<section id="H5A517C1AEF17498F8430526863AF5F71" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Combating International Islamophobia Act</short-title></quote>.</text></section>
<section id="HBD4590BE285A4D80B26188D60B143ABA"><enum>2.</enum><header>Authorization for establishment of Office to Monitor and Combat Islamophobia</header><text display-inline="no-display-inline"> Title 1 of the State Department Basic Authorities Act of 1956 (22 U.S.C. 2651a et seq.) is amended by adding at the end the following new section:</text>

<section id="H847E2319DB7E436A9F7F64778BB68E07"><enum>64.</enum><header>Monitoring and combating Islamophobia</header>
<subsection id="H5F1D36CCDEEC443EACEF83B4810E38C8"><enum>(a)</enum><header>Office To Monitor and Combat Islamophobia</header>
<paragraph id="H566EB8EED24242C5BCD2FB1246ADD6FC"><enum>(1)</enum><header>Establishment</header><text>The Secretary of State shall establish within the Department of State an Office to Monitor and Combat Islamophobia (in this section referred to as the <quote>Office</quote>).</text></paragraph>
<paragraph id="H3920E9DD83E64B70B8AB77F6425F0400"><enum>(2)</enum><header>Head of Office</header>
<subparagraph id="HA70543AE7A034D3BB811F0A85B38214D"><enum>(A)</enum><header>Special Envoy for Monitoring and Combating Islamophobia</header><text>The head of the Office shall be the Special Envoy for Monitoring and Combating Islamophobia (in this section referred to as the <quote>Special Envoy</quote>).</text></subparagraph>
<subparagraph id="HB351ACF7226346ACB99DE2B07CC57404"><enum>(B)</enum><header>Appointment of Special Envoy</header><text display-inline="yes-display-inline">The <deleted-phrase reported-display-style="strikethrough" committee-id="HFA00">Secretary of State</deleted-phrase> <added-phrase reported-display-style="italic" committee-id="HFA00">President, by and with the advice and consent of the Senate,</added-phrase> shall appoint the Special Envoy. If the <deleted-phrase reported-display-style="strikethrough" committee-id="HFA00">Secretary</deleted-phrase> <added-phrase reported-display-style="italic" committee-id="HFA00">President</added-phrase> determines that such is appropriate, the <deleted-phrase reported-display-style="strikethrough" committee-id="HFA00">Secretary</deleted-phrase> <added-phrase reported-display-style="italic" committee-id="HFA00">President</added-phrase> may appoint the Special Envoy from among officers and employees of the Department of State. The Secretary <added-phrase reported-display-style="italic" committee-id="HFA00">of State</added-phrase> may allow such officer or employee to retain the position (and the responsibilities associated with such position) held by such officer or employee prior to such appointment.</text></subparagraph></paragraph></subsection>
<subsection id="HCF885ADF99AF41978792CA17A15483C3"><enum>(b)</enum><header>Purpose of office</header><text>Upon establishment, the Office shall assume primary responsibility for the following:</text>
<paragraph id="HC5AF2DC2D4B24EA591040EEAFAAB3504"><enum>(1)</enum><text>Monitoring and combating acts of Islamophobia and Islamophobic incitement that occur in foreign countries.</text></paragraph>
<paragraph id="H58B0C396EC3F4F38AA194501E2919D6C"><enum>(2)</enum><text>Coordinating and assisting in the preparation of that portion of the reports required by paragraph (9) of section 116(d) and subsection (k) of section 502B of the Foreign Assistance Act of 1961 (22 U.S.C. 2151n(d) and 2304) relating to an assessment and description of the nature and extent of acts of Islamophobia and Islamophobic incitement.</text></paragraph>
<paragraph id="H977AC9BACAA043ADA0B4B602A0175180"><enum>(3)</enum><text>Coordinating and assisting in the preparation of that portion of the report required by clause (viii) of section 102(b)(1)(A) of the International Religious Freedom Act of 1998 (22 U.S.C. 6412(b)(1)(A)) relating to an assessment and description of the nature and extent of acts of Islamophobia and Islamophobic incitement.</text></paragraph></subsection>
<subsection id="HB599EE96F2E648B78DC9DE0D93C53134"><enum>(c)</enum><header>Consultations</header><text>The Special Envoy shall consult with domestic and international nongovernmental organizations and multilateral organizations and institutions, as the Special Envoy considers appropriate, to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H55564A20BDA64CB781DE3289237EE300"><enum>3.</enum><header>Inclusion in Department of State annual reports of information concerning acts of Islamophobia in foreign countries</header>
