<section id="HC6605CFE5FCA484AAEDD056F15AB346F"><enum>101.</enum><header>Federal campaign reporting of foreign contacts</header> 
<subsection id="H99EEE6AF6D394BB2AD5CB135B57656E6"><enum>(a)</enum><header>Initial notice</header> 
<paragraph id="H4DAF18C3B7BF48818684B48BDB759E27"><enum>(1)</enum><header>In general</header><text>Section 304 of the Federal Election Campaign Act of 1971 (52 U.S.C. 30104) is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H01FC0AA2F805431C839CD58AD80A453B" style="OLC"> 
<subsection id="H7831B249231C4A64932BB104E11805B9"><enum>(j)</enum><header>Disclosure of reportable foreign contacts</header> 
<paragraph id="HC6AF112446D94DC5AB85A5D0B3B23068"><enum>(1)</enum><header>Committee obligation to notify</header><text display-inline="yes-display-inline">Not later than 1 week after a reportable foreign contact, each political committee shall notify the Federal Bureau of Investigation and the Commission of the reportable foreign contact and provide a summary of the circumstances with respect to such reportable foreign contact.</text></paragraph> 
<paragraph id="HC0D12DCC3BBD49AD88EA8D6B2DF061FC"><enum>(2)</enum><header>Individual obligation to notify</header><text>Not later than 3 days after a reportable foreign contact—</text> 
<subparagraph id="HF869D954B50C4BC78B1B20693BDA6569"><enum>(A)</enum><text>each candidate shall notify the treasurer or other designated official of the principal campaign committee of such candidate of the reportable foreign contact and provide a summary of the circumstances with respect to such reportable foreign contact; and</text></subparagraph> 
<subparagraph id="H4D880905DC7C4ECFAB28C7B3BC8625EE"><enum>(B)</enum><text>each official, employee, or agent of a political committee shall notify the treasurer or other designated official of the committee of the reportable foreign contact and provide a summary of the circumstances with respect to such reportable foreign contact.</text></subparagraph></paragraph> 
<paragraph id="H7AA87BA5B1FC46CFBE6DBFAD905A042C"><enum>(3)</enum><header>Reportable foreign contact</header><text>In this subsection:</text> 
<subparagraph id="HF79B300EDF804675850C73E0204CB040"><enum>(A)</enum><header>In general</header><text>The term <term>reportable foreign contact</term> means any direct or indirect contact or communication that—</text> 
<clause id="HFCBD672B27A046D1B862E84FB0422449"><enum>(i)</enum><text>is between—</text> 
<subclause id="HAF02B01E34AC473FBFC9C0205F56D75F"><enum>(I)</enum><text>a candidate, a political committee, or any official, employee, or agent of such committee; and</text></subclause> 
<subclause id="H64936CD966744D29BE8E41F3A02818A2"><enum>(II)</enum><text>an individual that the person described in subclause (I) knows, has reason to know, or reasonably believes is a covered foreign national; and</text></subclause></clause> 
<clause id="H8F230F94E3BE4803B462BAAB3AB88F7E"><enum>(ii)</enum><text>the person described in clause (i)(I) knows, has reason to know, or reasonably believes involves—</text> 
<subclause id="HE3A59EAED7A640B6994F023A70F796C2"><enum>(I)</enum><text>an offer or other proposal for a contribution, donation, expenditure, disbursement, or solicitation described in section 319; or</text></subclause> 
<subclause id="H48B34818ED2745529DB4897B71786E6F"><enum>(II)</enum><text display-inline="yes-display-inline">coordination or collaboration with, an offer or provision of information or services to or from, or persistent and repeated contact with, a covered foreign national in connection with an election.</text></subclause></clause></subparagraph> 
<subparagraph id="H645840F562E74701A4CD8F510679C9CC"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">The term <term>reportable foreign contact</term> shall not include any contact or communication with a covered foreign national by an elected official or an employee of an elected official solely in an official capacity as such an official or employee. For purposes of the previous sentence, a contact or communication by an elected official or an employee of an elected official shall not be considered to be made solely in an official capacity if the contact or communication involves a contribution, donation, expenditure, disbursement, or solicitation described in section 319.</text></subparagraph> 
<subparagraph id="HE4A3FFA13ACF44CFBC549B28B79DB0B2"><enum>(C)</enum><header>Covered foreign national defined</header> 
<clause id="H57237A45842348909BBDB83A68DEA094"><enum>(i)</enum><header>In general</header><text>In this paragraph, the term <term>covered foreign national</term> means—</text> 
<subclause id="HCC5F403EDE884456A5DC71E44FFD925E"><enum>(I)</enum><text>a foreign principal (as defined in section 1(b) of the Foreign Agents Registration Act of 1938 (22 U.S.C. 611(b)) that is a government of a foreign country or a foreign political party;</text></subclause> 
<subclause id="H4DB3CF341E0C415EB1D00B5A83D044F7"><enum>(II)</enum><text display-inline="yes-display-inline">any person who acts as an agent, representative, employee, or servant, or any person who acts in any other capacity at the order, request, or under the direction or control, of a foreign principal described in subclause (I) or of a person any of whose activities are directly or indirectly supervised, directed, controlled, financed, or subsidized in whole or in major part by a foreign principal described in subclause (I); or</text></subclause> 
<subclause id="H4AC030567FA14F2CA1DD408238A11785"><enum>(III)</enum><text>any person included in the list of specially designated nationals and blocked persons maintained by the Office of Foreign Assets Control of the Department of the Treasury pursuant to authorities relating to the imposition of sanctions relating to the conduct of a foreign principal described in subclause (I).</text></subclause></clause> 
<clause id="HF14E081471CB4A54A95A7A74DEC5F6AB"><enum>(ii)</enum><header>Clarification regarding application to citizens of the United States</header><text>In the case of a citizen of the United States, subclause (II) of clause (i) applies only to the extent that the person involved acts within the scope of that person’s status as the agent of a foreign principal described in subclause (I) of clause (i).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2AE45A192F364CB08EEC97DDEB2B00E4"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply with respect to reportable foreign contacts which occur on or after the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="H88556B3DAC3F43F5A6E1A3EF18758EE9"><enum>(b)</enum><header>Information included on report</header> 
<paragraph id="HFA4FF666BEF34540A2423B2F2251AD2F"><enum>(1)</enum><header>In general</header><text>Section 304(b) of such Act (52 U.S.C. 30104(b)) is amended—</text> 
<subparagraph id="HE7EE406F92404B5BAE44DF229FFB95A4"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (7);</text></subparagraph> 
