagraph commented="no" id="H48786186EA974A89B06FFA0D0D923315"><enum>(A)</enum><text display-inline="yes-display-inline">The terms and conditions of section 6 of such permit or any law of a State regulating the discharge of ballast water or any discharge incidental to the normal operation of a commercial vessel, upon the date of enactment of this section.</text></subparagraph> 
<subparagraph commented="no" id="HB47B59FFF9314519AAAF907B5B3CD632"><enum>(B)</enum><text display-inline="yes-display-inline">For each commercial vessel, the terms and conditions of such permit (except the terms and conditions referred to in subparagraph (A)) applicable to a discharge of ballast water—</text> 
<clause id="HE418747F4D874F8ABAE3CF5479FBF77C" commented="no"><enum>(i)</enum><text>on the date on which—</text> 
<subclause commented="no" id="H1F2A58A367684AAA8713AB39E119DAA0"><enum>(I)</enum><text>a ballast water treatment technology certified under subsection (e) is installed on the commercial vessel;</text></subclause> 
<subclause commented="no" id="H472B22CDC0FA41E18B41A0B9610C9148"><enum>(II)</enum><text>an alternative method of compliance established for the commercial vessel under subsection (f) is implemented for the commercial vessel;</text></subclause> 
<subclause commented="no" id="H9A3A8FA5A5B244309A1C4B55C5348445"><enum>(III)</enum><text>a petition is granted for the commercial vessel under subsection (g); or</text></subclause> 
<subclause commented="no" id="H50CA47581EB742438CDEC68FAF199CDF"><enum>(IV)</enum><text>a certificate is issued for the commercial vessel under subsection (h); or</text></subclause></clause> 
<clause commented="no" id="H781DDDEF439F4708B335B26D7E2D39F3"><enum>(ii)</enum><text>in any case not described in clause (i), on December 18, 2013.</text></clause></subparagraph></paragraph> 
<paragraph commented="no" id="H4AE37F9F30204FA4885E927EA53A85AF"><enum>(2)</enum><header>Discharges incidental to the normal operation of commercial vessels</header><text display-inline="yes-display-inline">Notwithstanding the expiration date set forth in the Vessel General Permit, the terms and conditions of such permit (except the terms and conditions referred to in paragraph (1)(A)) applicable to discharges incidental to the normal operation of a commercial vessel shall remain in effect.</text></paragraph></subsection> 
<subsection id="HD258CB161AB3444CA4B7FBA49D5E50DA"><enum>(n)</enum><header>Inspections and enforcement</header> 
<paragraph id="H7114849A72114E2497E9A577E5284B55"><enum>(1)</enum><header>In general</header> 
<subparagraph id="H73ACD3901E1F4866A4401AB6027E8584"><enum>(A)</enum><header>Coast Guard enforcement</header><text>The Secretary shall enforce the requirements of this section and may utilize by agreement, with or without reimbursement, law enforcement officers or other personnel and facilities of the Administrator, other Federal agencies, and the States.</text></subparagraph> 
<subparagraph id="H98A43318F64E4CDC8D858BBE21858792"><enum>(B)</enum><header>Environmental Protection Agency actions</header><text>Notwithstanding any enforcement decisions of the Secretary under subparagraph (A), the Administrator may use the authorities provided in sections 308, 309, 312, and 504 whenever required to carry out this section.</text></subparagraph></paragraph> 
<paragraph id="H976634F421E1453BB8EBFBCB2EBF5C7F"><enum>(2)</enum><header>Coast Guard inspections</header><text display-inline="yes-display-inline">The Secretary may carry out inspections of any commercial vessel at any time, including the taking of ballast water samples, to ensure compliance with this section. The Secretary shall use all appropriate and practical measures of detection and environmental monitoring of such commercial vessels and shall establish adequate procedures for reporting violations of this section and accumulating evidence regarding such violations.</text></paragraph></subsection> 
<subsection id="H280DC72D476D44F5B8F1D97B24B41339"><enum>(o)</enum><header>Compliance</header> 
<paragraph id="HFFC1BAF5984B4499A35654F11277CD9D"><enum>(1)</enum><header>Detention of commercial vessel</header><text display-inline="yes-display-inline">The Secretary, by notice to the owner or operator, may detain the commercial vessel if the Secretary has reasonable cause to believe that the commercial vessel does not comply with a requirement of this section or is being operated in violation of such a requirement.</text></paragraph> 