<subsection id="H1447B64539884FA2821D35C4A31DBD69"><enum>(a)</enum><header>Inclusion in annual country reports on human rights practices</header><text>The Foreign Assistance Act of 1961 (22 U.S.C. 2151 et seq.) is amended—</text>
<paragraph id="HEC34F0376E86449A90130552432D7C04"><enum>(1)</enum><text>in section 116(d) (22 U.S.C. 2151n(d))—</text>
<subparagraph id="H915B7033954E4FB99B69AE86173CAF44"><enum>(A)</enum><text>by redesignating paragraphs (9), (10), (11), and (12), as paragraphs (10), (11), (12), and (13), respectively; and</text></subparagraph>
<subparagraph id="HCF2B12A134C6416297FDCBD351BBD747"><enum>(B)</enum><text>by inserting after paragraph (8) the following new paragraph:</text>

<paragraph id="H8D93DE071091499487E1590E2BDD904B"><enum>(9)</enum><text>wherever applicable, a description of the nature and extent of acts of Islamophobia and Islamophobic incitement that occur during the preceding year, including descriptions of—</text>
<subparagraph id="HB9A6D13F394543949607595262B1FD02"><enum>(A)</enum><text>acts of physical violence against, or harassment of, Muslim people, and acts of violence against, or vandalism of, Muslim community institutions, including schools, mosques, and cemeteries;</text></subparagraph>
<subparagraph id="H2130F8AF711E41879DB3F32F44AD21A0"><enum>(B)</enum><text>instances of propaganda in government and nongovernment media that attempt to justify or promote racial hatred or incite acts of violence against Muslim people;</text></subparagraph>
<subparagraph id="HD4938989FAD946E9A159FB1E09DFA7D7"><enum>(C)</enum><text>the actions, if any, taken by the government of the country to respond to such violence and attacks or to eliminate such propaganda or incitement;</text></subparagraph>
<subparagraph id="H9C0FD707391643A0A1F5A9F4BA493755"><enum>(D)</enum><text>the actions taken by such government to enact and enforce laws relating to the protection of the right to religious freedom of Muslim people<deleted-phrase reported-display-style="strikethrough" committee-id="HFA00">; and</deleted-phrase><added-phrase reported-display-style="italic" committee-id="HFA00">;</added-phrase></text></subparagraph>
<subparagraph id="HAD87058B181A4041B7AFBC07899E0BD6"><enum>(E)</enum><text>the efforts of such government to promote anti-bias and tolerance education<deleted-phrase reported-display-style="strikethrough" committee-id="HFA00">;</deleted-phrase><added-phrase reported-display-style="italic" committee-id="HFA00">; and</added-phrase></text></subparagraph>
<subparagraph id="HABAC6620EC45449B817C708F5AFAC04D" committee-id="HFA00"><enum><added-phrase reported-display-style="italic" committee-id="HFA00">(F)</added-phrase></enum><text display-inline="yes-display-inline"><added-phrase reported-display-style="italic" committee-id="HFA00">any instances of forced labor, reeducation, or the presence of concentration camps, such as those targeting the Uyghurs in the Xinjiang Province of the People’s Republic of China;</added-phrase></text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H8684C88B268444A38E736DCD5B2F73AA" commented="no"><enum>(2)</enum><text>in section 502B (22 U.S.C. 2304), by—</text>
<subparagraph id="H4C334F6C98E14845918215EB7F2C113D" commented="no"><enum>(A)</enum><text>redesignating the second subsection (i) (relating to child marriage status) as subsection (j); and</text></subparagraph>
<subparagraph id="HF1632D08004240DDBE234130B2841FEE" commented="no"><enum>(B)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="H482F30AA8EB04ADC8B7EAEC59E7D9C08"><enum>(k)</enum><header>Information concerning acts of Islamophobia in foreign countries</header><text display-inline="yes-display-inline">The report required by subsection (b) shall include, wherever applicable, a description of the nature and extent of acts of Islamophobia and Islamophobic incitement that occur during the preceding year, including descriptions of—</text>
<paragraph id="H771A2882428D4FB2B68A34FC2D1C6A9A"><enum>(1)</enum><text>acts of physical violence against, or harassment of, Muslim people, and acts of violence against, or vandalism of, Muslim community institutions, including schools, mosques, and cemeteries;</text></paragraph>
<paragraph id="HF59DC731566C428F8D87B80723E87F37"><enum>(2)</enum><text>instances of propaganda in government and nongovernment media that attempt to justify or promote racial hatred or incite acts of violence against Muslim people;</text></paragraph>
<paragraph id="H01B87BA865704C129EB6DACFC54DD690"><enum>(3)</enum><text>the actions, if any, taken by the government of the country to respond to such violence and attacks or to eliminate such propaganda or incitement;</text></paragraph>