<subparagraph id="HEBCD02859B2B4064AF11B3BA7E3E3F80"><enum>(B)</enum><text>by striking the period at the end of paragraph (8) and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="H892388EC7448453C800451A30CBC7108"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H614594C5965944CCBD9E34C727A7BA30" style="OLC"> 
<paragraph id="HC37D02ADAA514F129338DF9D4F60BDD9"><enum>(9)</enum><text>for any reportable foreign contact (as defined in subsection (j)(3))—</text> 
<subparagraph id="H6D407511D02941B3A83F32A31B3C4CEB"><enum>(A)</enum><text>the date, time, and location of the contact;</text></subparagraph> 
<subparagraph id="H10696E32F39543F4AE650897D653AEC7"><enum>(B)</enum><text>the date and time of when a designated official of the committee was notified of the contact;</text></subparagraph> 
<subparagraph id="HE53F6B7208BA45E39221528851FD5AB6"><enum>(C)</enum><text>the identity of individuals involved; and</text></subparagraph> 
<subparagraph id="HD54C4700E2AB4BA28D14F0DDDFE1C9BC"><enum>(D)</enum><text>a description of the contact, including the nature of any contribution, donation, expenditure, disbursement, or solicitation involved and the nature of any activity described in subsection (j)(3)(A)(ii)(II) involved.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H3DDFD7D6CD4A4EF587078C89C9FFB62D"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply with respect to reports filed on or after the expiration of the 60-day period which begins on the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section id="H934E15A271B342EB8DE8B37084F6AD5A"><enum>102.</enum><header>Federal campaign foreign contact reporting compliance system</header> 
<subsection id="HF34C01587BF84A71942CE6A4DAA078F8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 302 of the Federal Election Campaign Act of 1971 (52 U.S.C. 30102) is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H577E665F5621458E8A93599F813442FA" style="OLC"> 
<subsection id="HE61B809DD9C84291BCEB44320834C278"><enum>(j)</enum><header>Reportable foreign contacts compliance policy</header> 
<paragraph id="H33ED6B37745A48E086359BC06F16BBB1"><enum>(1)</enum><header>Reporting</header><text>Each political committee shall establish a policy that requires all officials, employees, and agents of such committee to notify the treasurer or other appropriate designated official of the committee of any reportable foreign contact (as defined in section 304(j)) not later than 3 days after such contact was made.</text></paragraph> 
<paragraph id="HC73BD373ADB14B23ACB2A34A0E0EE1C9"><enum>(2)</enum><header>Retention and preservation of records</header><text>Each political committee shall establish a policy that provides for the retention and preservation of records and information related to reportable foreign contacts (as so defined) for a period of not less than 3 years.</text></paragraph> 
<paragraph id="H0D74C519FD4548DFBE404DBD5AEEF6BF"><enum>(3)</enum><header>Certification</header> 
<subparagraph id="HE638E981078B4755916233B5FC68B82C"><enum>(A)</enum><header>In general</header><text>Upon filing its statement of organization under section 303(a), and with each report filed under section 304(a), the treasurer of each political committee (other than an authorized committee) shall certify that—</text> 
<clause id="H30535017114F4486B0B92B98867866FD"><enum>(i)</enum><text>the committee has in place policies that meet the requirements of paragraphs (1) and (2);</text></clause> 
<clause id="H5D28641316084F2CAA63E4FE65EF0BB8"><enum>(ii)</enum><text>the committee has designated an official to monitor compliance with such policies; and</text></clause> 
<clause id="HFB429A9554854770AD9B984773BB98C8" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>not later than 1 week after the beginning of any formal or informal affiliation with the committee, all officials, employees, and agents of such committee will—</text> 
<subclause id="H1B2BCAAA8BB94631AAF7E73CC59BBD62" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text>receive notice of such policies;</text></subclause> 
<subclause id="HE721B9BD534A41DCB8D07291BEBFFFD4" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>be informed of the prohibitions under section 319; and</text></subclause> 
<subclause id="H10BCEB25C66648D0B9F53E6014A5797F" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>sign a certification affirming their understanding of such policies and prohibitions.</text></subclause></clause></subparagraph> 
<subparagraph id="H4066D630750244A8A2BB6B56CF8BBF86"><enum>(B)</enum><header>Authorized committees</header><text>With respect to an authorized committee, the candidate shall make the certification required under subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7864913DB8C349E782C55BD548BCC924"><enum>(b)</enum><header>Effective date</header> 
<paragraph id="HF94F9A774D0D4A31943DFA0F7CC0D70F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to political committees which file a statement of organization under section 303(a) of the Federal Election Campaign Act of 1971 (52 U.S.C. 30103(a)) on or after the date of the enactment of this Act.</text></paragraph> 
<paragraph id="HDB81F43D5FC7460FA426557CC0A9A35C"><enum>(2)</enum><header>Transition rule for existing committees</header><text>Not later than 30 days after the date of the enactment of this Act, each political committee under the Federal Election Campaign Act of 1971 shall file a certification with the Federal Election Commission that the committee is in compliance with the requirements of section 302(j) of such Act (as added by subsection (a)).</text></paragraph></subsection></section> 
<section id="H1ADBF44B40794D25A48B0ACA3726214C"><enum>103.</enum><header>Criminal penalties</header><text display-inline="no-display-inline">Section 309(d)(1) of the Federal Election Campaign Act of 1971 (52 U.S.C. 30109(d)(1)) is amended by adding at the end the following new subparagraphs:</text> 
<quoted-block display-inline="no-display-inline" id="H9F54A1246543403580C296603B1FC407" style="OLC"> 
<subparagraph id="H814CB4320325445DAF78741BFF4A652E" indent="up2"><enum>(E)</enum><text>Any person who knowingly and willfully commits a violation of subsection (j) or (b)(9) of section 304 or section 302(j) shall be fined not more than $500,000, imprisoned not more than 5 years, or both.</text></subparagraph> 
<subparagraph id="H4ADCCDBDBABF489F86459D5909562B20" indent="up2"><enum>(F)</enum><text>Any person who knowingly and willfully conceals or destroys any materials relating to a reportable foreign contact (as defined in section 304(j)) shall be fined not more than $1,000,000, imprisoned not more than 5 years, or both.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H69CB42A9055B4D968E9EC5920C741E17"><enum>104.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this subtitle or the amendments made by this subtitle shall be construed—</text> 