<paragraph id="H048E7A0898BB449EADF037FB86FB9DDE"><enum>(2)</enum><header>Sanctions</header> 
<subparagraph id="HA8C67C3C736C482490F72770EAEDAD7B" commented="no"><enum>(A)</enum><header>Civil penalties</header> 
<clause id="HFCCD19F7AE414BBC94B40D2895FB6F07" display-inline="no-display-inline" commented="no"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any person who violates this section shall be liable for a civil penalty in an amount determined under clause (ii). Each day of a continuing violation constitutes a separate violation. A commercial vessel operated in violation of this section is liable in rem for any civil penalty assessed for that violation.</text></clause> 
<clause id="H24FE1CBF0B4E4CE6BC260B174C601841" commented="no"><enum>(ii)</enum><header>Penalty amounts</header><text display-inline="yes-display-inline">The amount of a civil penalty assessed under clause (i) shall be determined as follows:</text> 
<subclause id="H868072E14A7649F9B13E6210E7656D72" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">For vessels with a ballast water capacity less than 1500 cubic meters, not to exceed $25,000 for each violation.</text></subclause> 
<subclause id="H66E31A4FA3BC40BD97594025F44DE254" commented="no"><enum>(II)</enum><text>For vessels with a ballast water capacity of 1500 cubic meters but not more than 5,000 cubic meters, not to exceed $28,750 for each violation.</text></subclause> 
<subclause id="HB69B83CB8CA54FCA812E715D5E394E20" commented="no"><enum>(III)</enum><text>For vessels with a ballast water capacity greater than 5,000 cubic meters, not to exceed $32,500 for each violation.</text></subclause></clause></subparagraph> 
<subparagraph commented="no" id="H60E385D6A3A74192B65E1729374777AB"><enum>(B)</enum><header>Criminal penalties</header><text display-inline="yes-display-inline">Any person who knowingly violates this section shall be punished by a fine of not less that $5,000 nor more than $50,000 per day of violation, or by imprisonment for not more than 3 years, or both. If a conviction of a person is for a violation committed after a first conviction of such person under this paragraph, punishment shall be by a fine of not more than $100,000 per day of violation, or imprisonment of not more than 6 years, or both.</text></subparagraph> 
<subparagraph id="H6A62CB3BA704430AB15E154721E2A97D"><enum>(C)</enum><header>Revocation of clearance</header><text display-inline="yes-display-inline">Upon request of the Secretary, the Secretary of Homeland Security shall withhold or revoke the clearance of a commercial vessel required by section 60105 of title 46, United States Code, if the owner or operator is in violation of this section.</text></subparagraph></paragraph> 
<paragraph id="H23E8AA2800484DD5A80B1D92C54D336F"><enum>(3)</enum><header>Enforcement actions</header> 
<subparagraph id="H4428246D98224064A5AAEE25415FEC55"><enum>(A)</enum><header>Administrative actions</header><text>If the Secretary finds that a person has violated this section, the Secretary may assess a civil penalty for the violation. In determining the amount of the civil penalty, the Secretary shall take into account the nature, circumstances, extent, and gravity of the prohibited acts committed and, with respect to the violator, the degree of culpability, any history of prior violations, and such other matters as justice may require.</text></subparagraph> 
<subparagraph id="HB761E25688F34824A7C6E922F146AB7C"><enum>(B)</enum><header>Civil actions</header><text>At the request of the Secretary, the Attorney General may bring a civil action in an appropriate district court of the United States to enforce this section. Any court before which such an action is brought may award appropriate relief, including temporary or permanent injunctions and civil penalties.</text></subparagraph></paragraph> 
<paragraph id="H221EC349C05D44A19D29DE6385019898"><enum>(4)</enum><header>Exclusion</header><text display-inline="yes-display-inline">No person shall be found in violation of this section whose commission of prohibited acts is found by the Secretary to have been in the interest of ensuring the safety of life at sea.</text></paragraph></subsection> 