<paragraph id="HBCD6C76749BA4C85BBA12A4310897CE8"><enum>(4)</enum><text>the actions taken by such government to enact and enforce laws relating to the protection of the right to religious freedom of Muslim people<deleted-phrase reported-display-style="strikethrough" committee-id="HFA00">; and</deleted-phrase> <added-phrase reported-display-style="italic" committee-id="HFA00">;</added-phrase></text></paragraph>
<paragraph id="HB2E798CC12A24B1A91C1B779059E4F60"><enum>(5)</enum><text>the efforts of such government to promote anti-bias and tolerance education<deleted-phrase reported-display-style="strikethrough" committee-id="HFA00">.</deleted-phrase><added-phrase reported-display-style="italic" committee-id="HFA00">; and</added-phrase></text></paragraph>
<paragraph id="H602CAD8CE1E44DC682B5438D4FFF8121" reported-display-style="italic" changed="added" committee-id="HFA00"><enum>(6)</enum><text display-inline="yes-display-inline">any instances of forced labor, reeducation, or the presence of concentration camps, such as those targeting the Uyghurs in the Xinjiang Province of the People’s Republic of China.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection>
<subsection id="H8173A79B8C5748DB8A6A1E5A323B1040"><enum>(b)</enum><header>Inclusion in annual report on international religious freedom</header><text>Section 102(b)(1)(A) of the International Religious Freedom Act of 1998 (22 U.S.C. 6412(b)(1)(A)) is amended—</text>
<paragraph id="HE6C1BB958E15469F920DF59BD7167007"><enum>(1)</enum><text>in clause (vi), by striking <quote>and</quote> at the end;</text></paragraph>
<paragraph id="HEB9A45C172A24B6EB07C0125E4BE453C"><enum>(2)</enum><text>in clause (vii)(II), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph>
<paragraph id="HD65C35DD238E4F7693BC82014A8A9C14"><enum>(3)</enum><text>by adding at the end the following new clause:</text>

<clause id="HAD13897E00F9453EA8592ED17FF7B765"><enum>(viii)</enum><text>wherever applicable, an assessment and description of the nature and extent of acts of Islamophobia and Islamophobic incitement that occur in that country during the preceding the year, including—</text>
<subclause id="HD3BF308B80C74FC0B882915A2DCA7F78"><enum>(I)</enum><text>acts of physical violence against, or harassment of, Muslim people, acts of violence against, or vandalism of, Muslim community institutions, instances of propaganda in government and nongovernment media that incite such acts, and statements and actions relating thereto<deleted-phrase reported-display-style="strikethrough" committee-id="HFA00">; and</deleted-phrase><added-phrase reported-display-style="italic" committee-id="HFA00">;</added-phrase></text></subclause>
<subclause id="HE35748F46F07432187D5CD5216027AF4"><enum>(II)</enum><text>the actions taken by the government of that country to respond to such violence and attacks or to eliminate such propaganda or incitement, to enact and enforce laws relating to the protection of the right to religious freedom of Muslims, and to promote anti-bias and tolerance education<deleted-phrase reported-display-style="strikethrough" committee-id="HFA00">.</deleted-phrase><added-phrase reported-display-style="italic" committee-id="HFA00">; and</added-phrase></text></subclause>
<subclause id="HC809CA5F26D047CA9E4836699E75F9E3" reported-display-style="italic" changed="added" committee-id="HFA00"><enum>(III)</enum><text display-inline="yes-display-inline">any instances of forced labor, reeducation, or the presence of concentration camps, such as those targeting the Uyghurs in the Xinjiang Province of the People’s Republic of China.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H8E0EB087BE284C5FB9E00B798CFE2B67"><enum>(c)</enum><header>Effective date of inclusions</header><text>The amendments made by subsections (a) and (b) shall apply beginning with the first reports required under sections 116(d) and 502B of the Foreign Assistance Act of 1961 (22 U.S.C. 2151n and 2304) and section 102(b)(1)(A) of the International Religious Freedom Act of 1998 (22 U.S.C. 6312(b)(1)(A)) that are submitted after the date that is 180 days after the date of the enactment of this Act.</text></subsection></section>
<section id="HB3D59AAD6EE7467E94471A5ACC116E0F" changed="added" committee-id="HFA00" reported-display-style="italic"><enum>4.</enum><header>Prohibition</header><text display-inline="no-display-inline">No funds made available pursuant to this Act or an amendment made by this Act may be used to promote or endorse a Boycott, Divestment, Sanctions (BDS) movement ideology or used to promote or endorse a Muslim ban, such as the one instituted by former President Trump.</text></section>