<paragraph id="H5CEBE1C7CEB64F7BBF13725E50C882AC"><enum>(1)</enum><text display-inline="yes-display-inline">to impede legitimate journalistic activities; or</text></paragraph> 
<paragraph id="H0E968C3E357F4639A95EFA4ECE803C62"><enum>(2)</enum><text display-inline="yes-display-inline">to impose any additional limitation on the right to express political views or to participate in public discourse of any individual who—</text> 
<subparagraph id="HB2C153DD336E42C7823CDAE02D47043E" commented="no"><enum>(A)</enum><text>resides in the United States;</text></subparagraph> 
<subparagraph id="H18424AD8C136469797B13A8BDDF033DE"><enum>(B)</enum><text>is not a citizen of the United States or a national of the United States, as defined in section 101(a)(22) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(22)); and</text></subparagraph> 
<subparagraph id="HC332985F47C54B9689E9EB57693C849F"><enum>(C)</enum><text>is not lawfully admitted for permanent residence, as defined by section 101(a)(20) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(20)).</text></subparagraph></paragraph></section></subtitle> 
<subtitle id="H65EC45EFB91542A984AF2EC61B72BEC9"><enum>B</enum><header>Strengthening Oversight of Online Political Advertising</header> 
<section id="H3139CCD171F6497A8798D12D55E20734" section-type="subsequent-section"><enum>111.</enum><header>Short title</header><text display-inline="no-display-inline">This subtitle may be cited as the <quote><short-title>Honest Ads Act</short-title></quote>.</text></section> 
<section id="HEC56BAE97E2649A886AE39EEAEC341D4"><enum>112.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this subtitle is to enhance the integrity of American democracy and national security by improving disclosure requirements for online political advertisements in order to uphold the Supreme Court’s well-established standard that the electorate bears the right to be fully informed.</text></section> 
<section id="HC6CE6B03A3214399B7B05BC8BE2BC65E"><enum>113.</enum><header>Expansion of definition of public communication</header> 
<subsection id="H249C4C7D5BE74B4EB78587C524424B48"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (22) of section 301 of the Federal Election Campaign Act of 1971 (52 U.S.C. 30101(22)) is amended by striking <quote>or satellite communication</quote> and inserting <quote>satellite, paid internet, or paid digital communication</quote>.</text></subsection> 
<subsection id="HF140035376D44652B6FCDAEBAF94157B"><enum>(b)</enum><header>Treatment of contributions and expenditures</header><text>Section 301 of such Act (52 U.S.C. 30101) is amended—</text> 
<paragraph id="H13A2BC3163CE482C8533E3A220E15315"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (8)(B)(v), by striking <quote>on broadcasting stations, or in newspapers, magazines, or similar types of general public political advertising</quote> and inserting <quote>in any public communication</quote>; and</text></paragraph> 
<paragraph id="HB60EA87C64BC4A18B631B9A847DD7A43"><enum>(2)</enum><text>in paragraph (9)(B)—</text>

<subsection id="HC76294A88C66442688FE4DE075A1210E"><enum>(c)</enum><header>Disclosure and disclaimer statements</header><text>Subsection (a) of section 318 of such Act (52 U.S.C. 30120) is amended—</text> 
<paragraph id="H2B8E19EB348F482583F1DAD91433146D"><enum>(1)</enum><text>by striking <quote>financing any communication through any broadcasting station, newspaper, magazine, outdoor advertising facility, mailing, or any other type of general public political advertising</quote> and inserting <quote>financing any public communication</quote>; and</text></paragraph> 
<paragraph id="H43C82F7B8B6D490CAFDF51836D45A43B"><enum>(2)</enum><text>by striking <quote>solicits any contribution through any broadcasting station, newspaper, magazine, outdoor advertising facility, mailing, or any other type of general public political advertising</quote> and inserting <quote>solicits any contribution through any public communication</quote>.</text></paragraph></subsection></section>

<subparagraph id="H8EFD28370BB3460A928B9B9B3A2DB9DF"><enum>(A)</enum><header>In general</header><text>Subparagraph (A) of section 304(f)(3) of the Federal Election Campaign Act of 1971 (52 U.S.C. 30104(f)(3)(A)) is amended by striking <quote>or satellite communication</quote> each place it appears in clauses (i) and (ii) and inserting <quote>satellite, or qualified internet or digital communication</quote>.</text></subparagraph>

<paragraph commented="no" id="HA3F2BA4C9E7E43EEBFDA34BA3D9BF15A"><enum>(2)</enum><header>Nonapplication of relevant electorate to online communications</header><text>Section 304(f)(3)(A)(i)(III) of such Act (52 U.S.C. 30104(f)(3)(A)(i)(III)) is amended by inserting <quote>any broadcast, cable, or satellite</quote> before <quote>communication</quote>.</text></paragraph>

<section commented="no" id="H9953F082160F43F69871713F34E93AEB"><enum>115.</enum><header>Application of disclaimer statements to online communications</header> 
<subsection commented="no" id="H1D0EC038422F4B25B939CF6BB7B39440"><enum>(a)</enum><header>Clear and conspicuous manner requirement</header><text>Subsection (a) of section 318 of the Federal Election Campaign Act of 1971 (52 U.S.C. 30120(a)) is amended—</text> 
<paragraph commented="no" id="H3A8F8F41DD8B4F7C82A0ACBE8850F562"><enum>(1)</enum><text>by striking <quote>shall clearly state</quote> each place it appears in paragraphs (1), (2), and (3) and inserting <quote>shall state in a clear and conspicuous manner</quote>; and</text></paragraph> 
<paragraph commented="no" id="H96E07FC10D1743929D496835E0737087"><enum>(2)</enum><text>by adding at the end the following flush sentence: <quote>For purposes of this section, a communication does not make a statement in a clear and conspicuous manner if it is difficult to read or hear or if the placement is easily overlooked.</quote>.</text></paragraph></subsection> 
<subsection commented="no" id="HE04E03C6BC5D445CAF3C50F06D870CA7"><enum>(b)</enum><header>Special rules for qualified Internet or digital communications</header> 
<paragraph commented="no" id="H125EF6BF1E244BAB83C7B21548A67F89"><enum>(1)</enum><header>In general</header><text>Section 318 of such Act (52 U.S.C. 30120) is amended by adding at the end the following new subsection:</text>

<paragraph id="HC94684332F8948C39C7ACC0002949ED4"><enum>(1)</enum><header>Special rules with respect to statements</header><text>In the case of any communication to which this section applies which is a qualified internet or digital communication (as defined in section 304(f)(3)(D)) which is disseminated through a medium in which the provision of all of the information specified in this section is not possible, the communication shall, in a clear and conspicuous manner—</text> 
<subparagraph commented="no" id="HCE260AD3B9D140C6B0E1F6E85EF1A075"><enum>(A)</enum><text>state the name of the person who paid for the communication; and</text></subparagraph> 