<subsection id="HEBFCC1B1166342999B671B3CE89CED0D"><enum>(p)</enum><header>Regulation under other sections of this Act</header><text display-inline="yes-display-inline">This section shall not affect the regulation of discharges from a commercial vessel pursuant to section 311 or 312.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H1663D6AC701D4EA9847359FD615FC450" commented="no"><enum>703.</enum><header>Discharges incidental to the normal operation of a covered vessel</header> 
<subsection id="HFA14BE26056040E58F18C8AD508F30E7" commented="no"><enum>(a)</enum><header>Discharges incidental to the normal operation of a covered vessel</header> 
<paragraph id="H72D18A984CA641E78CF718BB9079A851" commented="no"><enum>(1)</enum><header>No permit required</header><text>Section 402 of the Federal Water Pollution Control Act (33 U.S.C. 1342) is amended by adding at the end the following: </text>

<subsection id="H0018DC29A63B4337ACA2A1115883B21A" commented="no"><enum>(s)</enum><header>Discharges incidental to the normal operation of a covered vessel</header><text display-inline="yes-display-inline">No permit shall be required under this Act by the Administrator (or a State, in the case of a permit program approved under subsection (b)) for a discharge incidental to the normal operation of a covered vessel (as defined in section 312(p)).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC9D70ED84C474C959310AEC8100F4811" commented="no"><enum>(2)</enum><header>Best management practices for covered vessels</header><text>Section 312 of the Federal Water Pollution Control Act (33 U.S.C. 1342) is amended by adding at the end the following:</text>

<subsection id="H83FF3D4862644412B2663100D2B862C1" commented="no"><enum>(p)</enum><header>Best management practices for covered vessels</header> 
<paragraph id="H74285E4C62AA480BA8AB5E781F525D87" commented="no"><enum>(1)</enum><header>Definitions</header><text>In this subsection, the following definitions apply:</text> 
<subparagraph id="H584AA8B3EEFF4869A7B7A6D5A2981A6E" commented="no"><enum>(A)</enum><header>Covered vessel</header><text>The term <term>covered vessel</term> means every description of watercraft, or other artificial contrivance used or capable of being used as a means of transportation on water, that is engaged in commercial service (as defined under section 2101 of title 46, United States Code), and—</text> 
<clause id="H7BA9AFFC5D9E4CA683B54504822E47B6" commented="no"><enum>(i)</enum><text>is less than 79 feet in length; or</text></clause> 
<clause id="HF2FE2D19A94F4753867C21CF18CCCB2A" commented="no"><enum>(ii)</enum><text>is a fishing vessel (as defined in section 2101 of title 46, United States Code), regardless of length of the vessel.</text></clause></subparagraph> 
<subparagraph id="H6E52C798B59741289FFB5AF841A69567" commented="no"><enum>(B)</enum><header>Discharge incidental to the normal operation of a covered vessel</header><text>The term <term>discharge incidental to the normal operation of a covered vessel</term> means a discharge incidental to the normal operation of a commercial vessel (as defined in section 321), insofar as the commercial vessel is a covered vessel.</text></subparagraph></paragraph> 
<paragraph id="H0FF021FB3D3B44D08492D34CBF542E16" commented="no"><enum>(2)</enum><header>Determination of discharges subject to best management practices</header> 
<subparagraph id="H1062CCBB5471411999A0D876708732DE" commented="no"><enum>(A)</enum><header>Determination</header> 
<clause id="HDF9A03B6D62445A3B6CBF1E672094C93" commented="no"><enum>(i)</enum><header>In general</header><text>The Administrator, in consultation with the Secretary of the department in which the Coast Guard is operating, shall determine the discharges incidental to the normal operation of a covered vessel for which it is reasonable and practicable to develop best management practices to mitigate the adverse impacts of such discharges on the waters of the United States.</text></clause> 
<clause id="H43871510D3FE44EDB64230F6E5F03E5E" commented="no"><enum>(ii)</enum><header>Promulgation</header><text>The Administrator shall promulgate the determinations under clause (i) in accordance with section 553 of title 5, United States Code.</text></clause></subparagraph> 
