Motion by Mr. Burgess to amend the rule to H.R. 2474 to make in order amendment #11, offered by Rep. Stefanik (NY), which strikes a provision that significantly narrows independent-contractor status by defining a worker as an “employee” unless he or she is “free from control and direction in connection with the performance of the service, both under the contract for the performance of the service and in fact;” “the service is performed outside the usual course of business of the employer;” and “the individual is customarily engaged in an independently established trade, occupation, profession, or business of the same nature as that involved in the service performed.”.