<subparagraph commented="no" id="HA69F26AF7B5F426C9B73E7D3B1E972BC"><enum>(B)</enum><text>provide a means for the recipient of the communication to obtain the remainder of the information required under this section with minimal effort and without receiving or viewing any additional material other than such required information.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H2AFCBB13F46840C692A7A9ACA3CBC76B"><enum>(2)</enum><header>Safe harbor for determining clear and conspicuous manner</header><text>A statement in a qualified internet or digital communication (as defined in section 304(f)(3)(D)) shall be considered to be made in a clear and conspicuous manner as provided in subsection (a) if the communication meets the following requirements:</text> 
<subparagraph id="H4794337A6A5747FA9B39F02AAAE86E22"><enum>(A)</enum><header>Text or graphic communications</header><text>In the case of a text or graphic communication, the statement—</text> 
<clause id="HBB087A938703472397D866BABACB8E54"><enum>(i)</enum><text>appears in letters at least as large as the majority of the text in the communication; and</text></clause> 
<clause id="HFB7A5EFE9FB141509AC00845267AD3FF"><enum>(ii)</enum><text>meets the requirements of paragraphs (2) and (3) of subsection (c).</text></clause></subparagraph> 
<subparagraph id="H41C0C3A5A7B94BD384FC0307277AF36A"><enum>(B)</enum><header>Audio communications</header><text>In the case of an audio communication, the statement is spoken in a clearly audible and intelligible manner at the beginning or end of the communication and lasts at least 3 seconds.</text></subparagraph> 
<subparagraph id="H4EAC22CB8F934BF88C03E345C9387E95"><enum>(C)</enum><header>Video communications</header><text>In the case of a video communication which also includes audio, the statement—</text> 
<clause id="H6BEAB642CDD44FB5A48F44682437ADE2"><enum>(i)</enum><text>is included at either the beginning or the end of the communication; and</text></clause> 
<clause id="HB9CC79FD729845A981953DCC6381D567"><enum>(ii)</enum><text>is made both in—</text> 
<subclause id="H0CB0B7A085594315B21369DED8306D28"><enum>(I)</enum><text>a written format that meets the requirements of subparagraph (A) and appears for at least 4 seconds; and</text></subclause> 
<subclause id="H732B9551A0E1433AA6CB24080AB8A895"><enum>(II)</enum><text>an audible format that meets the requirements of subparagraph (B).</text></subclause></clause></subparagraph> 
<subparagraph id="H72962D4A3129484FB2A6D3DFD1B98F84"><enum>(D)</enum><header>Other communications</header><text>In the case of any other type of communication, the statement is at least as clear and conspicuous as the statement specified in subparagraph (A), (B), or (C).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph commented="no" id="HC5FCB2C3D3784C3F9ED86572161D8B7D"><enum>(2)</enum><header>Nonapplication of certain exceptions</header><text>The exceptions provided in section 110.11(f)(1)(i) and (ii) of title 11, Code of Federal Regulations, or any successor to such rules, shall have no application to qualified internet or digital communications (as defined in section 304(f)(3)(D) of the Federal Election Campaign Act of 1971, as added by this Act).</text></paragraph></subsection> 
<subsection commented="no" id="HCF72EB0AE60A481EB296345171D178BF"><enum>(c)</enum><header>Modification of additional requirements for certain communications</header><text>Section 318(d) of such Act (52 U.S.C. 30120(d)) is amended—</text>

<subsection commented="no" id="H44B03D1FA6F348A1A441982EFFC8AEAB"><enum>(a)</enum><header>In general</header><text>Section 304 of the Federal Election Campaign Act of 1971 (52 U.S.C. 30104), as amended by section 101(a), is further amended by adding at the end the following new subsection:</text>

<paragraph commented="no" id="H2F65FE50503F493BBBFFD6AA7316197E"><enum>(1)</enum><header>In general</header> 
<subparagraph commented="no" id="H665EF9982EE644249A79A4AE08CFE40A"><enum>(A)</enum><header>Requirements for online platforms</header><text>An online platform shall maintain, and make available for online public inspection in machine readable format, a complete record of any request to purchase on such online platform a qualified political advertisement which is made by a person whose aggregate requests to purchase qualified political advertisements on such online platform during the calendar year exceeds $500.</text></subparagraph> 
<subparagraph commented="no" id="H134BD71550A94BE68B5C4DD82F53F871"><enum>(B)</enum><header>Requirements for advertisers</header><text>Any person who requests to purchase a qualified political advertisement on an online platform shall provide the online platform with such information as is necessary for the online platform to comply with the requirements of subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H8A73EE9EAD4B40EB858439DB6809551B"><enum>(2)</enum><header>Contents of record</header><text>A record maintained under paragraph (1)(A) shall contain—</text> 
<subparagraph id="HB071719D7DF94E79B4FAE321B79DF2EA"><enum>(A)</enum><text>a digital copy of the qualified political advertisement;</text></subparagraph> 
<subparagraph commented="no" id="HEE466FEEF7F345079987ACCEB6729B59"><enum>(B)</enum><text>a description of the audience targeted by the advertisement, the number of views generated from the advertisement, and the date and time that the advertisement is first displayed and last displayed; and</text></subparagraph> 
<subparagraph id="HC89070321DD84742BDB39F6D55B2FE15"><enum>(C)</enum><text>information regarding—</text> 
<clause id="H65BB8E84E65F4DFBB472761DC49CBEF3"><enum>(i)</enum><text>the average rate charged for the advertisement;</text></clause> 
<clause id="H80014AD3AF544266866A43EE4FCC9F1A"><enum>(ii)</enum><text>the name of the candidate to which the advertisement refers and the office to which the candidate is seeking election, the election to which the advertisement refers, or the national legislative issue to which the advertisement refers (as applicable);</text></clause> 
<clause id="H7655013820BF446DB74AAD420CC54850"><enum>(iii)</enum><text>in the case of a request made by, or on behalf of, a candidate, the name of the candidate, the authorized committee of the candidate, and the treasurer of such committee; and</text></clause> 
<clause id="HFE690F878EED4984B58C7F60A3521EED"><enum>(iv)</enum><text>in the case of any request not described in clause (iii), the name of the person purchasing the advertisement, the name and address of a contact person for such person, and a list of the chief executive officers or members of the executive committee or of the board of directors of such person.</text></clause></subparagraph></paragraph> 