<subparagraph id="H18CFD5E3280A4819BB2814FD699C3E56" commented="no"><enum>(B)</enum><header>Considerations</header><text>In making a determination under subparagraph (A), the Administrator shall consider—</text> 
<clause id="HB9BD1588000B43919FC2BA56C8E3D7FD" commented="no"><enum>(i)</enum><text>the nature of the discharge;</text></clause> 
<clause id="H8300584DD87B410492E80458BF0742C7" commented="no"><enum>(ii)</enum><text>the environmental effects of the discharge, including characteristics of the receiving waters;</text></clause> 
<clause id="HCD5060279F3E470D9EBB6B90D2F0B047" commented="no"><enum>(iii)</enum><text>the effectiveness of the best management practice in reducing adverse impacts of the discharge on water quality;</text></clause> 
<clause id="H6E980D5252614FDBB8FD6156276DAF2D" commented="no"><enum>(iv)</enum><text>the practicability of developing and using a best management practice;</text></clause> 
<clause id="HA0E93E54D1E94B4DB4002D8D1D15B4CB" commented="no"><enum>(v)</enum><text>the effect that the use of a best management practice would have on the operation, operational capability, or safety of the vessel;</text></clause> 
<clause id="HC85F8D66DA2A4171ACAF1C62C85DCFC0" commented="no"><enum>(vi)</enum><text>applicable Federal and State law;</text></clause> 
<clause id="HB88F5C71CA324F23BAFFB8F88D8E9C7E" commented="no"><enum>(vii)</enum><text>applicable international standards; and</text></clause> 
<clause id="HE8493E7950A741A89E1DEEEB805BE37C" commented="no"><enum>(viii)</enum><text>the economic costs of the use of the best management practice.</text></clause></subparagraph> 
<subparagraph id="HB71B793B71314643A357DFC0D6C9CD7C" commented="no"><enum>(C)</enum><header>Timing</header><text>The Administrator shall—</text> 
<clause id="H0FB6976ECDCD4B8C8A75BC573E657E3C" commented="no"><enum>(i)</enum><text>make initial determinations under subparagraph (A) not later than 1 year after the date of enactment of this subsection; and</text></clause> 
<clause id="H6EECF9E77A324DB0A3833D0573EF7740" commented="no"><enum>(ii)</enum><text>every 5 years thereafter—</text> 
<subclause id="HC6DCB530FC214A3D9D2D310B91F75388" commented="no"><enum>(I)</enum><text>review the determinations; and</text></subclause> 
<subclause id="H57521DE990904C799D54F37119C1E1E7" commented="no"><enum>(II)</enum><text>if necessary, revise the determinations based on any new information available to the Administrator.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HE7A3FD75805F47869F8C08D3AEB2B316" commented="no"><enum>(3)</enum><header>Regulations for the use of best management practices</header> 
<subparagraph id="H26E70F76942340FAB0F9B36BC9D788A1" commented="no"><enum>(A)</enum><header>In general</header><text>The Secretary of the department in which the Coast Guard is operating shall promulgate regulations on the use of best management practices for discharges incidental to the normal operation of a covered vessel that the Administrator determines are reasonable and practicable to develop under paragraph (2).</text></subparagraph> 
<subparagraph id="H7F9F08DF8B9A422497A88AC9D1399E98" commented="no"><enum>(B)</enum><header>Regulations</header> 
<clause id="H0A2C39EE113540C5B9AD6C7C2D3A3E3B" commented="no"><enum>(i)</enum><header>In general</header><text>The Secretary shall promulgate the regulations under this paragraph as soon as practicable after the Administrator makes determinations pursuant to paragraph (2).</text></clause> 
<clause id="H110B697D751A4E88BE2992FE68CAB1F1" commented="no"><enum>(ii)</enum><header>Considerations</header><text>In promulgating regulations under this paragraph, the Secretary may—</text> 
<subclause id="H0AEE9A9CF2FB4691AB06BE78CB20345C" commented="no"><enum>(I)</enum><text>distinguish among classes, types, and sizes of vessels;</text></subclause> 
<subclause id="HB50612E705384863B7F9150CE6E1AD33" commented="no"><enum>(II)</enum><text>distinguish between new and existing vessels; and</text></subclause> 