<paragraph commented="no" id="HE4C360750FF44FD8A8A172D94B13098A"><enum>(3)</enum><header>Online platform</header><text>For purposes of this subsection, the term <term>online platform</term> means any public-facing website, web application, or digital application (including a social network, ad network, or search engine) which—</text> 
<subparagraph id="H5B58ADFFB7064D7498C984684EAFA522"><enum>(A)</enum><text>sells qualified political advertisements; and</text></subparagraph> 
<subparagraph id="H4139DBF77D234446B9ABB8956CE5B1BE"><enum>(B)</enum><text>has 50,000,000 or more unique monthly United States visitors or users for a majority of months during the preceding 12 months.</text></subparagraph></paragraph> 
<paragraph id="HCC31E830AD164BF3AC7D09D19F4302EA"><enum>(4)</enum><header>Qualified political advertisement</header><text>For purposes of this subsection, the term <term>qualified political advertisement</term> means any advertisement (including search engine marketing, display advertisements, video advertisements, native advertisements, and sponsorships) that—</text> 
<subparagraph id="H12A5278A96BC451B8E4470D6F3EAFB50"><enum>(A)</enum><text>is made by or on behalf of a candidate; or</text></subparagraph> 
<subparagraph id="HFF2B9CD361BE42B7898B661C5D80B8A4" commented="no"><enum>(B)</enum><text>communicates a message relating to any political matter of national importance, including—</text> 
<clause id="H0313E978FB0C4D57969035C8FA082787" commented="no"><enum>(i)</enum><text>a candidate;</text></clause> 
<clause id="H030908E35ED347B485379D7143FE7769" commented="no"><enum>(ii)</enum><text>any election to Federal office; or</text></clause> 
<clause id="H921C6746B98D47C5A03CD96F0E293B42" commented="no"><enum>(iii)</enum><text>a national legislative issue of public importance.</text></clause></subparagraph></paragraph> 
<paragraph id="H3CF0DB4DAAE0484597E12427A28D1923"><enum>(5)</enum><header>Time to maintain file</header><text>The information required under this subsection shall be made available as soon as possible and shall be retained by the online platform for a period of not less than 4 years.</text></paragraph> 
<paragraph id="HF4A0319694F2481AA8F7112F6B7411F2"><enum>(6)</enum><header>Safe harbor for platforms making best efforts to identify requests which are subject to record maintenance requirements</header><text>In accordance with rules established by the Commission, if an online platform shows that the platform used best efforts to determine whether or not a request to purchase a qualified political advertisement was subject to the requirements of this subsection, the online platform shall not be considered to be in violation of such requirements.</text></paragraph> 
<paragraph id="H42D42DE2E0EF4C62B58B27AB1795DBBF"><enum>(7)</enum><header>Penalties</header><text>For penalties for failure by online platforms, and persons requesting to purchase a qualified political advertisement on online platforms, to comply with the requirements of this subsection, see section 309.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBFE97E62AA7B4298BFB90428B1DD9BF9"><enum>(b)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Federal Election Commission shall establish rules—</text> 
<paragraph id="H03C687373E054594935702A8E37E873D"><enum>(1)</enum><text>requiring common data formats for the record required to be maintained under section 304(k) of the Federal Election Campaign Act of 1971 (as added by subsection (a)) so that all online platforms submit and maintain data online in a common, machine-readable and publicly accessible format;</text></paragraph> 
<paragraph id="HFAE85EC1B2754C6DAA67D152E9E4CF31"><enum>(2)</enum><text>establishing search interface requirements relating to such record, including searches by candidate name, issue, purchaser, and date; and</text></paragraph> 
<paragraph id="H7DCCFC42A48A49D4BF1ABF25FF07A8A7"><enum>(3)</enum><text>establishing the criteria for the safe harbor exception provided under paragraph (6) of section 304(k) of such Act (as added by subsection (a)).</text></paragraph></subsection> 
<subsection id="H10A37C5994A54A5EB8DD2910C9B6F2B4"><enum>(c)</enum><header>Reporting</header><text>Not later than 2 years after the date of the enactment of this Act, and biannually thereafter, the Chairman of the Federal Election Commission shall submit a report to Congress on—</text> 
<paragraph id="H845E6C32695447BB9DD9560EAB03FCD7"><enum>(1)</enum><text>matters relating to compliance with and the enforcement of the requirements of section 304(k) of the Federal Election Campaign Act of 1971, as added by subsection (a);</text></paragraph> 
<paragraph id="H3439993CF5CE48E5A04307C92A6FFB8A"><enum>(2)</enum><text>recommendations for any modifications to such section to assist in carrying out its purposes; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HEBF5309EB7EF4A7398A93D8BD176E6ED"><enum>(3)</enum><text display-inline="yes-display-inline">identifying ways to bring transparency and accountability to political advertisements distributed online for free.</text></paragraph></subsection></section> 
<section id="H405446E41D524A2A8D89B115646510EE"><enum>117.</enum><header>Preventing contributions, expenditures, independent expenditures, and disbursements for electioneering communications by foreign nationals in the form of online advertising</header><text display-inline="no-display-inline">Section 319 of the Federal Election Campaign Act of 1971 (52 U.S.C. 30121) is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H1E45DBF82E8746DEBF58463480CEB2AE" style="OLC"> 
<subsection id="HE26EC9FDE0A24765BF79E2F5ABC30BC6"><enum>(c)</enum><header>Responsibilities of broadcast stations, providers of cable and satellite television, and online platforms</header> 
<paragraph id="HE30AAE33C58849C59EDF3C206D82DA73"><enum>(1)</enum><header>Responsibilities described</header><text>Each television or radio broadcast station, provider of cable or satellite television, or online platform (as defined in section 304(k)(3)) shall make reasonable efforts to ensure that communications described in section 318(a) and made available by such station, provider, or platform are not purchased by a foreign national, directly or indirectly. For purposes of the previous sentence, a station, provider, or online platform shall not be considered to have made reasonable efforts under this paragraph in the case of the availability of a communication unless the station, provider, or online platform directly inquires from the individual or entity making such purchase whether the purchase is to be made by a foreign national, directly or indirectly.</text></paragraph></subsection> 
<paragraph id="H4C52909B646348E29891DE6B9953EF5A"><enum>(2)</enum><header>Special rules for disbursement paid with credit card</header><text display-inline="yes-display-inline">For purposes of paragraph (1), a television or radio broadcast station, provider of cable or satellite television, or online platform shall be considered to have made reasonable efforts under such paragraph in the case of a purchase of the availability of a communication which is made with a credit card if—</text> 
<subparagraph id="H3AC94E250EBA40ED9DED4951D896C535"><enum>(A)</enum><text>the individual or entity making such purchase is required, at the time of making such purchase, to disclose the credit verification value of such credit card; and</text></subparagraph> 
<subparagraph id="HD47D9A428028411E9BDCA79C358A81EB"><enum>(B)</enum><text display-inline="yes-display-inline">the billing address associated with such credit card is located in the United States or, in the case of a purchase made by an individual who is a United States citizen living outside of the United States, the individual provides the television or radio broadcast station, provider of cable or satellite television, or online platform with the United States mailing address the individual uses for voter registration purposes.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></subtitle></title> 
<title id="HC2CDA7226073486395090D1B87B31F56"><enum>II</enum><header>Closing Loopholes Allowing Spending by Foreign Nationals in Elections</header> 
<section id="H4A7E843B5D5E4887A2C6FC56CC299112"><enum>201.</enum><header>Clarification of prohibition on participation by foreign nationals in election-related activities</header> 
<subsection id="HC229B2260A1D4417A5D2C674382DA151"><enum>(a)</enum><header>Clarification of prohibition</header><text display-inline="yes-display-inline">Section 319(a) of the Federal Election Campaign Act of 1971 (52 U.S.C. 30121(a)) is amended—</text> 
<paragraph id="H563C0647E40E4B0E8CEBD3E7C3597EFD"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of paragraph (1);</text></paragraph> 
<paragraph id="H38CF53765E96413BA940B3EFDE46099D"><enum>(2)</enum><text>by striking the period at the end of paragraph (2) and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="HCEA5A336864B4440860A6BC26B188CFC"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="H433243280757417DA91C19719C098E17" display-inline="no-display-inline"> 
<paragraph id="H8C2B0F56BD144F0F8BF44BD8A25477C2"><enum>(3)</enum><text display-inline="yes-display-inline">a foreign national to direct, dictate, control, or directly or indirectly participate in the decision making process of any person (including a corporation, labor organization, political committee, or political organization) with regard to such person’s Federal or non-Federal election-related activity, including any decision concerning the making of contributions, donations, expenditures, or disbursements in connection with an election for any Federal, State, or local office or any decision concerning the administration of a political committee.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6407F88E00E64E32A36CC14F23267893"><enum>(b)</enum><header>Certification of Compliance</header><text>Section 319 of such Act (52 U.S.C. 30121), as amended by section 117, is further amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H2C01AFCBEDC1439CB2C07A02BF63DD53" style="OLC"> 
<subsection id="HC88F6D557FE74DDFA95347405C2E3578"><enum>(d)</enum><header>Certification of compliance required prior to carrying out activity</header><text display-inline="yes-display-inline">Prior to the making in connection with an election for Federal office of any contribution, donation, expenditure, independent expenditure, or disbursement for an electioneering communication by a corporation, labor organization (as defined in section 316(b)), limited liability corporation, or partnership during a year, the chief executive officer of the corporation, labor organization, limited liability corporation, or partnership (or, if the corporation, labor organization, limited liability corporation, or partnership does not have a chief executive officer, the highest ranking official of the corporation, labor organization, limited liability corporation, or partnership), shall file a certification with the Commission, under penalty of perjury, that a foreign national did not direct, dictate, control, or directly or indirectly participate in the decision making process relating to such activity in violation of subsection (a)(3), unless the chief executive officer has previously filed such a certification during that calendar year.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H40746CBC5B6448A4BDCCE449904C9721"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect upon the expiration of the 180-day period which begins on the date of the enactment of this Act.</text></subsection></section> 
<section id="HBFD89EC3551644D0A021C43D363E2C7B"><enum>202.</enum><header>Clarification of application of foreign money ban to certain disbursements and activities</header> 
<subsection id="HDDFA5323435F4E30AD2F1B136399A443"><enum>(a)</enum><header>Application to disbursements to Super PACs</header><text display-inline="yes-display-inline">Section 319(a)(1)(A) of the Federal Election Campaign Act of 1971 (52 U.S.C. 30121(a)(1)(A)) is amended by striking the semicolon and inserting the following: <quote>, including any disbursement to a political committee which accepts donations or contributions that do not comply with the limitations, prohibitions, and reporting requirements of this Act (or any disbursement to or on behalf of any account of a political committee which is established for the purpose of accepting such donations or contributions);</quote>.</text></subsection> 
<subsection id="HAD7DCC94237D409590724361EE403FBA"><enum>(b)</enum><header>Conditions under which corporate PACs may make contributions and expenditures</header><text>Section 316(b) of such Act (52 U.S.C. 30118(b)) is amended by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H95CE7D7CADAB43848E3C322AE8E5E5BC" style="traditional"> 
<paragraph id="HE1DF3C8C7D2249C183CCFA03AC37D11C" indent="up1"><enum>(8)</enum><text>A separate segregated fund established by a corporation may not make a contribution or expenditure during a year unless the fund has certified to the Commission the following during the year:</text> 
<subparagraph id="HE902088B769246B4B496513E47503450"><enum>(A)</enum><text>Each individual who manages the fund, and who is responsible for exercising decisionmaking authority for the fund, is a citizen of the United States or is lawfully admitted for permanent residence in the United States.</text></subparagraph> 
<subparagraph id="HAA35383E9CD145B7AD14FB296CF5E855"><enum>(B)</enum><text>No foreign national under section 319 participates in any way in the decisionmaking processes of the fund with regard to contributions or expenditures under this Act.</text></subparagraph> 