<subclause id="H9340013BBB6B44B6B55948DEBB8071A5" commented="no"><enum>(III)</enum><text>provide for a waiver of the applicability of the standards as necessary or appropriate to a particular class, type, age, or size of vessel.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H6C2D3C8504D441859E8EE59E5522FF82" commented="no"><enum>(4)</enum><header>Effect of other laws</header><text>This subsection shall not affect the application of section 311 to a covered vessel.</text></paragraph> 
<paragraph id="H30FB317017DD4E1B9CDA5AD16385545F" commented="no"><enum>(5)</enum><header>Prohibition relating to covered vessels</header><text>After the effective date of the regulations promulgated by the Secretary of the department in which the Coast Guard is operating under paragraph (3), the owner or operator of a covered vessel shall neither operate in, nor discharge any discharge incidental to the normal operation of the vessel into navigable waters, if the owner or operator of the vessel is not using any applicable best management practice meeting standards established under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H44111A355DA44746AF173F93538049B2"><enum>704.</enum><header>Conforming and technical amendments</header> 
<subsection id="H58A82C3CA1CA49229EB47B3C36DC0614" commented="no"><enum>(a)</enum><header>Effluent limitations</header><text>Section 301(a) of the Federal Water Pollution Control Act (33 U.S.C. 1311(a)) is amended by inserting <quote>312, 321,</quote> after <quote>318,</quote>.</text></subsection> 
<subsection id="HA5DF499B813B4275BBDF48152FAB86EA"><enum>(b)</enum><header>Review of Administrator’s actions</header><text>The first sentence of section 509(b)(1) of such Act (33 U.S.C. 1369(b)(1)) is amended—</text> 
<paragraph id="HE96CAA5A869E46BF875A67178A77A602"><enum>(1)</enum><text>by striking <quote>and (G)</quote> and inserting <quote>(G)</quote>; and</text></paragraph> 
<paragraph id="H83A3458F86A44FAEBD3439B7C8F562C8" commented="no"><enum>(2)</enum><text>by inserting after <quote>section 304(l),</quote> the following: <quote>and (H) in issuing any regulation or otherwise taking final agency action under section 312 or 321,</quote>.</text></paragraph></subsection></section> 
<section id="H1DFE53F23A9140F2BE3F3FE276A75ACE" commented="no"><enum>705.</enum><header>Regulation of ballast water and incidental discharges from a commercial vessel</header> 
<subsection id="H8AE0352146034A7BB49DEF224CCAEBB5" commented="no"><enum>(a)</enum><header>In general</header><text>Effective on the date of enactment of this Act, the following discharges shall not be regulated in any manner other than as specified in section 312 or 321 of the Federal Water Pollution Control Act (as added by this title):</text> 
<paragraph id="HB14240CB10274261B7DDDB2AC0BE3475" commented="no"><enum>(1)</enum><text>A discharge incidental to the normal operation of a commercial vessel.</text></paragraph> 
<paragraph id="H3C338176531E45B99E538962C0CF1754" commented="no"><enum>(2)</enum><text>A discharge of ballast water from a commercial vessel.</text></paragraph></subsection> 
<subsection id="H8AD783F3B75F4AF2ADF9618D774B0157" commented="no"><enum>(b)</enum><header>Definitions</header><text>In this section, the terms <term>ballast water</term>, <term>commercial vessel</term>, and <term>discharge incidental to the normal operation of a commercial vessel</term> have the meanings given those terms in section 321(a) of the Federal Water Pollution Control Act (as added by this title).</text></subsection></section> 
<section id="H2AB4E95A61AB44B38EE95ED9FCF19AA7"><enum>706.</enum><header>Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990</header> 
<subsection id="H3CDE49174BF3476B9C4F251FF755BB07"><enum>(a)</enum><header>Aquatic nuisance species in waters of the United States</header><text>Effective on the date of issuance of final regulations under section 321(b) of the Federal Water Pollution Control Act (as added by this title), section 1101 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (16 U.S.C. 4711) is repealed.</text></subsection> 
<subsection id="H2506698DE98C4C3180A4180AC29E3F18" commented="no"><enum>(b)</enum><header>Relationship to other laws</header><text display-inline="yes-display-inline">Effective on the date of enactment of this Act, section 1205 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (16 U.S.C. 4725) is repealed.</text></subsection></section></title>