<subparagraph id="H74E409198CC747C48E817915BA2AE8FA"><enum>(C)</enum><text>The fund does not solicit or accept recommendations from any foreign national under section 319 with respect to the contributions or expenditures made by the fund.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H4307F21A98124C4C9FEFB3B82F67A88B"><enum>(D)</enum><text>Any member of the board of directors of the corporation who is a foreign national under section 319 abstains from voting on matters concerning the fund or its activities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HC3EF23D2B6BA4237A987E599EDCF5E59"><enum>203.</enum><header>Audit and report on illicit foreign money in Federal elections</header> 
<subsection id="HA2429913DD594589B0CA3B8EA770FBA8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title III of the Federal Election Campaign Act of 1971 (52 U.S.C. 30101 et seq.) is amended by inserting after section 319 the following new section:</text> 
<quoted-block style="OLC" id="H3AD405B8DA8C4A40804CCE702D231429" display-inline="no-display-inline"> 
<section id="HBC72EC9ED4224DC39CB00AA2EB2F338F"><enum>319A.</enum><header>Audit and report on disbursements by foreign nationals</header> 
<subsection id="H9AB33652AA2D45A68E58BDC142729332"><enum>(a)</enum><header>Audit</header> 
<paragraph id="H295CAAE3DC8D40D1BFF33DB24B0C420D"><enum>(1)</enum><header>In general</header><text>The Commission shall conduct an audit after each Federal election cycle to determine the incidence of illicit foreign money in such Federal election cycle.</text></paragraph> 
<paragraph id="H2869D758246D4D4E968BE33C482260A0"><enum>(2)</enum><header>Procedures</header><text>In carrying out paragraph (1), the Commission shall conduct random audits of any disbursements required to be reported under this Act, in accordance with procedures established by the Commission.</text></paragraph></subsection> 
<subsection id="HB6DD4975327949A592C7F07A6C606A54"><enum>(b)</enum><header>Report</header><text>Not later than 180 days after the end of each Federal election cycle, the Commission shall submit to Congress a report containing—</text> 
<paragraph id="HA8059DA5B41144FCA6822AB2927C814C"><enum>(1)</enum><text>results of the audit required by subsection (a)(1); and</text></paragraph> 
<paragraph id="HA1291AA1DFA548DB8D6FE17D7408EF13"><enum>(2)</enum><text>recommendations to address the presence of illicit foreign money in elections, as appropriate.</text></paragraph></subsection> 
<subsection id="H4D5A7A2FCF57454DBEF139375BD76A4A"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">As used in this section:</text> 
<paragraph id="H3BF8D179DD24474DB49761D6D97A4551"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>Federal election cycle</term> means the period which begins on the day after the date of a regularly scheduled general election for Federal office and which ends on the date of the first regularly scheduled general election for Federal office held after such date.</text></paragraph> 
<paragraph id="H9DC9BA060C8C4BDC8C4F509324FB9BAB"><enum>(2)</enum><text>The term <term>illicit foreign money</term> means any disbursement by a foreign national (as defined in section 319(b)) prohibited under such section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H71B22E82676F4C829BEF7E52FDA222F3"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to the Federal election cycle that began during November 2018, and each succeeding Federal election cycle.</text></subsection></section> 
<section id="HCAF16C86B22548B293E7B2A9E37218E2"><enum>204.</enum><header>Prohibition on contributions and donations by foreign nationals in connections with ballot initiatives and referenda</header> 
<subsection id="H95CF34CA842B416CBDD95C2EF38BA783"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 319(a)(1)(A) of the Federal Election Campaign Act of 1971 (52 U.S.C. 30121(a)(1)(A)) is amended by striking <quote>election</quote> and inserting the following: <quote>election, including a State or local ballot initiative or referendum</quote>. </text></subsection> 
<subsection id="HC85B691E955F460EB2F599266DDABBD2"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply with respect to elections held in 2020 or any succeeding year.</text></subsection></section> 
<section id="H44450CDFF3D748A2BE84E10C9AA3D9B4"><enum>205.</enum><header>Expansion of limitations on foreign nationals participating in political advertising</header> 
<subsection id="HA6ECB225A6F24178B355B4BEF6F6C716"><enum>(a)</enum><header>Disbursements described</header><text display-inline="yes-display-inline">Section 319(a)(1) of the Federal Election Campaign Act of 1971 (52 U.S.C. 30121(a)(1)) is amended—</text> 
<paragraph id="H5F4F27C9A2D94B45B0DFF62B373B62F0"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of subparagraph (B); and</text></paragraph> 
<paragraph id="H87984E054E4F4D90851D174AB071F3AC"><enum>(2)</enum><text>by striking subparagraph (C) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="HE46EF53E92334DE28398CB8114FCFB17" style="traditional"> 
<subparagraph id="HB140D854D7714C36BA97FF1C9F2E3410"><enum>(C)</enum><text display-inline="yes-display-inline">an expenditure;</text></subparagraph> 
<subparagraph id="HD81B29105A04435E93C5F43E87CAD09D"><enum>(D)</enum><text>an independent expenditure;</text></subparagraph> 
<subparagraph id="HA9B031236C0F481BB468A45D0DE238D7"><enum>(E)</enum><text>a disbursement for an electioneering communication (within the meaning of section 304(f)(3));</text></subparagraph> 
<subparagraph id="H03A076D7B433405F8B31D54A67D3958D"><enum>(F)</enum><text>a disbursement for a communication which is placed or promoted for a fee on a website, web application, or digital application that refers to a clearly identified candidate for election for Federal office and is disseminated within 60 days before a general, special or runoff election for the office sought by the candidate or 30 days before a primary or preference election, or a convention or caucus of a political party that has authority to nominate a candidate for the office sought by the candidate;</text></subparagraph> 
<subparagraph id="HA42B4DFCC1384343B61CFF4C4F80357A"><enum>(G)</enum><text display-inline="yes-display-inline">a disbursement for a broadcast, cable or satellite communication, or for a communication which is placed or promoted for a fee on a website, web application, or digital application, that promotes, supports, attacks or opposes the election of a clearly identified candidate for Federal, State, or local office (regardless of whether the communication contains express advocacy or the functional equivalent of express advocacy);</text></subparagraph> 
<subparagraph id="H1FEAC150310F42E591A62F972C04206B"><enum>(H)</enum><text>a disbursement for a broadcast, cable, or satellite communication, or for any communication which is placed or promoted for a fee on an online platform (as defined in section 304(k)(3)), that discusses a national legislative issue of public importance in a year in which a regularly scheduled general election for Federal office is held, but only if the disbursement is made by a covered foreign national described in section 304(j)(3)(C); or</text></subparagraph> 
<subparagraph id="H70F936484F3C4FFC80B274B567DC5BFD"><enum>(I)</enum><text display-inline="yes-display-inline">a disbursement by a covered foreign national described in section 304(j)(3)(C) to compensate any person for internet activity that promotes, supports, attacks or opposes the election of a clearly identified candidate for Federal, State, or local office (regardless of whether the activity communication contains express advocacy or the functional equivalent of express advocacy);</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H60B776B0C1D34DC0AED6272455B5065A"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to disbursements made on or after the date of the enactment of this Act.</text></subsection></section></title> 
<title id="H7B720E8D3ED24A3B9C690ED24FCCE12A"><enum>III</enum><header>Deterring Foreign Interference in Elections</header> 
<subtitle id="HDEDCFF15DDE049EF8BF172D2D14D0D80"><enum>A</enum><header>Deterrence under Federal Election Campaign Act of 1971</header> 
<section id="HB7AF38629A4A4277AFE3774EC0AF81D4"><enum>301.</enum><header>Restrictions on exchange of campaign information between candidates and foreign powers</header><text display-inline="no-display-inline">Section 319 of the Federal Election Campaign Act of 1971 (52 U.S.C. 30121), as amended by section 117 and section 201(b), is further amended by adding at the end the following new subsection:</text>

<subsection id="H6931624A87F843B3B9EC70C5C329D18B"><enum>(e)</enum><header>Restrictions on exchange of information between candidates and foreign powers</header> 
<paragraph id="H4A9CE8C5011948D7AEDDF558B2902711"><enum>(1)</enum><header>Treatment of offer to share nonpublic campaign material as solicitation of contribution from foreign national</header><text>If a candidate or an individual affiliated with the campaign of a candidate, or if a political committee or an individual affiliated with a political committee, provides or offers to provide nonpublic campaign material to a covered foreign national or to another person whom the candidate, committee, or individual knows or has reason to know will provide the material to a covered foreign national, the candidate, committee, or individual (as the case may be) shall be considered for purposes of this section to have solicited a contribution or donation described in subsection (a)(1)(A) from a foreign national. </text></paragraph> 
<paragraph id="HBFBB6B96BDFE4CA59C354B1347FB98C1"><enum>(2)</enum><header>Definitions</header><text>In this subsection, the following definitions apply: </text> 
<subparagraph id="H05ABD56DB2B04521B3DA94C53E326983"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>candidate</term> means an individual who seeks nomination for, or election to, any Federal, State, or local public office.</text></subparagraph> 
<subparagraph id="H9DC0D680027C402685935602B03BD954"><enum>(B)</enum><text>The term <term>covered foreign national</term> has the meaning given such term in section 304(j)(3)(C).</text></subparagraph> 
<subparagraph id="H8C06262211354089AC2B4155A7DC0FD2"><enum>(C)</enum><text display-inline="yes-display-inline">The term <term>individual affiliated with a campaign</term> means, with respect to a candidate, an employee of any organization legally authorized under Federal, State, or local law to support the candidate’s campaign for nomination for, or election to, any Federal, State, or local public office, as well as any independent contractor of such an organization and any individual who performs services on behalf of the organization, whether paid or unpaid.</text></subparagraph> 
<subparagraph id="H284149C0B49742F3AF386BC288604636"><enum>(D)</enum><text display-inline="yes-display-inline">The term <term>individual affiliated with a political committee</term> means, with respect to a political committee, an employee of the committee as well as any independent contractor of the committee and any individual who performs services on behalf of the committee, whether paid or unpaid.</text></subparagraph> 
<subparagraph id="H55DD5B989F724DE584AD819B7F2FCE1D"><enum>(E)</enum><text display-inline="yes-display-inline">The term <term>nonpublic campaign material</term> means, with respect to a candidate or a political committee, campaign material that is produced by the candidate or the committee or produced at the candidate or committee’s expense or request which is not distributed or made available to the general public or otherwise in the public domain, including polling and focus group data and opposition research, except that such term does not include material produced for purposes of consultations relating solely to the candidate’s or committee’s position on a legislative or policy matter.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H61E9B2163D0E4F06B52FE85E62EBD561"><enum>302.</enum><header>Clarification of standard for determining existence of coordination between campaigns and outside interests</header><text display-inline="no-display-inline">Section 315(a) of the Federal Election Campaign Act of 1971 (52 U.S.C. 30116(a)) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H9948D8F59A8742CFB00EB4702724D8F1" indent="up1"><enum>(10)</enum><text display-inline="yes-display-inline">For purposes of paragraph (7), an expenditure or disbursement may be considered to have been made in cooperation, consultation, or concert with, or coordinated with, a person without regard to whether or not the cooperation, consultation, or coordination is carried out pursuant to agreement or formal collaboration.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></subtitle> 
<subtitle id="H4B75F154C72D4A94A0ACF7A4BDA51C1A"><enum>B</enum><header>[Reserved]</header></subtitle></title> 
<title id="H33C0CC0B6A85423ABC79B3A9CB8C160C"><enum>IV</enum><header>Miscellaneous Provisions</header> 
<section id="HC226C22C6DDA4BAB9269A1466F39F566"><enum>401.</enum><header>Effective dates of provisions</header><text display-inline="no-display-inline">Each provision of this Act and each amendment made by a provision of this Act shall take effect on the effective date provided under this Act for such provision or such amendment without regard to whether or not the Federal Election Commission, the Attorney General, or any other person has promulgated regulations to carry out such provision or such amendment.</text></section> 
<section id="H726318FA42A048C78C1B90ECCB278825"><enum>402.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or any amendment made by this Act, or the application of a provision of this Act or an amendment made by this Act to any person or circumstance, is held to be unconstitutional, the remainder of this Act, and the application of the provisions to any person or circumstance, shall not be affected by the holding.</text></section></title>
